Purpose and legislative effect
“The Act establishes a Deposit Protection Scheme and says its mandate is to operate as a pay-box.”
The Act establishes a Deposit Protection Scheme and says its mandate is to operate as a pay-box. Section 3(b) is replaced to require support for a safe, sound, efficient and stable market-based financial system in Ghana by ensuring prompt payouts to insured depositors when an insured event occurs. This section amends section 6 of Act 931, including a rule that an affected bank or specialised deposit-taking institution must surrender its licence after revocation. When a bank or specialised deposit-taking institution stops being a Scheme member, it must stop taking public deposits, return its membership certificate, and notify depositors and the public; the Corporation must revoke the certificate. This section amends section 10 of Act 931 by replacing paragraphs (c) and (d) in subsection (1).
