These Regulations may be cited as the European Union (Online Dissemination of Terrorist Content) (Designation of the Commissioner of An Garda SÃochána as a Competent Authority) Regulations 2025. 2. (1) In these Regulations - “Garda Commissioner” means - (a) the person for the time being appointed as the Commissioner of An Garda SÃochána under section 26 the Policing, Security and Community Safety Act 2024 (No.1 of 2024), (b) a person to whom the functions of the Commissioner under these Regulations stand delegated in accordance with section 39 of that Act, or (c) a person performing the functions of the Commissioner pursuant to section 28 of that Act; “Regulation (EU) 2021/784” means Regulation (EU) 2021/784 of the European Parliament and of the Council of 29 April 2021 on addressing the dissemination of terrorist content online. (2) A word or expression that is used in these Regulations and that is also used in Regulation (EU) 2021/784 has, unless the context otherwise requires, the same meaning in these Regulations as it has in that Regulation. (3) A reference in these Regulations to a numbered Article is a reference to the Article so numbered of Regulation (EU) 2021/784. 3. The Garda Commissioner is designated for the purposes of Article 12(1)(b) as the competent authority to scrutinise removal orders pursuant to Article 4. 4. The Garda Commissioner shall carry out his or her functions as the competent authority referred to in Regulation 3 in an objective and non-discriminatory manner, while fully respecting fundamental rights, and shall be independent in the exercise of those functions.
