I, JAMES BROWNE, Minister for Housing, Local Government and Heritage, in exercise of the powers conferred on me by subsection (3) of section 1 of the Planning and Development Act 2024 (No. 34 of 2024), hereby order as follows: 1. This Order may be cited as the Planning and Development Act 2024 (Commencement) (No. 2) Order 2025. 2. In this Order “Act of 2024” means the Planning and Development Act 2024 (No. 34 of 2024). 3. (1) The 18th day of June 2025 is appointed as the day on which the provisions of the Act of 2024 specified in Part 1 of the Schedule shall, to the extent specified in that Part, come into operation. (2) The 18th day of June 2025 is appointed as the day on which the repeal of the provisions of the Planning and Development Act 2000 effected by section 6 of the Act of 2024 shall, to the extent specified in Part 2 of the Schedule, come into operation. (3) The 18th day of June 2025 is appointed as the day on which the amendments to the enactments referred to in section 631 of the Act of 2024 shall, to the extent specified in Part 3 of the Schedule, come into operation. PART 1 Commencement of Certain Provisions of Act of 2024 1. Sections 15, 346, 358, 376, 388, 389, 402, 403, 571, 573, 624, 625, 627, 630, 632 and 633 2. Chapter 3 of Part 9 3. Part 17 (other than sections 532 and 533) 4. Subsections (2) and (8) of section 353, subsection (4) of section 354 and subsections (1), (2), (3) and (4) of section 355 5. Section 146A in so far only as it applies to the Commission 5. Subsection (1), and paragraph (a) of subsection (5), of section 148 PART 3 Commencement of Certain Amendments effected by section 631 of Act of 2024 1. The amendment (specified at reference number 19 of column (1) of Schedule 7 to the Act of 2024) of the Transport (Railway Infrastructure) Act 2001 (No. 55 of 2001) (in this paragraph referred to as the “Act of 2001”) in so far only as it – (a) inserts definitions of “Act of 2024” and “Commission” in subsection (1) of section 2 of the Act of 2001, (b) inserts a reference to section 376 of the Act of 2024 and deletes a reference to section 146 of the Act of 2000 in subsection (2) of section 42 of the Act of 2001, (c) inserts “or under section 522 of the Act of 2024” in subsection (7) of section 47E of the Act of 2001, and (d) inserts section 47G of the Act of 2001. 2. The amendment (specified at reference number 44 of column (1) of Schedule 7 to the Act of 2024) of section 3 of the Urban Regeneration and Housing Act 2015 (No. 33 of 2015) in so far only as it inserts the definition of “Board” in that section. 3. The amendment (specified at reference number 46 of column (1) of Schedule 7 to the Act of 2024) of the Planning and Development (Housing) and Residential Tenancies Act 2016 (No. 17 of 2016) (in this paragraph referred to as the “Act of 2016”) in so far only as it – (a) inserts the definition of “Board” in section 3 of the Act of 2016, (b) amends section 11 of the Act of 2016, and (c) inserts “or section 376 of the Act of 2024” in paragraph (b) of subsection (2) of section 12 of the Act of 2016. 4. The amendment (specified at reference number 48 of column (1) of Schedule 7 to the Act of 2024) of the Criminal Justice (Corruption of Offences) Act 2018 (No. 9 of 2018). 5. The amendment (specified at reference number 54 of column (1) of Schedule 7 to the Act of 2024) of section 15 of the Planning and Development, Heritage and Broadcasting (Amendment) Act 2021 (No. 11 of 2021) in so far only as it inserts “ section 586 of the Planning and Development Act 2024 ” in subsection (1). 6. The amendment (specified at reference number 57 of column (1) of Schedule 7 to the Act of 2024) of Part 9 of the Land Development Agency Act 2021 (No. 26 of 2021) in so far only as the insertion of section 74 of that Act by that amendment effects the substitution of the definition of “Board”. 7. The amendment (specified at reference number 64 of column (1) of Schedule 7 to the Act of 2024) of section 8 of the Planning and Development and Foreshore (Amendment) Act 2022 (No. 47 of 2022). 8. The amendment (specified at reference number 65 of column (1) of Schedule 7 to the Act of 2024) of section 68 of the Water Environment (Abstractions and Associated Impoundments) Act 2022 (No. 48 of 2022). 9. The amendment (specified at reference number 67 of column (1) of Schedule 7 to the Act of 2024) of the Local Government (Mayor of Limerick) and Miscellaneous Provisions Act 2024 (No. 7 of 2024) in so far only as it – (a) amends section 2 of that Act, and (b) inserts section 10A of that Act.
