D°fi“m°“s- 2.In this Act. unless the contextotherwise requires,— (a) "adjudicating officer" means the adjudicating officer appointed under sub-section (1) ofsection 71; (b) "advertisement" means any document described orissued as advertisement throughany mediumandincludesanynotice.circularorotherdocumentsorpublicity inanyform.informingpersonsaboutarealestateproject,orofferingforsaleofaplot, buildingorapartmentorinvitingpersonstopurchaseinanymannersuchplot,building or apartment or to make advances or deposits forsuch purposes; (c) "agreementforsale" meansanagreemententeredintobetweenthepromoter and the allohttee; “ (d)"allottee" inrelationtoarealestateproject,meansthepersontowhomaplot, apartmentorbuilding,asthecasemaybe.hasbeenallotted, sold(whetherasfreehold or leasehold) or otherwise transferred by the promoter, and includes the person who subsequently acquires the said allotment through sale, transferorotherwisebut does notinclude apersontowhomsuchplot, apartmentorbuilding, as thecasemaybe, is given on rent; ' (e) "apartment" whether called block, chamber, dwelling unit, flat. office, showroom,shop,godown, premises,suit,tenement,unitorbyanyothername, means aseparate and self-containedpartofany immovableproperty, includingone ormore rooms or enclosed spaces, located on one or more floors or any part thereof, in a buildingoronaplotofland,usedorintendedtobeusedforanyresidentialorcommercial use such as residence, office, shop, showroom or godown or for carrying on any business. occupation, profession ortrade,orforanyothertype ofuseancillarytothe purpose specified; (f) "AppellateTribunal " means theReal EstateAppellateTribunal established under section 43; (g) "appropriateGovernment" meansinrespectofmattersrelatingto,— (i)theUnionterritorywithoutLegislature,theCentralGovernment; (ii)theUnionterritoryofPuduchcrry,theUnionterritoryGovernment; (iii)theUnionterritoryofDelhi,theCentralMinistryofUrbanDevelopment; (iv) theState,theStateGovernment; (h) "architect" meansapersonregisteredasanarchitectundertheprovisionsof theArchitectsAct, 1972; 20 of 1972. (1') "Authority" means the Real Estate RegulatoryAuthority established under sub-SW: (i) "building" includesanystructureorerectionorpanofastructureorerection which is intended to be used for residential. commercial or for the purpose of any business. occupation. profession or trade. or for any other related purposes; (k) "carpet area" means the net usable floorareaofanapartment. excludingthe area covered by the external walls, areas underservices shafts. exclusive balcony or verandah area and exclusive open terrace area. but includes the area covered by the internalpartitionwallsoftheapartment. Scanned by CamScanner 'ar 339‘ 1] THEGAZETTEOFINDIAEXTRAORDINARY 3 whichisappurtenanttothenetusablefloortueaot'anapartment.meantfortheexclusive use ofthe allottee: and "exclusive open terrace area“ tneans the area ofopen terrace whichisappurtenanttothenetusablefloorareaofanapartment.tneantfortheexclusive use ofthe allottee: (I)“Chairperson"meanstheChairpersonoftheRealEstateRegulatoryAuthority appointed under section 2l: (m) "commencement certificate" means the commencement certificate or the building pomerrnit. by whatever name called issued by the competentauthoritytoalloworperrrritthepromotertobegindevelopmentworksonan mmova e prope y. as per the sanctionedplan: (It) "commonare s" mean— (i)theentirelandfortherealestateprojectorwheretheprojectisdeveloped inphasesandregrstratronunderthisActissoughtforaphase.theentirelandfor that phase; (it)thestaircases.lifts.staircaseandliftlobbies.firescapes.andcommon entrances andexits ofbuildings; (iii)thecommonbasements,terraces.parks.playareas.openparkingareas and common storage spaces: (iv)thepremisesforthelodgingofpersonsemployedforthemanagement ofthe property including accommodation for watch and ward staffs orforthe lodging ofcommunity service personnel; (v) installations of central services such as electricity. gas. water and sanitation,air-conditioningandincinerating.systemforwaterconservationand renewable energy; (vi) the water tanks. sumps. motors. fans. compressors. ducts and all apparatus connected with installations forcommon use; (vii)allcommunityandcommercialfacilitiesasprovidedintherealestate project; (viii) all other portion of the project necessary or convenient for its maintenance.safety,etc.. andincommonuse; (0) "com a " means a company incorporated and registered under the 18 of2013. CompaniesAct.2013andincludes.