THE SALARY AND ALLOWANCES OF LEADER OF OPPOSITION IN THE NAGALAND LEGISLATIVE ASSEMBLY ACT, 1992. (THE NAGALAND ACT NO. 5 OF 1992) Received the assent of the Governor of Nagaland on 25-4-92 and published in the Nagaland Gazette extraordinary Dated. 1-5-92. An Act. to provide for the salary and allowances of Leader of Opposition in the Nagaland Legislative Assembly. WHEREAS, it is expedient to provide for determination of salary and allowances of the Leader of Opposition in the Nagaland Legislative Assembly. It is hereby enacted in the fortythird year of the Republic of India as follows: Short title and commencement. 1. (1) This Act may be called the Nagaland Salary and Allowances of the Leader of Opposition in the Nagaland legislative Assembly Act, 1992. (2) It shall come into force on such date as the State Government may, by notification in the official Gazette, appoint. Definition. 2. In this Act, unless there is anything repugnant in the subject or context (a) “Leader of Opposition” means a member of the State Legislative Assembly, who is for the time being, the leader in the State Legislative Assembly of the party in opposition to the ruling Government having the largest and required numerical strength and recognised as such by the Speaker of the Assembly. Salary of Leader of Opposition. 3. (1) There shall be paid to the leader of the opposition a salary of Rs. 1,250/- (Rupees One thousand two hundred and fifty) only per mensum equivalent to Cabinet Ministers. Residence of Leader of Opposition. 4. (1) The Leader of Opposition shall, so long as he continues as such leader, be entitled without payment of rent to the use of free furnished residence. (2) Such residence shall be maintained at the public expenses which shall not exceed the amount prescribed by rules. Conveyance and Conveyance allowance for Leader of Opposition. 5. The Leader of Opposition shall be entitled to a conveyance and conveyance allowance as entitled to a Cabinet Minister so long as he remains Leader of Opposition. Travelling and Daily allowance. 6. The Leader of the Opposition shall be entitled while on official tour travelling and daily allowances at the rates applicable to a Cabinet Minister Provided that such official tour is approved by the Speaker of the Nagaland Legislative Assembly. SecretariaI Assistants and facilities. 7. The following Secretarial Assistants and facilities shall be entitled to the Leader of the Opposition: (a) P.A. cum-Stenographer. -1 No. (b) Office Peon. -1 No. (c) Telephone without STD in Office. -1 No. (d) Telephone without STD in Residence. -1 No. Notification respecting the date on which a person becomes or ceased to be Leader of Opposition to be conclusive evidence thereof. 8. The date on which a person becomes or ceased to be a Leader of Opposition shall be published in the official Gazette and any such notification shall be conclusive evidence of the fact that he become or ceased to be the Leader of the Opposition on that date for all the purposes of this Act. Power to make rules 9. (1) The State Government may, by notification in the official Gazette, make rules for carrying out the purpose of this Act, (2) All rules and orders made under this Act shall be laid before the Nagaland Legislative Assembly, as soon as may he, after they are made arid shall be subject to such modifications as the Legislative Assembly may make.
