X OF 2012 (Received the assent of the Governor on 27th April 2012) THE ASSAM COLLEGE EMPLOYEES (PROVINCIALISATION) (AMENDMENT) ACT, 2012 THE ASSAM GAZETTE, EXTRA ORDINARY, MAY 2, 2012 1197 AN ACT s further to amend the Assam College Employees (Provineialisation) (Amendment) Act, 2005. Preamble Whereas it is expedient further to amend the Assam College Assam Act Employees (Provinckjlisstion) Act, 2005, hereinafter referred to as Ihe No.XLVI principal Act, in the manner hereinafter appearing; of2005 It is hereby enacted in the Sixty-third Year of the Republic of India as follows:- Short title, extent CO This Act may he called the Assam College Employees and (Provinoidisation) {Amendment) Act, 2012. commencement (2) It shall have the like extent as the principal Act. (3) It shall come into force at once. , ■ ;'_,, . ■ _ t 1 5i t Amendment 2, the principal Act, in section 3,- of section 3 © f°r the existing clause (c), the following shall be substituted, namely “(C) the posts in each provincialised* College shall constitute an independent cadre for each category of employees except the post of Principals of, Colleges. All Principals of provincialised T Colleges shall form an independent common cadre. Save and except the cadre of Principals, no inter cadre transfer from one College to another including mutual transfer shall be allowed. The services of the Principals shall be transferable among the Colleges.”; (ii) in clause (d) , for the existing proviso, the following provisos shall be substituted, namely :- “Provided that the option once exercised by an existing or ■, , retired employee may be withdrawn by him at any time if he wants to come under provineialisation under this Act, subject to the refund, of the amount of Government’s share of the Contributory Provident Fund with interest thereon upto the date of refund of Government’s share of the Contributory Provident Fund with interest: ■ Provided further that the withdrawal of option shall be effective on the date of refund of the amount of the Government’s share of the Contributory Provident Fund with interest thereon;” X ir» ^G‘ MOHD.
