First published in the ' Madhya Pradesh Gazette (Extra-ordinary)' dated the 29th June, 20011 PrOmulgated by the Governor in the Fifty-Second year of the Republic of India: An Ordinance further to amend the Madhya Pradesh Upkar Adhiniyam, 1981. WHEREAS, the State Legislature is not in session and the Governor of Madhya Pradesh is satisfied that circumstances exist which render it necessary for him to .take immediate action; (cid:9) • Now, THEREFORE, in exercise of the powers conferred by clause (1) of Article 213 of the Constitution of India: the Governor of Madhya Pradesh is pleased to promulgate the: following Ordinance:— Short title. I. This Ordinance may be called the Madhya Pradesh Upkar (Sanshodhan) Adhyadcsh, 2001. hladliva Pradesh Act No.! of 1982 2. DuriAg the period of operation of this Ordinance the Madhya Pradesh Upkar AdhiniYam, 1981 to he referred (No. 1 of 1982) (hereinafter referred to as the Principal Act), shall have effect subject to the amendment temporarily specified in Section-3. amended Amendment of Section 3. .3. For section 3 of the Principal Act, the following section shall be substituted, namely: Levy of energy development cess. 3 (1) Every distributor of electrical energy shall pay to. the State Government at the prescribed time and in the prescribed manner an energy development cess at the rate of one paise per unit on the total units of electrical energy sold or supplied to a consumer or consumed by himself or his employees during any month: Provided that no cess shall be payable in respect of electric energy,— (i) (a) sold or supplied to the Government of India for consumption by ti' — Government; or (b) sold or supplied to the Government of India or a railway company for consumption in the construction, mainten.dnce or operation of any railway administered by the Government of Indiai• t. (ii) sold or supplied in bulk to a Rural Electric Co-operative Society registered under -the Madhya Pradesh Co-operative SocieticiThet, 1960 ,(No. 17 of 1961): Explanation.—For the purpose of this sub-section 'month means such period as may be . prescribed. (2) Every producer producing electrical energy by his captive p-wer unit or diesel generator set of capacity exceeding 10 Kilowatt in total shall pay to the State Goverment an energy development cess at. the fate of 20 paise per unit on the total units of electrical energy produced whether for sale or supply to a consumer or for consumption by himself or his employees during any month: -CT (cid:9) kri(cid:9) f-{(cid:9) 29 7.11 2001 704 (3) Provided that no Cess shall be payable in respect of electrical energy produced by :— the Government of India for consumption by that Government. the Government of India or a railway company for consumption in the construe- - (ion, maintenance or operation of any railway administered by the Govern- ment of India. the State Government for consumption by that Government. (iv).a Rural Electric Co-operative Socciety registered under the M. P. Co-operative Societies Act, 1960 (No. 17 of 1961). (v) the Local bodies including Municipal bodies and Panchayats for consumption in public street lamp or lamps in any market place or water works or any other places of public resort maintained by such bodies : Provided further that the amount of energy development cess shall be collected by the Madhya Pradesh State Electricity Board and the amount so collected shall be made available to the State Government". The proceeds of the ccss under sub-section (I) and (2) shall first be credited to the Consolidated Fund of the state and the State Government may, at the commence- ment of each financial year, after due appropriation has been made by law, withdraw from the Consolidated Fund 'of the State an amount equivalent to the proceeds of ccss realized by the State Government in the preceding financial year and shall place it to the credit of a separate fund to be called the Energy Deve- lopment Fund and such credit to the said fund shall be an expenditure charged on the Consolidated Fund of the State Government of Madhya Pradesh. The amount in the credit of the funds shall, at the discretion of the State Government be utilized for :— (a) research and development in the field of energy including electrical energy as well • as other conventional and non-conventional sources of energy; improving the efficiency of generation, transmission, distribution and utilization of energy including reduction of losses in transmission and distribution; research in design, construction, maintenance, operation and materials of the equip- ment used in the field of energy with a view to achieve.,Optimum efficiency, continuity and safety:- survey of energy sources including non-perennial sources to alleviate energy shortage; (c) energy conservation programmes; extending such facilities and services to the consumers as may be deemed necessary; creation of a laboratory and testing facilities for testing of electrical appliances and equipments and other equipments used in the field of energy; 11-77:577r.-era- (cid:9) 704 (4) 1 1771gt?! This Act may be called the Madhya Pradesh Upkar (Sanshodhan) Adhiniyam,• 2012- • Amendment of 2. In Section 3 of the Madhya Pradesh Upkar Adhiniyam, 1981 (No. 1 of 1982), for Section 3.' '(cid:9) (cid:9) sub-section (1), the following sub-section shall be substituted, namely :— . • at the prescribed Government "(1) (a) Every Generating Company shall pay to the State time and in the prescribed 'manner an energy development cess at the rate of fifteen paise per unit on the total units of electrical energy sold or supplied to a. distribution licensee or consumer in the State bf Madhya Pradesh or consumed by itself or its employees during prescribed period : Provided that no cess shall be payable in respect of electrical energy sold or supplied by any Generating Company in which the Government of Madhya Pradesh has fifty • . ' one percent or more equity..(cid:9) or operating a captive generating plant shall pay to the State , (b) Every person owning.
