Road Transport (Operatorâs Licence Application) (Amendment) Regulations 2023
These amendments require a road transport operator to give the Minister for Transport the number of employees it employed on 31 December of the previous year.

I, EAMON RYAN, Minister for Transport, in exercise of the powers conferred on me by section 2 (6) of the Road Traffic and Transport Act 2006 (No. 28 of 2006) (as adapted by the Transport, Tourism and Sport (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 351 of 2020 )), and for the purposes of giving effect to Regulation (EU) 2020/1055 of the European Parliament and of the Council of 15 July 2020 , hereby make the following regulations: 1. These Regulations may be cited as the Road Transport (Operator’s Licence Application) (Amendment) Regulations 2023. 2. In these Regulations, “Principal Regulations” means the Road Transport (Operator’s Licence Application) Regulations 2018 ( S.I No. 398 of 2018 ). 3. Regulation 2 of the Principal Regulations is amended by the insertion after the definition of “duly accredited person” of the following definition: “ ‘EU Regulation’ means Regulation (EC) No 1071/2009 of the European Parliament and of the Council of 21 October 2009 as amended by Commission Regulation (EU) No 613/2012 of 9 July 2012 , Council Regulation (EU) No 517/2013 of 13 May 2013 and Regulation (EU) 2020/1055 of the European Parliament and of the Council of 15 July 2020 4. The Principal Regulations are amended in Regulation 6 – (a) in paragraph (d), by the substitution of “the EU Regulation” for “Regulation (EC) No 1071/2009 of the European Parliament and of the Council of 21 October 2009”, and (b) in paragraph (g), by the insertion of “with appropriate equipment and facilities” after “premises”. 5. Schedules 1 and 2 to the Principal Regulations are amended by the insertion under “Transport Manager Details” of the following additional details: “NUMBER OF EMPLOYEES Number of Employees on 31 December of the previous year”.
