BEitenactedbyParliamentintheSixty-fourthYearoftheRepublicofIndiaasfollows: CHAPTERI PRELIMINARY 1.(1)ThisActmaybecalledtheCriminalLaw(Amendment)A~i,2013. Shorttitle and commencement. (2)Itshallbedeemedtohavecomeintoforceonthe3rddayofFebruary,2013. CHAPTERn AMENDMENTSTOTHEINDIAN PENALCODE 45 of 1860. 2. IntheIndianPenalCode(hereafterinthisChapterreferredtoasthePenalCode), Amendment insection100,afterclauseSixthly,thefollowingclauseshallbeinserted,namely:- ofsection 100. "Seventhly.-Anactofthrowingoradministeringacidoranattempttothrow oradministeracidwhichmayreasonablycausetheapprehensionthatgrievoushurt willotherwisebetheconsequenceofsuchact.". 2 THEGAZETTEOFINDIAEXTRAORDINARY [PART 11- Insertionofnew 3. I.fter section 166 ofthe Penal Code, the following sections shall be inserted, sections 166A namely:- and 1668. Public servant "166A. Whoever, beingapublicservant,- disobeying (a) knowingly disobeys any direction ofthe law which prohibits him direction underlaw. from requiring the attendance at any place ofanyperson for the purpose of investigationintoanoffence oranyothermatter, or (b)knowinglydisobeys,totheprejudiceofanyperson,anyotherdirection ofthelawregulatingthemannerinwhichheshallconductsuchinvestigation, or (c)failstorecordanyinformationgiventohimundersub-section(1)of section154oftheCodeofCriminalProcedure, 1973,inrelationtocognizable 2 of1974. offence punishable under section 326A, section 326B, section 354, section 354B, section 370, section 370A, section 376, section 376A, section 376B, section 376C,section 3760, section 376Eorsection509, shallbepunished withrigorousimprisonmentforatermwhichshallnotbelessthan sixmonthsbutwhichmayextendtotwoyears,andshallalsobeliabletofme. Punishment 166B.Whoever,beinginchargeofahospital,publicorprivate,whetherrunby for non the Central Government, the State Government, local bodies or any other person, treatment of contravenestheprovisionsofsection357CoftheCodeofCriminalProcedure, 1973, 2of1974. victim. shallbepunishedwithimprisonmentforatermwhichmayextendtooneyearorwith fmeorwithboth.". Amendment of 4. Insection228Aofthe PenalCode, insub-section(1), forthewords, figures and section 228A. letters "offence under section 376, section 376A, section 376B, section 376C or section 3760",thewords,figuresandletters"offenceundersection376,section376A,section376B, section376C,section3760orsection376E"shallbesubstituted. Insertion of 5. After section 326 ofthe Penal Code, the following sections shall be inserted, new sections namely:- 326A and 3268. Voluntarily '326A.Whoevercausespermanentorpartialdamageordeformityto,orburnsor causing maimsordisfigures ordisables, anypartorpartsofthe bodyofaperson orcauses grievous hurt grievoushurtbythrowingacidonorbyadministeringacidtothatperson,orbyusing by useof acid, etc. anyothermeanswiththeintentionofcausingorwiththeknowledgethatheislikelyto cause suchinjuryorhurt, shallbe punishedwithimprisonmentofeitherdescription foratermwhichshallnotbelessthantenyearsbutwhichmayextendtoimprisonment forlife,andwithfme: Providedthatsuchfineshallbejustandreasonabletomeetthemedicalexpenses ofthetreatmentofthevictim: Provided furtherthat any fine imposed underthis sectionshall be paidto the victim. Voluntarily .326B. Whoeverthrows orattemptstothrowacidonanypersonorattemptsto throwing or administeracidtoanyperson, orattemptstouse anyothermeans, withthe intention attempting to ofcausing permanent or partial damage or deformity or burns or maiming or throw acid. disfigurement or disability or grievous hurt to that person, shall be punished with imprisonmentofeitherdescriptionforatermwhichshallnotbelessthanfiveyearsbut whichmayextendtosevenyears,andshallalsobeliabletofme. Explanation I.