Act to provide for establishment and incorporation of the Himalayan University, ftanagar in the State of Arunachal Pradesh and mafters connected therewith and i ncide ntal th e reto. Whereas, with a view to keep pace with the rapid development in all spheres of knowledge in the world and the colotry it is essential to create world level modern research and study facilities in the Stale to provide the State ofthe art ofeducational facilities to the youth at theirdoor steps so that they c€rn make out of them human resources compatible to liberalized economic and socialorder ofthe world; And whereas, rapid advancement in knowledge and changing requirements of human resources makes it essential that a resourceful and quick and responsive system of educational research and development be created which can urork with entrepreneurialzealunder an essentialregulatory setup and such a system can be created by allowing the private institutions engaged in higher education having sufficient resources and institutions engaged in higher education having sufflcient resources and experience to establish uBiversities and by incorporating such universities with such regulatory provisions to ensure efficient working of such institutions, And whereas, the Jeen Foundation , New Delhi, a Non-Profit organization registered under section 25 of the CompaniesAct, 1956 having its registered office at New Oelhi is engaged in the field of education for which are imparting education in the various disciplines; And whereas, the said Jeen Foundation has agreed to establish the said facility in a Univercity for research and studies in the disciplines specified in the Schedule . and shall also deposit an amount of rupees three crore to be utilized in establishment of an endowment fund in accordance with the provisions of this Act ; 257 And vhereas, if the said Jeen Foundation is allowed to run the University, it would contribute a long in the academic development of the people of the State; Now, therefore, be it enacted by the Arunachal Pradesh Staie Legislature in the Sixty{hird Year of the Republic of India, as follows:- 1, Short title, extent and commencement:-(1) This Act may be called the Himalayan University ltanagar (Arunachal Pradesh) Act, 2012. (2) ' lt extends to the whole of the State ofArunachal Pradesh. (3) lt shall come into force on such date as the State Govemrnent by notrfication in the Official Gazette appoint. 2. Definitions:- In this Act, unless the context otherwise requires, - (a) "AlCTE" meansAll lndia Councilof Technical Education established underAll lndia Councilof Technical EducationAct, 1987 (CentralAcl No.52 of 1987); (b) "CSIR' means the Council of Scientific and Industrial research;t{ew Delhi- a funding agency of the Central Govemment; (c) 'DEC'means the Distance Education Council establ,shed under section 28 of lndira Gandhi National Open UniveEity Act, 1985 (cenkalAot No. 5o to rsesl; (d) "Distance education' means education imparted by combination of any two or more means of communication, viz broad casting, telecasting, correspondence courses, seminars, contact programmes and any other such methodology; (e) "DST" means the Department of Science and Technology of the . CentElGovemment; (D "employee" means a percon appointed by the University to work in the University and includes teachers, officers and other emplayees of the University; (g) "fee" means collection made by the University from the students by whatever name it may be called, which is not refundablei (h) 'Govemmenf means the Slate Govemment ofArunachal Pradesh; (i) "higher education" means study of a curriculum or course for the pursuit of knowledge beyond 10+2 level; 258 (j) "hostel' means a place of residence for the studenb of the University, or its colleges, institutions or centers, maintained or recognized to be as such by the University; (ll) 'ICAR' means the lndian Council of Agriculture Research, a society registered under the Societies Registration Act, 1860 (CentralAct No. 21 of 1956); (l) 'MCl" means Medical Council of lndia constituted under section 3 of the Indian Medical CouncilAct, 1956 (CentralAct No. 102 of 1956); (m) "NAAC" means the NationalAssessment and Accreditation Council, ' Banglore an autonomous institution of the UGC; (n) "NCTE" means the National Council of Teacher Educatjon constituted under section 3 of the National Council of Teacher Education Act, 1993 (CentralAct No. 73 of 1993); (o)'ofi campus centea means a centre of the University established by it outside the main campus operated and maintained as its constituent . -_ unit, having the University's complement of facilities, faculty and staffl (p) 'PCl' means Pharmacy Councilof lndia constituted under section 3 of the PharmacyAct, 1948 (CentralAct No. 8 