— M. (i) a corporation established byorunderany CentralActorStateAct; (it) a development authority or any public authority established by the Govermnentinthis behalfunderanylawforthetimebeingin force: (p) "competent authorit " mezurs the localauthority orany authoritycreatedor established underany law forthe time beingin forceby theappropriateGovernment which exercises authority over land under its jurisdiction. and has powers to give permission fordevelopmentofsuchimmovableproperty; f (q) "com letion certificate" means the completion certificate. or such other certificate.by whatevernamecalled. issuedbythecompetentauthoritycertifyingthat the real estate project has been developed according to the sanctioned plan. layout 1: planand specifications. as approvedby thecompetentauthority underthe local laws; (r)"day"meanstheworkingday.intheconcernedStateorUnionterritory.asthe casemaybe.notifiedbytheappropriateGovernmentfromtimetotime; Scanned by CamScanner THEGAZETTEOFINDIAEXTRAORDINARY [PART — .(s)"development"withitsgrammaticalvariationsandcognateexpressions,means carryingoutthedevelopmentofimmovableproperty, engineeringorotheroperations in,on, overorunderthelandorthemakingofanymaterialchangeinanyimmovable property orland and includes re-development; (t) "development works" means the external development works and internal developmentworkson immovableproperty; (u) "engineer" means aperson whopossesses abachelor's degreeorequivalent fromaninstitutionrecognisedbytheAllIndiaCouncilofTechnicalEducationorany University or any institution recognised under a law or is registered as an engineer underanylawforthetimebeinginforce; (v) "estimated cost of real estate project" means the total cost involved in developingtherealestateprojectandincludesthelandcost, taxes,cess, development and other charges; ’— "".' "——-_' .————" (w) "externaldevelopmentworks"includesroadsandroadsystemslandscaping, watersupply,seweageanddrainagesystems,electricitysuplytransformer,sub-station, solidwastemanagementanddisposaloranyotherworkwhichmayhavetobeexecuted in theperiphery of, oroutside, aprojectforitsbenefit, as may beprovidedunderthe locallaws; (x) "family" includeshusband, wife, minorsonand unmarried daughterwholly dependent on a person; 0) "garage"meansaplacewithinaprojecthavingaroofandwallsonthreesides for parking any vehicle, but does not include an unenclosed or uncovered parking space such as open parking areas; (2) "i movableproperty" includesland.buildings,rightsofways, lightsorany other benefit arising out of land and things attached to the earth or permanently fastened to anything which is attachedto the earth, butnot standing timber, standing crops or grass; (za) "interest"meanstheratesofinterestpayablebythepromoterortheallottee, asthe case maybe. Explanation—For the purpose ofthis clause— (i)therateofinterestchargeablefromtheallotteebythepromoter,incase ofdefault,shallbeequal totherateofinterestwhichthepromotershallbeliable to paythe allottee, incaseofdefault; (ii) the interest payable by the promoter to the allottee shall be from the datethepromoterreceivedtheamountoranypartthereoftillthedatetheamount orpartthereofandinterestthereon isrefunded, andthe interestpayableby the allotteetothepromotershallbefromthedatetheallotteedefaultsinpaymentto thepromotertill thedateitispaid; (zb)"intemaldevelopmentworks"meansroads,footpaths,watersupply,sewers, drains,parks,treeplanting,streetlighting,provisionforcommunitybuildingsandfor treatment and disposal of sewage and sullage water, solid waste management and disposal, water conservation, energy management, fire protection and fire safety ‘ requirements,socialinfrastructuresuchaseducationalhealthandotherpublicamenities _ l orany otherwork in aproject forits benefit, as per sanctionedplans; (zc) "local authority" means the Municipal Corporation or Municipality or Panchayatmmal Body conmforthe time being in forceforprovidingmunicipalservicesorbasicservices.asthecasemaybe,inrespect ofareas underitsjurisdication; Scanned by CamScanner SEC-1] THEGAZE'ITEOFINDIAEXTRAORDINARY 5 (zd) "Member" means the member of the Real Estate Regulatory Authority appointedunder section 21 and includes the Chaiperson; (ze)"notification"meansanotificationpublishedintheOfficialGazetteandthe expression "notify" shall be construed accordingly; (If) "occupancy certificate" means the occupancy certificate, or such other certificate by whatever name called, issued by the competent authority permrtting occupationofanybuilding,asprovidedunderlocallaws,whichhasprovrsronforc1v1c infrastructure such as water, sanitationandelectricity; (zg) "Person" includes,— __',.