-For the pwposes of section 326A and this section, "acid" includesanysubstancewhichhasacidicorcorrosivecharacterorburningnature,thatis capableofcausing bodilyinjuryleading to scarsordisfigurement ortemporary or permanentdisability. Explanation 2.-Forthe pwposes ofsection326Aandthis section, permanent or partial damageordeformityshallnotberequiredtobeirreversible.'. SEC. 1] THEGAZETTEOFlNDIAEXTRAORDINARY 3 6. Insection354ofthePenalCode,forthewords"shallbepunishedwithimprisonment Amendment ofeitherdescriptionforatennwhichmayextendtotwoyears,orwithfine,orwithboth",the ofsection 354. words"shallbepunishedwithimprisonmentofeitherdescriptionforatennwhichshallnot belessthanoneyearbutwhichmayextendtofiveyears,andshallalsobeliabletofme" shall be substituted. 7.Aftersection354ofthePenalCode,thefollowingsectionsshallbeinserted,namely:- Insertion of new sections 354A,354B, 354C and 354D. '354A.(1)Amancommittinganyofthefollowingacts- Sexual harassment (i)physicalcontactandadvancesinvolvingunwelcomeandexplicitsexual and overtures; or punishment for sexual (il) ademandorrequestforsexualfavours; or harassment. (iii)showingpornographyagainstthewillofawoman; or (tv)makingsexuallycolouredremarks, shallbeguiltyofthe offenceofsexualharassment. (2)Any man who commitsthe offence specified in clause (l) orclause(il) or clause(iii)ofsub-section(1)shallbepunishedwithrigorousimprisonmentforatenn whichmayextendtothreeyears,orwithfine, orwithboth. ExplanationI.-Forthepurposeofthissection,"privateact"includesanactof watching carried out in a place which, in the circumstances, would reasonably be expectedtoprovideprivacyandwherethe victim's genitals, posteriororbreastsare exposedorcoveredonlyinunderwear;orthevictimisusingalavatory;orthevictim isdoingasexualactthatisnotofakindordinarilydoneinpuelic. Explanation2.-Wherethevictimconsentstothecaptureoftheimagesorany act, but not to their dissemination to third persons and where such image or act is disseminated, suchdissemination shallbeconsideredanoffenceunderthis section. 354D.(1)Anymanwho- Stalking. (I) followsawomanandcontacts,orattempts.tocontactsuchwomanto fosterpersonalinteractionrepeatedlydespiteaclearindicationofdisinterestby suchwoman; or 4 THEGAZETTEOFINDIAEXTRAORDINARY [PARI'11- (il) monitorstheusebyawomanoftheintelllet,emailoranyotherform ofelectroniccommunication, commitstheoffenceofstalking: Provided that such conduct shall not amount to stalking ifthe man who pursued it proves that- (i) itwaspursuedforthepurposeofpreventing ordetecting crime and the man accused ofstalking had been entrusted with the responsibility of preventionanddetectionofcrimebythe State;or (il) it was pursued under any law orto comply with any condition or requirementimposedbyanypersonunderanylaw; or (iii)intheparticularcircumstances suchconductwasreasonableandjustified. (2)Whoevercommits theoffenceofstalkingshallbepunishedonfirstconviction withimprisonmentofeitherdescriptionforatermwhichmayextendtothreeyears,and shall also be liableto fme; and be punishedon asecond orsubsequent conviction, withimprisonmentofeitherdescriptionforatermwhichmayextendtofiveyears,and shallalsobeliabletofine.'. Substitution of 8. For section 370 ofthe Penal Code, the following sections shall be substituted, new sections namely:- 370 and 370A for section 370. Trafficking of '370. (I) Whoever, forthepurposeofexploitation,(a)recruits, (b)transports, person. (c)harbours,(d)transfers,or(e)receives,apersonorpersons,by- First.-- usingthreats, or Secondly.-usingforce, oranyotherform ofcoercion,or Thirdly.- byabduction, or Fourthly.-bypractising fraud, ordeception, or Fifthly.- byabuseofpower, or Sixthly.-byinducement, includingthegivingorreceiving ofpayments orbenefits, inordertoachieve theconsentofanypersonhavingcontrol over thepersonrecruited,transported, harboured, transferredorreceived, commitstheoffenceoftrafficking. Explanation1.