of 1948); (q) "prescribed' means prescribed by Statutes made under this Act; (r) "regulating body" means a body established or constituted by or under any law for the time being in force layrng down norms and @nditions for ensuring academic sEndards of hrghereducation, such as UGC, AICTE, NCTE, MCI, PCI, NAAC, ICAR, DEC, CSIR, etc, and includes the State Government; (s) " rules" means the rules made under thisAct; (t) "schedule" means the Scheduleto this Act; (u) "sponsoring Body" means the Jeen Foundation, New Delhi a non- profit company registered under section 25 of the companies Act 1956 having its registration number ; (v) "Satutes", "Ordinances' and "Regulations' mean respectively, the Statutes, Ordinances and Regulations of the University made under this Act; ,EO (w) 'student of the University" means a person enrolled in the University iortaking a course of study for a degree, diploma or otheracademic distinction duly instituted - by the University, including a research degree: (x) 'study centre" means a centre established and maintained or recognized or approved by the University for the purpose of advrsing, counseling or for rendering any other assistance required by the st-rdents in the context of distance education; located \Mithin or outside the State ofArunachal Pradesh in lndia and abroad. Such centers shall be designated as Academic centers and shall function independently within the framework of the University rules and regulations; (v) "teacher' means a Professor, Reader, Lecturer or any olher person required to impart educaton or lo guide research or to render guidance in any other form to the students for pursuing a course of study of the U niversity; (z) "UGC' means the University Grants Commission, established under section 4 of the University Grants Commission Act, 1956 (Central Act No. 3 of 1956); and (aa) "Universih/ means the HIMALAYAN University, ltanagar, Arunachal Pradesh. (ab) 'Counseling Cente/'means a centre established and maintained or recognized by the University for the purpose of advising, counseling orfor rendering any other assistance required by the students in the context of distance education: (ac) "Affiliation" means and includes recognition of institutions,colleges and schools, association oflnstitutions, Colleges and schools Dcated in or outside the State ofArunachal Pradesh including overseas, and admission of such institutions, colleges and schools under the University for the purpose of conducting the formal and informal educational, professional and vocational programs of the University. (ad) "Course' includes programs and courses of studies imparted in the formal mode and / or in the informal (nonjormal)/ distance education mode and / or in the virtual campus in the institution, college, school and/ or Study Centre of the University. 260 (e) "OFF-Campus program center" means and includes an institutions, college, s-chool in or outside Slate of Arunachal Pradesh or in any ',. part of lndia or abro€d authorized by the University in witing tc conduct all or any number of programlcourses offered by the University according to the rules and regulations as prescribed by the University and /or terms and conditions as may be specified by the University and agreed upon by the Institution, College or School. (aD "Regional Campus" means the campus of the University Colleges, lnstitutions and Schools located in and outside ltanagar, inside the Slate of Arunachal Pradesh or in any part of lndia and/or abroad. Such regional Campuses for convenience shall be properly designated. (ag) "Virtual Campus" includes the education/courses/programs provided to students through E-learning^,vebsite/CD-ROM etc. 3. lncorporation: (1) The first Chancellor and the first Vice- Chancellor of the University and the first members of the Board of Managementand the Academic Counciland allpersons who may hereafter become such officers or members, so long as they continue to hold such office oI membership, are hereby constituted a body corporate by the name of HIMALAYAN University, ltanagar, Arunachal Pradesh. (2) The University shall have perpetual succession and a common seal and shall sue and be sued by the said name. (3) The University shall situate and have its headquarters at ltanagar, Arunachal Pradesh. (4) The University shall be autonomous body. 4, Powers and functions of the Unive6ity : The University shall have thefollowing powers and functions, namely:- (i) to provide for instruction in the disciplines specified but not limited in Schedule and to make provisions for research and for the advancement and dissemination of knowledge; (ii) to grant, subject to such conditions as the University may determine, diplomas or certificate, and conferdegrees or other aca- demic distinctions