__ (i)anindividual; ‘(ii)aHinduundividedfamily; (iii)acompany; 9 of 1932. (iv)afirmundertheIndianPartnershipAct, 1932ortheLimitedLiability 6 °f2009- PartnershipAct,2008,asthecasemaybe; (v) acompetentauthority; (vi)anassociationofpersonsorabodyofindividualswhetherincorporated or not; (vii)aco-operativesocietyregisteredunderanylawrelatingtoco—operative societies; (viii) any such other entity as the appropriate Government may, by notification,specifyinthisbehalf; (zh) "planning area" means a planning area or a development area or a local planning areaoraregional developmentplan area, bywhatevernamecalled, orany otherareaspecifiedassuchbytheappropriateGovernmentoranycompetentauthority and includes any area designated by the appropriate Government or the competent authoritytobeaplanningareaforfutureplanneddevelopment,underthelawrelating toTownandCountryFlamingforthetimebeinginforceandasrevisedfromtimeto time; (zi) "prescribed" meansprescribedbyrulesmadeunderthisAct; (zj) "project" meanstherealestateprojectasdefinedincluase(zn); (21:) "promoter"means,— (i) aperson who constructs orcauses to be constructed an independent buildingorabuildingconsistingofapartments,orconvertsanexistingbuilding or apartthereofinto apartments, forthe purpose ofselling all orsomeofthe apartments to other persons and includes his assignees; or (ii) apersonwhodevelopslandintoaproject, whetherornottheperson alsoconstructsstructuresonanyoftheplots,forthepurposeofsellingtoother persons all or some of the plots in the said project. whether with or without structures thereon; or (iii) any development authority or any other public body in respect of allotteesof— (a) buildings or apartments. as the case may be. constructed by suchauthorityorbodyonlandsownedbythemorplacedattheirdisposal bytheGovernment;or Scanned by CamScanner THEGAZETTEOFINDIAEXTRAORDINARY [PARTII— (b)plotsownedbysuchauthorityorbodyorplacedattheirdisposal bytheGovernment, forthepurposeofsellingallorsomeoftheapartmentsorplots;or (iv)anapexStatelevelco-operativehousingfinancesocietyandaprimary co—operative housing society which constructs apartments or buildings forits Members orinrespectoftheallotteesofsuchapartmentsorburldmgs; or (v) anyotherperson whoactshimselfasabuilder,coloniser,contractor, developer, estatedeveloperorby anyothernameorclaims tobeactingas the holderofapowerofattorneyfromtheownerofthelandonwhichthebuildingor apartmentisconsuuctedorplotisdevelopedforsale;or (vi)suchotherpersonwhoconstructs anybuildingorapartmentforsale tothegeneralpublic. Explanation—For the purposes of this clause, where the person who constructsorconvertsabuildingintoapartmentsordevelopsaplotforsaleand the persons who sells apartments or plots are different persons, both ofthem shall be deemed to be thepromoters and shall bejointly liable as such for the functions and responsibilities specified, under this Act or the rules and regulations made thereunder; (zl) "prospectus" means any document described orissued as a prospectus or any notic—e, circ.u—lar, or"otherdocumentofferi.ngforsale oranyreal estate prO.jector inviting any person to make advances ordeposits forsuch purposes; (zm) "realestateagent" means anyperson, whonegotiates oracts onbehalfof oneperson in a transaction oftransferofhis plot, apartment orbuilding, as the case maybe.inarealestateproject,bywayofsale,withanotherpersonortransferofplot, apartment or building, as the case may be, ofany otherperson to him and receives remuneration orfeesorany othercharges forhis services whetheras commissionor otherwise and includes a person who introduces, through any medium, prospective buyersandsellerstoeachotherfornegotiationforsaleorpurchfiplot,apfififit ‘07building,asfitecasemaybe,andincludespropertydealers,brokers,middlemenby whatevernamecalled; V" (m) "real estate project" means the development of a building or a building consisting of apartments, or converting an existing building or a part thereof into apartments,orthedevelopmentoflandintoplotsorapartment,asthecasemaybe.for the purpose ofselling all or some ofthe said apartments orplots orbuilding, as the casemaybe.andincludesthecommonareas,thedevelopmentworks,allimprovements andstructuresthereon, andalleasement, rightsandappurtenancesbelongingthereto; (zo) "regulations" means theregulationsmadeby theAuthority underthisAct: (21)) "rule"meanstherulesmadeunderthisActbytheappropriateGovernment: (zq) "sanctionedplan" meansthe siteplan,buildingplan. serviceplan, parking andcirculationplan, landscapeplan.layoutplan,zoningplanandsuchotherplanand includesstructuraldesigns.ifapplicable.permissionssuchasenvironmentpermission and such