Merchant Shipping (Seafarers) (Official Log Books) Regulation (Cap. 478, sections 119 and 134)(Enacting provision omitted—E.R. 5 of 2024)[2 September 1996] L.N. 342 of 1996(Format changes—E.R. 5 of 2024) 1. (Omitted as spent—E.R. 5 of 2024) 2. Interpretation (1) In this Regulation, unless the context otherwise requires—Closing of Openings Regulations (《關閉孔口規例》) means the Merchant Shipping (Safety) (Closing of Openings in Hulls and in Watertight Bulkheads) Regulations (Cap. 369 sub. leg. U); (E.R. 5 of 2024)Crew Accommodation Regulation (《船員艙房規例》) means the Merchant Shipping (Seafarers) (Crew Accommodation) Regulation (Cap. 478 sub. leg. I); (E.R. 5 of 2024)Disciplinary Offences Regulation (《違紀行為規例》) means the Merchant Shipping (Seafarers) (Disciplinary Offences on Board Ships) Regulation (Cap. 478 sub. leg. N); (E.R. 5 of 2024)entry (記項) means an entry in an official log book (including an entry contained in a separate document annexed to any official log book in accordance with section 6) of any particulars specified in column 1 in any paragraph of the Schedule and an entry amending or cancelling such an entry;Musters Regulations (《召集規例》) means the Merchant Shipping (Safety) (Life-Saving Appliances and Arrangements, Musters and Training) Regulation (Cap. 369 sub. leg. AY); (L.N. 90 of 2017)Repatriation Regulation (《遣返規例》) means the Merchant Shipping (Seafarers) (Repatriation) Regulation (Cap. 478 sub. leg. Q); (E.R. 5 of 2024)ship (船、船舶) means a Hong Kong ship;Steering Gear Regulation (《舵機規例》) means the Merchant Shipping (Safety) (Navigational Equipment and Safety of Navigation) Regulation (Cap. 369 sub. leg. BA); (L.N. 75 of 2016 and L.N. 175 of 2018)tons (噸) and tonnage (噸位) mean tons and tonnage as calculated in accordance with the Merchant Shipping (Registration) (Tonnage) Regulations (Cap. 415 sub. leg. C); (E.R. 5 of 2024)wages submission (工資糾紛的提交) means a submission under section 87 of the Ordinance to the Superintendent.(L.N. 75 of 2016 and L.N. 175 of 2018)(2) In this Regulation, references to the gross or register tonnage of a ship are, in the case of a ship having alternative gross or alternative register tonnages, references to the larger of its gross tonnages or to the larger of its register tonnages, as the case may require. 3. Application This Regulation shall apply to—(a) every ship to which the Merchant Shipping (Seafarers) (Crew Agreements, Lists of Crew and Discharge of Seafarers) Regulation (Cap. 478 sub. leg. L) applies; and (E.R. 5 of 2024)(b) every ship authorized by virtue of a passenger certificate and general safety certificate issued under Part II of the Merchant Shipping (Safety) Ordinance (Cap. 369) to carry passengers within river trade limits. 4. Entries in official log books Subject to the provisions of the Ordinance, the Merchant Shipping Ordinance (Cap. 281), the Merchant Shipping (Safety) Ordinance (Cap. 369) and any regulations made under any of those Ordinances, entries of particulars specified—(a) in column 1 in each paragraph of Part 1 of the Schedule shall from time to time be made in the official log book kept in every ship;(b) in column 1 in each paragraph of Part 2 of the Schedule shall be so made in the official log book kept in every ship in respect of which a load line certificate has been issued under section 51, or a load line exemption certificate has been issued under section 63, of the Merchant Shipping (Safety) Ordinance (Cap. 369); and(c) in column 1 in each paragraph of Part 3 of the Schedule shall be so made in the official log book kept in every ship to which the Closing of Openings Regulations apply. 5. Making, signing and witnessing of entries (1) Each entry shall be made in the official log book by the person or by one of the persons (or by a person authorized by any such person for that purpose) specified in column 2 in each paragraph of the Schedule.(2) Each entry—(a) subject to subsection (3), shall be signed by the person or by one of the persons specified in column 2 in each paragraph of the Schedule; and(b) subject to the provisions of each paragraph of the Schedule, shall be witnessed by the person, if any, specified in column 3 in each paragraph of the Schedule.(3) An entry which is to be signed by the master may, except where the contrary intention appears, be signed by an officer authorized by the master for that purpose.(4) Each entry shall include the date when it is made. 6. Annexes to official log books If it is not practicable by reason of its length, the circumstances in which it is to be made or for any other reason for an entry to be contained in the official log book, it shall be contained in a separate document annexed to the official log book and referred to in an entry in the official log book; and references in this Regulation to an official log book include references to any documents annexed to an official log book in accordance with this section. 7. False, inaccurate or incomplete entries No person shall make an entry he knows or has reason to believe is false, inaccurate or incomplete. 