lafo/kku ds vuqPNsn&348 ds [kaM ¼3½ ds v/khu mDr vf/kfu;e dk vaxzsth Hkk"kk esa izkf/kd`r ikB le>k tk;sxk A fcgkj&jkT;iky ds vkns’k ls] T;ksfrLo:i JhokLro] ljdkj ds lfpo ¼izŒ½A [Bihar Act 06, 2024] The Bihar State MINIORITIES COMMISSION (Amendment) Act, 2024 AN Act to amend the Bihar State Minorities Act , 1991 (Bihar Act, 7, 1991) Whereas, with a view to protect rights of minorities conferred under the Constitution of India and for implementation of policies and programmes relating to such rights, in the State of Bihar, an enactment known as Bihar State Minorities Commission Act, 1991 is in existence. Whereas, in the existing Act, minorities have been defined to mean religious and linguistic minorities, who have been so recognized by the Government. Whereas, in the State of Bihar apart from pre-dominant Muslim Minority, there are other minorities such as Christian, Baudh, Jain, Sikh and some other minorities also reside in Bihar, Which is reported in the Bihar Caste based survey 2022-23. Whereas, experience has proved that many of religious and linguistic minority's issues have not been addressed effectively. Whereas, it is felt imperative to re-organize and re-structure Bihar State Minorities Commission to address the issues relating to all minorities, religious and linguistic, in a holistic manner. Now, therefore, the legislature of State of Bihar enacts the following Act, in 75th year of republic as follows:- 1. Short title, extent and commencement.- (1) This Act may be called Bihar State Minorities Commission (Amendment) Act, 2024. (2) This Act shall extend to the whole State of Bihar. (3) This Act shall come into force immediately on publication in Bihar gazette. 2. Amendment in section 4 of Bihar Act 7, 1991.- After Sub-section (2) in Section 4 following Sub-section (3) shall be added with effect from the date this Amendment Act comes into force. (3) (i) The Commission constituted in exercise of power under Section 4 of the existing Act shall stand dissolved. (ii) On dissolution of the Commission constituted under Section 4, the State Government shall appoint Administrator who shall be an officer not below the rank of Secretary to the Government, for discharge of day to day functions of the Commission. (iii) The State Government may issue direction by Notifications/ Resolutions/ Advisory to the Administrator who shall be bound by such direction/ resolution/ advisory issued by the State Government. 3. Amendment in section 5 of Bihar Act 7, 1991.- Sub Section 'c' shall be added in the section '5' of the said Act :- 4 (cid:464)बहार गजट (असाधारण) 14 माच(cid:91) 2024 (c) Notwithstanding, tenure prescribed in the section 5, of the Act, the State Government shall have the power to dissolve the commission anytime if it is satisfied that dissolution is in the larger public interest to make the functioning of the commission consistent with the aims and object of the Act and in furtherance of rights and welfare of all religious and linguistic minority habitant of State of Bihar. 4. Addition of section 19 in Bihar Act 7, 1991.- A new section 19 shall be added after section 18 of the said act:- 19 (i) Measures to be taken during interregnum: After dissolution of the Commission, the State Government shall constitute a committee of experts comprising of five members to study and make recommendations to the Department of Minorities Welfare regarding identifying minorities based on data collected and analyzed in the Bihar Caste based survey, 2022-23 and to submit a comprehensive report to the department. For the purpose of preparation of report the department may nominate people from different religious and linguistic minorities. (ii) On completion of the study, the State Government will frame policies for holistically addressing the issues in relation to all religious and linguistic minorities. (iii) Above exercise contained in Sub-section (i) and (ii) shall be completed within a maximum period of one month. (iv) On completion of one month as provided in Sub-section (iii) above, the State Government shall constitute a Commission under Section 4 of the existing Act within a maximum period of two months from its dissolution.
