(cid:200)लीयर(cid:581)स अिधिनयम, 2015 (झारख(cid:214)ड अिधिनयम-10, 2016 ) औ(cid:429)ोिगक (cid:466)वकास के (cid:292)ो(cid:215)साहन के उ(cid:423)े(cid:230)य से (cid:466)विभ(cid:219)न अनु(cid:163)ि(cid:431)य(cid:585), अनुमितय(cid:585) एवं (cid:232)वीकृितय(cid:585) को (cid:215)व(cid:464)रत एवम ् समयब(cid:424) मंजरू (cid:547) (cid:292)दान करने, नए िनवेश(cid:585) को सुगम एवं सरल करने हेतु (cid:292)(cid:465)(cid:272)या(cid:215)मक आव(cid:230)यकताओं को कम करते हुए (cid:466)विनयामक ढाँचे को सरल बनान े सहज (cid:229)यापार (cid:229)यव(cid:232)था म(cid:581) सुधार लान े के िलए एवम ् झारख(cid:214)ड रा(cid:207)य म(cid:581) िनवेशकोनुकूल वातावरण उपल(cid:222)ध करने हेतु एक (cid:466)वधेयक एवम ् यह (cid:466)वधेयक भारत गणरा(cid:207)य के 66व(cid:581) वष(cid:91) म(cid:581) िन(cid:224)नवत ् (cid:509)प से झारख(cid:214)ड (cid:466)वधान सभा (cid:430)ारा अिधिनयिमत होता है:- 2 झारख(cid:214)ड गजट (असाधारण) बुधवार, 1 जून, 2016 सं(cid:468)(cid:162)(cid:431) शीष(cid:91)क, सीमा एवं (cid:292)ारंभ (1) यह अिधिनयम “झारखंड िसंगल (cid:466)वंडो (cid:200)लीयर(cid:581)स अिधिनयम, 2015“ के नाम से जाना जाएगा। (2) यह अिधिनयम पूरे झारख(cid:214)ड रा(cid:207)य म(cid:581) (cid:292)भावी होगा। (3) यह अिधिनयम झारखंड सरकार के राजप(cid:287) म(cid:581) अिधसूचना क(cid:551) ितिथ से (cid:292)भावी होगा। 2. जब तक संदभ(cid:91) अ(cid:219)यथा न हो, इस अिधिनयम म(cid:581) (1) “एजस(cid:581) ी“, का अिभ(cid:292)ाय झारखंड ओै(cid:429)ोिगक संरचना (cid:466)वकास िनगम (JIIDCO) है। (2) Governing Body (शासी िनकाय ) का अिभ(cid:292)ाय धारा-4 के तहत ् ग(cid:465)ठत सिमित है। (3) “अपीलीय (cid:292)ािधकार“ से अिभ(cid:292)ाय धारा- 25 के अंतगत(cid:91) श(cid:466)(cid:416) (cid:292)ा(cid:431) सिमित है। (4) “लागू अिधिनयम(cid:585)“ से अिभ(cid:292)ाय है, (क) (cid:466)बहार दकु ान एवम ् वा(cid:468)ण(cid:468)(cid:207)यक सं(cid:232)थान अिधिनयम, 1953 (ख) के(cid:219)(cid:289)(cid:547)य (cid:466)ब(cid:272)(cid:551) कर अिधिनयम , 1956 (ग) मात(cid:215)ृ व लाभ अिधिनयम, 1961 (घ) बोनस भुगतान अिधिनयम , 1965 (ड.) अनुब(cid:219)ध (cid:302)म (रेगुलेशन व ् एबोिलशन) अिधिनयम, 1970 (च) (cid:274)(cid:205)े यु(cid:465)ट अिधिनयम, 1972 (छ) समान पा(cid:464)र(cid:302)ािमक अिधिनयम, 1976 (ज) झारखंड वै(cid:227)यु एडेड कर अिधिनयम, 2005 (झ) जल ((cid:292)दषू ण िनयं(cid:287)ण एवं िनषेध ) अिधिनयम, 1974 (ञ) वायु ((cid:292)दषू ण िनयं(cid:287)ण एवं िनषेध ) अिधिनयम, 1981 (ट) पया(cid:91)वरण (संर(cid:162)ण) अिधिनयम, 1986 (ठ) बॉयलर अिधिनयम, 1923 (ड) वेतन भुगतान (payment of wages) अिधिनयम, 1936 (ढ) कारखाना अिधिनयम, 1948 (ण) (cid:219)यूनतम वेतन अिधिनयम, 1948 (त) (cid:466)बहार (cid:466)व(cid:429)तु अिधिनयम, 1948 (थ) झारखंड मनोरंजन कर अिधिनयम, 2012 या उ(cid:419)रािधकार(cid:547)/संशोिधत अिधिनयम या रा(cid:207)य सरकार (cid:430)ारा अिधसूिचत कोई अ(cid:219)य सुसंगत/(cid:292)ासंिगक अिधिनयम। (5) “स(cid:162)म (cid:292)ािधकार“ से अिभ(cid:292)ाय है सरकार का कोई (cid:466)वभाग या एजस(cid:581) ी, (cid:232)थानीय (cid:292)ािधकार, वैधािनक िनकाय, रा(cid:207)य (cid:232)वािम(cid:215)वाधीन िनगम, पंचायती राज सं(cid:232)थाएं, नगर(cid:547)य (cid:232)थानीय िनकाय या (cid:465)कसी अिधिनयम या सरकार के (cid:292)शासिनक िनयं(cid:287)ण के अतं गत(cid:91) ग(cid:465)ठत या (cid:232)था(cid:466)पत कोई अ(cid:219)य (cid:292)ािधकार या एज(cid:581)सी (cid:468)जसके पास रा(cid:207)य म(cid:581) एक ((cid:229)यापा(cid:464)रक) (cid:292)ित(cid:437)ान (cid:232)था(cid:466)पत करन े अथवा संचािलत करने के िलए अनमु ित (cid:292)दान या जार(cid:547) करने क(cid:551) श(cid:466)(cid:416) एवं जवाबदेह(cid:547) है। (6) “मंजूर(cid:547)“ का अिभ(cid:292)ाय है झारखंड रा(cid:207)य म(cid:581) उ(cid:429)म/(cid:292)ित(cid:437)ान (cid:232)था(cid:466)पत करने के संबंध म(cid:581) (cid:465)कसी स(cid:162)म (cid:292)ािधकार (cid:430)ारा अनाप(cid:466)(cid:419) (cid:292)माण-प(cid:287), आवंटन, सहमित, (cid:232)वीकृित, अनुमित, िनबंधन, नामांकन, अनु(cid:163)ि(cid:431) झारख(cid:214)ड गजट (असाधारण) बुधवार, 1 जून, 2016 3 जार(cid:547)/(cid:292)दान करना एवम ् इसके अ(cid:219)तगत(cid:91) स(cid:468)(cid:224)मिलत ह(cid:585)गे वैसे सारे अनुमित, जो (cid:292)चिलत अिधिनयम(cid:585) के अ(cid:219)तगत(cid:91) आव(cid:230)यक ह(cid:583)। (7) “(cid:466)वभाग“ से अिभ(cid:292)ाय है, झारखंड सरकार का (cid:466)वभाग। (8) “(cid:468)जला कायक(cid:91) ारणी सिमित“ से अिभ(cid:292)ाय है धारा-12 के तहत ् ग(cid:465)ठत सिमित। (9) “(cid:468)जला (cid:232)तर(cid:547)य नोडल एज(cid:581)सी“ का अिभ(cid:292)ाय है, धारा- 14 के तहत िन(cid:465)द(cid:91)(cid:436) एजस(cid:581) ी। (10) “उ(cid:429)मी“ से ता(cid:215)पय (cid:91) है, एक (cid:229)य(cid:466)(cid:416) या (cid:229)य(cid:466)(cid:416)य(cid:585) का िनकाय/समूह या एक क(cid:224)पनी, जो ((cid:465)कसी एक) उ(cid:429)म म(cid:581) अिधकांश िनवेश या िनयं(cid:287)ण म(cid:581) (cid:510)िच रखता है या रखने का (cid:292)(cid:232)ताव करता हो और जो िनवेश का (cid:292)(cid:232)ताव लाता हो। (11) “सरकार“ से अिभ(cid:292)ाय है, झारखंड सरकार। (12 ) "High Powered Committe" से अिभ(cid:292)ेत है, धारा- 6 के तहत ग(cid:465)ठत सिमित। (13) “औ(cid:429)ोिगक नीित“ से ता(cid:215)पय (cid:91) है, झारखंड औ(cid:429)ोिगक नीित या झारख(cid:214)ड सरकार (cid:430)ारा अ(cid:219)य (cid:162)े(cid:287) (cid:466)वशेष नीित अथवा के(cid:219)(cid:289) या रा(cid:207)य (झारख(cid:214)ड) सरकार क(cid:551) वैसी योजनाएँ (cid:468)ज(cid:219)ह(cid:581) औ(cid:429)ोिगक संव(cid:424)(cid:91)न हेतु समय- समय पर अिधसूिचत (cid:465)कया गया हो। (14) “अिधसूचना“ का ता(cid:215)पय (cid:91) है, झारखंड राजप(cid:287) म(cid:581) (cid:292)कािशत अिधसूचना एवं अिधसूिचत श(cid:222)द का प(cid:464)र(cid:292)े(cid:234)यानु(cid:509)प अिभ(cid:292)ाय (15) “(cid:466)व(cid:465)हत“ से अिभ(cid:292)ेत है, इस अिधिनयम के तहत (cid:292)ावधािनत िनयम तथा इस अिधिनयम को लागू करने हेतु (cid:292)चिलत अिधिनयम(cid:585) के तहत बनाए गए िनयम (16) "Web Portal"से आशय है, एज(cid:581)सी (cid:430)ारा संधा(cid:464)रत वेब पोट(cid:91)ल। 3. Notification of Agency (एजे(cid:219)सी का अिधसूचना) झारख(cid:214)ड सरकार, रा(cid:207)य म(cid:581) नए िनवेश(cid:585) के िलए Single Window तथा औ(cid:429)ोिगक सरलीकरण को सिचवालय समथन(cid:91) (cid:292)दान करने हेतु “झारखंड औ(cid:429)ोिगक आधारभूत संरचना (cid:466)वकास िनगम“ ((cid:468)जडको) को अिधसूिचत करेगा। 4. Governing Body (शासी िनकाय) (1) इस अिधिनयम के उ(cid:423)े(cid:230)य(cid:585) के िलए एक Governing Body (शासी िनकाय) का गठन (cid:465)कया जाएगा। (2) धारा- 4.1 के तहत ग(cid:465)ठत Governing Body (शासी िनकाय) म(cid:581) अ(cid:218)य(cid:162) एवं िन(cid:224)न सूिचत सद(cid:232)य ह(cid:585)ग:े - सद(cid:232)य पदनाम (क) माननीय मु(cid:201)यमं(cid:287)ी अ(cid:218)य(cid:162) (ख). उ(cid:429)ोग मं(cid:287)ी उपा(cid:218)य(cid:162) 4 झारख(cid:214)ड गजट (असाधारण) बुधवार, 1 जून, 2016 (ग) (cid:466)व(cid:419) मं(cid:287)ी सद(cid:232)य (घ) राज(cid:232)व, िनबंधन एव ं भूिम सुधार मं(cid:287)ी सद(cid:232)य (ड.) मु(cid:201)य सिचव सद(cid:232)य (च) (cid:292)धान सिचव/सिचव, उ(cid:429)ोग सद(cid:232)य सिचव (छ) रा(cid:207)य सरकार (cid:430)ारा मनोनीत अ(cid:219)य नािमत, य(cid:465)द कोई हो सद(cid:232)य (3) अपने काय(cid:607) के समुिचत एवं (cid:292)भावी िनव(cid:91)हन हेत,ु य(cid:465)द आव(cid:230)यक हो तो Governing Body (शासी िनकाय) (cid:465)कसी दो (cid:466)वशेष(cid:163) सद(cid:232)य को सहयो(cid:468)जत कर सकता है। 5. Governing Body (शासी िनकाय) के काय (cid:91) रा(cid:207)य सरकार के सम(cid:274) िनयं(cid:287) और पयव(cid:91) े(cid:162)णाधीन रहते हुए Governing Body (शासी िनकाय) इस अिधिनयम के तहत सम(cid:274) नीित मागद(cid:91) श(cid:91)न एवं (cid:465)दशा-िनद(cid:566)श (cid:292)दान करेगा। (1) Governing Body (शासी िनकाय) अपने (cid:292)भावी काय (cid:91) संचालन के िलए आव(cid:230)यक Single Window मंजूर(cid:547) एवं उ(cid:429)ोग सरलीकरण हेतु रणनीित (cid:465)दशा और मागद(cid:91) शन(cid:91) तय करने के िलए (cid:468)ज(cid:224)मेदार होगा। (2) Governing Body (शासी िनकाय) (cid:430)ारा पा(cid:464)रत आदेश एवं िलए गए िनणय(cid:91) सभी सरकार(cid:547) (cid:466)वभाग, (cid:292)ािधकार तथा एजस(cid:581) ी के िलए अंितम एवं मा(cid:219)य होगा एवं ऐसे (cid:466)वभाग, (cid:292)ािधकार और एजस(cid:581) ी िनधा(cid:91)(cid:464)रत समय-सीमा के अंदर अपे(cid:468)(cid:162)त मंजूर(cid:547) एवं अनमु ित जार(cid:547) कर(cid:581)ग,े बशत (cid:566) िनवेशक/आवेदक (cid:430)ारा (cid:292)चिलत अिधिनयम(cid:585) के सुसंगत (cid:292)ावधान(cid:585) एवं रा(cid:207)य/के(cid:219)(cid:289) सरकार के िनयम(cid:585) का अनुपालन (cid:465)कया जायेगा। (3) इस िनयम के (cid:292)भावी (cid:465)(cid:272)या(cid:219)वयन के िलए Governing Body (शासी िनकाय) "High Empowered committee" एवं "Single Window" मंजूर(cid:547) सिमित को अपने काय/(cid:91) श(cid:466)(cid:416) (cid:292)दान कर या वापस ले सकती है। (4) Governing Body (शासी िनकाय) क(cid:551) बैठक(cid:581) अपन े काय(cid:607) को पूण (cid:91) करने के िनिम(cid:419) आव(cid:230)यकता अनु(cid:510)प आहूत क(cid:551) जाएगी, (cid:465)क(cid:219)तु "High Empowered committee" एवं "Single Window" मंजूर(cid:547) सिमित के काय (cid:91) (cid:292)दश(cid:91)न क(cid:551) समी(cid:162)ा एवं जहां आव(cid:230)यक हो, वहाँ आव(cid:230)यक अनुशंसा (cid:292)दान करन े हेतु हर वष(cid:91) कम से कम दो बार िनकाय क(cid:551) बैठक(cid:581) उस जगह आहूत क(cid:551) जाएगी जो िनकाय के अ(cid:218)य(cid:162) (cid:430)ारा िनधा(cid:91)(cid:464)रत क(cid:551) जाएगी। (5) Governing Body (शासी िनकाय) "High Empowered committee" तथा रा(cid:207)य सरकार (cid:430)ारा िन(cid:465)द(cid:91)(cid:436) मामल(cid:585) पर (cid:466)वचार कर उिचत िनणय(cid:91) ले सकता है। (6) Governing Body (शासी िनकाय) वहृ त एवं अित वहृ त उ(cid:429)ोग(cid:585) के िलए यथा (cid:466)व(cid:465)हत (cid:466)व(cid:419)ीय उ(cid:215)(cid:292)ेरण (Incentives) पैकेज के अनमु ोदन को अनशु ंिसत करेगा। 