This part names the Act, says it applies across India with one stated territorial exception, and lists key definitions used in the Act. This segment says certain transfers and securities transactions are not liable to stamp duty, and it sets out who must collect or pay duty, how duty is paid, and what powers the Government and Collector have. Certain recipients must give stamped receipts on demand, and unstamped or insufficiently stamped instruments are generally not to be admitted, acted on, registered, or authenticated unless the Act’s exceptions apply. If an instrument is undervalued for stamp duty, the registering officer must refer it to the Collector, and the Collector may assess value, require extra duty, interest, and penalties, or certify it as duly stamped. The Central Government can issue directions and authorise SEBI or the RBI to issue instructions, circulars, or guidelines for Part AA of Chapter II. State Governments can make rules about stamp sales, publish rules, delegate certain powers, and must provide low-cost translations of the Act.