on the basis of examinations, evaluation to any other method oftesting on persons, and to withdraw any such di- plomas, certificates, degrees orotheracademic distinctions for good and sufflcient causei 261 (iii) to organize and to undertake extra-mural studies and extension service; (iv) to confer honorary degrees or other distinctions in the manner prescfibed; (v) to provide instruction, including conespondence and such other courses, as it may determlne; (vi) to institute Professorships, Readerships, Lectureships and other teaching or academic posts required by the University and to make appointrnent thereto; (vii) to create administrative, academically and other posts and to make appointments thereto; (viii)to appoint persons working in any other university or organization having specific knowledge permanently orfor a specified period; (ix) to co-operate, collaborate or associate with any other university or authority or institution in such manner and for such purpose as the University may determine; (x) to establish study centers and maintain schools, institutions and such centers, specialEed laboratories or other units for research and instructions as are in the opinion of the University, necessary for the furtherance of its object; (xi) to insttute and award fullowships, scholarships, studentships, medals and prizes; (xii) to establish and maintain hostels for students of the University; (xiii) to make provisions for research and consulbncy, and for that purpose to enter into such arrangements with other institutions or bodies as the University may deem necessary; (xiv) to determine standards for admission into the University, which may include examination, evaluation or any other method of testing; (xv) to demand and receive payment offees and other charges; (xvi) to supervise the residences ofthe students ofthe University and to make arrangements for the promotion of their health and general wetlare; 262 (xvii) to make special arrangements in respect of women students as the University may consider desirable, (x/iii) to regubte and enforce discipline among the employees and students of the University and take such disciplinary measures in this regard as may be deemed necessary by the University; (xix) to make arrangements for promoting the health and generalwelFare ofthe employees of the University; (xx) to receive donations and acquire, hold, manage and dispose ofany movable or immovable property. (xxi) to borrow money with the approval of the Sponsoring Body for the purposes of the University ; (xxii) to mortgage or hypothecate the property of the University with the approvalofthe Sponsoring Body ; (xxiii) to establish examination centers Counseling c€nters; information ; centers ; (r<iv) to set up off campus cenhe or information centers within the State ofArunachal Pradesh and/or any part of lndia and Abroad ; and (xxv) to do all such other acts and things as may be necessary incidental or conducive to the attainment of all or any of the obiects of the University. (xxvi) to establish a campus at ltanagar in the SEte of Arunachal Pradesh and to have atfiliated institutions, colleges, schools, and approved study centers Academic Centers, off Campus program Centers / lnstitutions and to establish Regional Campus(es) at different places in lndia and other countries. (xxvii) to create higher levels of intellectual abilities. (xxviii) to establish state of the art facilities for education, training and research. (xxix) to offer programs through multi modalform of educatioo. (xxx) to institute degrees, diplomas, certificate and other academic distinctions on the basis of examination, or any other mode of evaluation and assessment as laid down by the acedemic council. (x)o(i) to ensure that the standard of the degrees, diplomas, certificate and other academic distinctions of high standard. 263 ()oodi) to offercontinuing distance education both formaland /or informal ()oqiii) to confer honorary deg rees and other academic distinctions in the manner laid down in the statutes. (xqiv) to encourage and promote research acwites and set up independent research institutions for pure and applied research, and institute awards and fellowship at institutions other than the University for underhking research. ()oory) to afiliate orcolhborate with any other college or university, research institution, industry association, professional association or any other organization, in lndia or overseas, or conceptualize, design and develop specific educational and research programs, training programs and exchange programs forstudents, faculty members and others. ()C/J(VD to recognize the various courses and programs offered by the individuals, institutions, and organizatioDs in various streams of education offered in the multimode methodology of teaching. ()ooi) to undertake surveys, studies and consultancy for any organization in lndia or overseas. (Dfrviii) to undertake programs of the training and development of faculty members of the University and other institutions in lndia or overseas. 