No. 28.NATIONAL HEALTH INSURANCE (TERMINATION OF SANATORIUM BENEFIT AND ABOLITION OF INSURANCE COMMITTEES) REGULATIONS, 1934. 1.—(1) These Regulations may be cited as the National Health Insurance (Termination of Sanatorium Benefit and Abolition of Insurance Committees) Regulations, 1934. (2) In these Regulations unless the context otherwise requires :— The expression " the Minister " means the Minister for Local Government and Public Health; The expression " County Council " includes a County Borough Council ; The expression " Committee " means an Insurance Committee, (3) The Interpretation Act, 1923 , applies to the interpretation of these Regulations as it applies to the interpretation of an Act of the Oireachtas. 2.—(1) The Accounts relating to the Sanatorium Benefit and Administration Funds of each Committee shall be closed as at the 31st of December, 1929, and any sum standing to the credit thereof or to the debit thereof as at that date, shall, after all assets have been realised and liabilities discharged in respect of the period ended the 31st day of December, 1929, be transferred to an account to be designated the Insurance Committees' (Abolition) Adjustment Account. (2) The balance in the General Administration Fund shall be transferred to the Insurance Committees' (Abolition) Adjustment Account. (3) Steps shall be taken to dispose of any furniture, stationery and any other property of the Committees and the proceeds thereof shall be credited to the Insurance Committees' (Abolition) Adjustment Account. (4) Two-ninths of the moneys in the Insurance Committees' (Abolition) Adjustment Account representing the amount of State Grant included therein shall be transferred to the Exchequer and from the remainder payment shall be made of :— ) The amounts ascertained to be due as compensation to officials of Committees in accordance with the provisions of Section 23 (4) of the National Health Insurance Act, 1929 ) Any expenses incurred in winding-up the affairs of the Committees, including— (i) payment of salaries or wages of persons formerly employed by Committees whose services have been retained after the 31st day of December, 1929, for the purpose of winding-up the affairs of such Committees ; (ii) payment in respect of the cost of the disposal of premises, properties and records of Committees ; (iii) payment of any other sum incidental to or consequent on the winding-up of the affairs of Committees. The balance remaining in the Account shall be applied by the Minister for the purpose of defraying expenditure of a capital nature in respect of the provision of approved apparatus and appliances required in connection with modern methods for the diagnosis and treatment of tuberculosis under tuberculosis schemes approved by the Minister. (5) Interest at the rate credited from time to time to current accounts in the National Health Insurance Fund shall be credited to the Insurance Committees' (Abolition) Adjustment Account. 3.—All agreements between a Committee and the County Council or Board of Health for the area of the Committee which would, but for this provision, have continued in operation after the 31st day of December, 1929, shall be deemed to have ceased and determined as at that date. 4.—These Regulations shall be deemed to have come into force on the 1st January, 1930.
