S.I. No. 396/1985 - Inland Post Amendment (No. 30) Scheme, 1985. S.I. No. 396 of 1985. INLAND POST AMENDMENT (No. 30) SCHEME, 1985. AN POST, in exercise of the powers conferred on it by Section 70 of the Postal and Telecommunications Services Act, 1983 , hereby makes the following Scheme: 1. (i) This Scheme may be cited as the Inland Post Amendment (No. 30) Scheme, 1985. (ii) This Scheme shall be operative with effect from the 1st day of January 1984. 2. In this Scheme "the Principal Warrant" means the Inland Post Warrant, 1939 (S.R. and O. No. 202 of 1939). 3. The following Regulation is hereby substituted for Regulation 15 of the Principal Warrant (as amended by Regulation 6 of the Inland Post Amendment (No. 9) Warrant, 1959 ( S.I. No. 46 of 1959 (1) ( ) Every such packet shall be subject to examination in the post. ) Every such packet shall be posted either without a cover or in an unfastened cover or in a cover which can be easily removed for the purpose of examination without breaking any seal or tearing any paper or separating any permanently adhering surfaces or cutting any string. ) Any such packet posted without a cover shall not be fastened or otherwise treated so as to prevent easy examination. ) Any such packet shall not contain or bear any communication in the nature of a letter. ) Any such packet shall not contain any sample of material of any kind. (2) ( ) Notwithstanding subparagraph ( ) Notwithstanding subparagraph ( (i) Every item shall be made up in a reasonably strong wrapper appropriate to its contents and so that no part of the contents can be removed without either breaking or tearing the wrapper or forcing two adhering surfaces apart or breaking a seal. ) (ii) of the Foreign Post Warrant, 1949. (iii) Application for a permit shall be made to the local Head Office or, in the case of applicants in the Dublin Postal District, to the Controller, Dublin Postal District. (iv) Where a sender has branches at different addresses in the same Head Post Office District, or within the Dublin Postal District, application may be made for a single permit to cover all the said sender's branches in such District; in all other cases, each branch of a sender shall require a separate permit. (v) Each posting must consist of a minimum number of one hundred items. (vi) Postings must be made at least once every twelve months. (vii) Posting must be made at a designated Post Office. "Ceadaithe faoi Sheala Sealed under Permit Corcaigh 3. Cork 3." (x) When an application is made for a permit, or for its annual renewal, a sample of each item (cover and contents) shall be provided. (xi) In the event of an item being found to contravene Post Office regulations, An Post shall have the right to terminate the permit without refund of the fee or part thereof. 4. Regulation 17 of the Principal Warrant shall be amended as follows: ) the following paragraph is hereby added after paragraph (1): "(1A) Notwithstanding paragraph (1) hereof, a newspaper in a closed or sealed plastic wrapper may be accepted by An Post for transmission by post provided that each of the following conditions is observed by the senders: (i) Every item shall be made up in a reasonably strong wrapper appropriate to its contents and so that no part of the contents can be removed without either breaking or tearing the wrapper or forcing two adhering surfaces apart or breaking a seal. (ii) The sender shall pay in respect of each period of twelve months an annual fee of £20 for a permit to post newspaper items in closed or sealed plastic wrappers transparent or opaque, if such fee has not already been paid in respect of a comparable permit for the same period under the provisions of Regulations 15 (2) ( ) (ii) of this Warrant or Regulation 25 (2) ( ) (ii) of the Foreign Post Warrant, 1949. (iii) Application for a permit shall be made to the local Head Post Office or, in the case of applicants in the Dublin Postal District, to the Controller, Dublin Postal District. (iv) Where a sender has branches at different addresses in the same Head Office District, or within the Dublin Postal District, application may be made for a single permit to cover all the said sender's branches in such District; in all other cases, each branch of a sender shall require a separate permit. (v) Each posting must consist of a minimum number of one hundred items. (vi) Postings must be made at least once every twelve months. (vii) Postings must be made at a designated Post Office. (viii) The cover of each item shall bear in the upper left-hand corner, beneath the sender's name and address, where these are given, the words "Newspaper Post — Inland" and, under these words, "Ceadaithe faoi Shéala Sealed under Permit" with the name of the appropriate Head Post Office and the permit number, in the following format: "Ceadaithe faoi Shéala Sealed under Permit Corcaigh 3. Cork 3." (x) When an application is made for a permit, or for its annual renewal, a sample of each item (cover and contents) shall be provided. (xi) Sealed newspapers shall remain subject to examination at any time by an officer of the Post Office. In the event of any items being found to contravene Post Office regulations, An Post shall have the right to terminate the permit without refund of the fee or part thereof. (xii) Subject to the foregoing, all provisions of this Warrant applicable to newspaper items shall continue to apply." ) The following subparagraphs are hereby substituted for subparagraphs (4) and (5) of paragraph (4): "(4) the title of the newspaper, and the reference to its registration for transmission by post; (5) a reference to any page of or place in the newspaper to which the attention of the addressee is directed; and (6) in the case of a newspaper posted under permit in a sealed or closed plastic wrapper, the number and designation of the permit".
