This Act establishes the North East Christian University, requires an endowment fund, sets up its governance structure, and gives the University powers to run courses, manage funds, and make regulations.
The North East Christian University Act 2012 (Act No.4 Of 2013) Received the assent of the Governor ofNagaland on 10.5.2013 and published in the Nagaland Gazette Extra Ordinary on 5& June 2013. To established and cooperate a private University by the name of the North East Christian University (NECU) with emphasis on providing an instruction, Teaching Training and researchin the field of professional courses of Science, Health, Science, Liberal & Fine Arts, Commerce, Law, Technical, Technology, Interfaith, Religious Education, Management and other Allied areas sponsored jointly by the Nagaland Baptist Church Council (NBCC) and the Council of Naptist Curches in northeast India (CBCNAI) and to provide for matter connected therewith or incidental thereto. WHEREAS the establishment of aPrivate University can be done only through a n ~ cotf the State Legislative Assembly. as per provision in the University Grant Cornrnission(Establishmentand maintenance Standard In Private University) Regulation Act 2003 And WHEREAS The University shall be &tory innature opento any private institutions and colleges. Be it enacted by the Nagaland Legislative Assembly in the Sixty-third years of the Republic of India as follow: CHAPTER 1 PRELIMlNARY Short title and commencement 1. (i) The Act may be called the North East Christian UniversityAct 2012. (ii) It shall come into force on the date appointed by the State Government by notifcation in the Office Gazette. Definitions 2. In this Act unless the context othenviserequires, the following words shall have the meaning assigned herein (1) "Academic Council" means the Academic Council of the University; (2) "Board Of Studies" means the Board of Studies constituted under this Act; (3) "ChanceIIor" means the Chancellor or the University; (4) "Director" means a Director of University, (5) "Executive Council" means Executive Council of the University (6) "Finance Committee" means F i c eC ommittee of the University (7) "Finance Officer" means Finance Office of the University (8) "Fund"meansthe Funds oftheUniversity and includes funds fora sponsored scheme. (9) "Governing Council" means the Governing Council ofthe University; (10) "Governor" meansthe Governor ofNagaland; (11) "Notification" means notification published in the Official Gazette ofthe Government ofNagaland; (12) "Pro-Chancellor" means the Pro-Chancellor of the University; (13) "Registrar" means the Registrar of the University; (1 4) "Regulation" means a regulation made under this Act; (15) "Schedule" means aschedule ofthis Act; (16) "State Government" means the State Government ofNagaland; (17 ) "UGC" means University Grants Commission constituted under the Umversity Grants CommissionGrant,Act, 1956 (1 8) "University" means the Private University by the name "The North East Christian University" establishment under this Act. (1 9) "Vice ChanceUor" means the Vice Chancellor of the Umversity; (20) The Visitor" means the Visitor ofthe University; " CHAPTER I1 ESTABLISHMENT OBJECTIVE POWERAND FUNCTION OF UNIVERSITY. Establishment of the University 3. (1) As soon as the commencement of this act, the state Government shall call upon theNagaland Baptist Church Council and Council ofBaptist Church inNortheast India, the Sponsoring Bodies to set up an endowment Fund of Rupees One Crore for the purpose of the university. (2) Immediately after the setting up of the Endowment Fund as aforesaid, the State Government shall accord sanction for establishment of the university by name of theNorth East Christian University and thereafter the Sponsoring Bodies shall accordingly establish tlie University. The State Government shall notiEj the fact of establishment ofthe University (3) in the Official Gazette as soon as may be after the establishment of the University by the Sponsoring Bodies. (4) The University shall be a body corporate by the name aforesaid, having perpetual succession and common seal and shall, by that name, sue and be used. (5) (i) The headquarter of the University shall be at Dimapur in the state of Nagaland. (ii) The University shall have the power to established other campuses, study centers etc, within the Northeastern State of India for reason of operational expediency and for the Board based activities of the university. (6) The University may established off-campus centre, and study centres subject to the provisions of the University Grant Commission Act 1956 and the regulation made there under and the pmvisions of any law for the time being in force. (7) The University may further institute its own college and also affiliate any other college or institution in accordancew ith the produce enshrined in the regulations. Objects of Universi@. 4. (1) The University shall design and run course and programme leading to the award of Certificate Diplomas, degree ofbachelor, master, doctoral and post-doctoral levels and other academic distinctions, under the faculties and in the subjects enumerated in the Schedule to this Act. (2) The University, by regulation has the power to abolish or create any faculty or any cause or programme of study enumerate in the schedule without causing any detriment to the interest of teachers or students' concerned, ad any such regulation shall deemed as an amendment of this Act. (3) 6) The University may impart instruction in regard to a course or programme of study through one more modes, which may include distance, continuing and regular modes of teaching and learning. (ii) without prejudice to the above, the main objective of the University shall he to provide high quality professional, technical and technological m campus, class room, formal and regular course and programmes of study to the students hailing from sponsoring Bodies State in such subjects, areas an d fields of study which are generally not offered by other institution inNortheast India. (ii The University shall especially strive to have professional, academic and other possible Link-ups and ties with various Centers of Excellence in and outside the country for promoting the standard of education provided metho-dologies of teaching and for upgrading the potentials of teaching and non-teaching staffof the University. Power and function of Universitv. 