other permissions, which are approved by thecompetent authority priorto startofareal estate project; (zr)wordsandexpressionsusedhereinbutnotdefinedinthisActanddefinedin anylawforthetimebeinginforceorinthemunicipallawsorsuchotherrelevantlaws oftheappropriateGovernmentshallhavethesamemeaningsrespectivelyassignedto theminthoselaws. "W" ”rim - SBC. 1] THEGAZE’I'I’EorINDIAEXTRAORDINARY 7 CHAPTERH REGISTRATION orREALESTATEmowerANDREGIS’I‘RATIONorREALESTATEAGENTS \Al)Nopromotershalladvertise,market,book,sellorofferforsale,orinvitepersons prior to purchase in any mannerany plot, apartmentorbuilding, as thecasemaybe, in any real feglsmnon . . . . . . . . ofreal estate estate prOJect or part ofIt, In any planmng area, Without registering the real estate project project with with the Real Estate RealatoryAuthority establishedunderthisAct: Real lEstate Regu atory Providedthatprojects thatare ongoingon thedateofcommencementofthisActand Authority. forwhichthecompletioncertificatehasnotbeenissued,thepromotershallmakeanapplication totheAuthority forregistrationofthe saidprojectwithinaperiodofthreemonthsfromthe dateofcommencementofthisAct: Provided furtherthatiftheAuthority thinks necessary, in theinterestofallottees, for projects whicharedevelopedbeyondtheplanningareabutwiththerequisitepermissionof the local authority, it may, by order, directthe promoterofsuchprojectto registerwiththe Authority, andtheprovisionsofthisActortherulesandregulations madethereunder, shall apply to such projects from that stage ofregistration. /(2)Notwithstandinganything containedin sub-section(1), noregistrationofthereal estateproject shall be required—— (a)wheretheareaoflandproposedtobedevelopeddoesnotexceedfivehundred squaremetersorthenumberofapartmentsproposedtobedevelopeddoes notexceed eight incluswe ofall phases: ‘fifi —___—’-# Provided that, if the appropriate Government considers it necessary, it may, reduce the threshold below five hundred square meters or eight apartments, as the casemaybe,inclusiveofallphases,forexemptionfromregistrationunderthisAct; (b)wherethepromoterhasreceivedcompletioncertificateforarealestateproject priortoconunencementofthisAct; / (c) for the purpose ofrenovation or repair or re—development which does not involve marketing, advertising selling or new allotment of any apartment, plot or building, as thecase may be, underthereal estate project. Explanation—Forthepurposeofthissection. wheretherealestateprojectisto bedevelopedinphases,every suchphaseshallbeconsideredastandalonerealestate project, and the promoter shall obtain registration under this Act for each phase separately. f”..— 4.(1)EverypromotershallmakeanapplicationtotheAuthorityforregistrationofthe Application real estateprojectin such form,manner, within such time and accompanied by suchfeeas for' _ maybe specified by theregulations made bytheAuthogtx 33:33:82” projects. V6.The promoter shall enclose the following documents along with the application referredtoin sub-section (1),namely:— (a)abriefdetailsofhisenterpriseincludingitsname,registeredaddress.typeof enterprise (proprietorship. societies. partnership. companies. competent authority), and the particulars ofregistration. and the names and photographs ofthe promoter; (17)abriefdetailoftheprojects launchedby him, inthepastfiveyears, whether alreadycompletedorbeingdeveloped.asthecasemaybe.includingthecurrentstatus ofthe said projects, any delay in its completion. details ofcases pending, details of it, .- i .3 t 1, . I _. t ._~,_ .. ., | .~ ! ._ Scanned by CamScanner THEGAZETTEOFINDIAEXTRAORDINARY [PARTII— (c)anauthenticatedcopyoftheapprovalsandcommencementcertificatefrom thecompetentauthorityobtainedinaccordancewiththelawsasmaybeapplicablefor therealestateprojectmentionedintheapplication,andwheretheprojectisproposed tobedevelopedinphases.anauthenticatedcopyoftheapprovalsandcommencement certificatefromthecompetentauthorityforeach ofsuchphases; (d) the sanctionedplan, layout plan and specifications oftheproposedproject orthephasethereof, andthewholeprojectassanctionedbythecompetentauthority; (e) the plan ofdevelopmentworksto beexecutedin theproposedproject and theproposedfacilitiestobeprovidedthereofincludingfirefightingfacilities,drinking waterfacilities,emergencyevacuationservices,useofrenewableenergy; (1‘)thelocationdetailsoftheproject,withcleardemarcationoflanddedicatedfor theprojectalong withits boundaries includingthelatitude andlongitudeoftheend points ofthe project; (g)proformaoftheallotmentletter.agreementforsale,andtheconveyancedeed proposed to be signed with the allottees; (h) the