About this statute
A day named in the First Schedule is declared a public holiday across the Republic. The President may declare an additional day to be a public holiday, if it is in the public interest and done by executive instrument. The President may declare another day to be a public holiday instead of a day listed in section 1, if the President is satisfied that observing that day would be inexpedient. A person must not open a shop or carry on business on a public holiday, unless an exception applies. A day listed in the Second Schedule must be celebrated as a commemorative day.
