I, HELEN MCENTEE, in exercise of the powers conferred on me by sections 4 (1)(d) and 12F(1) of the Communications (Retention of Data) Act 2011 (No. 3 of 2011), hereby make the following regulations: 1. These Regulations may be cited as the Communications (Retention of Data) (Data Security) Regulations 2023. 2. In these Regulations, “Act of 2011” means the Communications (Retention of Data) Act 2011 (No. 3 of 2011). 3. For the purposes of section 4(1)(d) of the Act of 2011- (a) the period of 13 months from the date on which the data were first processed by the service provider concerned is prescribed in respect of data retained under section 3(1), 3A(5) or 3B(1) of the Act, and (b) the period of 1 month from the day on which the order concerned ceases to have effect is prescribed in respect of data retained under section 7A(11) or 7B(10) of the Act. 4.
