About this statute

This Act applies across India, starts on a date the Central Government appoints by notification, and restricts what banking companies and certain other persons may do or call themselves. This provision sets banking capital, shareholding, reserve, dividend, reserve-ratio, branch, and loan restrictions, and gives the Reserve Bank powers to approve, direct, certify, or cancel in specified cases. Banking companies must keep Indian assets above 75% of demand and time liabilities, file periodic returns and financial statements, and comply with Reserve Bank directions and inspections. This part gives the Reserve Bank, Central Government, Administrator, and liquidator powers and duties for banking-company takeover, amalgamation, winding up, and compensation, and it bars certain disruptive conduct at banking company premises. The Reserve Bank can ask for a moratorium for a banking company, and the Central Government can order it. During the moratorium, the company generally cannot pay depositors or other creditors. The Reserve Bank can also prepare reconstruction or amalgamation schemes, which the Central Government may sanction and make binding.