6. High Empowered committee उ(cid:205)च (cid:232)तर(cid:547)य सिमित (1) इस अिधिनयम के उ(cid:423)े(cid:230)य से एक उ(cid:205)चश(cid:466)(cid:416) (cid:292)ा(cid:431) सिमित का गठन (cid:465)कया जाएगा। (2) धारा 6.1 के तहत ् ग(cid:465)ठत उ(cid:205)च श(cid:466)(cid:416) (cid:292)ा(cid:431) सिमित म(cid:581) अ(cid:218)य(cid:162) एवं िन(cid:224)न सूिचत सद(cid:232)य ह(cid:585)ग:े झारख(cid:214)ड गजट (असाधारण) बुधवार, 1 जून, 2016 5 सद(cid:232)य पदनाम (क) मु(cid:201)य सिचव अ(cid:218)य(cid:162) (ख)्. (cid:466)वकास आयु(cid:416) सद(cid:232)य (ग) (cid:292)धान सिचव/सिचव, उ(cid:429)ोग सद(cid:232)य (घ) (cid:292)धान सिचव/सिचव, योजना-सह-(cid:466)व(cid:419) (cid:466)वभाग सद(cid:232)य (ड.) िनदेशक, उ(cid:429)ोग सद(cid:232)य-सिचव (3) य(cid:465)द ऐसा करना आव(cid:230)यक हो तो"High Empowered committee" स(cid:224)बंिधत (cid:292)शासी सिचव अथवा अ(cid:219)य (cid:465)कसी (cid:466)वभागीय पदािधकार(cid:547) को (cid:466)वशेष आमं(cid:466)(cid:287)त सद(cid:232)य के (cid:510)प म(cid:581) आमं(cid:466)(cid:287)त कर सकती है। 7. Functions of High Powered Committee (उ(cid:205)च (cid:232)तर(cid:547)य सिमित के काय)(cid:91) :- (1) उ(cid:429)ोग सरलीकरण एवं Single Window मंजूर(cid:547) हेतु उ(cid:205)च श(cid:466)(cid:416) (cid:292)ा(cid:431) सिमित (cid:430)ारा एकल (cid:468)खड़क(cid:551) मंजरू (cid:547) सिमित, एजस(cid:581) ी, (cid:468)जला (cid:232)तर(cid:547)य नोडल एज(cid:581)सी एवं (cid:468)जला कायक(cid:91) ारणी सिमित के काय(cid:607) का िनयिमत (cid:510)प से िनर(cid:547)(cid:162)ण पयव(cid:91) े(cid:162)ण एवं समी(cid:162)ा क(cid:551) जाएगी। (2) सिमित शासी िनकाय या रा(cid:207)य सरकार (cid:430)ारा स(cid:587)पे गए अ(cid:219)य काय(cid:607) को भी स(cid:224)प(cid:219)न करेगी। (3) इस अिधिनयम के (cid:292)भावी (cid:465)(cid:272)या(cid:219)वयन के िलए सिमित इस अिधिनयम अथवा शासी िनकाय (cid:430)ारा (cid:292)द(cid:419) श(cid:466)(cid:416)/काय(cid:607) के तहत ् single window मंजूर(cid:547) सिमित और (cid:468)जला कायक(cid:91) ारणी सिमित को अपन े काय (cid:91) श(cid:466)(cid:416)याँ (cid:292)दान कर या वापस ले सकती है। (4) Single Window मंजूर(cid:547) सिमित एवं (cid:468)जला कायक(cid:91) ारणी सिमित के काय (cid:91) (cid:292)दश(cid:91)न क(cid:551) समी(cid:162)ा एवं जहाँ आव(cid:230)यक हो, वहाँ आव(cid:230)यक अनशु ंसा (cid:292)दान करने हेतु कम से कम हर ितमाह(cid:547) म(cid:581) एक बार उ(cid:205)च श(cid:466)(cid:416) (cid:292)ा(cid:431) सिमित क(cid:551) बैठक उस जगह आहूत क(cid:551) जाएगी (cid:468)जसे सिमित के अ(cid:218)य(cid:162) (cid:430)ारा िनधा(cid:91)(cid:464)रत क(cid:551) जाएगी। (5) Single Window मंजूर(cid:547) सिमित के अनशु ंसा पर उ(cid:205)च श(cid:466)(cid:416) (cid:292)ा(cid:431) सिमित बड़(cid:547) प(cid:464)रयोजनाओं के िलए (cid:466)व(cid:419)ीय (cid:292)ो(cid:215)साहन पैकेज क(cid:551) (cid:232)वीकृित देगा। उ(cid:205)च श(cid:466)(cid:416) (cid:292)ा(cid:431) सिमित सभी वहृ त एवं अित वहृ त प(cid:464)रयोजनाओं के िलए (cid:466)व(cid:419)ीय (cid:292)ो(cid:215)साहन पैकेज क(cid:551) अनशु ंसा शासी िनकाय को करेगा। (6) High Empowered committee, Single Window मंजूर(cid:547) सिमित के CEO (cid:430)ारा िन(cid:465)द(cid:91)(cid:436) मामल(cid:585) पर (cid:466)वचार कर उिचत िनणय(cid:91) ले सकती है। (7) य(cid:465)द आव(cid:230)यक हो तो (cid:465)कसी भी मु(cid:423)ा/मामला/(cid:292)(cid:232)ताव को अपनी अनुशंसाओं एवं सुझाव(cid:585) के साथ सिमित शासी िनकाय को िन(cid:465)द(cid:91)(cid:436)/संसूिचत करेगी। (8) सिमित, रा(cid:207)य म(cid:581) िनवेश और अ(cid:219)य संबंिधत गित(cid:466)विधय(cid:585) के संव(cid:424)(cid:91)न के िलए (cid:468)ज(cid:224)मेदार होगी। (9) High Empowered committee संबंिधत (cid:466)वभाग को (cid:466)विभ(cid:219)न (cid:292)चिलत अिधिनयम(cid:585) के तहत द(cid:547) जाने वाली हर सेवा के िलए समय-सीमा क(cid:551) अनुशंसा करेगी। 6 झारख(cid:214)ड गजट (असाधारण) बुधवार, 1 जून, 2016 (10) High Empowered committee संबंिधत (cid:466)वभाग के िलए लागू (cid:466)विभ(cid:219)न (cid:292)चिलत अिधिनयम(cid:585) के तहत (cid:232)व-(cid:292)माणन, ड(cid:547)(cid:224)ड मंजूर(cid:547), िनर(cid:547)(cid:162)ण(cid:585) एवं तीसरे प(cid:162) (cid:430)ारा िनर(cid:547)(cid:162)ण(cid:585) के यु(cid:466)(cid:416)करण क(cid:551) अनुशंसा करेगी। 8. Single Window Clearance Committee (एकल (cid:468)खड़क(cid:551) मंजूर(cid:547) सिमित) (1) इस अिधिनयम के उ(cid:423)े(cid:230)य(cid:585) के िलए एकल (cid:468)खड़क(cid:551) मंजूर(cid:547) सिमित का गठन (cid:465)कया जाएगा। (2) धारा 8.1 के तहत ् ग(cid:465)ठत एकल (cid:468)खड़क(cid:551) मंजरू (cid:547) सिमित म(cid:581) मु(cid:201)य कायक(cid:91) ार(cid:547) पदािधकार(cid:547) (CEO) एवं िन(cid:224)न सूिचत सद(cid:232)य ह(cid:585)ग:े - सद(cid:232)य पदनाम (क) (cid:292)धान सिचव/सिचव, उ(cid:429)ोग अ(cid:218)य(cid:162) (ख) (cid:292)धान सिचव/सिचव, योजना-सह-(cid:466)व(cid:419) सद(cid:232)य (ग) (cid:292)धान सिचव/सिचव, राज(cid:232)व, िनबंधन व भूिम सुधार सद(cid:232)य (घ) (cid:292)धान सिचव/सिचव, नगर (cid:466)वकास एवं आवास सद(cid:232)य (ड.) Functions of Single Window Clearance Committee (एकल (cid:468)खड़क(cid:551) मंजरू (cid:547) सिमित) के कायः(cid:91) - रा(cid:207)य सरकार सम(cid:274) िनयं(cid:287)ण एवं पयव(cid:91) े(cid:162)णाधीन रहते हुए (1) Single Window मंजूर(cid:547) सिमित, उ(cid:429)म (cid:232)थापना तथा उ(cid:429)म संचालन क(cid:551) शु(cid:509)आत जैसा (cid:465)क रा(cid:207)य सरकार (cid:430)ारा अिधसूिचत है, के िलए मंजू(cid:464)रय(cid:585) (को (cid:292)दान करन)े क(cid:551) श(cid:466)(cid:416) का (cid:292)योग करेगी। झारख(cid:214)ड गजट (असाधारण) बुधवार, 1 जून, 2016 7 (2) Urban Local bodies तथा Panchayati Raj Institutions स(cid:465)हत अ(cid:219)य वैधािनक िनकाय(cid:585) म(cid:581) िन(cid:465)हत श(cid:466)(cid:416)य(cid:585) को छोड़कर रा(cid:207)य सरकार उिचत अिधसूचना के मा(cid:218)यम से य(cid:465)द ऐसा आव(cid:230)यक हो तो, (cid:465)क(cid:219)ह(cid:547)ं अ(cid:219)य श(cid:466)(cid:416)य(cid:585) को इसको (सिमित को) ह(cid:232)तांत(cid:464)रत कर सकती है। (3) SWCC (cid:430)ारा श(cid:466)(cid:416)य(cid:585) का ह(cid:232)तांतरण मंजू(cid:464)रय(cid:585) एवं (cid:232)वीकृितय(cid:585) क(cid:551) अव(cid:232)था तक (cid:465)कया जा सकता है। तदोपरांत सभी मंजू(cid:464)रय(cid:585) एवं (cid:232)वीकृितयाँ संबंिधत उिचत (cid:292)ािधकार (cid:430)ारा जार(cid:547) (cid:465)कए जाय(cid:581)गे। (4) MSME प(cid:464)रयोजनाओ ं हेतु (cid:466)व(cid:419)ीय (cid:292)ो(cid:215)साहन (Incentives) का अनुमोदन सिमित (cid:430)ारा (cid:465)कया जाएगा तथा MSME के अित(cid:464)र(cid:416) प(cid:464)रयोजनाओं के िलए अनुमोदन हेतु सिमित, उ(cid:205)च श(cid:466)(cid:416) (cid:292)ा(cid:431) सिमित को अनशु ंसा भेजेगी। 