AN POST, in exercise of the powers conferred on it by Section 70 of the Postal and Telecommunications Services Act, 1983 , and with the consent of the Minister for Communications, hereby makes the following Scheme: 1 . (i) This Scheme may be cited as the Foreign Post Amendment (No. 26) Scheme, 1985. (ii) This Scheme shall be operative with effect from the 25th day of February, 1985. 2. In this Scheme— "the Principal Warrant" means the Foreign Post Warrant, 1949 ( S.I. No. 267 of 1949 ); "Warrant No. 24" means the Foreign Post Amendment (No. 24) Warrant, 1982 ( S.I. No. 59 of 1982 ). 3. The following Regulation is hereby substituted for Regulation 21 of the Principal Warrant: "21. (1)Subject to the provisions of this Scheme, any letter or postcard upon which no part, or a part only, of the postage thereon is prepaid, shall be charged with an amount calculated in accordance with paragraph (4) of this Regulation. (4) The charge upon a postal packet upon which no part or a part only of the postage payable thereon is prepaid shall be an amount equal to — ) in the case of an outgoing postal packet — the deficient postage, to which shall be added a handling charge of sixteen pence, ) in the case of an incoming postal packet — the minimum rate in force in the State for outgoing letters to which the provisions of this Scheme apply, multiplied by the fraction of which the numerator equals the amount of the deficient postage and the denominator equals the minimum rate for outgoing letters to the State in force in the country in which the packet was posted, to which shall be added a handling charge of sixteen pence. Provided that the charge including the handling charge shall not in any case be less than the sum of nineteen pence." 4. The First Schedule to the Principal Warrant is hereby amended by the substitution for the entries therein (inserted by Regulation 3 of Warrant No. 24) of the entries in the First Schedule to this Scheme. 5. The Second Schedule to the Principal Warrant is hereby amended by the substitution for the entries therein (inserted by Regulation 4 of Warrant No. 24) of the entries in the Second Schedule to this Scheme. 6. The Fourth Schedule to the Principal Warrant is hereby amended by the substitution for the entries therein (inserted by Regulation 5 of Warrant No. 24) of the entries in the Third Schedule to this Scheme. 7. The following Regulation is hereby substituted for Regulation 5 of the Foreign Post Amendment (No. 4) Warrant, 1956 ( S.I. No. 148 of 1956 ) in the case of a mail bag containing packets addressed to one and the same addresses conveyed by surface means, 140p; ) in the case of a mail bag containing packets addressed to one and the same addressee conveyed by air over all or part of the route, a rate not exceeding 350p; ) in the case of a mail bag containing packets addressed to different addressees conveyed by surface means, 215p; ) in the case of a mail bag containing packets addressed to different addressees conveyed by air over all or part of the route, a rate not exceeding 500p. (2) For the purpose of paragraph (1) of this Regulation the weight of the mail bag and its contents shall be calculated to the next nearest kg. (3) Where postage is charged and paid under this Regulation, postage shall not be charged on the individual packets contained in the mail bag." 8. The following Regulation is hereby substituted for Regulation 5 of the Foreign Post Amendment (No. 5) Warrant, 1957 ( S.I. No. 58 of 1957 "5. There shall be charged and paid on outgoing packets to which this Warrant applies the following rates of postage: For a packet not exceeding 50g ... ... ... ... Such rate as may be fixed by An Post from time to time provided that the maximum rate for an air mail packet does not exceed forty four pence for each 10g or part of 10g in weight, and for an air letter, forty two pence. SECOND SCHEDULE 1. Late Fee Postal Packet. A fee (in addition to the postage) not exceeding 10p as may be prescribed. 2. Customs Clearance Fee on incoming postal packet liable to Custom Duty. A fee of 100p per packet. 3. Express postal packet — outgoing. Express postal packet — incoming. A fee not exceeding 50p as may be prescribed. At the scale of fees in force for express delivery of Inland postal packets. 4. Ordinary registration. Late-fee registration. A fee of 90p per packet. A fee (in addition to the ordinary registration fee) not exceeding 12p as may be prescribed. 5. Advice of delivery. A fee of 30p per registered postal packet. This Scheme applies to the Foreign Post Service and comes into operation on 25th February, 1985. It authorises alterations, reductions and increases in the postage rates for letters, postcards and certain other items and increases in the fees for miscellaneous services. It also authorises increases in compensation for registered and insured letter packets.
