Repeal of Madras Act V of 1931. 12. Power to remove difficulties. THE TELANGANA TRAFFIC CONTROL ACT, 1938.1 ACT No. V OF 1938. 1. (1) This Act may be called 2[the Telangana Traffic Control Short title, extent Act, 1938.] and commencement. (2) It extends to the whole of the 2[State of Telangana.] (3) This section shall come into force at once, and the rest of this Act shall come into force on such date as the State Government may, by notification, appoint. 2. In this Act, ‘Public place’ means a road, street, way or Definition. other place, whether a thoroughfare or not, to which the public are granted access or over which they have a right to pass and includes,- 3[(a) in the cities of Hyderabad and Secunderabad, a public street as defined in clause (46) of section 2, of the Greater Hyderabad Municipal Corporations Act, 1955 (Act II of 1956);] (b) in a municipality governed by 4[the Andhra Pradesh (Andhra Area) District Municipalities Act, 1920,] a public street as defined in clause (21) of section 3 of that Act; and 1. The Andhra Pradesh Traffic Control Act, 1938 in force in the combined State, as on 02.06.2014, has been adapted to the State of Telangana, under section 101 of the Andhra Pradesh Reorganisation Act, 2014 (Central Act 6 of 2014) vide. the Telangana Adaptation of Laws Order, 2016, issued in G.O.Ms.No.45, Law (F) Department, dated 01.06.2016. 2. Substituted by G.O.Ms.No.45, Law (F) Department, dated 01.06.2016. 3. Inserted by section 3 of and the Schedule to the Andhra Pradesh Extension of Laws Act, 1958 (Andhra Pradesh Act XXIII of 1958). 4. Andhra Area Act repealed by Act No.6 of 1965. 2 [Act No.V of 1938] (c) in a local area governed by 5[the Andhra Pradesh (Andhra Area) District Boards Act, 1920,] a public road as defined in clause (18) of section 3 of that Act. Power of State 3. The State Government may, after previous publication, Government to make rules to provide,– make rules for the control of traffic. (a) for the regulation of the use of any public place and the closing thereof or parts thereof; and (b) for the regulation of traffic in any public place or its reservation for particular kinds of traffic. Penalty for breach 4. In making any rule under section 3, the State of rules. Government may provide that a breach thereof shall be punishable,- (a) with fine which may extend to fifty rupees and, in case of a continuing breach, with fine which may extend to fifteen rupees for every day during which the breach continues after conviction for the first breach; or (b) with fine which may extend to ten rupees for every day during which the breach continues after receipt of notice from an officer empowered in that behalf by the State Government, to discontinue such breach. 6[5. Notwithstanding anything contained in this Act, all by- Existing by-laws laws relating to any of the matters mentioned in section 3 of to continue. this Act which have been made under 11[the Greater Hyderabad Municipal Corporation Act, 1955 (Act II of 1956] 12[the Andhra Pradesh (Andhra Area) District Municipalities Act, 1920] or 8[the Andhra Pradesh (Andhra Area) District Boards Act, 1920,] and are in force at the commencement of this Act shall continue to be valid, but any such by-law may be cancelled or altered by a rule made under section 3 aforesaid. 11. The Madras Government Roads Traffic Control Act, Repeal of Madras Act V of 1931. 1931, is hereby repealed. 12. If any difficulty arises in giving effect to the provisions of Power to remove this Act or of 11[the Greater Hyderabad Municipal difficulties. Corporation Act, 1955 (Act II of 1956)] 12[the Andhra Act V of 1920. Pradesh (Andhra Area) District Municipalities Act, 1920,] Act XIV of 1920. 8[the Andhra Pradesh (Andhra Area) District Boards Act, 1920], the Indian Motor Vehicles Act, 1914, or 10[the Andhra Central Act 8 of 1914.