number, type and the carpet area ofapartments for sale in the project alongwiththeareaoftheexclusivebalconyorverandahareasandtheexclusiveopen terraceareasapartmentwiththeapartment,ifany; (i)thenumberandareasofgarageforsaleintheproject; (i) the names and addresses ofhis real estate agents, ifany. forthe proposed project; (k)thenames andaddressesofthecontractors, architect, structuralengineer,if any and otherpersons concerned with the developmentofthe proposedproject; (I)adeclaration,supportedbyanaffidavit,whichshallbesignedbythepromoter oranypEi's'on atlfirisedby the promoter, stating:— (A)thathehasalegaltitletothelandonwhichthedevelopmentisproposed alongwithlegallyvaliddocumentswithauthenticationofsuchtitle,ifsuchland is owned by anotherperson; (B) that the land is free from all encumbrances, or as the case may be detailsoftheencumbranceson such landincluding anyrights,title, interestor nameofanypartyinoroversuchlandalongwithdetails; (C)thetimeperiodwithinwhichheundertakestocompletetheprojector phase thereof, as thecase maybe; (D)thatseventypercent.oftheamountsrealisedfortherealestateproject fromtheallottees,fromtimetotime,shallbedepositedinaseparateaccountto bemaintainedinascheduledbanktocoverthecostofconstructionandtheland cost and shall be used only for thatpurpose: Providedthatthepromotershallwithdrawtheamountsfromtheseparate account, to cover the cost of the project. in proportion to the percentage of completionoftheproject: Provided further that the amounts from the separate account shall be withdrawnbythepromoterafteritiscertifiedbyanengineer,anarchitectanda chartered accountant in practice that the withdrawal is in proportion to the percentageofcompletion oftheproject: Provided also that thepromotershall gethis accounts auditedwithin six monthsaftertheendofeveryfinancialyearbyacharteredaccountantinpractice, "'- and shall produce a statement of accounts duly certified and signed by such Scanned by CamScanner SEC. 1] THEGAZETTEOFINDIAEXTRAORDINARY 9 charteredaccountantanditshallbeverifiedduringtheauditthattheamounts collected for a particular project have been utilised for the project and the withdrawal has been in compliance with the proportion to the percentage of completionoftheproject. Explanation.—Forthepurposeofthisclause,theterm "schedulebanlt" means abankincludedin the Second SchduledtotheReserveBank ofIndia 2 of 1934. Act, 1934; (E)thatheshalltakeallthependingapprovalsontime,fromthecompetent authorities; (F)thathehasfurnishedsuchotherdocumentsasmaybeprescribedby therulesorregulationsmadeunderthisAct;and (m)suchotherinformationanddocumentsasmaybeprescribed. (3) The Authority shall operationalise a web based online system for submitting applications for registration ofprojects within a period ofone year from the date ofits establishment. 5. (I) On reciptoftheapplication undersub—section (1) ofsection 4, theAuthority Grant of shallwithinaperiodofthirtydays. ‘eg'mm' . (a) grant registration subject to the provisions ofthis Act and the rules and regulationsmadethereunder, andprovidearegistrationnumber,includingaLoginId andpasswordtotheapplicantforaccessingthewebsiteoftheAuthorityandtocreate hiswebpageandtofilltherein thedetailsoftheproposedproject; or (b) rejecttheapplicationforreasonstoberecordedinwriting,if suchapplication does not conform to the provisions of this Act or the rules or regulations made thereunder: Provided that no application shallberejectedunlesstheapplicanthas been givenan opportunityofbeingheardin thematter. (3)Theregistrationgrantedunderthissectionshallbevalidforaperioddeclaredby thepromoterundersub-clause(C)ofclause(1)ofsub—section(2)ofsection4forcompletion oftheprojectorphasethereof, as thecasemaybe. 6. The registration granted undersection 5 maybeextendedby theAuthority on an Extension of applicationmadebythepromoterduetoforcemajeure, insuchformandonpaymentofsuch registration. Explanation—For the purposes of this clause, the term "unfair practice means" a practice which, for the purpose of promoting the sale or development of any real estate projectadoptsanyunfairmethodorunfairordeceptivepracticeincludinganyofthefollowing practices,namely:— (A) the practice of making any statement, whether in writing or by visible representation which,— (0falselyrepresentsthattheservicesareofaparticularstandardorgrade; (ii) represents that the promoter has approval or affiliation which such promoterdoes not have; (iii) makes afalseormisleading representationconcerningtheservices; (B) the promoter permits the publication of any advertisement or prospectus