To the Council of the County Borough of Limerick; to the Limerick County Borough Board of Health; and to all whom it may concern: WHEREAS by an Order under his Seal of Office bearing date the Twenty-eighth day of June, 1923, called the Limerick County Borough Scheme Order, 1923, the Minister for Local Government, in pursuance of Section 5 of the Local Government (Temporary Provisions) Act, 1923 (hereinafter referred to as "the Act"), did amend and modify the existing County Scheme relating to the County Borough of Limerick as set out in the First Schedule to the Act in such way as to bring it into conformity with the provisions of the Scheme set out in the Schedule to the said Order (which said provisions are in the said Order and this Order referred to as the Limerick County Borough Scheme): AND WHEREAS in pursuance of Section 5 of the Act, the Minister for Local Government and Public Health, by Order under his Seal of Office, bearing date the Eighteenth day of March, 1925, and entitled the Limerick County Borough Scheme (No. 2) Order, 1925, did further amend the Limerick County Borough Scheme in manner therein appearing: AND WHEREAS the Limerick County Borough Scheme has come into operation, and I, the Minister for Local Government and Public Health, deem it necessary further to amend the Limerick County Borough Scheme in manner hereinafter appearing, and did on the Fifteenth day of May, 1929, give to the Council of the County Borough of Limerick, one month's notice of my intention to make such amendment and have taken into consideration any representation which has been made to me by the said Council within such month in respect of such amendment: NOW THEREFORE I, the Minister for Local Government and Public Health, in exercise of the powers given to me by Section 5 of the Act, and of all other powers in this behalf enabling me, the said month having expired, do by this my Order, order and direct as follows, that is to say:— 1. The Limerick County Borough Scheme shall be amended by the addition of the following article after article 20 thereof:— "20a. (i) The Council may, with the consent of the Minister, by resolution, provide that the powers, duties and functions conferred an the Board of Health by the foregoing provisions of this Scheme shall be transferred to such person or persons as the Minister shall from time to time appoint for the purpose. "(ii.) Such a resolution shall come into force on a date to be specified therein and shall continue to be in force until either the Minister by Order annuls such resolution or until the quarterly meeting of the Council held next after a triennial election whichever of such events shall first occur. "(iii.) The Minister may appoint such and so many persons as he shall think fit to exercise and perform the powers, duties and functions of the Board of Health during the continuance in force of such a resolution, and may from time to time remove all or any such persons and appoint others in their place, and may fix the tenure of office, duties and remuneration of all such persons, and the remuneration of all such persons shall be paid as part of the expenses of the Board of Health. "(iv.) While such a resolution remains in force all the powers, duties and functions of the Board of Health shall be exercised and performed by, and all the property, debts and liabilities of the Board of Health shall vest in and be discharged by the person or persons appointed from time to time under the foregoing sub-article." 2. This Order may be cited as the Limerick County Borough Scheme (Amendment) Order, 1929, and shall take effect as from the date hereof.
