The Meghalaya Removal of Restrictions on Use and Enjoyment of Land Act (Act No. 11 of 1981) of 1980

--- Section 1. Section 1.Short title, extent and commencement --- . (1) This Act may be called the Meghalaya Removal of Restrictions on User and Enjoyment of Land Act, 1981. (2) It shall extend to such areas of Meghalaya as the State Government may, by notification, specify in this behalf. (3) It shall come into force on such date as the State Government may, by notification, appoint and different dates may be appointed for different areas of the State. --- Section 2. Section 2.Exemption from application of the Act --- This Act shall not apply to Government land --- Section 3. Section 3.Definitions --- In this Act, unless there is anything repugnant in the subject or context:- (a) land includes benefits arising out of land and things and structures attached to the earth; and (b) prescribed means prescribed by Rule made under this Act. --- Section 4. Section 4.Removal of restrictions on use and enjoyment of land. --- Notwithstanding anything to the contrary in any contract, custom, usage or practice when a person who has acquired a permanent, heritable and transferable right of use, occupation or enjoyment in any land by purchase or otherwise sells his land, it shall not be lawful for him or the landlord to impose any restriction or condition on the buyer regarding enjoyment or disposal of the land and such restriction or condition shall be void. --- Section 5. Section 5.Illegal realisation --- Notwithstanding anything to the contrary in any contract, custom, usage or practice, realisation of any ‘Salami’ in any form, shall be illegal. --- Section 6. Section 6.Penalties --- Whoever wilfully fails or neglects to comply with any requirement made of him under this Act, or violates any provision of this Act shall, on conviction before a Magistrate, be punishable with fine which may extend to one thousand rupee. --- Section 7. Section 7.Power to make rules --- The State Government may, from time to time, by notification, make rules for carrying out the purpose of this Act.