whetherinanynewspaperorotherwiseofservicesthatarenotintendedtobeoffered; (d)thepromoterindulgesin anyfraudulentpractices. (2) The registration granted to the promoter under section 5 shall not be revoked unless theAuthority has given tothepromoternotless than thirty days notice, in writing, stating the grounds on which it is proposed to revoke the registraton, andhas considered any cause shown by the promoter within the period of that notice against the proposed revocation. (3) The Authority may, instead ofrevoking the registration under sub-section (1), permitit toremain in force subject to such furtherterms andconditions as it thinks fitto imposeintheinterestoftheallottees,andanysuchtermsandconditionssoimposedshallbe bindingupon thepromoter. (4)TheAuthority, upontherevocationoftheregistration,— (a)shalldebarthepromoterfromaccessingitswebsiteinrelationtothatproject andspecifyhisnameinthelistofdefaultersanddisplayhisphotographonitswebsite andalsoinformtheotherRealEstateRegulatoryAuthorityinotherStatesandUnion _ territories about such revocation orregistration; (17)shallfacilitatetheremainingdevelopmentworkstobecaniedoutinaccordance withtheprovisionsofsection 8; (c) shalldirectthebankholdingtheproject backaccount.specifiedundersub- clause (D) of clause (I) of sub-section (2) of section 4, to freeze the account. and thereafter take such further necessary actions, including consequent de-freezing of thesaidaccount.towardsfacilitatingtheremainingdevelopmentworksinaccordance withthe provisionsofsection 8; (:1) may. to protect the interest ofallotteesorin the public interest. issuesuch directionsasitmaydeemnecessary. (2)EveryrealestateagentshallmakeanapplicationtotheAuthorityforregistrationin suchform.manner,withinsuchtimeandaccompaniedbysuchfeeanddocumentsasmaybe prescribed. (3)TheAuthority shall, within suchperiod,insuchmanneranduponsatisfyingitself ofthefulfillmentofsuchconditions. as maybeprescribed— (a)grantasingleregistrationtotherealestateagentfortheentireStateof Union tenitory, as thecase may be; (b)rejecttheapplicationforreasonstoberecordedinwriting,ifsuchapplication does not conform to the provisions of the Act or the rules or regulations made thereunder: Provided that no application shall be rejected unless the applicanthas been given an opportunity ofbeing heardin thematter. (4) Whereon the completion of the period specified under sub-section (3), if the applicant does not receive any communication about the deficiencies inhis application or therejection ofhis application, he shall bedeemedtohavebeen registered. (5) Every real estate agent who is registered as per the provisions ofthis Act orthe rulesandregulationsmadethereunder,shallbegrantedaregistrationnumberbytheAuthority, whichshallbequotedbytherealestateagentineverysalefacilitatedbyhimunderthisAct. (6)Everyregistrationshallbevalidforsuchperiodasmaybeprescribed,andshallbe renewableforaperiod in such mannerand on paymentofsuchfeeasmaybeprescribed. (7) Where any real estate agent who has been granted registration under this Act commitsbreachofanyoftheconditionsthereoforanyothertermsandconditionsspecified underthisActoranyrulesorregulationsmadethereunder,orwheretheAuthorityissatisified that such registration has been secured by the real estate agent through misrepresentation orfraud,theAuthoritymay.withoutprejudicetoanyotherprovisionsunderthisAct.revoke the registration orsuspend the same forsuch period as itthinks fit: Provided thatnosuchrevocationorsuspensionshall bemadebytheAuthorityunless an opportunity ofbeing heard has been given to the real estate agent. 10. (d)facilitatethepossessionofalltheinformationanddocuments,astheallottee, isentitledto,atthetimeofbookingofanyplot,apartmentorbuilding,asthecasemay be; (e) discharge suchotherfunctions as maybeprescribed. CHAPTERIII FUNcrions AND DUTIES OFPROMOTER Functions and 11.(1)Thepromotershall,uponreceivinghisLoginIdandpasswordunderclause(g; du'i“ 0f ofsub-section (1) orundersub-section (2) ofsection5, as thecase maybe, createhis web Prommer' pageonthewebsiteoftheAuthorityandenteralldetailsofth'eproposedprojectasprovided undersub-section(2)ofsection4,inallthefieldsasprovided,forpublicviewing,including— (a) details oftheregistration granted bytheAuthority; (b)quarterly up-to-datethe listofnumberandtypes ofapartments orplots, as thecasemay be,booked; (c) quarterly up-to-datethe listofnumberofgaragesbooked; (d) quarterlyup-to—datethelistofapprovalstakenandtheapprovalswhichare pending subsequent to commencementcertificate; (e) quarterly up-to-date status oftheproject; and (f)suchotherinformationanddocumentsasmaybespecifiedbytheregulations