-Theexpression"exploitation"shallincludeanyactofphysical exploitationoranyformofsexualexploitation,slaveryorpracticessimilartoslavery, servitude,ortheforcedremovaloforgans. Explanation2.-Theconsentofthevictimisimmaterialindeterminationofthe offenceoftrafficking. (2)Whoevercommitstheoffenceoftraffickingshallbepunishedwithrigorous imprisonment for a term which shall not be less than seven years, but which may extendtotenyears,andshallalsobeliabletofme. (3)Wheretheoffenceinvolvesthetraffickingofmorethanoneperson,itshall bepunishablewithrigorous imprisonmentforatermwhichshallnotbelessthanten yearsbutwhichmayextendtoimprisonmentforlife,andshallalsobeliabletofme. (4)Wheretheoffenceinvolvesthetraffickingofaminor,itshallbepunishable withrigorousimprisonmentforatermwhichshallnotbelessthantenyears, butwhich mayextendtoimprisonmentforlife,andshallalsobeliabletofine. (5)Wheretheoffenceinvolvesthetraffickingofmorethanoneminor,itshallbe punishablewithrigorousimprisonmentforatermwhichshallnotbelessthanfourteen years,butwhichmayextendtoimprisonmentforlife,andshallalsobeliabletofine. SEC.1] THEGAZETTEOFINDIAEXTRAORDINARY 5 (6) Ifapersonisconvictedoftheoffenceoftraffickingofminoronmorethan one occasion, thensuchpersonshallbe punishedwithimprisonmentfor life, which shallmeanimprisonmentfortheremainderofthatperson'snaturallife,andshallalso beliabletofme. (7)Whenapublicservantorapoliceofficerisinvolvedinthetraffickingofany personthen,suchpublicservantorpoliceofficershallbepunishedwithimprisonment forlife,whichshallmeanimprisonmentfortheremainderofthatperson'snaturallife, andshallalsobeliabletofme. 370A. (/)Whoever,knowingly orhaving reasontobelieve thataminorhas Exploitation beentrafficked, engages suchminor forsexualexploitationinanymanner,shall be ofa trafficked person. punished with rigorous imprisonmentfor a termwhich shallnotbe less than five years, butwhichmayextendtoseven years,andshallalsobeliabletofme. (2)Whoever,knowinglybyorhaving reasontobelieve thatapersonhasbeen trafficked,engagessuchpersonfor sexualexploitationinanymanner, shallbepunished with rigorous imprisonmentfor atermwhichshallnotbe less thanthree years, but whichmayextendtofiveyears,andshallalsobeliabletofme.'. 9.Forsections375,376,376A,376B,376Cand376DofthePenalCode,thefollowing Substitution of sections shall be substituted, namely:- new sections for sections 375, 376, 376A,3768, 376C and 376D. '375. Aman issaidtocommit"rape"ifhe- Rape. (0)penetrateshispenis,toanyextent,intothevagina,mouth, urethraor anusofawomanormakeshertodosowithhimoranyother person;or (b) inserts,to any extent, anyobjectorapartofthebody, notbeingthe penis,intothevagina,theurethraoranusofawomanormakeshertodosowith himoranyotherperson;or (c) manipulatesanypartofthebodyofawomansoastocausepenetration intothevagina,urethra,anusoranypartofbodyofsuchwomanormakesherto dosowithhimoranyotherperson;or (d) applieshismouthtothevagina,anus, urethraofawomanormakes hertodosowithhimoranyotherperson, underthe circumstancesfallingunderanyofthefollowing sevendescriptions: First.-Againstherwill. Secondly.-Without her consent. Thirdly.-With her consent, when her consent has been obtained by puttingheroranypersoninwhom she isinterested,infearofdeathorofhurt. Fourthly.-With her consent, when the man knows that he is not her husband and that herconsent is given because she believesthathe is another mantowhomsheisorbelievesherselftobelawfullymarried. Fifthly.-Withherconsentwhen, atthetimeofgivingsuchconsent, by reason ofunsoundness ofmind or intoxication or the administration byhim personally or through another ofany stupefying or unwholesome substance, she is unable to understand the nature and consequences ofthatto which she gives consent. 