0oodx) to undertake collaborative reseafth with any organization in India or overseas, and undertake commerciali2ation of technologies. (XL) to develop, register and license all forms of intellectual property righb, including, inter alia, trademarks, copyrights, know-hovv and patents etc. (XLl) to conceptualize, design, develop and comrilercialize various products, equipment and machinery as part of the research ani, development activity. (XLll) to provide "Education For All" which includes Formal modes of instruction keeping in view the literacy and the educational needs of deprived sections of the society by estabtishing informal educational centers in and outside the State ofArunachal Pradesh, to achieve cent per cent literacy and education at least up to the level of Matriculation. 264 (XUll) to bring higher education within the reach of Majority of the youth aspiring higher qualification and/or research by a network of formal institutions such as regional campuses, off-campus programme centers and academic centers throughout the country in accomplishment of the prime objective "Desired Education ForAIl". (XLM to encourage sports, cultural, extra curricular and co-curricular activities for students and staff. (xLV) to do all things necessary or expedient to promote the above ob.iectives. (XLM) to pursue any other objective as may be approved by the Board. 5. UniveEity to be self-financed : The University shall be self financed and shall not be entitled to receive any grant or other financial assistance from the State Govemment. 6, Power of affiliation : The University shall have powerto affiliate or collaborate with any other college oruniversity, research institution, industry association, professional association or any other organization, in lndia or overseas, or conceptualize, design and develop specific educational and research programs, training programs and exchange programs forstudents, faculty members and others or otherwise admit to its privileges to any other institutions. 7. Endowment Fund : (1) There shallbe established an Endowment Fund with an amount of rupees three crore which has to be deposited by the Sponsoring Bodywith the State Govemment. (2) The Endowment Fund shall be used as security deposit to ensure that the University complies with the provisions of this Act and functions as per provisions of this Act, Statutes and Ordinances. The State Government shallhave the powers to forfeit in the prescribe mannel a partorwhole ofthe Endowment Fund in case the University or the Sponsoring Bodycontravenes and of the provisions ofthis act or Stiatutes, Ordinances, Regulations or rules make thereunder. (3) lncome from the Endovwnent Fund may be utilized frcr development of infrastructure of the University but shall not be utilised to meet out the recurring expenditure of the University. zb3 (4) The amount of the Endowment Fund shall be invested and kept invested until the dissolution of the university in long term Rxed deposit or deposited or kept deposited until the dissolution of university in any Scheduled Bank in the Joint Account operated by the State and the Sponsoring Body. (5) The certmcates of the securities shall be kept in the safe custody of the Slate Govemment and deposit in the interest bearing Personal Deposit Account in Bank, the deposit shall be made with the conditbn that the amount shall not be withdrawn without the permission of the State Govemment. 8. Goneral Fund : The University shallestablish a fund, which shall be called the General Fund to which following shall be credited, namely:- (a) fees and other charges received by the University; (b) any contributions made by tle Sponsoring Body; (c) any irEome received from consultancy and other wo* und€rtaken by the University in pursuance of its obiectives; (d) trusts, bequests, donations, iindowments and any other grants; and (e) all other sums received by the 0niversity. j 9. Application of General Fund The General Fund shall be utilized for meeting all expenses, recuning or non-recuning in connection with the affairs of the University: Provided that no expenditure shall be incuned by the University in excess of ttre limits for total recuring expenditure and total non-recuning expenditure for the year, as may be fixed by the Board of Management, without the prior appro\ral of the Board of Man€gement. 