10. Officers/Employees of the Agency (एज(cid:581)सी के पदािधकार(cid:547)/कम(cid:91)चार(cid:547)):- (1) (cid:466)विभ(cid:219)न (cid:466)वभाग(cid:585) के पदािधका(cid:464)रय(cid:585) को संबंिधत (cid:292)शासी (cid:466)वभाग/संगठन (cid:430)ारा (cid:292)ितिनयु(cid:466)(cid:416) के आधार पर एजस(cid:581) ी म(cid:581) िनयु(cid:416) (cid:465)कया जाएगा, इनम(cid:581) शािमल ह(cid:583):- (क) झारख(cid:214)ड रा(cid:207)य (cid:292)दषू ण िनयं(cid:287)ण पष(cid:91)द का एक पदािधकार(cid:547), जो मु(cid:201)य अिभयंता के पद से नीचे का ना हो। (ख) नगर (cid:466)वकास एवं आवास (cid:466)वभाग का एक पदािधकार(cid:547), जो मु(cid:201)य नगर (cid:220)लानर के पद से नीचे का ना हो। (ग) (cid:302)म (cid:466)वभाग का एक पदािधकार(cid:547), जो संयु(cid:416) (cid:302)माय(cid:416)ु के पद से नीचे का ना हो। (घ) वा(cid:468)ण(cid:207)य-कर (cid:466)वभाग का एक पदािधकार(cid:547), जो संयु(cid:416) वा(cid:468)ण(cid:207)यकर आयु(cid:416) के पद से नीचे का ना हो। (ड.) वन, पया(cid:91)वरण एवं जलवायु प(cid:464)रवत(cid:91)न (cid:466)वभाग का एक पदािधकार(cid:547), जो मु(cid:201)य वन संर(cid:162)क के पद से नीचे का ना हो। (च) झारख(cid:214)ड (cid:466)बजली (cid:466)वतरण िनगम िलिमटेड का एक पदािधकार(cid:547), जो मु(cid:201)य अिभयतं ा के पद से नीचे का ना हो। (छ) राज(cid:232)व, िनबंधन एवं भूिम सुधार (cid:466)वभाग का एक पदािधकार(cid:547) जो, िनदेशक, भूिम अजन(cid:91) के पद से नीचे का ना हो। (ज) खनन ् (cid:466)वभाग का एक पदािधकार(cid:547), जो अपर िनदेशक, खनन ् के पद से नीचे का ना हो। (2) य(cid:465)द (cid:466)वभाग/संगठन उप-धारा-1 म(cid:581) व(cid:468)णत(cid:91) (cid:302)णे ी/पद के पदािधकार(cid:547) देने म(cid:581) असमथ (cid:91) हो तो, (cid:292)ितिनयु(cid:416) पदािधकार(cid:547), एज(cid:581)सी म(cid:581) अपनी (cid:292)ितिनयु(cid:466)(cid:416) तक, उप-धारा-1 म(cid:581) व(cid:468)णत(cid:91) पद के पदािधकार(cid:547) के समान माने जाय(cid:581)ग,े पर(cid:219)तु इससे वे (cid:465)कसी अित(cid:464)र(cid:416) (cid:466)व(cid:419)ीय लाभ के अिधकार(cid:547) नह(cid:547)ं ह(cid:585)गे। (3) सभी िनयामक (cid:466)वभाग, जो अनुमोदन/मंजरू (cid:547) (cid:292)दान करते ह(cid:583), उ(cid:429)म (cid:232)थापना और उ(cid:429)म संचालन शु(cid:509) करने के िलए सार(cid:547) नई प(cid:464)रयोजनाओं को समय-सीमा के अंदर (cid:232)वीकृित (cid:292)दान करने के िलए JIIDCO म(cid:581) (cid:292)ितिनयु(cid:416) अपन े वर(cid:547)य पदािधकार(cid:547) को अिधसूचना (cid:430)ारा सश(cid:416) कर(cid:581)गे। ऐसी अिधसूचना जार(cid:547) होने तक (cid:292)ितिनयु(cid:416) पदािधकार(cid:547) समय-सीमा के भीतर ऐसी मंजू(cid:464)रय(cid:585) के आवेदन(cid:585) के िन(cid:232)तारण के िलए (cid:468)ज(cid:224)मेदार ह(cid:585)गे। 8 झारख(cid:214)ड गजट (असाधारण) बुधवार, 1 जून, 2016 (4) SWCC का मु(cid:201)य कायक(cid:91) ार(cid:547) अिधकार(cid:547) एजस(cid:581) ी म(cid:581) (cid:292)ितिनयु(cid:416) पदािधकार(cid:547) के ऊपर पयव(cid:91) े(cid:162)ण एवं िनयं(cid:287)ण क(cid:551) श(cid:466)(cid:416) का (cid:292)योग करेगा, पर(cid:219)तु धारा-1 म(cid:581) व(cid:468)णत(cid:91) पदािधकार(cid:547) (cid:468)जनक(cid:551) सेवाएँ (cid:292)ितिनयु(cid:466)(cid:416) के आधार पर एज(cid:581)सी म(cid:581) पद(cid:232)थापन क(cid:551) गई अपने मूल (cid:466)वभाग/संगठन म(cid:581) अपने संवग (cid:91) के संब(cid:424) िनयम और (cid:466)विनयम (cid:430)ारा शािसत ह(cid:585)गे। (5) एज(cid:581)सी, अनुब(cid:219)ध या आउटसोिस(cid:589)ग के मा(cid:218)यम से इस अिधिनयम के तहत ् उ(cid:419)रदािय(cid:215)व िनव(cid:91)हन हेतु अ(cid:219)य किम(cid:91)य(cid:585) क(cid:551) आव(cid:230)यकता को पूर(cid:547) करेगी। 11. मु(cid:201)य कायक(cid:91) ार(cid:547) अिधकार(cid:547) (CEO) के काय:(cid:91) - (1) CEO उ(cid:429)ोग (cid:466)वभाग के (cid:292)धान सिचव/सिचव के (cid:292)भार म(cid:581) भी ह(cid:585)गे। (2) CEO समय-समय पर रा(cid:207)य म(cid:581) लगाए जाने वाली औ(cid:429)ोिगक एवं अ(cid:219)य प(cid:464)रयोजनाओं के संबंध म(cid:581) (cid:465)कसी उ(cid:429)मी से (cid:292)ा(cid:431) (cid:292)(cid:232)ताव(cid:585) क(cid:551) पर(cid:547)(cid:162)ा उन पर (cid:466)वचार एवं उन पर कार(cid:91)वाई कर(cid:581)गे। (3) Governing Body (शासी िनकाय) "High Empowered Committee" एवं समय-समय पर रा(cid:207)य सरकार (cid:430)ारा अिधसूचना (cid:430)ारा (cid:465)दये गए श(cid:466)(cid:416)य(cid:585)/काय(cid:607) का (cid:292)योग CEO (cid:430)ारा (cid:465)कया जाएगा। (4) CEO रा(cid:207)य म(cid:581) िनवेश अ(cid:219)य संबंिधत गित(cid:466)विधय(cid:585) को (cid:292)ो(cid:215)साहन देने के िलए सभी (cid:292)यास(cid:585) का सम(cid:219)वय करेगा। (5) CEO सभी द(cid:232)तावेज(cid:585), अनुमोदन(cid:585) एवं SWCC (cid:430)ारा जार(cid:547) िनदेश(cid:585) या अनुदान(cid:585) के आवंटन पर ह(cid:232)ता(cid:162)र करने के िलए स(cid:162)म अिधकार(cid:547) ((cid:292)ािधकार) होगा। (6) CEO (cid:465)कसी मामला/मु(cid:423)ा/(cid:292)(cid:232)ताव को अपनी अनशु ंसाओं एवं सुझाव(cid:585), य(cid:465)द वह आव(cid:230)यक समझ(cid:581) को, "High Empowered Committee" को िन(cid:465)द(cid:91)(cid:436) करेगा। (7) CEO (cid:466)विभ(cid:219)न प(cid:464)रयोजनाओं म(cid:581) SWCC (cid:430)ारा (cid:465)दये गए अनुमोदन क(cid:551) समी(cid:162)ा एवं अनु(cid:302)वण करेगा। (8) CEO, Governing Body (शासी िनकाय) एवं "High Empowered Committee" (उ(cid:205)च श(cid:466)(cid:416) (cid:292)ा(cid:431) सिमित) के िलए मािसक, ितमाह(cid:547) एवं अधव(cid:91) ा(cid:466)ष(cid:91)क (cid:292)गित (cid:464)रपोट(cid:91) बनाने एवं (cid:292)(cid:232)तुित के िलए (cid:468)ज(cid:224)मेदार होगा। (9) CEO िनवेश (cid:292)(cid:232)ताव(cid:585) को धरातल पर लागू करने के िलए एवं अनमु ोदन/मंजूर(cid:547) देने के िलए JIIDCO म(cid:581) (cid:292)ितिनयु(cid:416) (cid:466)वभाग(cid:585) के (cid:466)विभ(cid:219)न अिधका(cid:464)रय(cid:585) के मा(cid:218)यम से सभी (cid:466)वभाग(cid:585) से सम(cid:219)वय करेगा। (10) CEO िनवेश (cid:292)(cid:232)ताव(cid:585) को धरातल पर लागू करने के िलए एवं अनमु ोदन/मंजरू (cid:547) (cid:292)दान करने के िलए सभी (cid:466)वभाग/(cid:292)ािधकार/कायाल(cid:91) य (cid:468)ज(cid:219)ह(cid:585)ने अपने पदािधका(cid:464)रय(cid:585) को JIIDCO म(cid:581) (cid:292)ितिनयु(cid:416) नह(cid:547)ं (cid:465)कया से सम(cid:219)वय करेगा। (11) CEO रा(cid:207)य म(cid:581) उ(cid:429)ोग लगाने हेतु उ(cid:429)ािमय(cid:585) को सभी तरह के आव(cid:230)यक सहायता (cid:292)दान करेगा। (12) CEO, JIIDCO (cid:430)ारा अनरु (cid:468)(cid:162)त एवं संचािलत, Single Window मंजूर(cid:547) के वेब-पोट(cid:91)ल के काय(cid:607) क(cid:551) अनु(cid:302)वण, समी(cid:162)ा एवं मू(cid:227)यांकन करेगा। झारख(cid:214)ड गजट (असाधारण) बुधवार, 1 जून, 2016 9 12. (cid:468)जला कायक(cid:91) ारणी सिमित (Distric Empowered Committee) (1) रा(cid:207)य सरकार अिधसूचना (cid:430)ारा (cid:468)जला (cid:232)तर पर एक सिमित का गठन कर सकता है जो ’’(cid:468)जला कायक(cid:91) ा(cid:464)रणी सिमित (DEC)’’ कह(cid:547) जाएगी। 2) धारा 12.1 के तहत ग(cid:465)ठत (cid:468)जला कायक(cid:91) ा(cid:464)रणी सिमित म(cid:581) अ(cid:218)य(cid:162) एवं िन(cid:224)नसूिचत सद(cid:232)य होग-(cid:581) सद(cid:232)य पदनाम (क) (cid:468)जला के उपायु(cid:416) अ(cid:218)य(cid:162) (ख) (cid:468)जला वा(cid:468)ण(cid:207)यकर उपायु(cid:416) सद(cid:232)य (ग) (cid:162)े(cid:287)ीय पदािधकार(cid:547), झारख(cid:214)ड (cid:292)दषू ण िनयं(cid:287)ण पष(cid:91)द सद(cid:232)य (घ) महा(cid:292)ब(cid:219)धक, (cid:468)जला उ(cid:429)ोग के(cid:219)(cid:289) सद(cid:232)य सिचव (ङ) (cid:468)जला योजना पदािधकार(cid:547) सद(cid:232)य (च) (cid:302)म (cid:466)वभाग के (cid:468)जला पदािधकार(cid:547) सद(cid:232)य (छ) (cid:468)जला के संबंिधत (cid:466)बजली (cid:466)वतरण क(cid:224)पनी (cid:468)जसके अ(cid:363)तगत (cid:468)जला आता हो के कायप(cid:91) ालक अिभयतं ा सद(cid:232)य (ज) (cid:468)जला खनन पदािधकार(cid:547) सद(cid:232)य (झ) (cid:292)मंडल वन अिधकार(cid:547) सद(cid:232)य 13. (cid:468)जला कायक(cid:91) ा(cid:464)रणी सिमित के काय (cid:91) (Functions of District Executive Committee) (1) इस अिधिनयम के (cid:292)भावी (cid:465)(cid:272)या(cid:219)वयन हेत,ु (cid:468)जला कायक(cid:91) ा(cid:464)रणी सिमित िनयिमत (cid:510)प से (cid:468)जला (cid:232)तर(cid:547)य नोडल एजस(cid:581) ी के काम-काज का अनु(cid:302)वण, पयव(cid:91) े(cid:162)ण एवं समी(cid:162)ा करेगा। (2) धारा-7 के तहत यह सिमित "High Empowered Committee" (उ(cid:205)च श(cid:466)(cid:416) (cid:292)ा(cid:431) सिमित) (cid:430)ारा सौपे गये अ(cid:219)य काय(cid:607) का स(cid:224)पादन करेगी। (3) इस अिधिनयम के (cid:292)भावी (cid:465)(cid:272)या(cid:219)वयन के िलए सिमित इस अिधिनयम अथवा उ(cid:205)च श(cid:466)(cid:416) (cid:292)ा(cid:431) सिमित (cid:430)ारा (cid:292)दत श(cid:466)(cid:416)/काय(cid:607) के तहत (cid:468)जला (cid:232)तर(cid:547)य नोडल एजस(cid:581) ी को काय/(cid:91) श(cid:466)(cid:416)याँ (cid:292)दान कर या वापस ले सकती है। (4) अपने ((cid:468)जला कायक(cid:91) ारणी सिमित के) काय(cid:607) (काय (cid:91) (cid:292)दश(cid:91)न) क(cid:551) समी(cid:162)ा एवं जहाँ आव(cid:230)यक हो, वहाँ आव(cid:230)यक अनुशंसा (cid:292)दान करने हेतु कम-से-कम मह(cid:547)न े म(cid:581) एक बार (cid:468)जला कायक(cid:91) ारणी सिमित क(cid:551) बैठक उस जगह आहूत क(cid:551) जाएगी (cid:468)जसे सिमित के अ(cid:218)य(cid:162) (cid:430)ारा िनधा(cid:91)(cid:464)रत क(cid:551) जाएगी। (5) (cid:468)जला कायक(cid:91) ारणी सिमित, (cid:468)जला (cid:232)तर(cid:547)य नोडल एजे(cid:219)सी (cid:430)ारा िन(cid:465)द(cid:91)(cid:436) मामल(cid:585) पर (cid:466)वचार कर उिचत िनणय(cid:91) ले सकती है। 