6 THEGAZETIEOFINDIAEXTRAORDINARY [PARTII- Sixthly.-Withorwithoutherconsent,whenshe is undereighteenyears ofage. Seventhly.-When she is unable to communicate consent. Explanation I.-Forthe purposes ofthis section, "vagina" shall also include labiamajora. Explanation 2.-Coqsent means an unequivocal voluntary agreement when thewomanbywords,gesturesoranyformof verbalornon-verbalcommunication, communicateswillingnesstoparticipateinthespecificsexualact: Providedthatawomanwhodoesnotphysically resisttotheactofpenetration shall not by the reason only ofthat fact, be regarded as consenting to the sexual activity. Exception I.-Amedicalprocedureorinterventionshallnotconstituterape. Exception2.-Sexualintercourseorsexualactsbyamanwithhisownwife,the wifenotbeingunderfifteenyearsofage, isnotrape.'. Punishment 376.(1)Whoever,exceptinthecasesprovidedforinsub-section(2),commits for rape. rape, shallbe punishedwithrigorous imprisonmentofeitherdescription for aterm whichshallnotbe lessthansevenyears, butwhichmay extendto imprisonmentfor life,andshallalsobeliabletofme. (2) Whoever,- (a)beingapoliceofficer,commitsrape- (I) withinthelimitsofthepolicestationtowhichsuchpoliceofficer is appointed; or (il) inthepremisesofanystationhouse; or (iil) ona womaninsuchpoliceofficer'scustodyorinthecustody ofapoliceofficersubordinatetosuchpoliceofficer;or (b) being a public servant, commits rape on a woman in such public servant's custody or in the custody ofa public servant subordinate to such public servant; or (c)beingamemberofthearmedforcesdeployedinanareabytheCentral oraStateGovernmentcommitsrapeinsucharea;or (d)beingonthemanagementoronthestaffofajail,remandhomeorother placeofcustodyestablishedbyorunderanylawforthetimebeinginforceorof a women's or children's'institution, commits rape on any inmate ofsuchjail, remandhome,placeorinstitution;or (e)beingonthemanagementoronthestaffofahospital,commitsrapeon a womaninthathospital;or (f) being arelative, guardian orteacherof, or aperson inaposition of trustorauthoritytowardsthewoman,commitsrapeonsuchwoman;or (g)commitsrapeduringcommunalorsectarianviolence;or (h)commitsrapeonawoman knowinghertobepregnant;or (I) commits rape on awoman when she is under sixteenyears ofage; or SEC. 1] THEGAZETTEOFINDIAEXTRAORDINARY 7 (j)commitsrape,onawomanincapableofgivingconsent;or (k) being inapositionofcontrolordominance overawoman, commits rape onsuchwoman;or (I)commitsrapeonawomansufferingfrommentalorphysicaldisability;or (m) while committing rape causes grievous bodily harm or maims or disfiguresorendangersthelifeofawoman;or (n)commitsraperepeatedlyonthesamewoman, shallbepunishedwithrigorous imprisonmentforatermwhichshallnotbelessthan tenyears,butwhichmayextendtoimprisonmentforlife,whichshallmeanimprisonment fortheremainderofthatperson'snaturallife,andshallalsobeliabletofme. Explanation.-For the purposes ofthis sub-section,- (a)"armedforces"meansthenaval,militaryand air forcesand includes any memberoftheArmed Forcesconstitutedunderanylawforthetimebeing inforce,includingtheparamilitaryforcesandanyauxiliaryforcesthatareunder thecontroloftheCentralGovernmentortheStateGovernment; (b)"hospital"meanstheprecinctsofthehospitalandincludestheprecincts ofanyinstitutionforthereceptionandtreatmentofpersonsduringconvalescence orofpersonsrequiringmedicalattentionorrehabilitation; (c) "police officer" shall have the same meaning as assigned to the expression"police"underthePoliceAct, 1861; 5 of 1861. (<1)"women'sorchildren'sinstitution"meansaninstitution,whethercalled anorphanageorahomeferneglectedwomenorchildrenorawidow'shomeor aninstitutioncalledbyanyothername,whichisestablishedandmaintainedfor thereceptionandcareofwomenorchildren. 