This provision gives the Act its short title, says it applies across Maharashtra, and lets the State Government set the commencement date by Gazette notification.
--- Section 1.. Section 1..Short title, extent and commencement. --- ( 1 ) This Act may be called the 1 [the Maharashtra Stamp Act]. ( 2 ) It extends to the whole of the 2 [State of Maharashtra]. ( 3 ) It shall come into force on such date4 as the State Government may, by notification in the Official Gazette , direct. [Footnotes] 1. The short title was amended for "the Bombay Stamp Act, 1958" by Mah. 24 of 2012, Sch. Entry 67, w.e.f. 1 st May 1960. 2. These words were substituted for the words “State of Bombay” by the Maharashtra Adaption of Laws (State and Concurrent Subjects) Order, 1960. --- Section 2.. Section 2..Definitions. --- In this Act, unless there is anything repugnant in the subject or context,- 1 ( aa ) "Additional Controller of Stamps, Mumbai" means the officer or officers so designated by the State Government and includes any other officer whom the State Government may, by notification in the Official Gazette , appoint in this behalf;] ( a ) "association" means any association, exchange, organisation or body of individuals, whether incorporated or not, established for the purpose of regulating and controlling business of the sale or purchase of, or other transaction relating to, any goods or marketable securities; 2 (b) "banker" means an association, a company or a person who accepts, for the purpose of lending or investment, deposits of money from the public, repayable on demand or otherwise and withdrawable by cheque, draft, order or otherwise;] ( c ) "bond" includes,- (i) any instrument whereby a person obliges himself to pay money to another, on condition that obligation shall be void if a specified act is performed, or is not performed, as the case may be; ( ii ) any instrument attested by a witness and not payable to order or bearer, whereby a person obliges himself to pay money to another; and ( iii ) any instrument so attested whereby a person, obliges himself to deliver grain or other agricultural produce to another; 3 [ Explanation .- Notwithstanding anything contained in any law for the time being in force, for the purposes of this clause, "attested", in relation to an instrument, means attested by one or more witnesses each of whom has seen the executant sign or affix his mark to the [Footnotes] 1.
