About this statute

This section establishes the Energy Commission and gives it corporate status and powers to sue, hold and dispose of property, and enter contracts. The Commission must manage energy resources in Ghana and carry out listed regulatory and licensing functions. The Minister may give the Commission general directions if the Minister считает they are needed in the public interest and relate to the Commission’s functions. The Commission must include a chair, a representative of the National Development Planning Commission, the Executive Secretary, and four other qualified persons. The President appoints the members after consulting the Council of State and must consider their knowledge, expertise, and experience. Members of the Commission have fixed terms, may resign in writing to the President, can lose membership after four unexplained missed meetings, and the Chairman must notify the President of vacancies within two months.