8. Time for making of entries (1) Entries of particulars specified in paragraphs 1, 2, 3, 5 and 38 of the Schedule shall be made at the time when an official log book is opened, and—(a) a further entry of particulars specified in paragraph 3 of the Schedule shall be made as soon as practicable after any change of master; and(b) a further entry of particulars specified in paragraph 38 of the Schedule shall be made as soon as practicable after a new load line certificate is issued in respect of the ship under section 51, or a new load line exemption certificate is issued in respect of the ship under section 63, of the Merchant Shipping (Safety) Ordinance (Cap. 369).(2) The entry of particulars specified in paragraphs 7 and 22 of the Schedule shall be made as soon as practicable after the ship arrives at or leaves any dock, wharf, port or harbour, as the case may require.(3) The entry of particulars specified in paragraph 9 of the Schedule shall be made as soon as practicable after every time when each muster should have been held in accordance with the Musters Regulations.(4) The entries of particulars specified in paragraph 33(b) and (c) of the Schedule shall be made daily or at such other time during the continuance of the illness or injury as the person making any such entry thinks fit.(5) The entry of particulars specified in paragraph 39 of the Schedule shall be made before the ship leaves any dock, wharf, harbour or other place for the purpose of proceeding to sea.(6) Every other entry shall be made as soon as practicable after the occurrence to which it relates or, if it amends or cancels an existing entry, as soon as practicable after the person intending to sign it becomes aware of the facts giving rise to the amendment or cancellation.(7) Subject to the provisions of section 9, no entry shall be made in an official log book after the time referred to in section 11(1). 9. Amendment and cancellation of entries (1) Subject to the provisions of this section, an entry shall not be amended or cancelled.(2) Where—(a) in the case of an entry which was required to be signed by the master, it appears to the person who for the time being is master of the ship that the entry is inaccurate or incomplete; or(b) in the case of any other entry, it appears to the person who signed the entry that it is inaccurate or incomplete,that person shall, if it is practicable to do so before the time referred to in section 11(1), make and sign a further entry referring to the entry and amending or cancelling it, and sections 5(1) and (2)(b), 6 and 12(1) shall apply to the further entry.(3) Where, after the time referred to in section 11(1), it appears to the Superintendent that an entry, other than an entry made in respect of a disciplinary offence, is inaccurate or incomplete, he—(a) may make and sign a further entry referring to the entry and amending or cancelling it; and(b) shall, if it is practicable to do so, inform any master or seafarer, to whom any such further entry relates, of its contents.(4) Where, after the time referred to in section 11(1), it appears to the Superintendent that any entries made pursuant to section 9 of the Disciplinary Offences Regulation have been improperly made to such an extent that, in his opinion, the disciplinary offence to which those entries relate cannot stand, he may make a further entry referring to those entries and cancelling them. 10. Production of official log book The master of a ship shall, on demand, produce to the Superintendent, an officer of the Marine Department or an officer of customs and excise, the official log book required to be kept in the ship. 11. Delivery of official log book (1) The master shall, within 28 days after the time specified in subsection (2) or (3), as the case requires, or, if it is not practicable within that time, as soon as practicable thereafter, deliver the official log book to the Superintendent.(2) Subject to subsection (3), the time referred to in subsection (1) is either—(a) if any person is employed in the ship under a crew agreement, the time when the last person remaining so employed is discharged from the ship; or(b) in any other case, the time when the ship first calls at a port more than 12 months after the first entry (other than an entry specified in paragraph 1, 2, 3, 5 or 38 of the Schedule) is made in the official log book.(3) If, at the time specified in subsection (2), there is pending a wages submission and the ship concerned is within the waters of Hong Kong, the time referred to in subsection (1) is either the time when all such submissions have been determined by the Superintendent or withdrawn, or the expiration of 7 days after the time specified in subsection (2), whichever is the earlier. 12. Offences (1) Where an entry which is to be signed or witnessed by the master or by a person who is a member of the crew is not made, signed and witnessed in accordance with the provisions of this Regulation, the master of the ship at the time when the entry is or should have been made, signed and witnessed commits an offence and is liable on conviction to a fine at level 1.