Statute overview

About this statute

This Act applies across India and sets rules for waqf property, including who may create a waqf, registration requirements, publication of auqaf lists, and government oversight powers. The Board and Chief Executive Officer have wide powers over waqf administration, records, registration, inspection, budgeting, accounts, and recovery; mutawallis must comply with reporting, budget, account, and inspection duties, and unauthorized transfer of waqf property is prohibited and penalized. This provision block limits purchases and leases of waqf property, gives the Board and Chief Executive Officer enforcement powers, imposes mutawalli duties, and sets penalties for non-compliance. This part covers the Waqf Fund, board budgeting and accounts, tribunal procedure, restrictions on civil suits, and rulemaking powers. A corresponding State law in force immediately before commencement is repealed, and the Central Government may remove difficulties by order within two years of commencement.
