Time within which a notice under section 8(1) shall be served on the prosecution by the defence Any notice under section 8(1) of the Ordinance shall be served on the prosecution—(a) in the case of a trial in the Court of First Instance or the District Court, not later than— (39 of 1999 s. 3)(i) 28 days before the commencement of the trial; or(ii) such date before the commencement of the trial as the Court may specify in any case; or(b) in the case of a trial in the magistrate’s court, not later than—(i) 28 days before the date on which evidence is first received by a magistrate (excluding the plea day); or(ii) such date before the date on which evidence is first received by a magistrate as the court may specify in any case.
