About this statute

This provision sets up the Registration Act’s scope, registration offices, key officers, filing rules, and several required documents and procedures. The registering officer must examine execution and identity before registration, and may attest a power of attorney for exempt persons without requiring personal attendance. The State Government may make rules for registration matters, and approved rules are published in the Official Gazette. The Inspector-General also has power to issue orders in certain cases, and incorrect registration conduct with intent to injure is punishable. Banks lending to agriculturists for agricultural purposes must send the mortgage instrument copy to the registering officer, and certain courts and officers must send related property documents for filing. Mortgagees under title-deed mortgages must file a notice within 30 days, or later dealings with a third party may be void and the person may face imprisonment and fine.