5. Without prejudice to the generality ofthe following provision of the foregoing provisions, the Universitv shall have the followin-g v.o wer and function: (i) TO provide for'itructions, teaching and training in all branches ofstudy and particularly for research, advancement and dissemination of knowledge through establishment of institutes, departments, schools, faculties and other centers of excellence; To hold examination and to grant and confer certificates, diplomas, degrees and other academic distinction on those who pass the examinations, to confer honorary distinctions on men and women of eminence and to withdraw the certificates, diplomas etc, from those who had been conferred for good and sufficient reasons. (jii To transfer the university into the centre of ~xcellence~articulairnl ~ the field of Science, Health sciences, Liberal & FineArts, Commerce, Law, Technical, Technology, Interfaith Religious Education management Social Work Environment Science, etc; (N) To maintain and manage the physical and financial assets of the University in the most affected manner with a view to promoting the purposes of the University. To appoint professors, associate professor, assistant professors, readers, lecturers and others connected with teaching with a view to imparting instructions ofveiy high standard; To establish all physical amenities conducive to the most effected learning by the students enrolled with the University; To instate fellowships, scholarships, prizes, medals, etc. withaviewto promotmg research and motivating study; To collaborate, cooperate and act jointly with other organi7ationni nstitutions, Universities etc. within and outside India, particularly in the fields of Medical Education, Engineering, Technology, Environment Science, Law and Religion Education, FineArts etc. for strengtheningr esearch and improving the quality of instructions to students; To dissenlinate knowledge through seminar, conference, executive, education programmes, community development programmes, publication And training programmes; To provide consultancy to industry, Government and Public Organizations; To establish and maintain within the premises of the University or elsewhere, such class rooms, study halls as the University may consider necessary and to adequately fiunish the same; To receive grants, subscriptions, donation and gifts for the purpose of the university and consistent with the objects for which the University is established; To purchase, take on lease or accept as gift or otherwise any land or building or works which may be necessary or convenient for the purpose of the University on such terms and conditions as the University may deem fit, and to construct or alter and maintain any such building or works; To execute conveyances, transfer re-conveyances, mortgages, lease licenses and agreement in respect of property, movable or immovable, including security belonging to the University or to acquire the same for the purpose of the University; To enter into agreements with organization which may include the Central Government, the State Government, the University Commission or other authority for receiving grants; To accept grants ofmoney, security or property of any kind on such terms and condition a may be deemed expedient; To raise and borrow money on mortgages, promising notes or on other obligations or security based upon all or any of the prosperities and assets of the university with or without any security and upon such terms and condition as it may deemed fit and to payout of the fund of the university, all expenditure incidental to the raising of the money and to repay and redeem any money borrowed; ( ~ ' >To invest the fimds of the University or money entrusted to the university in other such securities and in such as it may deemed fit and from time to time transpose any instrument; and (xix) To do all other acts as the University may consider necessary that are conductive or incidental to the attainment and promotion of the aforesaid objectives. (2) The Chancellor shall be responsible forthe distribution of the aforesaid powers and functions of the University amongst the officers, councils committee boards and other authority of the University in accordance with the provisions of this act for canying out the objectives of the University. m CHAPTER ADMISSION, DISCIPLINE, HONOORARY DEGREE AND WITHDRAWEL OF DEGREES Secular character of University 6. The University shall be open for study to all persons irrespective of class, caste, creed, religion, language or gender or like consideration. Provided that nothing in this section shall be deemed as preventing the university fiommaking specialprovisionf or admission into courses of study in the University or for concessions in fee in favor of students who are ordinarily members belonging to the Sponsoring Bodies, namely, Nagaland Baptist Church Council and Council of Baptist Church inNortheast India. Eligibility for admission 7. Subject to the provision in thisAcf no student shall be eligible for admission to a course or programme of study in the University unless he possesses the qualificationsprescribed in theregulations. Residence of students 8. Students oftheuniversity may reside in hostel maintenance or recognized by the University under such conditions as may be prescribe in the regulations. Discipline 9. (1) The %ce Chancellor shall be responsible for the maintenance of discipline in the University and his order in this regard shall be carried out by the officer and authority of the University. (2) ~ohvithstandiann~y thing in sub-section the punishment of debarring a student~man~tionoftheUnivomrruis~ti cafinghimfiomtheUniversity - or hostel or aninstitutionof the University or any other punishment of suchserious nature, shall be imposed only by the Executive Council on receipt of a report from the %ce Chancellor. Provided that the Executive Council shall impose such a punishment only after giving the student concerneda reasonable opportunity of being heard. Award of Certificate, Diplomas and Degree ete . - 10. A Certificate. Di~lomaoar Deeree or any other academic distinction shall be , granted to or conferred upon, a student only after he has undergone therelevant of study for the duration prescribedthereof and passed the same with the qualifjmg mark prescribed thereof by the