10. Officers of the Univeraity : The following shall be the officers of the University, namely:: (i) the Chancellor; (ii) theMce€hancellor; (iii) the Pro-Mce-Chancellor; (rv) the Provost; M the Proctor; 266 (vi) the Deans of Faculties; (vii) the Reglstrar; (viii) the Chief Finance and Accounts Officer; and (ix) such other officers as may be declared by the statutes to be the officers of the University. 11. The Chancellor : (1) The Chancellor shall be appointed by the Sponsoring Body for a period offive years from the date on which he enters upon his office and shall be eligible for re-appointment; Provided that a Chancellorshall notwithstanding the expiration of his term continue to hold office until his successor enters upon the office- (2) Any vacancy in the office of Chancellor shall be filled within six months from the date ofsuch vacancy. (3) The Chancellor shall, by virtue of his office, be the head of the University. (4) The Chancellor shall, if present, preside at the meetings of the Board of management and at lhe convocation of the Un iversity forconferring degrees, diplomas or other academic distinctions. (5) The Chancellor shall have the following powers, namely:- (a) to call for any information or record in connection with the affairs of the University; (b) to appoint the Vice-Chancellor; (c) to remove the Vice-Chancellor; (d) such other powers as may be prescribed by the Statutes or Goveming Body. (e) ln absence of the Vice-Chancellor due to any reason, the Chancellor can appoint any suitable person to perform all the function ot the Mce-Ghancellor. (0 The office of the Chancellor may be located anywhere in lndia or overseas. 12, The Vice-Chancellor : (1) The Vice-Chancellor shall be appointed by the Chancellor from a panelofthree persons recommended by the Board of management and shall, subject to the provisions contained in sub-section (8), hold office for a term ofthree years: zol Provided that, after expiry ofthe term of three years, a person shall be eligible for re-appointment for another term of three years: Provided further that a Vice-Chancellor shall notwithstanding the expiration of his term continue to hold office until his successorenters upon the otfice. (2) Any vacancy in the office of Vice-Chancellor shall be rilled within six months from the date of such vacancy. (3) The Vice-Chancellor shall be the principal executive and academic offrcer of the Universityand shallexercise generalsuperintendence and control over the atfairs of the University and shall execute the decisions of the authorities of the University. (4) The Vice-Chancellor shall preside at the convocation of the U niversity in the absence of the Chancellor. (5) lf in the opinion of the Vice-Chancellor it is necessary to take immediate action on any matter forwhich powers are conferred on any other authority by oi'underthisAct, he may take such action as he deems necessary and shallat the earliest opportunity thereafter report his action to such officer or authority as would have in the ordinary course dealt with the matter : Provided that if in the opinion of the concerned officer or authority such action should not have been taken by the Vice-Chancellor then such case shall be referred to the Chancellor, whose decision thereon shall be final : Provided further that where any such action taken by the Vrce-Chancellor affects any person in the service of the University, such person shall be entitled to prefer, within three months from the date on which such action is communicated to him, an appeal to the Board of Management and the Board of Management may c,onfirm or modify or reverse the action taken by the Vice-Chancellor (6) lf, in the opinion of the Vice-Chancellor, any decision of any authority of the University is outside the powers conferred by this Act or Satutes, Ordinances, Regulationsor rules made thereunderor is likely to be pre.judicial to the interests of the University, he shall direct the concerned authority to revise its decision within fifteen days from the date of its decision and in case the authority refuse or fails to revise such decision, then such matter shall be referred to the Chancellor and his decision thereon shall be final. 268 (7) The VrceChancellor shall exercise such other powers and perform such other duties as may be prescribed by the Statutes or the Ordinances. (8) lf the Chancellor is satisfied, on an enquiry made or caused to be made on a representation made on him orotherwise, that the continuance of Vice-Chancellor in his office is prejudicialto the interest of the University or the situation so wananls, he may, by an order in writing and stating the reasons therein for doing so, ask the Vice.Chancellor to relinquish his office from such date as may be specified in the order: Provided that before taking an aclion under this sutssection, the Vice-Chancellor shall be given an opportunity of being heard. (9) lf in the opinion of the Sponsor, the actions of the Vice-Chancellor are found to be in any way detrimental to the interests of the University, the Sponsor can recommend the Chancellor to appoint such other person as may be found appropriate in the position of Vic€-Chancellor to succeed the person so acting. The Sponsor may stipulate the date from which such other peBon shall assume the offce of the Mce-Chancellor. 