10 झारख(cid:214)ड गजट (असाधारण) बुधवार, 1 जून, 2016 (6) य(cid:465)द ऐसा आव(cid:230)यक हो तो (cid:465)कसी भी मामला/मु(cid:423)ा/(cid:292)(cid:232)ताव को अपनी अनशु ंसाओ ं एवं सुझाव(cid:585) के साथ, सिमित, उ(cid:429)ोग (cid:466)वभाग को भेजेगी। (7). (cid:468)जला कायक(cid:91) ारणी सिमित का एक सद(cid:232)य (cid:229)य(cid:466)(cid:416)गत (cid:510)प से इसक(cid:551) बैठक म(cid:581) (cid:465)ह(cid:232)सा लेगा और य(cid:465)द वह बैठक म(cid:581) उप(cid:468)(cid:232)थत होने म(cid:581) असमथ (cid:91) है तो वे एक वर(cid:547)य अिधकार(cid:547) को बैठक म(cid:581) उिचत िनणय(cid:91) लेने हेतु िल(cid:468)खत (cid:292)ािधकार प(cid:287) देकर (cid:292)ितिनयु(cid:416) करेगा। (8) सिमित (cid:468)जला म(cid:581) उ(cid:429)ोग(cid:585) के (cid:292)ो(cid:215)साहन एवं अ(cid:219)य गित(cid:466)विधय(cid:585) के िलए (cid:468)ज(cid:224)मेदार होगी। (9) (cid:468)जला कायक(cid:91) ा(cid:464)रणी सिमित, (cid:292)गित (cid:464)रपोट(cid:91) बनाने एवं उसे (cid:468)जला योजना सिमित को स(cid:587)पने के िलए (cid:468)ज(cid:224)मेदार होगी। 14. (cid:468)जला (cid:232)तर(cid:547)य नोडल एजस(cid:581) ी (District Level Nodal Agency) (cid:468)जला उ(cid:429)ोग के(cid:219)(cid:289) एज(cid:581)सी एवं (cid:468)जला कायक(cid:91) ारणी सिमित का (cid:468)जला (cid:232)तर(cid:547)य नोडल एजस(cid:581) ी होगा। 15.(cid:468)जला (cid:232)तर(cid:547)य नोडल एजस(cid:581) ी के काय((cid:91) Functions of District Level Nodal Agency) (1) यह (cid:468)जले म(cid:581) िनवेश (cid:292)ो(cid:215)साहन गित(cid:466)विधय(cid:585) म(cid:581) सहायता (cid:292)दान करेगी। (2) यह (cid:468)जले म(cid:581) उ(cid:429)िमय(cid:585) को िनवेश एवं उनक(cid:551) प(cid:464)रयोजनाओं या औ(cid:429)ोिगक इकाईय(cid:585) क(cid:551) (cid:232)थापना म(cid:581) सहायता एवं मागद(cid:91) श(cid:91)न (cid:292)दान करेगा। (3) यह उ(cid:429)िमय(cid:585) को आवेदन (cid:292)प(cid:287) उपल(cid:222)ध करान े एवं उ(cid:429)िमय(cid:585) से भरा हुआ (cid:292)प(cid:287) (cid:292)ा(cid:431) करन े जहाँ कह(cid:547)ं भी अिधकृत हो स(cid:465)हत (cid:466)व(cid:466)वध मंजू(cid:464)रय(cid:585) के िलए मागद(cid:91) श(cid:91)न (cid:292)दान करेगा और (cid:466)वभाग(cid:585) एवं (cid:292)ािधकार(cid:585) से आव(cid:230)यक मंजूर(cid:547) को िनयत समय म(cid:581) उ(cid:429)िमय(cid:585) के िलए सुगम करेगा। (4) यह कायक(cid:91) ारणी सिमित एवम ् (cid:468)जला कायक(cid:91) ारणी सिमित (cid:430)ारा स(cid:587)पी गयी और रा(cid:207)य सरकार (cid:430)ारा समय- समय पर अिधसूचना के मा(cid:218)यम से (cid:292)(cid:215)यायो(cid:468)जत श(cid:466)(cid:416)/काय(cid:607) का (cid:292)योग करेगा। 16. अनुमा(cid:219)य मंजू(cid:464)रया ँ(Eligible Clearances) (1) सभी (cid:292)(cid:232)ता(cid:466)वत या मौजुद िनवेश, (cid:468)जसम(cid:581) एक या अिधक (cid:292)चिलत/लागू अिधिनयम(cid:585) के अंतगत(cid:91) मंजूर(cid:547) क(cid:551) आव(cid:230)यकता हो, एकल (cid:468)खड़क(cid:551) मंजूर(cid:547) वेब-पोट(cid:91)ल के मा(cid:218)यम से सु(cid:466)वधा (cid:292)ाि(cid:431) के पा(cid:287) ह(cid:585)गे जब कभी वेब- पोट(cid:91)ल पर संबंिधत (cid:292)चिलत अिधिनयम के तहत मंजूर(cid:547) क(cid:551) सु(cid:466)वधा होगी। (2) उप-धारा-1 म(cid:581) सुगिमत मंजू(cid:464)रय(cid:585) के अित(cid:464)र(cid:416) सभी मंजू(cid:464)रय(cid:585) के मामल(cid:585) म(cid:581) संबंध म(cid:581) एजस(cid:581) ी मे िनयु(cid:416) अिधकार(cid:547) स(cid:162)म पदािधकार(cid:547) (cid:430)ारा िनयम समय-सीमा के भीतर मंजरू (cid:547) (cid:292)दान करने क(cid:551) कार(cid:91)वाई करेगा। 17. समझौता (cid:163)ापन (Memorandum of Understanding) (1) SWCC के CEO औ(cid:429)ोिगक नीित के तहत वहृ त उ(cid:429)ोग(cid:585) के िलए एवं वैसे मामले (cid:468)जनम(cid:581) सरकार के (cid:430)ारा (cid:466)वशेष िनद(cid:566)श (cid:292)ा(cid:431) हुआ हो, के समझौता (cid:163)ापन (MOU) पर ह(cid:232)ता(cid:162)र कर(cid:581)गे। झारख(cid:214)ड गजट (असाधारण) बुधवार, 1 जून, 2016 11 (2) वहृ त उ(cid:429)ोग के िनिमत समझौता (cid:163)ापन पर SWCC के CEO उ(cid:205)च श(cid:466)(cid:416) (cid:292)ा(cid:431) सिमित के पूवा(cid:91)नुमित के प(cid:433)ात ् ह(cid:232)ता(cid:162)र कर(cid:581)गे। 18. वेब-पोट(cid:91)ल (Web Portal) (cid:466)विभ(cid:219)न (cid:292)चिलत/लागू अिधिनयम(cid:585) एवं समय-समय पर अिधसूिचत औ(cid:429)ोिगक नीित के तहत ् सभी मंजू(cid:464)रय(cid:585) के Single Window मंजूर(cid:547) हेतु वेब-पोट(cid:91)ल का अनुर(cid:162)ण एवं संचालन करेगी। 19. एक(cid:551)कृत आवेदन (cid:292)प(cid:287) (CAF) (1) (cid:292)चिलत अिधिनयम(cid:585) एवं समय-समय पर अिधसूिचत औ(cid:429)ोिगक नीित के तहत ् िनधा(cid:91)(cid:464)रत वत(cid:91)मान आवेदन (cid:292)प(cid:287) क(cid:551) जगह एक एक(cid:551)कृत आवेदन (cid:292)प(cid:287) सशु(cid:227)क जार(cid:547) (cid:465)कया जायेगा। सभी स(cid:162)म (cid:292)ािधकार ऐसे (cid:292)प(cid:287) (Combined Application Form) को कार(cid:91)वाई हेतु (cid:232)वीकार करके आव(cid:230)यक मंजूर(cid:547) (cid:292)दान कर(cid:581)गे। (2) बशत(cid:566) (cid:465)क जहाँ कोई आवेदन (cid:292)प(cid:287) एवं शु(cid:227)क ऐसी मंजू(cid:464)रय(cid:585) के िलए के(cid:219)(cid:289)(cid:547)य अिधिनयम(cid:585) म(cid:581) (cid:292)ावधािनत हो, आवेदन उसी (cid:292)प(cid:287) म(cid:581) एवं उसी शु(cid:227)क के साथ जमा (cid:465)कया जाएगा (cid:468)जस शु(cid:227)क के साथ जमा (cid:465)कया जाना है। 20. (cid:232)व-(cid:292)माणन (Self-Certification) (1) (cid:292)(cid:215)येक उ(cid:429)मी को पूर(cid:547) तरह से तैयार CAF को जमा करने के समय (cid:466)व(cid:465)हत (cid:292)प(cid:287) म(cid:581) (cid:232)व(cid:292)माणन (cid:292)(cid:232)तुत करना होगा और उसके बाद स(cid:162)म (cid:292)ािधकार के सम(cid:162) (cid:466)व(cid:465)हत समय-सीमा के भीतर (cid:232)व(cid:292)मा(cid:468)णत करना होगा (cid:465)क वह (cid:292)चिलत अिधिनयम(cid:585) के लागू (cid:292)ावधान(cid:585) एवं उसके तहत ् बने िनयम(cid:585) का अनपु ालन करेगा। (2) उ(cid:429)मी (cid:430)ारा उप-धारा-1 के तहत (cid:292)(cid:232)तुत (cid:232)व-(cid:292)माणन को स(cid:162)म (cid:292)ािधकार (cid:430)ारा उ(cid:429)िमय(cid:585) को अनुदान एवं मंजूर(cid:547) (cid:292)दान करने एवं अ(cid:219)य लाभ देने के उ(cid:423)े(cid:230)य से (cid:232)वीकार (cid:465)कया जायेगा। 21. िनर(cid:547)(cid:162)ण(cid:585) क(cid:551) यु(cid:466)(cid:416)यु(cid:416)ता (Rationalisation of Inspections) (1) (cid:292)चिलत अिधिनयम(cid:585) एवं (cid:466)व(cid:466)वध (cid:232)तर के (cid:292)ािधकार(cid:585) के िनयम(cid:585) के (cid:292)ावधान(cid:585) के तहत ् िनर(cid:547)(cid:162)ण (cid:302)मायु(cid:416) काया(cid:91)लय एवं झारख(cid:214)ड रा(cid:207)य (cid:292)दषू ण िनयं(cid:287)ण पष(cid:91)द और अ(cid:219)य (cid:430)ारा वष(cid:91) म(cid:581) एक बार (cid:465)कया जायेगा। (2) (cid:466)वभाग जो(cid:468)खम आधा(cid:464)रत मू(cid:227)यांकन, जैसा (cid:465)क अपने-अपने िनयम(cid:585)/उप िनयम(cid:585) म(cid:581) (cid:466)व(cid:465)हत है के आधार पर िनर(cid:547)(cid:162)ण करेगा, पर(cid:219)तु (cid:466)वशेष िशकायत के (cid:466)व(cid:509)(cid:424) िनर(cid:547)(cid:162)ण (cid:466)वभागीय (cid:292)मुख क(cid:551) िल(cid:468)खत अनमु ित के प(cid:433)ात ् (cid:465)कया जा सकता है। 22. ततृ ीय प(cid:162) का िनर(cid:547)(cid:162)ण (Third Party Inspections) (cid:292)चिलत अिधिनयम(cid:585) या (cid:466)विभ(cid:219)न रा(cid:207)य (cid:292)ािधकार(cid:585) के िनयम(cid:585) के (cid:292)ावधान(cid:585) के तहत ् िनर(cid:547)(cid:162)ण जहाँ लागू होता हो, स(cid:162)म (cid:292)ािधकारो के Empanelment ततृ ीय प(cid:162) िनर(cid:547)(cid:162)ण एज(cid:581)िसय(cid:585) (cid:430)ारा (cid:466)व(cid:465)हत (cid:465)कया जा सकता है। ततृ ीय प(cid:162) िनर(cid:547)(cid:162)ण (cid:464)रपोट(cid:91) को ऐसे (cid:292)प(cid:287) म(cid:581) जैसा (cid:465)क (cid:466)व(cid:465)हत (cid:465)कया जा सकता है, म(cid:581) (cid:292)(cid:232)तुत (cid:465)कया जायेगा। 23. िन(cid:232)तारण क(cid:551) (cid:292)(cid:465)(cid:272)या (Procedure of Disposal) (1) मंजू(cid:464)रय(cid:585) के िलए आवेदन(cid:585) का िन(cid:232)तारण उस (cid:292)(cid:465)(cid:272)या का पालन करते हुए (cid:465)कया जाएगा जसै ा (cid:465)क (cid:466)व(cid:465)हत (cid:465)कया जा सकता है। 12 झारख(cid:214)ड गजट (असाधारण) बुधवार, 1 जून, 2016 (2) उप-धारा-1 म(cid:581) िन(cid:465)द(cid:91)(cid:436) आवेदन(cid:585) का िन(cid:232)तारण िनधा(cid:464)(cid:91) रत/(cid:466)व(cid:465)हत समय अविध के अ(cid:219)दर (cid:465)कया जायेगा। (3) मंजू(cid:464)रयाँ (cid:292)दान करते समय उपयु(cid:416) (cid:292)ािधकार आवेदक से अित(cid:464)र(cid:416) सूचनाओं क(cid:551) मांग कर सकता है। (4) बशत(cid:566) (cid:465)क अित(cid:464)र(cid:416) सूचना स(cid:162)म (cid:292)ािधकार (cid:430)ारा ऐसी मंजू(cid:464)रय(cid:585) के िलए िनधा(cid:91)(cid:464)रत समयाविध के अंदर मांगा जाएगा। (5) पुनः बशत(cid:566) (cid:465)क अित(cid:464)र(cid:416) सूचनाएँ केवल एक बार मांगी जाएगी। (6) य(cid:465)द उपयु(cid:416) (cid:292)ािधकार (cid:430)ारा आवेदक से कोई अित(cid:464)र(cid:416) सूचना नह(cid:547)ं मांगी जाती है तो वह ((cid:292)ािधकार) िनधा(cid:91)(cid:464)रत समय-सीमा के समाि(cid:431) के पहले मंजू(cid:464)रय(cid:585) के संद(cid:91)भ म(cid:581) आवेदन पर आदेश(cid:585) को िनगत(cid:91) करेगा। (7) मंजू(cid:464)रय(cid:585) के िलए अित(cid:464)र(cid:416) सूचना मांगे जाने के मामले म(cid:581) आवेदन को िनधा(cid:91)(cid:464)रत समयाविध जो अित(cid:464)र(cid:416) सूचना (cid:292)ाि(cid:431) ितिथ से िगनी जाएगी के भीतर िन(cid:232)तारण (cid:465)कया जायेगा। 