About this statute

This section says the Act applies to finance transactions between financial institutions and their customers for residential property purposes. This section says the Act adds to the Mortgages Act, 1972 and does not reduce its provisions, unless this Act says otherwise. If a financial institution grants a loan, the loan security must include a mortgage over the property and stamped, registered title deeds deposited with the mortgagee. A mortgage is only enforceable if it is in writing and includes specified details; a mortgage in the First Schedule or similar form may still be enforceable for form and expression. Financial institutions must give mortgagors written loan information at least 14 days before disbursement, and mortgagors must acknowledge receipt in writing within 7 days.
