The Code of Civil Procedure (Telangana) Amendment Act, 1953
This amendment applies to the whole of Telangana, comes into force at once, and adds a further exemption from attachment for certain sums payable under government life insurance policies.
THE CODE OF CIVIL PROCEDURE (TELANGANA) AMENDMENT ACT, 1953. (ACT NO. XI OF 1953.) ARRANGEMENT OF SECTIONS Sections 1. Short title, extent and commencement. 2. Amendment of section 60, Act 5 of 1908. THE CODE OF CIVIL PROCEDURE (TELANGANA) AMENDMENT ACT, 1953.1 ACT No. XI OF 1953. 1. (i) This Act may be called the 2Code of Civil Procedure Short title, extent (Telangana) Amendment Act, 1953. and commencement. (ii) It extends to the whole of the State of 2Telangana. (iii) It shall come into force at once. 2. In the proviso to sub-section (1) of section 60 of the Amendment of Code of Civil Procedure, 1908- section 60. Act 5 of 1908. (i) after clause (k) the following clause shall be inserted, namely:- (kk) amounts payable under policies issued in pursuance of the Rules for 3[the Andhra Pradesh Government Life Insurance Department]; and (ii) after Explanation 2, the following Explanation shall be inserted, namely:- 1. The Code of Civil Procedure (Andhra Pradesh) (Telangana Area) Amendment Act, 1953 (Act No.XI of 1953) initially applicable to the Telangana area of the State of Andhra Pradesh subsequently extended to the Andhra area with certain modifications by Act No.X of 1962 and in force in the combined State as on 02.06.2014 has been adapted to the State of Telangana, under section 101 of the Andhra Pradesh Reorganisation Act, 2014 (Central Act 6 of 2014) vide. the Telangana Adaptation of Laws (No.2) Order, 2016, issued in G.O.Ms.No.46, Law (F) Department, dated 01.06.2016. 2. Substituted by G.O.Ms.No.46, Law (F) Department, dated 01.06.2016. 3. Substituted by Act No.X of 1962. 2 [Act No. XI of 1953] “Explanation 2-A. Where any sum payable to a Government servant is exempt from attachment under the provisions of clause (kk), such sum shall remain exempt from attachment notwithstanding the fact that owing to the death of the Government servant it is payable to some other person.” * * *