madebytheAuthority. (2)Theadvertisementorprospectusissuedorpublishedbythepromotershallmention prominentlythewebsiteaddressoftheAuthority,whereinalldetailsoftheregisteredproject havebeenenteredandincludetheregistrationnumberobtainedfromtheAuthorityandsuch othermatters incidentalthereto. (3) The promoter at the time of the booking and issue of allotment letter shall be responsibletomakeavailabletotheallottee,thefollowinginformation.namely:— (a) sanctioned plans, layout plans. along with specifications. approved by the competentauthority, bydisplayatthesiteorsuchotherplaceasmay bespecifiedby theregulations made by theAuthority; (b) the stage wise time schedule of completion of the project. including the provisionsforcivicinfrastructurelikewater,sanitationandelecu'icity. (b)beresponsibletoobtainthecompletioncertificateortheoccupancycertificate, orboth,asapplicable,fromtherelevantcompetentauthorityasperlocallawsorother lawsforthetimebeinginforceandtomakeitavailabletotheallotteesindividuallyor totheassociation ofallottees, as the case may be; (c)beresponsibletoobtaintheleasecertificate, wherethereal estateprojectis developed on a leasehold land, specifying the period oflease, and certifying thatall duesandchargesinregardtotheleaseholdlandhasbeenpaid, andtomakethelease certificate availableto theassociation ofallottees; (d) be responsible for providing and maintaining the essential services, on reasonable charges, till the taking over of the maintenance of the project by the association ofthe allottees; (e)enabletheformation ofan associationorsocietyorco-operativesociety.as thecasemaybe,oftheallottees,orafederationofthesame.underthelawsapplicable: Provided that in the absence of local laws, the association of allottees, by whatevernamecalled,shallbeformedwithinaperiodofthreemonthsofthemajority ofallotteeshavingbooked theirplotorapartmentorbuilding,as thecasemaybe,in the project; 0‘) execute aregistered conveyancedeedoftheapartment,plot orbuilding, as thecasemaybe, infavouroftheallotteealongwiththeundividedproportionatetitle inthecommonareastotheassociationofallotteesorcompetentauthority,asthecase maybe, asprovidedundersection 17ofthisAct; (g)payall outgoingsuntilhetransfersthephysicalpossessionoftherealestate projecttotheallotteeortheassociationsofallottees,asthecasemaybe.whichhehas collectedfromtheallottees,forthepaymentofoutgoings(includinglandcost,ground rent,municipalorotherlocaltaxes.chargesforwaterorelectricity.maintenancecharges, including mortgage loan and intereston mortgages orotherencumbrances and such other liabilities payable to competent authorities, banks and financial institutions. whicharerelatedtotheproject): Providedthatwhereanypromoterfailstopayalloranyoftheoutgoingscollected by him from the allottees orany liability. mortgageloan and interest thereonbefore transferringtherealestateprojecttosuchallottees,ortheassociationoftheallottees, asthecasemaybe.thepromotershallcontinuetobeliable,evenafterthetransferof the property. to pay such outgoings and penal charges. if any. to the authority or persontowhom they are payable and be liable forthe costofany legal proceedings which may be taken thereforby such authorityorperson; (’1)afterheexecutesanagreementforsaleforanyapartment.plotorbuilding,as thecasemaybe.notmortgageorcreateachargeonsuchapartment.plotorbuilding. (6)Thepromotershallprepareandmaintainallsuchotherdetailsasmaybespecified. fromtimetotime,byregulationsmadebytheAuthority. Explanation—Forthepurposeofthisclause,theallottees,irrespectiveofthenumber ofapartmentsorplots,asthecasemaybe,bookedbyhimorbookedinthenameofhisfamily, orinthecaseofotherpersonssuchascompaniesorfirmsoranyassociationofindividuals, etc., by whatever namecalled, bookedin its name orbooked in the name ofits associated entities orrelatedenterprises, shall beconsideredas oneallotteeonly. (3)Incaseanystructuraldefectoranyotherdefectinworkmanship,qualityorprovision ofservicesoranyotherobligationsofthepromoteraspertheagreementforsalerelatingto suchdevelopmentis broughtto thenotice ofthepromoterwithin aperiod offiveyears by theallotteefromthedateofhandingoverpossession,itshall bethedutyofthepromoterto rectifysuchdefectswithoutfurthercharge,withinthirtydays,andintheeventofpromoter's failure to rectify such defects within such time, the aggrieved allottees shall be entitled to receive appropriatecompensationin themannerasprovided underthisAct. 