(2) A person who contravenes section 7 or 9(2) commits an offence and is liable on conviction to a fine at level 1.(3) The master of a ship who contravenes section 10 or 11(1) commits an offence and is liable on conviction to a fine at level 1. The date on and place at which the official log book is closed. The master None 7. A record of the date and hour of departure for sea from, and arrival from sea at, any dock, wharf, port or harbour. A record of each occasion on which, in accordance with the Musters Regulations, a muster, drill or training of the crew in the use of life-saving appliances is held on board the ship, the training and type of drill held, and the occasions on which lifeboats, rescue boats and davit-launched liferafts, as applicable, are lowered or launched. Where a muster, drill, training or inspection is not held on board the ship when required by the Musters Regulations, a record of why the muster, drill, training or inspection, as the case may be, was not carried out or carried out only in part. The master A member of the crew 10. Where any of the following accidents have occurred— (a) there is loss of life or major injury to any person on board, or any person is lost or missing from, a ship or a ship’s boat; (b) a ship is lost or presumed to be lost, or is abandoned or materially damaged; (c) a ship strands or is in collision; (d) a ship is disabled; or (e) any material damage is caused by a ship. The master A member of the crew 11. A record of every signal of distress or a message that a vessel, aircraft or person is in distress at sea, observed or received. The master A member of the crew 12. Where the master, on receiving at sea a signal of distress or information from any source that a vessel or aircraft is in distress, is unable, or in the special circumstances of the case considers it unreasonable or unnecessary, to go to the assistance of the persons in distress (in accordance with section 84 of the Merchant Shipping (Safety) Ordinance (Cap. 369)), a statement of his reasons for not going to the assistance of those persons. The master in person A member of the crew 13. Where a dispute relating to the amount payable to a seafarer under a crew agreement is submitted to the Superintendent under section 87 of the Ordinance— (a) a statement of the dispute; (b) a record of whether he accepts the submission; and The Super-intendent None (c) if he accepts the submission, either— (i) a record of his decision; or(ii) a statement that he is of the opinion that the dispute ought not to be decided by him. 14. A record of— (a) every seafarer discharged from the ship; and (b) the place, date and time of his discharge. The person in whose presence the seafarer is discharged or, if the seafarer is not present at the time he is discharged, the master A member of the crew 15. Where the Superintendent consents to the discharge of a seafarer outside Hong Kong, a record of his consent. The Super-intendent, if practicable, or the master in person If the entry is signed by the master, a member of the crew 16. Where a seafarer has, for the purpose of repatriation, left the ship on which the seafarer worked, a record of— (L.N. 75 of 2016) (a) the name of the seafarer; (b) the date on which the seafarer left the ship; (L.N. 75 of 2016) (c) the circumstances under which the seafarer was entitled to be repatriated; and (L.N. 75 of 2016) The master A member of the crew (d) any provision made by the master on the seafarer’s employer’s behalf to ensure that the Superintendent is informed of the particulars specified in section 5(2) of the Repatriation Regulation. Where, pursuant to section 9 of the Repatriation Regulation, the master is required by the Superintendent to convey a person under a conveyance order, a record of— (a) the conveyance order, identifying the person to whom it relates; (b) any direction received by the master in respect of any such requirement, specifying the direction; and The master A member of the crew (c) whether the person is employed as a member of the crew and, if not— (i) the date on which and the place at which he came on board the ship; and(ii) the date on which and the place at which he left the ship. 18. In respect of a seafarer referred to in an entry made pursuant to paragraph 16, a record of— (a) whether he left any property (including money) on board the ship; (b) all such property of which the master has taken charge pursuant to section 15(3) of the Repatriation Regulation specifying each item of such property; (c) each article forming part of such property sold pursuant to section 15(4)(a) of the Repatriation Regulation, and the price received for it; (d) each article forming part of such property destroyed or disposed of pursuant to section 15(4)(b) of the Repatriation Regulation and the name of the person to whom disposal was made; and The master A member of the crew (e) each article forming part of such property delivered to any person pursuant to section 15(5) or (6) of the Repatriation Regulation specifying the person (whether the seafarer, his employer or his next of kin) to whom the delivery was made and the date, place and manner of delivery. 