regulations. Award of Honorary Degrees 11. The University shall have the power to confer an honorary degree of academic distinction upon any person for his attainment and position, if the Government Council approves by majority a recommendation of the Academic Council passed by two thirds of the relationmembership ofthe Academic Council doing SO. Withdrawal of Certificate Diploma etc. 12. The Governing and Academic Council shall have the power to withdraw a Certificate or Diploma or aDegree or any other academic distinction including an honorary degree academic distinction granted to, or conferred upon a student or an eminent person, for good and sufficient reason to be enumerated in the regulations. The Council shall follow the same procedure follow for awarding honorary degrees. Teaching and Curriculum 13. (i)A ll teaching in the University shall be done by teaching appointed by the University in accordance with the regulations. i ) The syllabus, curriculum, the manner of organizationofteachinga nd other connected matters inrespect of eachcourse or programme of study in the University shall be as prescribed inthe regulations. CHAPTER IV OFFICERS OF UNIVERSITY Officers of University 14. The following shall be the officers ofthe University: (i) The %sitor (in) The Chancellor (i) The Pro Chancellor (iv) The Vice Chancellor (v) The Regisixar (vii The Director (s) (vii) The Dean (s) (viii) The Finance Officer (x) Such other person who may be declared by regulation as Officer of the University Visitor 15. The Governor of Nagaland shall be the Visitor of the University. Power and function of Visitor 16. (1) The Visitor shall preside over the convocation ofthe Univers~tya nd in the case of his inability, the chancellor shall do so. (2) The %sitor shall constitute a Committee every five years fiomthe date of establishment of the University comprising eminent persons in the field of education to review the working o the University and caused its report to be laid before the Nagaland Legislative Assembly. (3) The Committee tenure shall ordinarily be three months and in no case be extended beyond six months. (4) The University shall bear the expenditure incwent on the Committee. (5) The Officers and Councils under this Act have an obligation to send all the notices, minutes and decisions of their meetings to the Visitor well in advance. (6) The Visitorhas the power to attend the meeting of the Government Council and when he so attends, he shall preside over the meetings ofthe Government Council. (7) The Visitor has the power to seek from the Chancellor information on all affairs ofthe University which shall be provided to him withutmost dispatch. Chancellor 17. The Official Representative of the Council of Baptist Churches Northeast India by whatever designation he may be called shall be the Chancellor of the University. Power and functions of Chancellor 18. (1) The Chancellor is the Plenipotentiary ofthe University and has all powers in regard to the conduct of the affairs of the University in accordance with the provisionof this Act and all unspeciiied power shall vest in him which shall be used for more effective implementationoft his Act. (2) Subject to the foregoing provision, he shall preside over the meetings of the Governing Council. (3) He shall also preside over the Executive and Finance Councils. He has power to attend the meetings of other Councils under this Act (4) and when he so attends, he shall preside over the meetings of such Councils. Pro Chancellor 18. (A). (1) There shall be a Pro Chancellor forthe University appointed by the Chancellor in consultation with the Governing and the Executive Council. (2) The Pro Chancellor shall assist the Chancellor in maintaining administrative and academic discipline in the University. (3) The Honorarium of the Pro Chancellor with be decided as per regulaiions. Vice chancellor 19. (1) There shall be a fdlt ime vice chancellor for the university who shall unction as the Principal Executive and Academic Officer of the University. There shall be a Selection Committee to recommend the selection ofthe (2) Vice Chancellor which shall comprise a nominee of the Government Council, anominee of the Chancellor and two nominees of the sponsoring Bodies. (3) The recommendation of the Selection Committee shall M e rb e considered and recommended by the Government Council to the Chancellor for his final approval. (4) The Vice Chancellor shall not hold ofice beyond 65 years of age. (5) In case of emergent circumstance where the appointment of a Vice Chancellor on the basis of a panel prepared by a selection committee is not possible for any reason, the Chancellor until an appointment is made in accordance with that procedure may appoint a suitable person to function as Vice Chancellor for a period of exceeding one year. (6) Our terms and conditions of service of the Vice Chancellor shall be as per regulations. Power and function of Vice Chancellor 20. (1) Subject to the foregoing provision, the Vice Chancellor shall preside over the meetings of the Acadenuc Council. (2) He shall: @ Exercise general supervision and control over the affairs of the University; u Ensure the observance of the provisions ofthis Act and the regulations made there under; i Be responsible for organizing instructions and maintenance of discipline in the University; (iv) 'Create temporary posts for a period not exceeding one year and abolished the same; (v) Take such action as he may deem necessary in case of any emergency and report the same to the Oficer or CouncilorAuthority concerned which would have ordinarily dealt with the matter: Provided that ifthe Officer or Councilor autliority does not approve ofthe action taken by the Vice Chancellor, the matter will be referred to the Chancellor or through the Pro Chancellor or whose decision shall be final. Provided fiuther that the person affected by the decision ofthe Vice Chancellor or the Officer or Councilor authority has a right of appeal to the Chancellor or the Visitor, as the case may be, within thuty days ofthe decision coming to the knowledge of the affected person; and (vi) Exercise such other powers perfom such other duties as may be assigned to him by the Chancellor or Pro Chancellor or any Councilor Officer or authority under this Act or by any regulation. Registrar 2 1. (1) There shall be a fidl time Registrar for the University. (2) The registrar shall be appointed by the Vice Chancellor in consultation with the Chancellor and the Pro Chancellor iiom out ofthree persons empanelled by the Executive Council which shall not indicate any order of preference and leave the selection solely to the independent judgment of the Vice Chancellor. In case of emergent circumstances where the appointment of Registrar on (3) the basis ofpanel prepared by the Executive Council is not possible for any reason, the Vice Chancellor, until an appointment is made in accordance with that procedure, may appoint a suitable personlofficer of theuniversity in consultation with the Chancellor and the Pro Chancellor to function as registrar for a period not exceeding one year. (4) The Registrar shall not hold office beyond the age of 62 years. (5) Other terms and conditions of service of the Registrar shall be as per regulations. Power and function of the Registrar. 