About this statute

This Act is called the Code of Criminal Procedure, 1973, applies across India with stated exceptions, and sets out courts’ and police powers, magistrates’ roles, prosecutor appointments, and some public reporting duties. This part sets out when police, private persons, and Magistrates may arrest people, and what must happen after arrest, including informing the arrested person, taking them before a Magistrate, and not holding them without warrant for more than 24 hours (subject to exceptions). This provision lets certain magistrates order immediate restoration of an abducted or unlawfully detained woman or minor girl, and sets rules for search warrants, searches, seizure, witness attendance, and related reporting. The provision lets Magistrates order monthly maintenance payments, manage and enforce those orders, and gives police and Magistrates powers to disperse assemblies, control public nuisances, issue urgent preventive orders, and investigate offences. Police and magistrates have powers and duties for searches, custody, reports, death inquiries, and court jurisdiction rules.