19. A record of any inspection of crew accommodation carried out under— (L.N. 75 of 2016) (a) section 38(2) of, and section 31(2) of Schedule 6 to, the Crew Accommodation Regulation; or The master A member of the crew (b) sections 28 and 34 of the Merchant Shipping (Seafarers) (Working and Living Conditions) Regulation (Cap. 478 sub. leg. A record of any inspection carried out with respect to the supply of provisions and drinking water, the space and equipment for storing and handling provisions and drinking water and the galley and other equipment used for preparing and serving meals, and the result of the inspection. A record of any drill, check and test carried out by the ship’s crew of the ship’s steering gear, under section 13 of the Steering Gear Regulation. Where a seafarer employed in the ship complains under section 98 of the Ordinance about the provisions or water provided for the seafarers employed in the ship, a record of— (L.N. 75 of 2016) (a) the name of the seafarer making the complaint; (b) the complaint, specifying— (i) the provisions or the water complained of; and(ii) the manner in which they are alleged not to be in accordance with regulations made under section 96 of the Ordinance (whether because of bad quality, unfitness for use or deficiency in quantity); (c) action taken by the master on the complaint (if applicable); (d) whether the seafarer states to the master the seafarer’s dissatisfaction with the action taken by the master on the complaint and whether the seafarer claims to complain to the Superintendent (if applicable); (L.N. 75 of 2016) The master (subparagraphs (a) to (e)) The seafarer making the complaint (L.N. 75 of 2016) (e) if the seafarer claims to complain to the Superintendent, the arrangements made by the master to enable the seafarer to do so; (L.N. 75 of 2016) (f) the investigation of the complaint by the Superintendent (if applicable); and The Superintendent (subparagraph (f)) None (g) every examination of provisions and water made under section 98(3) of the Ordinance (if applicable). Where a seafarer employed in the ship complains under section 99 of the Ordinance about any other seafarer employed in the ship, any conditions on board the ship or anything relating to the seafarer’s employment, a record of— (L.N. 75 of 2016) (a) the name of the seafarer making the complaint; The master (subparagraphs (a) to (e)) The seafarer making the complaint (b) the complaint, specifying the person or matter complained of and the nature of the complaint; (c) action taken by the master on the complaint (if applicable); (L.N. 75 of 2016) (d) whether the seafarer states to the master the seafarer’s dissatisfaction with the action taken by the master on the complaint and whether the seafarer claims to complain to the Superintendent (if applicable); (L.N. 75 of 2016) (e) if the seafarer claims to complain to the Superintendent, the arrangements made by the master to enable the seafarer to do so; and (f) the investigation of the complaint by the Superintendent (if applicable). Where by reason of any event it appears to the master that an officer— (a) may be unfit to discharge his duties, whether by reason of incompetency or misconduct or for any other reason; (b) may have been seriously negligent in the discharge of his duties; or The master in person An officer other than the officer referred to in an entry under subparagraph (i) (c) may have failed to comply with the provisions of section 78 of the Merchant Shipping (Safety) Ordinance (Cap. 369), a record— (i) of the name of the officer and of the grade and number of his certificate of competency or licence; (ii) of any such event or a reference to any other entry relating to it; (iii) of any statement made by the officer to the master in respect of that event or those events and which the officer wishes to be recorded; and (iv) that the entries made pursuant to subparagraphs (i) to (iii) have been read over to the officer by the master, and if they are not read over, the reason for not doing so. 26. A record of any re-rating (including promotion) of a seafarer, with the date on which the re-rating takes effect. The master A member of the crew 27. A record of any reduction in the scale of provisions or water to be provided for seafarers employed in the ship specifying— (a) the reduction made; (b) the reason for the reduction; and (c) the duration of the reduction. The master A member of the crew 28. Where a child is born in the ship or in one of the ship’s boats, a record of— The master in person The mother of the child (a) (i) date of the birth;(ii) if the birth takes place at sea, the position of the ship by latitude