Statute overview

About this statute

This provision starts the Order, gives the Department powers to make environmental regulations and grants, sets air-quality planning duties, and creates offences for obstructing or misleading authorised persons. Owners or occupiers of land in an ASSI generally must not carry out specified operations unless they notify the Department and a listed condition is met. The Department and public bodies also have notice, consent, management, appeal, and enforcement powers, with offences and fines for non-compliance. The provision lets regulations cover fees, environmental enforcement, information-sharing, fixed penalties, warrants, and related procedures, but limits some of what those regulations can do.