22. (1) The Registrar shall be the ex Officio Secretary of all the Councils of the University under the Act. (2) The Registrar shall: (i) Comply with all direction and order of the Executive Council, the Vice Chancellor, the Pro Chancellor and the Chancellor; (ii) Be the custodian of the records, the common seal and such other property of the University as the Executive Council may commit to his - charge: (iiii Issue notice for, and keep minutes of the meetings of the Councils, Board of studies and other authorities of the Universiw; (iv) Conduct all official correspondence between the University and other outside the University and between various Councils, Board and authorities within the University. (iv) Furnish notice, minute and other records of the University to the Vice Chancellor, the Pro Chancellor and the Chancellor and the Vice Chancellor; (vi) Call meetings ofthe Executive Council for taking emergent decisions, if any in the absence of the Chancellor, the Pro Chancellor and the Chancellor and theVice Chancellor; (vii) Perform such other duties as may be assigned by the Chancellor, the Pro Chancellor; the Vice Chancellor and the Executive Council; and (viii) Be directly responsible to the Vice Chancellor for the proper discharge of his duties. Director 23. (i) There shall be the following full time Director (s) who shall be appointed by the Chancellor. (ii) aDirector for operations in the State omagaland ;a nd i as many Director (s) as required to be fixed by regulation for looking after the operation outside the State ofNagaland. (2) the Director (s) shall not hold office beyond the age 62 years. (3) their other terms and condition shall the state of be as per regulation. Power and function of director (s) 24. (1) TheDirector- in-Charge of operation in the State ofNagaland shall be a member of all Council of the University. (2) The Chancellor may appoint co-opt. any other Director -in-Charge of operations in the State ofNagalandto any Committee, Boardor authority of the University. (4) The Director (s) shall be solely responsible for the operationoftheU niversity at the respective field levels. (5) Their other power and functions shall be as per regulations. Finance officer 25. (1) There shall be a full time Finance Oficer for the University who shall be appointed by the Chancellor. (2) The Chancellor, on his subjective satisfactionmayr eplace the F'iceO fficer by any other Officer in the employment of the University or by special recruitment, in which case the outgoing Finance Officer, if he is considered fit, shall be assigned some other duties in the University. His other terms and conditions of service shall be as per regulations. (3) Power and function of Finance Offifer 26. (1) The Finance Oficer shall be responsible for assisting the Chancellor the Vice Chancellor the other officers, the Councils, Committees bodies and authority of the University in managingthe administration of the Gnance of the University subject to regulation (2) He shall be members of the Governing and Finance Council. (3) The Chancellor may co-opt the Finance Officer in any other Council Committee Bodies orAuthority of the University. DeandHeads of DepartmentwFacuult 27. (1) There shall be a Dean or Head fir each Department or Faculty of Study in the University who shall be appointed in accordance with the regulation. (2) Their other terms and conditions of service shall be as per regulation Powers and Funcfion ofD eans/Heads " 28. (1) The Deans meads of DepartmentsFaculties are mainly responsible for the Educational Administration in respect of courses or programmes of study in the University. (2) Their other power and functions shall be as per regulation. CHAPTERV COUNCILS, COMITTEES AND BOARDS Councils of University 29. The following shall be the Councils ofthe University (1) The Governing Council (2) The Executive Council (3) The Academic Council The Governing Council 30. (1) The following shall be the member of Governing Council: (i) The Chancellor shall be the ex-officio Co-chairman. (ii) The Pro chancellor shall be the ex officio Co-Chairman. (iii) The Vice Chancellor shall be the ex officio Vice Chairman (N) The Director Incharge of the operations in Nagaland shall be an ex officio member. (v) The Fiance Officer shall be an ex officio member; (vi) One nominee of thevisitor; (uii) Two eminent educationist/academiciansn ominated by the Chancellor; (viii) Three person nominated by the Nagaland Baptist Church Council; (ix) Five persons nominated by the Councils of Baptist Churches in North East India; (x) Two person nominatedby the Pro Chancellor; (xi) Two member of the teaching community of the University to be nominated by the Academic Councils; and (xii) The Registrar shall be the ex officio Secretay. (2) The Governing Councils shall be reconstituted every five years. (3) A nominated member may resign from the membership of the Governing Council at any time by addressing his resignation to the Chancellor. - - (4) An ex officio shall cease to be a member of the Governing Council if he ceases to be in office by virtue of which he became an ex officio member. (5) A nominated member shall cease to be amember of the Governing Council if he ceases to be in office on account of which he was nominated to the Governing Council. (6) Amember shall cease to be a member of the Goveming Council on declaration to be ofunsound mind or insolvent by a competent court or if he convicted for acriminal offence involving moral Qitude or ifhe fails three consecutive meetings of the Council. (7) The nominating authorities shall have aright to replace their nominees to the Council at any point of time. (8) Casual vacancies arising in the Council before its reconstitution shall be filled for the unexpired term. Power and function of Governing Council. 