24. ड(cid:547)(cid:224)ड (cid:232)वीकृित (Deemed Approval) स(cid:162)म (cid:292)ािधकार (cid:430)ारा िनधा(cid:91)(cid:464)रत अविध के भीतर मंजूर(cid:547) नह(cid:547)ं (cid:465)दये जान े या अ(cid:468)(cid:219)तम आदेश जार(cid:547) नह(cid:547)ं (cid:465)कय े जाने क(cid:551) (cid:468)(cid:232)थित म(cid:581) रा(cid:207)य सरकार (cid:430)ारा, अिधसूचना के मा(cid:218)यम से अिधसूिचत मंजू(cid:464)रय(cid:585) को ड(cid:547)(cid:224)ड (cid:232)वीकृित माना जाएगा। 25. अपील(Appeals) (1) (cid:468)जला कायक(cid:91) ारणी सिमित, (cid:468)जला (cid:232)तर(cid:547)य नोडल एजस(cid:581) ी और एज(cid:581)सी (cid:430)ारा प(cid:464)रयोजना को र(cid:423) (cid:465)कये जाने के िनणय(cid:91) या कोई अ(cid:219)य िशकायत से पी(cid:468)़डत उ(cid:429)मी सिमित के िनणय(cid:91) क(cid:551) सूचना (cid:292)ाि(cid:431) ितिथ के 30 (cid:465)दन के अ(cid:219)दर Single Window मंजूर(cid:547) सिमित से जैसा (cid:465)क (cid:466)व(cid:465)हत हो सकता है ((cid:292)थम अपील कर सकता है)। Single Window मंजूर(cid:547) सिमित के आदेश के (cid:466)व(cid:509)(cid:424) अपील उ(cid:205)च श(cid:466)(cid:416) (cid:292)ा(cid:431) सिमित के पास ह(cid:585)गे। (2) High Powered Committee के आदेश के (cid:466)व(cid:510)(cid:424) (cid:292)धान सिचव/सिचव, उ(cid:429)ोग के मा(cid:218)यम से (cid:465)(cid:430)तीय अपील शासी िनकाय के सम(cid:162) (cid:465)कया जाएगा और इस अिधिनयम के तहत ् शासी िनकाय का िनणय(cid:91) अंितम और सभी के िलए बा(cid:218)य होगा। (3) (cid:466)व(cid:465)हत (cid:292)(cid:465)(cid:272)या का पालन करते हुए, अपीलीय (cid:292)ािधकार अपील (cid:292)ाि(cid:431) के एक माह के अ(cid:219)दर या सिमित के आगामी बैठक जो बाद म(cid:581) हो अपील का िन(cid:231)पादन करेगा। 26. शु(cid:227)क (Fee) आवेदक(cid:585) (cid:430)ारा एक(cid:551)कृत आवेदन (cid:292)प(cid:287) (CAF) या अ(cid:219)य (cid:292)प(cid:287) म(cid:581) जो लागू अिधिनयम या िनयम(cid:585) के तहत ् शु(cid:227)क जो (cid:466)व(cid:465)हत हो के साथ हो, ऐसे मंजू(cid:464)रय(cid:585) के आवेदन जमा (cid:465)कए जाय(cid:581)गे। 27. िनयम बनाने क(cid:551) श(cid:466)(cid:416) (Power to make rules) (1) इस अिधिनयम के उ(cid:423)े(cid:230)य(cid:585) को पूरा करने के िलए रा(cid:207)य सरकार के पास िनयम बनाने क(cid:551) श(cid:466)(cid:416) होगी। झारख(cid:214)ड गजट (असाधारण) बुधवार, 1 जून, 2016 13 (2) रा(cid:207)य सरकार अिधसूचना (cid:430)ारा मंजू(cid:464)रय(cid:585) से संबंिधत इस अिधिनयम के (cid:465)कसी भी (cid:292)ावधान के काया(cid:91)(cid:219)वयन को य(cid:465)द यह इसे लोक(cid:465)हत म(cid:581) आव(cid:230)यक समझती हो तो िशिथल कर सकती है। (3) इस अिधिनयम के तहत बनाए गए (cid:292)(cid:215)येक िनयम को स(cid:287)ाधीन झारख(cid:214)ड (cid:466)वधान सभा के सम(cid:162) तुरंत रखा जाएगा, और य(cid:465)द (cid:466)वधान सभा स(cid:287)ाधीन न हो तो िनयम को अिधसूिचत होने क(cid:551) ितिथ के तुरंत बाद वाले स(cid:287) म(cid:581) रखा जाएगा। 28. अिभभावी (cid:292)भाव (Overriding Effect) इस अिधिनयम म(cid:581) अ(cid:219)यथा (cid:292)ावधािनत को छोड़कर इस अिधिनयम के (cid:292)ावधान, रा(cid:207)य के कोई अ(cid:219)य उस समय लागू कानून (िनयम) म(cid:581) िन(cid:465)हत (cid:465)कसी असंगित के बावजूद भी (cid:292)भावी ह(cid:585)गे। बशत(cid:566) (cid:465)क जुमा(cid:91)ना, द(cid:214)ड, शु(cid:215)क और अ(cid:219)य समान (cid:292)ावधान य(cid:465)द (cid:292)चिलत अिधिनयम के तहत ् कोई हो तो, लागू अिधिनयम के (cid:292)ावधान(cid:585) के अनुसार लगाए जाय(cid:581)गे और (cid:466)व(cid:465)हत तर(cid:547)के से जमा (cid:465)कए जाय(cid:581)गे। 29. ग(cid:215)यारोध के िनराकरण क(cid:551) श(cid:466)(cid:416) (Power to remove difficulties) (1) इस अिधिनयम के (cid:292)ावधान(cid:585) को (cid:292)भावी बनाने के (cid:272)म म(cid:581) (cid:465)कसी (cid:292)कार के ग(cid:215)यारोध उ(cid:215)प(cid:219)न होते ह(cid:583) तो रा(cid:207)य सरकार, राजप(cid:287) म(cid:581) (cid:292)कािशत आदेश (cid:430)ारा ऐसे (cid:292)ावधान, जो इस अिधिनयम के (cid:292)ावधान(cid:585) से (cid:466)वसंगत न हो, व जो ग(cid:215)यारोध को दरू करने के िलए आव(cid:230)यक (cid:292)तीत हो, कर सकेगी। 30. अथद(cid:91) (cid:214)ड (Penalty) (1) (cid:465)कसी एजे(cid:219)सी या (cid:466)वभाग या उपयु(cid:416) (cid:292)ािधकार (cid:430)ारा (cid:465)दये गए (cid:232)व-(cid:292)माणन क(cid:551) शत(cid:591) या (cid:468)ज(cid:224)मेदा(cid:464)रय(cid:585) का पालन करने म(cid:581) असफल रहने क(cid:551) (cid:468)(cid:232)थित म(cid:581) उ(cid:429)मी को (cid:292)थम दोष पर प(cid:219)(cid:289)ह हजार (cid:510)पये तक और दसू रे दोष या उसके बाद के (cid:292)(cid:215)येक दोष(cid:585) पर प(cid:205)चीस हजार (cid:510)पये तक के द(cid:214)ड का सामना करना होगा। (2) उपयु(cid:416) (cid:292)ािधकार, लागू अिधिनयम के तहत (cid:466)व(cid:465)हत िनयम के अनुसार कानून के तहत ् उपयु(cid:416)(cid:91) उप- धारा (1) को (cid:292)भावी बनाने के िलए स(cid:162)म होगा। (3) अथद(cid:91) (cid:214)ड अिधरो(cid:466)पत करनवे ाला स(cid:162)म (cid:292)ािधकार एज(cid:581)सी को संसूिचत करने के साथ संबंिधत उ(cid:429)मी को अथद(cid:91) (cid:214)ड के संबंध म(cid:581) संसूिचत करेगा। संसूचन जार(cid:547) होन े क(cid:551) ितिथ से तीस (cid:465)दन के अ(cid:219)दर, उ(cid:429)मी को ऐसे अिधरो(cid:466)पत रािश को एजस(cid:581) ी के पास जमा करना होगा। (4) रा(cid:207)य सरकार समय-समय पर अिधसूचना के मा(cid:218)यम से अथद(cid:91) (cid:214)ड क(cid:551) रािश को प(cid:464)रवित(cid:91)त कर सकती है। 31. स(cid:427)ाव कृत कार(cid:91)वाई से अिभर(cid:162)ण (Protection of action taken in good faith) Governing Body (शासी िनकाय) एवं "High Empowered Committee" (उ(cid:205)च श(cid:466)(cid:416) (cid:292)ा(cid:431) सिमित) अथवा Single Window मंजूर(cid:547) सिमित या (cid:468)जला कायक(cid:91) ारणी सिमित या एजस(cid:581) ी या (cid:468)जला (cid:232)तर(cid:547)य नोडल एज(cid:581)सी से अ(cid:218)य(cid:162) या अ(cid:219)य सद(cid:232)य या ऐसे सिमित के कोर कम(cid:568) के (cid:430)ारा इस अिधिनयम या उसके तहत ् बन े (cid:465)कसी िनयम के doing business, and to provide for an investor friendly environment in the State of Jharkhand; and Be it enacted by the Jharkhand Legislative Assembly in the 66thyear of the Republic of India as The Environment (Protection) Act, 1986 l. The Boiler Act 1923 m. The Payment of Wages Act 1936 n. The Factories Act 1948 o. The Minimum Wages Act, 1948 p. The Bihar Electricity Act 1948 q. The Jharkhand Entertainment Tax Act, 2012 Or successor/amended Act or any other relevant Act notified by the State Government; e) “Appropriate Authority” means any department or agency of the Government, Local Authority, Statutory Body, State Owned Corporation,Panchayat Raj Institutions, Urban Local Bodies or any other authority or Agency constituted or established under any Act or under administrative control of the Government, which is entrusted with the powers and responsibilities to grant or issue permissions for setting up or commencement of operations of an enterprise in the State; f) “Clearance” means grant or issue of no-objection certificate, allotment, consents, approvals, permissions, registrations, enrolments, licences and the like, by any Appropriate Authority in connection with the setting up of an enterprise in the State of Jharkhand and shall include all such permissions as are required underany applicable acts; g) “Department” means a department of the State Government of Jharkhand; h) “District Executive Committee” means the committee constituted under Section 12; i) “District Level Nodal Agency” means the agency specified under Section 14; j) “Entrepreneur” means a person or body of persons or a company, having or proposing to have majority investment or controlling interest in an enterprise and who brings forth a proposal for investment; k) “Government” means the State Government of Jharkhand; l) “High Powered Committee” means the committee constituted under Section 6; m) “Industrial Policy” means Jharkhand industrial policy or other sector specific policies or schemes of Central or Government of Jharkhand as notified from time to time for industrial promotion. n) “Notification” means a notification published in the Jharkhand Gazette and the word ‘notified’ shall be construed accordingly; o) “Prescribed” means prescribed by rules made under this Act and rules made under applicable Acts to implement this Act. p) “Web Portal” means web portal maintained by the Agency. 