This section establishes the Witness Protection Agency as a body corporate and gives it property and contracting powers. The Agency may acquire, store, use, maintain, and control firearms, ammunition, and other necessary equipment for special protection purposes. The Agency must establish and maintain a Witness Protection Programme and may make related decisions and provide advice. The Agency is given powers to run its work, manage funds and staff, work with others, handle witness-protection information, and compel appearances or documents. Subject to the Act, the Agency is not under the direction or control of any person or authority.

Section 1
The President must appoint necessary Agency staff, other public officers may assist the Agency, and the Agency may hire consultants on the Board’s recommendation.
Section 16
This section requires a Memorandum of Understanding to spell out programme participation, protection and assistance, include a breach-termination term, and inform the participant of a right to complain to the Attorney-General.