3 1. The Govemjng Council shall: 1. Recommend the broad policies and programmed ofthe University and suggest measures for the improvement and development of the University 2. Consider and pass resolution on the Annual Report, the financial statement and audit report. 3. Take all necessary steps for the fulfillment of the objective of the Umversity 4. Acquire, hold, control and adrmnister the property and other movable and immovable assets of the University. 5. Administerfundsplace at the disposal oftheuniversity; 6. Manage and regulate hance, accounts, investments, property and business and all other administrative affaire of the University and for the purpose appoint agents as it may deem fit. 7. Invest the money belonging to the University, including any income £corn trust, endowment funds etc,, in such stocks, funds,s hares or securities as it may be, from time to time, deem fit and appropriate ; 8. Enter into, vary, cany out and cancel contract on behalf of the University; 9. Regulate and determined all others matters concerning the University; 1 0. Co-operate with other institution, Universities and other authorities in such manner and for such purpose as it may be determine; 11. Delegate any of its power to the Chancellor, the Pro Chancellor, the Vice Chancellor, the Registrar or the Director or any other authority of the University for a temporary duration; and 12. Perform such other function as it may deem fit forthe proper functioning and administration of the University. 32. Meeting of Governing Couneil (1) The Governing Council shall meet at least once in a year on a date fixed in consultation with the Executive Council The Chairman or inhis absence, the Co-chaiian or in the absence of both, (2) the Vice Chairman shall prescribe overthemeeting. (3) Ifthe Visitor choose to attend any meeting, he shall have the overridingright to preside over the meeting (4) A report on the working of the University during then previous years, the statement of receipts and expenditure, the balance sheet, the audit report and other such date shall be placed before theAnnual Meeting of the General council. (5) All meeting of the Council shall be called by the Secretary at fifteen days notice. (6) If any five members of the Council desire a meeting to discuss a matter of urgent important the Secretary shall call a meeting forthwith and the requirement of fifteen days notice shall be deemed to have been waived. (7) Two fi& members shall constitute quorum (8) All questions shall be decided by majority of member present and voting. (9) Eachmember shall have one vote and in case of tie, the Presiding Officer shall have additional casting vote (10 ) Ifbusiness ofthe Council has to be transactedurgentlyw ithout waiting for a formal meeting to take place the Chancellor may authorize the circulation of questiontothemembersford ecision whichshall be deemed as valid decision of the Council for act~onh;o wever such decision shall be circulate to all concerned for information and compliance. (11) All other details relating to the conduct of meetings, function etc ofthe Governing Council shall be as per regulations. Executive Council 33 (1) The following shall be the members of the Executive Council (iJTh e Chancellor shall be the Ex-officer Chairman; i ) The Pro-Chancellor shall be the Ex-officer Co-Chairman; i The Vice Chancellor shall bethe Ex-officer Vice Chairman; (iv) The Director in charge ofthe operation inNagaland shall be an ex-officer members, (v) The Finance officer shall be an ex-officer member; (vi) One nominee ofthe Visitor (vii) Two nominee of theNagaland State Government; (viiij Three nominee £tom the Nagaland Baptist Church Council; (ix) Five nominees £tom the Council of Baptist Church in Northeast India (x) One nominee of the Chancellor who shall be a member of the Governing Council, to be named by the Chancellor; and (xi) The Registrar shall be the ex- officer secretary (2) The term of the executive council shall run simultaneously with the Government council which is five years (3) A members of the Executive Council when ceases to be a member of the Governing Council, shall cease to be a member of the Executive Council. (4) The nominating authority shall have aright to replace their nominees to the Council at any point of time (5) Casual vacancies arising in the Council before its reconstitution shall be fill for the unexpired term Power and function of Executive Council 34 (1) The Executive Council sW, (i) Create post and appoint, from the times, of members of the teaching and non-teaching stafffor carrying out the purposes ofthis Act on such terms and condition prescribed by regulation; ('i) Exercise control and impose discipline over the employees of the University; (ii) Accept on behalf of the University, endowment" bequests, donation, grants and transfer of any immovable property (iv) Received money, securities, instruments of any other movable properties for and on behalf of the University (v) Grant receipt, sign and execute instruments and eOOOrsement, discount cheques or other negotiable instrument through its accredited agencies; (vi) Make, sign and account for such documents and instrument as may be necessary for proper canying out of the management of the property or aairo fthe University; (vii) Introduce course of study at the University and take decisions in this regard on the recommendations of the Academic Council; (viii) Cooperate with an co-opt other educational, medical and other institutions and authorities in India and aboard; (k) Create fellowship and scholarships or other assistance on such terms and conditions as it may prescribe by regulations, for carrying out research, investigation and study; (x) Grant leave accept casual leave to officer and other employees of the University and provide for alternative arrangement in the absence of officers and employees; - . (xi) Manage and regulate iinance, accounts, inveshnents, property, business and all other administrativea ffairso fthe University and appoint, forthat purpose - ( ) Invest money belonging to the University, including any unapplied income insuchstocks, funds,s hares or security or movable and immovable -p ro-p erty in India and aboard, as it may from time to time, deem fit, and vary such University, (xiiii Tmnsfer or accept transfers of movable or immovable property on behalf of the University; (xiv) Enter into, vary, cany out and cancel contacts onbehalf ofthe univers~ty and for other purpose appoint agents (xv) Provide building, premise, furniture's, apparatus and other inhstructure facilities for the carrying out of the work of the University, (xvi) Entertain, adjudicate upon and if it thinks fit, redress grievance of officers and employees of the University; (xvii) Appoint examiners, moderators and other if necessary, to remove them for good and suflicient cause, inconsultationoftheA cademic Council (fiS)el ect a common seal for the University and provide for the custody of the seal; (xix) Delegates any of its powers to the Chancellor, the Pro Chancellor, the Vice Chancellor, the Registrar or the Director or any Council or any other authority of the University for temporary durahon; and (xx) Exercise such other powers and perform such other duties as it may be entrusted to it by the Government Councilor by regulations; Meeting of Executive Council 3 5 (1) The Executive Council shall meet at least once inthree months. (2) The Chainnan or in his absence, the Co-chairman or in the absence of both, the Vice Chairman shall preside over the meetings. (3) All meeting of the council shall be called by the Secretary at fifteen days notice (4) If any three members of the Council desire a meeting to discuss a matter of urgent importance, the Secretary shall call a meeting forthwith and the requirement of fifteen days notice shall be deemed to have been waived (5) Two Nulmembers shall constitute quorum (6) If any three members of the Committee desire a meeting- to discuss a matter of urgent importance, the Secretary shall be call a meeting and the requirement of fifteen days notice shall be deemed to have been waived (7) One-third members shall constitute quorum (8) All questions shall be decided by majority of members present and voting (9) Eachmembers shall have one vote and in case of tie, the Presidin-g Officer shall have an additional casting vote. (10) Ifbusiness of the committee has to be transacted urgently without waiting for a formal meeting to take place, the Chancellor may authorize the circulation of question to the members for decision, which shall be deemed as valid decision of the Committee for action; however such decision shall be circulate at the earliest to all concern for information and compliance (11 ) All other details relating to the conduct ofthe meetings, fiction etc, of the finance Committee shall be as per regulation; Adhoc Committee 43. Theuniversity shallhavet he power to constituteAdhoc Committee for any purpose connected with the affairs of the Universitv and such Committee shall oresent their report to the Chancellor the reports are advisory in nature and wherever feasible shall be acted upon by the University, Board of Studies 44 (1) For eachDepartment/Faculty, the University shall establish a Board of Study which shallcompnset he following: (i) Senior most member of the academic community in the DepartmenVFaculty concerned as the Chairman; (u) Thenext senior most member ofthe academic community inthe Department/ Faculty as member of the Board; i ) Three members of the academic community in the DepartmentiFaculty as member ofthe Board: (2) The Chairman, Vice Chairmanandmembers of the Board willb e nominated by the Chancellor; (3) The board shallmeet every quarter in a year and submit quarterly reports to theAcademic Council which shall consider the reports at the earliest and report to the Governing and Executive Councils (4) The reports of the Boards are advisory in character and mainly should relate to academic and connected at administrative matters with the utmost aim of converting the Department/Faculty into a Center of Excellence (5) All other details relating to the conduct of the meetings, functions etc of the Boards of Studies shall be as per regulation Priority amongst Councils, Committee, Boards etc 45 (1) as far as possible, the Councils, Committee, Boards under this Act and the Adhoc Committees that may be constitutedunder regulations, shall function in harmony (2) Not withstanding anythmg in this Act or any regulation made there under, any conflict between the Councils, Committees, Boards under this Act shall been deemed to have been resolved in favor of the Councilor Committee or Board which has precedence over the other as found in the following order; (i) The Governing Councils (u) TheExecutive Councils (iv) The Academic Councils (v) TheFiceC ommittees (vi) The Boards of Studies (vii) The Adhoc Committees CHAPTER VI FINANCE, CONTRACT, AUDIT ETC Nofinancial obligation on State Government 46. (1) This Act and the regulation that may be made there under shall not caste any fmancial obligation in any manner on the Government ofNagaland or its agencies, all expenditure called for the implementation of this Act and the regulations shall be exclusively borne by the University (2) Nothing herein shall be deemed to prevent the Government ofNagaland for contributing on giving a grant to the University for promoting academic excellence. Funds of University 47. The University shall operate the following two funds namely; (i) The Endowment Fund (ii) The General Fund Endowment Fund Endowment Fund 48 (i) as the University has already set up an Endowment Fund with Rupees One Crore to begin with, into which, further amounts, as determined by the Government by the Governing Council shall be credited every year (ii) The University shall have power to invest the Endowment Fund in such manners as may beprescribed by regulation (3 The interest, dividends on other forms of growth ofthe money from the Endowment Fund on account of deposits, investments etc shall be credited to the Endowment Fund (4) When a resolution by the Sponsonng Bodies or an Act by the Nagaland Legislat~veAssemblyfo rdissolution of the University ispassed, all Moneys in the General Fund and all otherreceipt ofthe Universityonall others, shall stand transferred to the Endowment Fund for exclusively applying the Fund for the proposes of rehabilitating the students