15. (2) On the transferorassignment being permitted by the allottees and theAuthority under sub-section (1), the intending promoter shall be required to independently comply withallthependingobligationsundertheprovisionsofthisActortherulesandregulations made thereunder, and thepending obligations aspertheagreementforsaleenteredintoby theerstwhilepromoterwiththeallottees: Provided that any transfer or assignment permitted under provisions ofthis section shall not result in extension oftime to the intending promoter to complete the real estate projectandhe shall berequiredtocomply with all thependingobligations oftheerstwhile promoter,andincaseofdefault,suchintendingpromotershallbeliabletotheconsequences ofbreachordelay,asthecasemaybe.asprovidedunderthisActortherulesandregulations madethereunder. 16. (2)Afterobtainingtheoccupancycertificateand handingoverphysical possessionto theallotteesintermsofsub—section(1).itshallbetheresponsibilityofthepromotertohand- overthenecessarydocuments andplans. includingcommon areas. to the associationofthe allottees orthecompetentauthority, as thecase may be, asperthe local laws: Providedthat,intheabsenceofanylocallaw,thepromotershallhandoverthenecessary documentsandplans,includingcommonareas,theassociationoftheallotteesorthecompetent authority, as thecase may be, within thiitydays afterobtaining the occupancycertificate. Return of 18.(1)Ifthepromoterfailstocompleteorisunabletogivepossessionofanapartment, amount and plotorbuilding.— compensation. (4)Theallotteeshallbeentitledtoclaimtherefundofamountpaidalongwithinterest at such rate as may be prescribed and compensation in the manner as provided underthis Act,fromthepromoter,ifthepromoterfailstocomplyorisunabletogivepossessionofthe apartment,plotorbuilding,asthecasemaybe,inaccordancewiththetermsofagreementfor sale or due to discontinuance ofhis business as a developer on account ofsuspension or revocation of his registration under the provisions ofthis Act or the rules or regulations madethereunder. (5)Theallotteeshallbeentitledtohavethenecessarydocumentsandplans,including thatofcommonareas,afterhandingoverthephysicalpossessionoftheapartmentorplotor buildingasthecasemaybe, bythepromoter. (6)Everyallottee,whohasenteredintoanagreementforsaletotakeanapartment,plot or building as the case may be, under section 13, shall be responsible to make necessary paymentsin themannerandwithinthetime asspecifiedinthe saidagreementforsaleand shallpayatthepropertimeandplace,theshareoftheregistrationcharges,municipaltaxes, water and electricity charges, maintenance charges, ground rent, and other charges, ifany. (7)Theallotteeshallbeliabletopayinterest,atsuchrateasmaybeprescribed,forany delayinpaymenttowards any amountorcharges tobepaid undersub-section(6). (8) The obligations of the allottee under sub-section (6) and the liability towards interestundersub-section(7)maybereducedwhenmutuallyagreedtobetweenthepromoter and such allottee. (9)Everyallotteeoftheapartment,plotorbuildingasthecasemaybe,shallparticipate towardstheformationofanassociationorsocietyorcooperativesocietyoftheallottees,or afederationofthesame. (I) The appropriate Government may, while formulating a policy on real estate Advocacy sector (including review oflaws related to real estate sector) or any other matter, make a and awareness reference to theAuthority for its opinion on possible effect, ofsuch policy or law on real measu’cs‘ estate sector and on the receiptofsuch areference, theAuthority shall within aperiod of sixty daysofmakingsuchreference, giveits opiniontotheappropriate Governmentwhich maytheraftertakefurtheractionasitdeemsfit. (2) The opinion given by the Authority under sub-section (1) shall not be binding upontheappropriateGovernmentinformulatingsuchpolicyorlaws. (3)TheAuthorityshalltakesuitablemeasuresforthepromotionofadvocacy,creating awareness andimpartingtraining aboutlawsrelatingtorealestate sectorandpolicies. 34. (3) Where an issue is raised relating to agreement, action, omission, practice or procedure that— (a) has an appreciable prevention, restriction or distortion of competition in connection with thedevelopmentofareal estateproject;or (b)haseffectofmarketpowerofmonopolysituationbeingabusedforaffecting interest ofallottees adversely, thentheAuthority,maysuomotu, makereferenceinrespectofsuchissuetotheCompetition CommissionofIndia. Rectification 39. (3)Onorbeforetheexpirationoftheperiodofsupersessionspecifiedinthenotification issued under sub-section (1), the appropriate Government shall reconstitute theAuthority byafresh appointmentofits Chairpersonandothermembers andin suchcase anyperson who had vacated his office under clause (a) ofsub-section (2) shall notbe deemed to be disqualifiedforre-appointment.
