Purpose and legislative effect
“The Act establishes the Legal Aid Commission as a body corporate with perpetual succession.”
The Act establishes the Legal Aid Commission as a body corporate with perpetual succession. The Commission’s object is to provide legal aid to indigent persons and to people with reasonable grounds to take, defend, prosecute, or join Constitution-related proceedings. The Commission must carry out a set of legal aid functions, including deciding who and what can receive aid, setting priorities and conditions, and managing related offices, grants, agreements, information, research, and contribution rules. The Commission is generally not subject to direction or control by any person or authority when performing its functions, unless the Constitution or another law says otherwise. The Commission is run by a Board with specified members, and the President appoints those members.