376A. (c) superintendent ormanagerofajail, remandhome orotherplace of custodyestablishedbyorunderanylawforthetimebeinginforce,orawomen's orchildren'sinstitution; or (d)on the managementofahospitalorbeingonthestaffofahospital, abusessuchpositionorfiduciaryrelationshiptoinduceorseduceanywomaneitherin his custodyorunderhischargeorpresentinthepremisesto have sexual intercourse withhim,suchsexualintercoursenotamountingtotheoffenceofrape,shallbepunished withrigorousimprisonmentofeitherdescriptionforatermwhichshallnotbelessthan fiveyears,butwhichmayextendtotenyears,andshallalsobeliabletofine. 8 THEGAZETTEOFINDIAEXTRAORDINARY [PARTll- Explanation1,-Inthissection,"sexualintercourse"shallmeananyoftheacts mentionedinclauses(a)to(d)ofsection375. Explanation2.-Forthepurposesofthissection,Explanation1tosection375 shallalsobeapplicable. Explanation 3.-"Superintendent", inrelationto ajail,remandhomeorother placeofcustodyorawomen'sorchildren'sinstitution,includesapersonholdingany otheroffice in suchjail, remand home, place orinstitutionbyvirtue ofwhich such personcanexerciseanyauthorityorcontroloveritsinmates. Explanation4.-Theexpressions''hospital''and"women'sorchildren'sinstitution" shall respectively have the same meaning as in Explanation to sub-section (2) ofsection376. 3760.Whereawomanisrapedbyoneormorepersonsconstitutingagroupor Gang rape. actinginfurtheranceofacommonintention,eachofthosepersonsshallbe deemedto havecommittedtheoffenceofrapeandshallbepunishedwith rigorousimprisonment foratermwhich shall notbeless thantwenty years, butwhichmayextendto life whichshallmeanimprisonmentfortheremainderofthatperson'snaturallife,andwith fine: Providedthatsuchfineshallbejustandreasonabletomeetthemedicalexpenses andrehabilitationofthevictim: Provided further that any fine imposedunderthis section shall be paidto the victim. 376E. Whoeverhasbeenpreviouslyconvictedofanoffencepunishableunder Punishment for repeat section 376 or section 376A or section 3760 and is subsequently convicted ofan offenders. offencepunishableunderanyofthesaidsectionsshallbepunishedwithimprisonment forlifewhichshallmeanimprisonmentfortheremainderofthatperson'snaturallife,or withdeath.'. Amendment 10. In section 509 ofthe Penal Code, for the words "shallbe punished with simple ofsection imprisonmentforatermwhichmayextendtooneyear,orwithfine,orwithboth",thewords 509. "shallbepunishedwithsimpleimprisonmentforatermwhichmayextendtothreeyears,and alsowith fme" shallbe substituted. CHAPTERIII AMENDMENTSTOTHECODEOFCRIMINALPROCEDURE, 1973 Amendment 11.IntheCodeofCriminalProcedure, 1973(hereafterinthisChapterreferredtoas 2 of 1974. ofsection 26. theCodeofCriminalProcedure),insection26,intheprovisotoclause(a),forthewords, figures and letters "offenceundersection 376and sections 376Ato 3760 ofthe Indian Penal Code", the words, figures and letters "offence under section 376, section 376A, 45 of1860. section376B,section376C,section3760orsection376EoftheIndianPenalCode"shall be substituted. Amendment 12. In section54AoftheCodeofCriminalProcedure,thefollowingprovisosshallbe ofsection inserted,namely:- 54A. "Provided that, ifthe person identifying the person arrested is mentally or. physically disabled, such process of identification shall take place under the supervisionofaJudicialMagistrate whoshall takeappropriate stepstoensurethat suchpersonidentifies thepersonarrestedusingmethodsthatpersoniscomfortable with: SEC.1] THEGAZETTEOFINDIAEXTRAORDINARY 9 Providedfurtherthatifthepersonidentifyingthepersonarrestedismentallyor physicallydisabled,the identificationprocessshallbevideographed.". 13.Insection154oftheCodeofCriminalProcedure,insub-section(1),thefollowing Amendment provisosshallbeinserted,namely:- ofsection 154.