3. Notification of Agency Notificatio n ofJIIDCO The Government of Jharkhand shall notify the “Jharkhand Industrial Infrastructure Development Corporation (JIIDCO) to provide secretariat support to single window clearance and industrial facilitation for the new investments in 16 झारख(cid:214)ड गजट (असाधारण) बुधवार, 1 जून, 2016 the State. 4. Governing Body Constituti on of Governing (1) There shall be constituted a ‘Governing Body’ for the purposes of this Act. Body (2)The Governing Body constituted under section 4.1 shall consist of the Chairman and the following members: Members Designation Chairman and Hon’ble Chief Minister Chairman Members a. of Industry Minister Vice Chairman b. Governin g Body Finance Minister Member c. Revenue, Registration and Land Reforms Minister Member d. Chief Secretary Member e. Principal Secretary/Secretary, Industry Member -Secretary f. Other nominations by the State Government if any Members g. (3) The Governing Body may co-opt any other member if so required, for proper and effective discharge of its functions. The Apex Committee may co-opt any other member if so required, for proper and effective discharge of its functions 5. Fun ctions of Governing Body Functions Subject to the overall control and superintendence of the State Government, the of Governing Body shall provide overall policy guidance and direction under this Act. Governing Body (1)The Governing Body shall be responsible for setting the strategic directionsandguidance for the Single Window Clearance and industries facilitation required for its effective functioning. (2)The orders passed and decisions taken by the Governing Body shall be final and binding on all Government Departments, Authorities and Agency and such Departments, Authorities and Agency shall issue requisite clearance झारख(cid:214)ड गजट (असाधारण) बुधवार, 1 जून, 2016 17 and permissions within the stipulated time limit, provided that the relevant provisions of the applicable Acts and Rules of the State Government or Central Government are complied by the investor/ applicant. (3)The Governing Body may assign or revoke its functions / powers to High Powered Committee and Single Window Clearance Committee for effective implementation of this Act. (4)The Governing Body shall meet as often as required to carry out its functions but it shall meet at least twice in every year at such place, as the Chairman of the Governing Body may decide, for performance review of the High Powered Committee and the Single Window Clearance Committee; and for providing necessary recommendations where required. (5)The Governing Body may also consider matters referred by the High Powered Committee and the State Government, and take appropriate decisions.

(6)The Governing Body shall grant approval of financial incentive packages for Mega and Ultra-mega projects on the recommendation of the High- Powered Committee. 6. High Powered Committee Constituti on of High Powered (1) There shall be constituted a High Powered Committee for the purpose of Committe this Act. e (2) The High Powered Committee constituted under section 6.1 shall consist of the Chairman and the following members: Members Designation Chairman and Chief Secretary Chairman Member s a. ofHigh Development Commissioner Member b. Powered Committe Principal Secretary/Secretary, Industry Member c. e Principal Secretary /Secretary,Finance Member d. Member- Director of Industries e. Secretary (3) The High Powered Committee may invite other department secretaries or any other officer of a Department as a special invitee as required. 7. Functions of High Powered Committee Functions of High Powered (1)The High Powered Committee shall regularly monitor, supervise and review Committe the functioning of the Single Window Clearance Committee, Agency, District e Level Nodal Agency and District Executive Committee for industries facilitation and single window clearance. (3)The Committee may assign or revoke the functions / powers to the Single Window Clearance Committeeand District Executive Committee within the powers / functions assigned under this Act or by the Governing Body for effective implementation of this Act. (4)The High Powered Committee shall meet at least once in every quarter at such place, as the Chairman of the Committee may decide, for performance review of the Single Window Clearance Committeeand District Executive Committee; and for providing necessary recommendations where required. (5)The High Powered committee shall grant approval of financial incentive packages for large projects on the recommendationof Single Window Clearance Committee. The High Powered Committee shall recommend financial incentive packages for all Mega and Ultra-mega projects to governing body. (6)The High Powered Committee may also consider matters referred to it by the CEO of Single Window Clearance Committee and take appropriate decisions. (7)It shall further refer any case / issue / proposal to the Governing Body with its recommendations and suggestions, if considered necessary. (8)The Committee shall be responsible for promoting investments in the state and other related activities. (9)The High Powered Committee shall recommend the time-line for each service provided under various applicable Acts to the concerned department. (10) The High Powered Committee shall recommend self-certification, deemed clearances, rationalisation of inspections and third party inspections under various applicable acts wherever applicable to the concerned department. 8. Single Window Clearance Committee (1) There shall be constituted a Single Window Clearance Committee (SWCC) for the purpose of this act. (2) The Single Window Clearance Committee shall consist of the following composition: Members Designation a. Principal Secretary/Secretary, Industry Chief Executive Officer b. Principal Secretary /Secretary, Finance-cum- Member Planning c. Principal Secretary/Secretary, Revenue, Member Registration and Land Reform d. Principal Secretary/Secretary, Urban Member Development and Housing. e. Principal Secretary/Secretary, Labour, Member Employment and Training f. Principal Secretary, Forest, Environment and Member झारख(cid:214)ड गजट (असाधारण) बुधवार, 1 जून, 2016 19 Climate Change g. Principal Secretary/Secretary, Energy Member h. Principal Secretary/Secretary, Water Resources Member i. Principal Secretary/Secretary, Mining and Member Geology J. Chairman, Jharkhand State Pollution Control Member Board k. Director of Industries Member- Convener (3) The Principal Secretary, Department of Industries shall be Chairman of this Single Window Clearance Committee. The Single Window Clearance Committee may invite the other departmental Secretaries or any other officer of any department as a special invitee as required. 9. Functions of Single Window Clearance Committee Subject to overall control and superintendence of the State Government, (1) The Single Window Clearance Committee shall exercise powers of clearances for setting up of business and starting of business operations as notified by State Government. (2) The State Government may devolve upon it any other powers, if so required, through appropriate notification except the powers vested with the statutory bodies including ULBs and PRIs. The SWCC shall pursue the proposals with regards to ULBs and PRIs directly with them or through the Deputy Commissioner of the district concerned to facilitate their early clearance. (3) The delegations of powers shall be exercised by the SWCC up to the stage of clearances and approvals. All clearances and approvals, thereafter, shall be issued by the Appropriate Authority concerned. (4) Financial incentives for MSME projects shall be approved by this Committee and other than MSME projects, this committee shall recommend to the High Powered Committee for approval. 