Preamble : For administrative purposes and educational interests of students, it is necessary to establish two new Universities namely Patliputra University in Patna and Purnia University in Purnia by division of two existing universities namely Magadh University, Bodhgaya and Bhupendra Narain Mandal University, Madhepura. It is also necessary to delete certain existing provisions of Bihar State Universities Act, 1976 in view of the re- organisation of Bihar and creation of new Jharkhand State. For these purposes, it is 4 (cid:1)बहार गजट (असाधारण), 17 अअअअगगगगःःःःतततत 2016 expedient to amend certain provisions, to add certain new provisions and to delete certain existing provisions of Bihar State Universities Act, 1976 . Be it enacted by the legislature of the State of Bihar in the sixty-seventh year of the Republic of India as follows. 1. Short title, extent and commencement. - (1) This Act may be called The Bihar State Universities (Amendment) Act, 2016. (2) It shall come into force with effect from the date which the State Government , by notification, may fix. 2. Amendment in section 3 of Bihar Act 23 of 1976. - Sub section (1) of section 3 of The Bihar State Universities Act, 1976 (Bihar Act 23, 1976) shall be amended as follows:- (1) Clauses (d), (e) and (f) of sub section (1) of section 3 of Bihar Act 23,1976 will be deleted. (2) Clause (g) of sub section (1) of section 3 of Bihar Act 23,1976 shall be renumbered as clause (d) and shall be substituted by the following :- "(d) The Magadh University headquarters of which will be at Bodhgaya (Gaya) and territorial jurisdiction of which will be the whole of the Magadh Division.” 3. Clause (h) and (i) of sub section (1) of section 3 of Bihar Act 23,1976 shall be renumbered as clause (e) and (f) of sub section (1) of section 3 respectively. 4. Clause (j) of sub section (1) of section 3 of Bihar Act 23,1976 shall be substituted by the following renumbering as clause (f) :- "(f) The Bhupendra Narain Mandal University headquarters of which will be at Madhepura and territorial jurisdiction of which will be the whole of the Koshi Division.” 5. Clause (k) and (l) of sub section (1) of section 3 of Bihar Act 23,1976 shall be renumbered as clause (h) and (i) respectively. 6. The following two new clauses shall be added after clause (l) of sub section (1) of section 3 of Bihar Act 23,1976. "(j) Patliputra University may be established from the date notified in the official gazette by the State Government, by notification, headquarters of which will be at Patna and territorial jurisdiction of which will be territorial jurisdiction of Patna and Nalanda district of Patna Division except the colleges falling within the jurisdiction of the Patna University.” (cid:1)बहार गजट (असाधारण), 17 अअअअगगगगःःःःतततत 2016 5 "(k) Purnia University may be established from the date notified in the official gazette by the State Government, by notification, headquarters of which will be at Purnia and the territorial jurisdiction of which will be the whole of territorial jurisdiction of Purnia Division.” 3. Savings - Notwithstanding amendment in section 3 of Bihar Act 23, 1976, anything done or any action taken under the said section 3 (1) shall be deemed to have been validly done or taken and shall not be opened to question on the ground of amendment in section 3(1) of Bihar Act 23,1976.