and other affected by such dissolution; Provided that the quantum of moneys in the Endowment Fund shall be reviewed on a five yearly basis by the Governing Council and at the end of such review, if the fimd position is found to be reasonably comfortable, one-third of moneys in the Endowment Fund may be withdraw and credlted to the General Fund for purpose of developing of infrastmctural of the University of two-thirds of the members ofthe Governing Council vote in favor of such a proposal Provided further that no such transfer as in the first provision shall be made once a resolution or an Act for dissolving the University has been passed Generalf und, 49 (1 ) The University shall also set up a General Fund into which the following shall be credited: (i)C ontributions and grants made by Sponsoring Bodies; (ii) Contributions andgrants made by Government ofNagaland; (iii) Contributionsa nd grants made by the University Grant Commission; (iv) Contributions and grants made by the Central Government; (v) Contributions and grants made by other organization inIndia and aboard, subject to laws in force; (vi) Bequests, donation, endowments or other grant made by other grants made by private individuals and organization; (vii) Income received by the University on account of fees and other charges; and (viii) Amount received fiom any other sources. The funds shall be deposited in a banking institution or held in shares, (2) securities, debentures or in any other from as may be determined by regulation and as far as possible they may be held in such form which does not pose serious risk. (3) The funds shall be operated exclusively for the purpose ofthe University in such manner as may be prescribe by the regulations. Funds for sponsored schemes (50) The contributions, funds, amounts, grants received for a sponsored scheme shall not be credited to the University Fund but shall be kept separately and utilized only for the purpose of the scheme. The staff required to execute the sponsored scheme shall be recruited in accordance with the terms and condition stipulated by the sponsoring organizations Annual accounts and audit: (51) 1. The Annual Account of the University shall be prepared by the Finance Officer under the direction of the Executive Council 2. The accounts ofthe University shall be audited everyear by certitied auditors duly appointed by the Executive Council; 3. The annual accounts and the audit reports shall be first approved by the Finance Committee before presented to the Governing and Executive Comcik 4. The Executive Council and the Governing Council, in that order, consider the annual accounts and audit reports and make recommendations in regard thereof for further action by the Finance Committee which shall give an Action Taken Report to the Goveming and Executive Councils at the earliest Financial estimates: 52 O The annual budget for a financial year shall be prepared by the 'Finance Committeew eU before the commencement ofthe financial Year (2) The budget will thereafter be considered by the Executive Council and then finally approved by the Governing Council (3) Expenditure in excess of the budget in a financial year in extra ordinary circumstances shall be incurred only with the approval of the Executive Council (4) Such excess expenditure shall further be approved by the Governing Council at the time of approving the annual budget for the next financial Execution of contracts: 53. (1) all contract relating to the management and administration of the University shall be expressed to have been made by the Executive Council the Vice Chancellor shall execute contracts above rupees ten lakhs and the Registrar shall do so in all case all contracts shall be executed with the prior approval of Pro Chancellor Nothing herein shall be deemed to prevent the Registrar, with the prior (2) approval of the Pro Chancellor to delegate some of his contracting power to the Finance Officer. CHAPTER W RECRUITMENT AND CONDITION OF SERVICE OFE MPLOYEES Recruitment and conditions of service of employees 54 (1) Subject to the provisions of this Act, all officer and employees of the University shall be recruited under awritten agreement (2) Oscers and employees shall hold the posts of which they are recruited as per terms and condition prescribed in regulations Preference to persons from the Sponsoring Bodies 5 5 (1) Personwho are bona fide members of theNagalandBaptist Church Council and the Council of Baptist Church in Northeast India shall be given preference over others in the matter of recruitment to all posts, subject to Mlmento f the qualifications terms and other conditions ofthe appointment prescribed in regulations The Executive Council has aright to relax the qualifications, terms and other (2) condition of appointment to various posts in the University in favors of persons who are bona fidemembers of aforesaid Sponsoring Bodies without grossly compromising merit. Provident Fund and Pension 56 (1) The University shall constitute for the benefits of its employees such provident and Pension Fund and provide such insurance scheme as it may deem fit in such manner and subject to such condition as may be prescribed. CHAPTERVIII ANNUAL REPORT DIRECTIVE AM) DISSOLUTION Annual report 5 7 (1) The Annual Report ofthe University shall be pr@ by the Executive Council and approved by the Government Council, theAnnual Report shall be sent to the Chancellor who shall cause it to be laid before the Nagaland Legislative Assembly. (2) Ifthe University has off-campus in another State or off-shore campus in another country, the Annual Report shall also be sent to the Government of the State or foreign country. Directives by the State Government 58 (1) The Government ofNagaland has power to give directive to the University . . ifmismanagement, m a l m o n ,in discipline crisis and failure to comply with this Act and regulations made there under, come to notice of the Government of Nagaland (2) The University shall comply with all the directives given to it by the Government of Nagaland. Dissolution 59 (1) Ifaresolution by the hlghest decisionmaking body ofthe Sponsoring Bodies is passed for the dissolution ofthe University or a Bill for repeal ofthis Act is passed by the Nagaland Legislative Assembly and assented to by the Governor of Nagaland ,f or gross inability of the University to cany out its functions inaccordance