13. The Prc-Vice-Chancellor : (1) The Pro-Mce-Chancellor shall b€ appointed by the Chancellor. (2) The Pro-Vice-Chancellor shall hold office for a period ofthree years and shall be eligible for re-appointment for a second term. (3) The conditions of service of the Pro-Vice-Chancellor shall be such as may be prescribed by the Statutes. (4) lf the Chancellor is satisfied, on an enguiry made or caused to be made on a representration made to him or otherwise; that the continu- ance of Pro-Mce-Chancellor in his otfice is prejudicial to the interest of the University or the situation so warrants, he may, by an order in writing and stating the reasons therein for doing so, ask the Pro-Vice-Chancellor to relinquish his office from such date as may be specified in order: Provided that before taking an action under this sub-section, the Pro-Mce-Chancellor shall be given an opportunity of being heard. (5) The Pro-Mce-Chancellor shallassistthe Vice.Chancellor in such matters as are assigned to him by the Vice-Chancellor from time to time and shall exercise such powers and perform such functions as may be delegated to him by the Mce-Chancellor. 269 14. The Provost : (1) The Provost shall be appointed by the Vice-Chancellor for such period and in such manner as may be prescribed by the Statutes. (2) The Provost shall ensure discipline in the University and shall keep the various unions of the teachers and employees advised of the various policies and practices in the University. (3) The Provost shall exercise such other porrers and perform such other duties as may be prescribed by the Statutes. '15. The Proctor: (1) The Proclor shall be appointed by the Vice-Chancellor for such period and in such manner as may be prescribed by the Statutes. (2) The Proctor shall be responsible for the maintenance of discipline among the students and keep the various students' unions ad- vised of the various policies and practices in the University. (3) The Proctor shall exercise such other powers and perform such other duties as may be prescribed by the Statutes. 16, The Dean of Faculty : (1) There shall be a Dean of each Faculty who shall be appointed by the Chancellor or the Vice-Chancellor for a period of three years in such manner as may be prescribed by the Statutes. (2) The Dean shallconvene meetings ofthe faculty, as and when required, in consultation with the Vice-Chancellor and shall preside over the same. He shall formulate the policies and development programme of the faculty and presents the same to the appropriate authorities for their consideration. (3) The Dean of Faculty shallexercise such other powers and perform such other duties as may be prescribed by the Statutes. 17. The Registrar: (1) The Registrar shall be appointed by the Chancellor, in such manner as may be prescribed by the Statutes. (2) All contracts shall be signed and all documents and records shall be authenticated by the Registrar on behalf of the University. (3) The Registrar shall be the Member Secretary of the Board of Management and Academic Council but he shall not have the right to vote. (4) The Registrar shall exercise such other po/vers and perform such other duties as may be prescribed by the Statutes. 270 18. The Chief Finance and Accounts Officer: (1) The Chief Finance and Accounts Officer shall be appointed by the Chancellor or the Mce-Chancellor in such manner as may be prescribed by the Statutes. (2) The Chief Finance and Accounts Officer shall exercise such pouers and perform such duties as may be prescribed by the Statutes. 19. OtherofnceE : (1) The University may appoint such other officers as may be necessary for its functioning. (2) The manner of appointment and powers and functions of such orfficers shall be such as may be prescribed by the Statutes. 20. Authorities of the Univer8ity : The following shall be the authorities of the University, namely:- (i) the Board of Management; (ii) the Academic Council; (iii) the Faculties; and (iv) such other authorities as may be declared by the Statutes to be the authorities of the University. 