About this statute

This section gives the Act its short title, says it applies to the whole of India, and states when it comes into force, subject to a territorial exception. This part exempts certain specified instruments from stamp duty and gives the Government power to reduce, remit, or consolidate duties. Some persons must give stamped receipts on demand; fire-insurance renewal premiums or consideration must be receipted within one month, and the Collector can determine stamp duty on instruments brought to him. If an instrument understates property value below the minimum value rules, the registering officer must refer it to the Collector, who determines market value and duty; the Act also lets the Collector demand deficit duty, interest, penalties, and recover sums for unstamped or defective instruments. This section lets the Central Government issue directions and authorise SEBI or RBI to issue instructions, circulars, or guidelines. It also lets State Governments make rules about stamp supply and sale, delegate certain powers, and must publish or lay certain rules and provide cheap translations of the Act.