with this Act and regulations made there under, the University shall stand dissolved within one years of the passing of the resolution or the Act; Provided that any such resolution passed by the Sponsoring Bodies may be rescinded by it before the expiry of one year for the date of passing of the ongmal resolutions. (2) The dissolution shall not affected the pursuit of course by students but no further enrolment of students shall take place fromihe date of passing of the resolution or Act and iffor any reason, such continued pursuit of course by students is not possible, the Sponsoring Bodies shall take necessary steps for transferring the studies of students to other institution to other institutions, organizations or Universities etc, in consultation with UGC etc, or provide reasonable financial compensation in lieu thereof, as may be determined by the Government Council of the University, (3) The money in the Endowment Fund ofthe University shall be exclusively applied forthe purpose of rehabilitating the students and other affected by the dissolution ofthe University (4) The State Government shall have overriding power to monitor an ensure the implementation oftheprovisions in this Section and, in case of any failme of the University to discharge its obligation, it shall take over the funds, property and other assets of the University, at any time, for fulfilling the obligations either by itself or by appointing an agency on its behalf. (5) Mera ll the obligations under this Section have been met, the remaining funds, assets and liabilities ofthe University shall stand transferred to the Sponsoring Bodies immediately. CHAPTERM REGULATION Regulation 60 (1) All matter relating to the conduct of affair of the University not expressly provided for in thisAct indetails, shall be provided fir in the regulations of the University (2) The Executive Council shall make all draft regulations (3) While mahgd rafi regulations 'which affect the power, functions, authority and other relating matters of officers, Councils, Committees, Boards, Employees etc ofthe University, the Executive Council shall provide an opportunity of being heard to the affected parties. (4) All draft regulations made by the Executive Council by majority shall have to be approved by the Government Council by two-thirds majority of members present and voting for coming into effect. (5) All regulation approved by the Governing Council shall be notified in appropriate fonn. (6) A copy of the regulations shall be circulate to all concerned in the University. A copy of the regulations shall also be sent to the Chancellor, State and foreign Government concerned. (8) All regulations, as soon as made, shall be laid before the Nagaland LegislativeA ssembly whichmay annul or amend the regulations by motions by simple majoritywithin 90 days of laying. If the regulation are annulled or amended by the Nagaland Legislative (9) Assemblv. thevwill be of no effect or of amended affect, as the case may be, fi-om the date of passing ofthe motions for annulment or amendment.

The University must get and keep accreditation, obtain required prior approvals or recognition, and comply with other applicable laws and standards.
CHAPTERX MISCELLANEOUS Accreditation and compliance with laws 61 (1) The University shall seek, obtain and retain accreditation fi-om respective national accreditation bodies for all its course and prom- amme of study, as required under the University Grants Commission Act,1956 and the University Grant Commission. (2) The University shall obtain prior permission1r ecognition from bodies lie all Council of India, National Council for Technical Education, Bar Council of India Distance Education Council, Dental Council of India, Indian Nursing Council, Medical Council of lndia, National Council for teacher Education, Pharmacy Council of Indiaetc, for its course and programmes of study. (3) The University shall also comply withal other laws, rules, regulations in force in regard to maintenance of educational and other standards m the University Acts not invalidated on ground of defect etc 62 Not Act of Proceedings ofthe University shall be invalidated merely on the ground that the a Council, Committee, Board or any other authority ofthe University has not been duly constituted or there is avacancy in such Council etc, or on ground of any technical defect or demerit in this Act or regulations made there under or on ground of any irregularity in service of notice of meetings etc Transitory powers 63 Until the Councils. Committees. Boards etc. and the officers and emvlovees of the University are established or appointed, the Vice Chancellor, dischargi all the duties under this Act and no action taken by him shall be questioned on -m ound that the procedure laid down in this act has not been follow. Provided that the transitory powers as aforesaid shall be available only for one year fiom the date of commencement of this Act. Removal of doubts 64 (1) Nothing in this Act shall be constmed as transferring fiom the Sponsoring Bodies to the University any right of ownership or possession, if any, held over, or in respect of, the institute established by it other than the University established under this Act. (2) if any difficulty arise in giving effect to the provision ofthis Act, the State Government may by order, make such provisions, not inconsistent with the provisions ofthis Act, as appear to it to be necessary or expedient, for removing the diiculties. Provided that, no order under sub-section (2) shall be made afler the expiration ofaperiod of five years from the commencement of this Act. (3) every order made under sub-section (2) shall, as soon as may be, laid before the Nagaland Iegislative assembly which may annul or amend the orders by motion by simple majority within 90 days of lying. (4) if the orders are annulled or amended by the Nagaland Legislative Assembly, they will be of no effects as the case may be, from the date of passing of the motion for annulment or amendment. Protection of acts 65. No suit, prosecution or other legal proceedings shall lie against, and no damages shall be claimed from the Officers, Councils, Committees, Boards, Employees and other authorities ofthe university in respect of anything done or purported to have been done in good faith in pursuance of this Act or any regulation made there under.