and longitude at the time of the birth and, in any other case, the place of birth;(iii) name (if any) and surname of child; and(iv) sex of child; (b) (i) name and surname of father; (ii) his usual residence;(iii) his nationality; and(iv) his occupation, rank or profession: Provided that, if the child is illegitimate, no particulars of the father shall be entered except at the joint request of the mother and of the person acknowledging himself to be the father, given to the master in writing and signed by both the mother and that person; (c) (i) name and surname of mother;(ii) her maiden surname;(iii) her surname at marriage, if different from maiden surname;(iv) her usual residence; and(v) her nationality; and (d) the making of a return of the birth, identifying the person to whom the return was made. 29. Where any person dies in the ship or in a ship’s boat or is lost from the ship or a ship’s boat or where any person employed in the ship dies outside Hong Kong, a record of— (a) the date of the death or loss; (b) (i) if the death takes place in the ship or in a ship’s boat or if the deceased is lost from the ship or a ship’s boat, the place of death or the position of the ship or of the ship’s boat by latitude and longitude at the time of the death or loss (as the case may require); and(ii) if the death or loss does not take place in or from the ship or in or from a ship’s boat, the place of death; The master in person (subparagraphs (a) to (i)) A member of the crew (c) name and surname of deceased; (d) sex of deceased; (e) date of birth (if known) or age; (f) if the deceased was a woman who had been married, her maiden surname (if known); (g) occupation, rank or profession of deceased; (h) usual residence of deceased at time of death or loss; (i) his nationality; (j) (i) cause of death or loss, if known; and The ship’s medical practitioner or, if there is no ship’s medical practitioner, the master in person (subparagraph (j)(i)) A member of the crew (ii) if death not due to natural causes, circumstances of death or loss; The master in person (subparagraphs (j)(ii) to (m)) A member of the crew (k) if the deceased was lost from the ship or a ship’s boat, the steps taken to rescue him; (l) the making of a return of the death, identifying the person to whom the return was made; and (m) the notification of the death to the deceased’s next of kin, and the name and address of the next of kin. 30. Where any person is missing from the ship or a ship’s boat, a record of— The master in person A member of the crew (a) the date on and time at which the person is found missing; (b) the place where the ship or ship’s boat was on that date at that time or, if at sea, the position of the ship or of the ship’s boat by latitude and longitude on that date at that time (as the case may require); (c) name and surname of the missing person; (d) sex of the missing person; (e) date of birth (if known) or age; (f) if the missing person was a woman who had been married, her maiden surname (if known); (g) occupation, rank or profession of the missing person; (h) usual residence of the missing person at the time the person is found missing; (i) his nationality; (j) grounds for presumption of death; and (k) the making of a return of the missing person. 31. In respect of a seafarer dying or missing while or after being employed in a ship, a record of whether he left any property (including money) on board the ship. The master in person A member of the crew 32. Where an inquiry into the cause of a death is required to be held under section 122 of the Ordinance, a record— (a) of the name of the deceased and a reference to the relevant entry made under paragraph 29; The master (subparagraph (a)) None (b) of the date on and the place at which the inquiry is held; The Superintendent (subparagraph (b)) None (c) if the inquiry is not held at the next port where the ship calls after the death, of that fact. The master (subparagraph (c)) None 33. Where a person employed in the ship falls ill or is injured, a record of— (a) the circumstances of the injury; The master (subparagraph (a)) A member of the crew (b) the nature of the illness or injury or the symptoms thereof; (c) the treatment adopted; and (d) the progress of the illness or injury. The ship’s medical practitioner or, if there is no ship’s medical practitioner, the master (subparagraphs (b) to (d)) A member of the crew 34. When a seafarer is charged with a disciplinary offence under the Disciplinary Offences Regulation, a record— (a) if the offence is not to be dealt with by the master, of the name of the officer authorized under section 6(2) of the Disciplinary Offences Regulation to exercise the powers and duties of the master in respect of that offence; (b) of the name of the seafarer charged; (c) of the charge; The master or the officer named in an entry under subparagraph (a) A member of the crew other than the seafarer named in an entry under subparagraph (b) (d) that the master or the officer