The Department of Health and Social Services must, on request and subject to any regulations-based exceptions or conditions, give a registered trade union or branch a copy or abstract of a person’s doctor’s statement for a benefit claim. If a trade union is dissolved and an annuity arrangement fails, the union’s funds cannot be used to pay the annuitant directly; the money must be used to buy an annuity instead.
Friendly Societies Act (Northern Ireland) 1957 An Act to extend the powers of friendly societies, and amend the Friendly Societies Acts (Northern Ireland), 1896 to 1948; to make corresponding amendments for trade unions in relation to annuities and sums payable on the death of a member; to make provision with respect to the furnishing of information by the Ministry of Labour and National Insurance in connection with claims for benefit from friendly societies and trade unions; to make provision as to the effect of adoption orders; and for purposes connected therewith. Where the Department of Health and Social Services furnishes a registered trade union or branch of a registered trade union, in connection with a claim for benefit from the trade union or branch, with information relating to a claim or award under those enactments, the expenses incurred in connection therewith by that Department or any other government department shall be treated as expenses in carrying those enactments into effect. Regulations made under sub-section (1) shall be subject to negative resolution.] If, in the event of a dissolution of any … trade union which has entered into contracts, approved by the Commissioners of Inland Revenue under section twenty-two of the Finance Act, 1956 , for the payment of annuities, any such annuity ceases to be paid, or any contract for the payment of such an annuity fails in whole or in part, no payment shall be made in respect thereof out of the funds of the … union to the annuitant or other person entitled to the benefit of the contract, but any sum which, but for this provision, would have been paid to him shall be applied in purchasing for the benefit of the annuitant an annuity (for the like term, and subject to the like conditions against surrender, commutation or assignment) from a person lawfully carrying on in the United Kingdom a business of granting annuities on human life.
