I, TED NEALON, Minister of State at the Department of Communications, in exercise of the powers conferred on me by section 104 of the Harbours Act, 1946 (No. 9 of 1946), the Ministers and Secretaries (Amendment) Act, 1983 (No. 40 of 1983), and the Communications (Delegation of Ministerial Functions) Order, 1984 ( S.I. No. 146 of 1984 ), and after due compliance with section 106 of the said Harbours Act, 1946 , hereby order as follows: 1 (1) This Order may be cited as the Harbour Rates (Wicklow Harbour) Order, 1985. (2) This Order shall come into operation on the 1st day of April, 1985. 2. In this Order "the Order of 1983" means the Harbour Rates (Wicklow Harbour) Order, 1983 ( S.I. No. 386 of 1983 ). 3. (1) The Harbour Rates (Wicklow Harbour) Order, 1949 ( S.I. No. 172 of 1949 ), is hereby amended by— ) the substitution for the First Schedule (inserted by the Order of 1983) thereto of the following Schedule: "FIRST SCHEDULE Maximum Goods Rates Unit of Quantity per tonne per tonne per tonne per tonne per tonne Coal and Coke per tonne Rubber and Plastics per tonne Fruit and Vegetables per tonne Fish (Fresh) per tonne per tonne per tonne per tonne Other Animals (Live) 8' x 8' x 20' 8' x 8' x 40' Goods not otherwise mentioned in this Schedule per tonne ) the substitution for the Second Schedule (inserted by the Order of 1983) thereto of the following Schedule: "SECOND SCHEDULE Maximum Tonnage Rates Ref. No. Description of Charge 1. Tonnage rates on vessels other than those described at reference numbers 2 and 3 below: (a) On every ton of the net register tonnage or half the gross tonnage, whichever is the greater, of every vessel entering the harbour: (b) On every ton of the net register tonnage or half the gross tonnage, whichever is the greater of every vessel entering the harbour windbound: 2. Rates on fishing vessels: (a) As a composition in full in lieu of tonnage rates on every fishing vessel entering the harbour for the purpose of landing fish, per year: (b) On every fishing vessel entering the harbour for any purpose other than landing fish, for each entry: The rate at 2(b) is chargeable for each stay in the harbour of seven days or part thereof. 3. Rates on Pleasure Boats: ( a ) (i) On every open pleasure boat of 1 ton gross or under, not being a pleasure boat described in Clause (ii) of this subparagraph, as a composition in full in lieu of tonnage rates payable yearly in advance, a sum not exceeding: (ii) On every open pleasure boat of 1 ton gross or under with cuddy or cabin not exceeding six foot in length as a composition in full in lieu of tonnage rates payable yearly in advance, a sum not exceeding: ( b ) (i) On every decked or part decked pleasure boat of 1.5 tons gross or under, being neither a catamaran nor a trimaran, as a composition in full in lieu of tonnage rates payable half-yearly in advance, for the period— (I) 15th April - 14th October, a sum not exceeding (II) 15th October - 14th April, a sum not exceeding (ii) On every catamaran or trimaran of 1.5 tons gross or under as a composition in full in lieu of tonnage rates payable half-yearly in advance, for the period. (I) 15th April - 14th October, a sum not exceeding (II) 15th October - 14th April a sum not exceeding ( c ) On every decked or part decked pleasure boat of 10 tons gross or under but over 1.5 tons gross as a composition in full in lieu of tonnage rates payable half yearly in advance, for the period: (i) 15th April - 14th October, a sum not exceeding (ii) 15th October - 14th April a sum not exceeding ( d ) On every decked or part decked pleasure boat over 10 tons gross as a composition in full in lieu of tonnage rates payable half-yearly in advance, for the period; (i) 15th April - 14th October, a sum not exceeding (ii) 15th October - 14th April, a sum not exceeding ( e ) On all pleasure boats entering the Harbour and not paying the composition rates at reference number 3(a), (b), (c), or (d) above and remaining in the harbour less than 7 days: for vessels remaining in the harbour between 7 and 14 days a further: for vessels remaining in the harbour between 14 and 21 days a further: and for every 7 days or part thereof over 21 days a further: ", and ) the substitution for the Third Schedule (inserted by the Order of 1983) thereto of the following Schedule: "THIRD SCHEDULE Other (Maximum) Charges Ref. No. Description of Charge 1. For the use of any shed, wharf, pier or quay for any goods (except round native timber, including pit props for export) for a period exceeding the period authorised by the bye-laws of the harbour authority for the time being in force: (a) For each week or part thereof for the first two weeks, per tonne a sum not exceeding: (b) For each week or part thereof after the first two weeks, per tonne a sum not exceeding: 2. For the use of any wharf, pier or quay for round native timber including pit props for export for each week or part thereof after the expiration of the period authorised by the bye-laws of the harbour authority for the time being in force, per tonne: 3. Ballast, per tonne: 4. For the use of any wharf, pier or quay for the launching, lifting out, repairing, fitting or servicing of vessels, per period of seven days or part thereof: (2) Where rates fixed under this Order are payable at a metric tonne charge, lesser weights shall be chargeable as follows: ) any weight not exceeding 250 kilogrammes shall count as 250 kilogrammes, ) any weight exceeding 250 kilogrammes but not exceeding 500 kilogrammes shall count as 500 kilogrammes, ) any weight exceeding 500 but not exceeding 750 kilogrammes shall count as 750 kilogrammes, ) any weight exceeding 750 kilogrammes but not exceeding 1 tonne shall count as 1 tonne. 4. EXPLANATORY NOTE. This Order authorises Wicklow Harbour Commissioners to charge revised goods, tonnage and other rates at Wicklow Harbour.