referred to in subparagraph (a) has read the charge to the seafarer; (e) (i) if the seafarer admits the charge, of a statement that he admits it; or (ii) in any other case, of a statement that the seafarer does not admit the charge; (f) (i) of particulars of any statement made by the seafarer in answer to the charge; or(ii) that he declines to make a statement in answer to the charge; (g) of the decision of the master or of the officer referred to in subparagraph (a)— (i) as to whether or not he finds that the seafarer has committed the offence charged; and (ii) if he finds that the seafarer has committed the offence, as to the amount of the fine which he is imposing for that offence or that he is imposing no fine; and (h) where subparagraph (g)(i) applies, that the master or officer referred to in subparagraph (a) has, in accordance with section 8(h) of the Disciplinary Offences Regulation— (i) informed the seafarer of his rights under section 9 of that Regulation; and (ii) supplied the seafarer with copies of all entries in the official log book (including any annexes thereto) referring to the offence charged or that the seafarer did not request such copies, as the case may be. 35. If the master remits the whole or a part of a fine in accordance with the Disciplinary Offences Regulation, a record of the remission, referring to the relevant entry under paragraph 34 and stating the amount remitted and the reason for the remission. The master None 36. Where the Superintendent pursuant to section 9 of the Disciplinary Offences Regulation cancels entries relating to a disciplinary offence, a record of— (a) the cancellation of those entries; The Superintendent None (b) the date of the cancellation; and (c) action taken to cause the fine concerned (if any) to be refunded. 37. Where a fine has been imposed on a seafarer for a disciplinary offence— (a) a record that the amount of the fine so far as not remitted by the master has been paid to the Superintendent and— (i) identifying the seafarer on whom the fine was imposed; and (ii) specifying the amount paid; and The master in person (subparagraph (a)) None (b) if the ship concerned is within the waters of Hong Kong, a record of the receipt by the Superintendent of the amount specified in the entry made pursuant to subparagraph (a)(ii). A record of— (a) (i) the draughts shown on the scale referred to in paragraph 38(b);(ii) the freeboard on each side of the ship; and(iii) the mean freeboard,taken in each case when the ship is ready to leave any dock, wharf, harbour or other place for the purpose of proceeding to sea; The master An officer (b) the density of the water in which the ship was when the particulars referred to in subparagraph (a) were taken; (c) the allowances, if any, to be made in order to determine the mean freeboard which the ship will have when it first reaches salt water after leaving as aforesaid, being allowances in respect of— (i) the density of the water in which the ship was when the particulars referred to in subparagraph (a) were taken; (ii) the weight of any rubbish to be discharged overboard; and (iii) the weight of fuel, water and stores required for consumption before the ship reaches salt water; and (d) the mean draught and mean freeboard which the ship will have on reaching salt water, calculated after making the allowances referred to in subparagraph (c):Provided that— (i) subparagraph (c)(ii) and (iii) does not apply to a coastal-going ship; and (ii) subparagraphs (b), (c) and (d) do not apply if, at the time when the particulars referred to in subparagraph (a) were taken, the load line indicating the maximum depth to which the ship could then be loaded in salt water was not submerged. In this paragraph— freeboard (乾舷) means the distance measured vertically downwards from the upper edge of the deck-line marked on the side of the ship to the surface of the water; mean draught (平均吃水) means the mean of the draughts shown on the scales on the stem and on the stern post of the ship; mean freeboard (平均乾舷) means the mean of the freeboards on each side of the ship. A record of— (a) any inspection of the ship’s supplementary lighting required under Part IV, IVA or VIIB of the Merchant Shipping (Safety) (Passenger Ship Construction) (Ships Built Before 1 September 1984) Regulations (Cap. 369 sub. leg. AL) or under Part IV or VIA of the Merchant Shipping (Safety) (Passenger Ship Construction and Survey) (Ships Built On or After 1 September 1984) Regulations (Cap. 369 sub. leg. AM); and (L.N. 75 of 2016) The master An officer (b) any action taken to correct any defects found during any inspection referred to in subparagraph (a). 42. For ships of Class I, II or II(A) as specified in the Merchant Shipping (Safety) (Passenger Ship Construction) (Ships Built Before 1 September 1984) Regulations (Cap. 369 sub. leg. AL) or the Merchant Shipping (Safety) (Passenger Ship Construction and Survey) (Ships Built On or After 1 September 1984) Regulations (Cap. 369 sub. leg.