10. Officers/Employees of the Agency (1) The Officers of various departments shall be placed in the Agency on deputation/ secondment by concerned administrative department /organizations, include a. An Officer not below the rank of a Chief Engineer in the Jharkhand State Pollution Control Board. b. An Officer not below the rank of the Chief Town Planner in the Department of Urban Development and Housing. c. An Officer not below the rank of JointLabour Commissioner in the Department of Labour 20 झारख(cid:214)ड गजट (असाधारण) बुधवार, 1 जून, 2016 d. An Officer not below the rank of the Joint Commissioner Commercial Tax in the Department of Commercial Tax e. An Officer not below the rank of Chief Conservator of forests in the Department of Forest, Environment and Climate Change. f. An Officer not below the rank of Chief Engineer in Jharkhand BijliVitran Nigam Ltd g. An Officer not below the rank of Director of Land Acquisition in the Department of Revenue, Registration and Land Reforms. h. An officer not below the rank of Additional Director of Mines from the Department of Mines and Geology (2) In case the department/organizations is unable to provide the officers of the rank mentioned in sub-section-I, the deputed/secondment officer shall be deemed to be in the rank mentioned in sub-section-I till he remains on deputation with Agency. However, this will not entitle him any additional financial benefits on this account. (3) All regulatory departments who grants approvals/clearances shall empower their depute/secondment senior officer in the JIIDCO through notification to grant approvals within a time-frame for all new projects to setting-up of business and starting business operations. Till such notification, the deputed/seconded officers shall be responsible for disposal of applications for such clearances applications within the time- limit. (4) The Chief Executive Officer of the SWCC shall exercise the powers of supervision and control over all the officers on deputation/secondment to the Agency. However, the Officers as mentioned in sub-section-1whose services are placed with the Agency on deputation or secondment shall continue to be governed under the relevant rules and regulations of their respective cadres in their parent departments/organizations. (5) The Agency shall provide other staff requirement to discharge responsibility under this Act through contact or outsourcing mode. 11. Functions of Chief Executive Officer(CEO): Functions (1) CEO shall also be the Principal Secretary/Secretary in charge of the of Chief Department of Industries. Executive (2) The CEO shall examine, consider and process the proposals received Officer from any entrepreneur relating to industrial and other projects to be set up in the State from time to time. (3) The CEO shall exercise all the powers/ functions assigned by the Governing Body, High Powered Committee and as delegated from time to time by the State Government by notification (4) The CEO shall coordinate all efforts for promoting investments in the state and other related activities. (5) The CEO shall be the competent authority to sign all documents, approvals and sanction of grants or instructions issued by SWCC. (6) The CEO shall refer any case / issue / proposal to the High Powered Committee with its recommendations and suggestions, if considered necessary. (7) The CEO shall review and monitor investments in various projects for which the approvals have been granted by the SWCC. (8) The CEO shall be responsible for preparation, submission of monthly, quarterly, half yearly and yearly progress reports to the Governing Body झारख(cid:214)ड गजट (असाधारण) बुधवार, 1 जून, 2016 21 and High Powered Committee. (9) The CEO shall coordinate with all departments through various officers of departments deputed or seconded in the JIIDCO to grant approval/clearances and to implement the investment proposals on ground. (10) The CEO shall also coordinate with all departments/authorities/offices who are not deputed or seconded their officers in the JIIDCO to grant approval/clearances and to implement the investment proposals on ground. (11) The CEO shall provide all necessary assistance to entrepreneurs to set up industries in the State. (12) The CEO shall regularly monitor, review and evaluate the functioning of web-portal of Single Window Clearance maintained and operated by the JIIDCO. 12. District Executive Committee – DEC Constituti on of District (1) The State Government may by notification constitute committee at Executive district level called as “District Executive Committee”. Committe (2) The e District Executive Committee constituted under section 12.1 shall consist of the Chairman and the following members, namely:- Members Designation Chairman Deputy Commissioner of the District Chairman and a. Member s Deputy Commissioner Commercial Tax Officer ofthe of District Member b. District Executive Committe Regional Officer, Jharkhand Pollution Control Board Member c. e General Manager of DIC Member Secretary d. District Planning Officer Member e. District officer of Labour Department Member f. Executive Engineer of the District of concerned Electricity Member g. Distribution Company under which district falls District Mining Officer Member h. Divisional Forest Officer Member i. (3) The District Executive Committee may invite an officer of the concerned Department as a special invitee if so required 13. Functions of District Executive Committee Functionin g of District 22 झारख(cid:214)ड गजट (असाधारण) बुधवार, 1 जून, 2016 (1) The District Executive Committee shall regularly monitor, supervise and Executive review the functioning of the District Level Nodal Agency for the effective Committe implementation of the Act. e (2) It shall carry out such other functions as may be assigned to it by the High Powered Committee under section 7. (3) The Committee may assign or revoke the functions / powers to the District Level Nodal Agency within the powers / functions assigned by the Act or by the High Powered Committee for effective implementation of this Act. (4) The District Executive Committee shall meet at least once in every month at such place, as the Chairman of the Committee may decide, for performance review of the District Executive Committee; and for providing necessary recommendations wherever required. (5) The District Executive Committee may also consider matters referred to it by the District Level Nodal Agency and take appropriate decisions. (6) It shall further refer any case / issue / proposal to the Department of Industries with its recommendations and suggestions, if considered necessary. (7) A member of the District Executive Committee shall personally attend its meeting and in case he/she is unable to attend, he/she may depute a Senior Level Officer with a written authorisation to take appropriate decisions in the meeting. (8) The Committee shall be responsible for promoting investments in the District and other related activities. (9) The District Executive Committee shall be responsible for preparation and submission of progress reports to the District Planning Committee. 14. District Level Nodal Agency District District Industries Centre shall be the District Level Nodal Agencyof the Agency Level and District Executive Committee. Nodal Agency 15. Functions of District Level Nodal Agency Functionin (1) It shall assist in investment promotional activities in the district. g of (2) It shall guide and assist entrepreneurs in investment and setting up their District Level projects or industrial units in the district. Nodal (3) It shall guide the entrepreneurs on various clearances, including providing Agency application forms and also to receive the filled up forms from them wherever authorised and facilitate the entrepreneur on required clearances from the departments and authorities within the stipulated time. (4) It shall exercise all the powers/ functions assigned by the Single Window Clearance Committee and the District Executive Committee and as delegated time to time by the State Government by notification. 