This Act amends the Mizoram Road Fund Act, 2007 and starts on publication in the Official Gazette.

No. NE-313(MZ) 2006-2008 VOL - LI Aizawl, Thursday 17.03.2022 Phalguna 26, S.E. 1943, Issue No. 157 NOTIFICATION No. H.12018/179/07-LJD, the 16th March, 2022: The following Act is hereby published for general information. “The Mizoram Road Fund (Amendment) Act, 2022” (Act No. 3 of 2022) (Received the assent of the Governor of Mizoram on 8.3.2022) THE MIZORAM ROAD FUND (AMENDMENT) BILL, 2022 AN ACT Further to amend the Mizoram Road Fund Act, 2007 Be it enacted by the Legislative Assembly of Mizoram in the Seventy Second Year of the Republic of India as follows, namely :- 1. Short title, extent and Com- 1) This Act may be called the Mizoram Road Fund (Amendment) mencement:- Act,2022. 2) It shall have the like extent as the Principal Act. 3) It shall come into force from the date of publication in the Official Gazette. 2) Amendment of section 2 :- In section 2 of the Mizoram Road Fund Act, 2007 (hereinafter referred to as the Principal Act) 1) After Clause (h), a new clause shall be inserted, namely:- (i)(A) “Manager (Finance) means an officer appointed for the purposes of section 7 of this Act.” 2) Clause (r) shall be substituted by the following namely:- “(r) “Road” means all roads in Mizoram, other than National Highways declared under National Highway Act 1956 (Central Act No. 48 of 1956) which are maintained by the Road Agency, and including bridges, and other things that facilitate such passage.” 3) Clause (s) shall be substituted by the following, namely:- Ex-157/2022 - 2 - - 3 - Ex-157/2022 “(s) Road Agency” means PWD which is a body responsible for carrying out repair, maintenance, rehabilitation, strengthening and construction of roads and bridges”. 3) Amendment of section 4 :- In section 4 of the Principal Act :- (1) In sub-section (2) the words “a body corporate” shall be sub- stituted by the words and symbol “an autonomous body having separate powers, objectives and functions of its own.” (2) sub section 4 shall be substituted by the following namely : “(4) The Board shall consist of the following members namely: MEMBERS DESIGNATION a) Minister, PWD Chairman b) Chief Secretary Vice Chairman c) Secretary, PWD Member Secretary d) Finance Commissioner Member e) Secretary & PCCF Member f) Secretary, Planning Member g) Secretary, L& J Member h) Secretary, Transport Member i) Secretary, Commerce & Industries Member j) Secretary, LR & S Member k) Engineer-in-Chief, PWD Member l) Commissioner, AMC Member m) I.G.P Member n) 1 Representative from LADC Member o) 1 Representative from MADC Member p) 1 Representative from CADC Member q) Commissioner of Taxes, State Tax Member r) CE(Roads), PWD Member s) CE(Highways), PWD Member t) CE(Buildings), PWD Member u) CEO, MRFB, Sectt. Member v) Director, Transport Department Member w) Director, Geology & Mineral Resources Member x) 3 Representatives from Stake holders Member y) 4 Representatives from NGOs Member (3) Sub-section (11) shall be substituted by the following, namely:- “(11) The Board shall have a Secretariat, headed by Chief Executive Officer, not below the rank of Chief Engineer on deputation from Road Agency, with responsibility to carry out administrative and technical tasks for the Board and the Executive Committee and any other tasks as may be directed by the Board and the Executive Committee from time to time: Ex-157/2022 - 2 - - 3 - Ex-157/2022 Provided that an officer of Road agency not below the rank of Selection Grade will be eligible to be appointed on deputation as Chief Executive Officer.” 4) Amendment of section 5 In clause (b) of sub-section (2) of section 5 of the Principal Act,after sub clause (vii) a new sub clause(viii), (ix) and (x)shall be inserted as follows,namely:- “(viii) seeking convergence of road maintenance with other schemes/agencies; (ix) impart capacity building, in-house facilities and training of the road agencies; (x) recommend and review Road Safety issues”. 5) Amendment of section 7 In sub-section (1) of section 7 of the Principal Act, the words “the Vice Chairman and the Member Secretary” shall be substituted by the words “Chief Executive Officer and Manager (Finance) of the Board Secretariat” respectively.
