This Ordinance sets up Hong Kong’s competition rules, prohibits anti-competitive agreements and abuse of market power, and gives the Commission investigation and decision-making powers. This provision covers immunity, self-incrimination limits, search and seizure powers, offences, penalties, commitments, infringement notices, leniency, review, and penalty orders in Commission investigations and enforcement. This part lets the Commission seek Tribunal orders for merger contraventions, sets deadlines, creates disqualification and confidentiality rules, and gives the Tribunal powers over related proceedings. This part gives the Tribunal, Commission, Court of Appeal, and Chief Judge powers and duties on appeals, enforcement, notices, rules, service, and offences. An undertaking must not carry out a merger that substantially lessens competition in Hong Kong.