16. Eligible Clearances Eligible (1) All proposed or existing investments which need clearance under one or Clearance more of the applicable acts shall be eligible for facilitation through single s window clearance web-portal, whenever facility for clearance is available झारख(cid:214)ड गजट (असाधारण) बुधवार, 1 जून, 2016 23 in the web-portal for concerned applicable acts. (2) For all clearances other than facilitated under sub section (1), officers of departments placed in the agency shall process for clearances within the time-line prescribed by appropriate authority. 17. Memorandum of Understanding Memoran dum of Understan (1) The CEO of the SWCC or any authorised Officer shall sign memorandum of ding understanding (MoU) only for mega industries as provided under industrial policy and cases in which Government has given specific direction to do so. (2) The CEO of the SWCC shall obtain the approval of High Powered Committee before signing such MoU for mega industries. 18. Web- Portal Web The Agency shall maintain and operate web-portal for single window clearance portal of all clearances under various applicable Acts and Industrial Policy, as notified from time to time, under this Act. 19. Combined Application Form(s) (CAF) (1) The Combined Application Form(s) (CAF) shall be prescribed, along with Combined such fees, in lieu of existing forms prescribed under applicable Acts and Applicatio Industrial Policy, as notified from time to time. All appropriate authorities n Form shall accept such CAF for processing and issue of required clearances. (2) Provided that where any form and fee has been prescribed for such clearances in any Central law, the applications shall be submitted only in that very form along with that fee to be submitted. 20. Self-Certification Self- (1) Every entrepreneur shall furnish a self-certification, in such form as may be Certificati prescribed, at the time of submitting the duly completed CAF and thereafter on the appropriate authority within in the prescribed time limit that he/she shall comply with the applicable provisions of the applicable Acts and rules made there under. (2) The self-certification furnished as in sub-section (1) by the entrepreneurs(s) shall be accepted by the appropriate authorities for the purpose of granting and issuing of clearance and giving other benefits to the entrepreneur(s). 21. Rationalisation of Inspections Rationalis (1) Inspections under the provisions of applicable Acts or Rules by different ation of levels of authorities, shall be conducted jointly by the office of the Labour Inspection Commissioner and Jharkhand State Pollution Control Board and other, 24 झारख(cid:214)ड गजट (असाधारण) बुधवार, 1 जून, 2016 once in a year. s (2) Department shall conduct inspection based on risk based assessment as maybe prescribed in their respective rules/bye-laws.However, inspection against specific complaints may be conducted with the authorisation of the Head of the Departments. 22. Third Party Inspections Third Party inspection Inspections under the provisions of applicable Acts or Rules by different state s authorities, wherever applicable, may be prescribed to conduct through empanelled third party inspection agencies of appropriate authorities. The Third Party Inspection Report shall be furnished in such from as may be prescribed. 23. Procedure for Disposal Procedure (1) The applications submitted for clearances shall be disposed of by following for such procedure, as may be prescribed. Disposal (2) The applications referred to in sub-section (1), shall be disposed of within such period as prescribed. (3) While granting clearances, the Appropriate Authority may ask for any additional information from the applicants; (4) Provided that such additional information shall be sought by the Appropriate Authority within the period prescribed for such clearances. (5) Provided further that any additional informational shall be called for only at one time. (6) If no additional information is sought by the Appropriate Authority from the applicant, it shall pass orders on the application with regard to clearances before the expiry of the stipulated period. (7) In case, additional information is sought for clearances, the application shall be disposed of within the stipulated period, which shall be counted from the date of receipt of the additional information. 24. Deemed Approval Deemed Approval The State Government may, by notification, notify the clearances in respect of which, failure by the appropriate authority to grant clearance or pass final order within the period specified shall be treated as a deemed approval. . 25. Appeals Appeals (1)Any entrepreneur aggrieved by the decision of the District Executive Committee, District Level Nodal Agency and Agency disapproving the project, or any other grievances may make, within thirty days from the date of receipt of communication of the decision of the Committee, first appeal to theSingle Window Clearance Committeeas may be prescribed. Appeal against the order of Single Window Clearance Committee shall lie with High Powered Committee. (2)The second appeal against the order of High Powered Committee shall lie झारख(cid:214)ड गजट (असाधारण) बुधवार, 1 जून, 2016 25 with Governing Body through Principal Secretary/Secretary Industries and decision of Governing Body is final and binding on all under this Act. (3)The Appellate Authority shall, after following such procedure, as may be prescribed, dispose of the appeal within a period of one month from the date of its receipt or the next Body/Committee meeting whichever is later. 26. Fee Fee for clearance s The Application for such clearances shall be submitted by the applicants in such Combined Application Form – CAF or any other form prescribed under applicable Act or rules thereof along with such fee, as may be prescribed. 27. Power to make rules Power to make rules (1) The State Government shall have the power to make rules to carry out the purposes of this Act. (2) The State Government may, by notification, exempt from the operation of any of the provisions of this Act relating to clearances, if it considers necessary to do so in public interest. (3) Every rule made under this Act shall be laid immediately before the Jharkhand Legislative Assembly if it is in session, and if it is not in session, in the session immediately following the date on which such rule is notified. 28. Overriding effect Overriding effect Save as otherwise provided in this Act, the provisions of this Act shall have effect notwithstanding anything inconsisitent therewith contained in any other state law for the time being in force. Provided that fine, penality, duty and other similar provisions if any under applicable Act, shall be imposed as per provisions of the applicable Act, and shall be deposited as prescribed. 29. Power to remove difficulties Power to remove difficulties (1) If any difficulty arises in giving effect to any of the provisions of this Act, the State Government may, by an order published in the Official Gazette, make such provisions, not inconsistent with the provisions of this Act, as may appear to be necessary for removing the difficulty. 30. Penalty Penalty (1) Any entrepreneur who fails to comply with the conditions or undertakings in the self-certification given the Agency or Department or appropriate authorities shall face penalty which may extend to fifteen thousand rupees for the first offence and up to twenty five thousand for the second or subsequent offences. (2) The appropriate authority shall be competent for enforcement of the above 26 झारख(cid:214)ड गजट (असाधारण) बुधवार, 1 जून, 2016 sub-section (1) as per law according to the prescribed rule under the applicable Act. (3) The appropriate authority imposing the penalty shall communicate the same to the entrepreneur concerned with intimation to the Agency. The entrepreneur shall deposit the amount of such imposed penalty with the Agency within thirty days of the issue of communication. (4) The amount of penalty may be changed from time to time by government through notification. 31.