21. The Board of Management : (1) The Board of Management of the University shallconsistof the following, namely:- (a) the Chancello[ (b) theMce-Chancellor: (c) five persons nominated bythe Sponsonng Bodyout ofwhom two shall be eminent educationists; (d) one expert of manag€mentor informatjon technology or law or any otherfield from outside the university, nominated by he Chancellor. (e) one expert of finance, nominated by the Chancellor; (D Commissioner, Education or his nominee not below the rank of Deputy Secretary; and (g) two teachers, nominated by the Vice-Chancellor 271 (2) The Board of Management shall be the principal executive body of the University. All the movable and immovable property of the University shall vest in the Board of Management. lt shall have the following powers, namely:- (a) to provide general superintendence and directions and to controlthe functioning ofthe University by using all such polr.ers as are provided by this Act or the Statutes Ordinances, Regulations or rules made thereunder; (b) to revie{v the decisions of other authorities of he University in case they are not in conformity with the provisions of this Act or the Srtatutes, Ordinances, Regulations or rules made t)ereunderi (c) to approve the budget and annual report ofthe University; (d) to lay down the policies to be followed by the University; (e) to recommend to the Sponsoring Body about the voluntary liquidation of the University if a situatron arises when srnooth functioning of the Universlty does not remain possible, in spite of all effo(s; and (f) such other powers as may be prescribed by the Statutes. (3) The Board of Management shall meet at least two times in a calendaryear. (4) The quorum for meetings of the Board of Management shall be five. 22. The Academic Council : (1) TheAcademic Councilshallconsist of the Vice-Chancellor and such other members as may be prescribed by the Statutes. (2) The Vice,Chancellor shall be the Chairperson of theAcademic Council. (3) TheAcademic Council shall bethe principal academic bodyof the University and shall, subject to the provisions of this Act and the rules, Regulatjons, Statutes or Ordinances, made thereunder, co-ordinate and exercise generalsupervision over the academic policies ofthe University. 272 (4) The quorum for meeting of the Academic Councilshall besuch as may be prescribed by the Statutes. 23. Other authorilies : The composition, powers and functions of other authorities of the University shall be such as may be prescribed by the Statutes. 24. Disqualification for membership of an authority : A person shall be disqualified for being a member of any of tlre authorities of the University, if he- (a) is of unsound mind and stands so declared by a competent court, (b) is an undercharged insolvent; (c) has been convicted of any offence involving moral turpitude, or' (d) has been punished for indulging in or promoting unfair practice in the conduct of any examination, in any form, anywhere. 25. vacancies not to invalidate the proceedings of any authority ofthe University:- No act or proceeding of any authority of the university shall be invalid merely because of reason of any vacancy or defect in the constitution thereof. 26. Filling up of emergent vacancies : Any vacancies occurred in the membership of authorities of the University due to death, resignation or removalofa memberor due to change of capacity in which he was appointed or nominated, shall be filled up as early as possible by the person or the body who had appointed or nominated such a member: Provued that the person appointd or nominated as a memberofan authority of the University on an emergent vacancy, shall remain memberof such authority for only the remaining period of the member, in whose place he is appointed or nominated. 27. Committee : The authorities or officers of the University may, constitute such committees with such terms of reference as may be necessary for specific tasks to b€ performed by such committees. The constitution of such committees and their duties shall be such as may be prescribed by the Statutes. 28. The Statutes : (1) Subject to the provisions of this Act, the Stiatutes of the University may provide for all or any ol the follor ring matters, :- namely (a) the constitution, powers and functlons of the authorities of the University as may be constituted from time to time; (b) the terms and conditions of appointment of the Vice- Chancellorand his powers and functions; (c) the manner and terms and conditions of appointment of the Registrar and Chief Finance and Accounts Officer and their powers and functions; (d) the manner in which and the period forwhich the Provost and the Proctor shall be appointed and their powers and functions; (e) the manner in which the Dean of Faeulty shall be appointed ' and his powers and functions; (0 the manner.and terms and conditions of appoinbnent of other officers and teachers and their powers and functions; (g) the terms and conditions of service of employees of the University and their functions ; (h) the procedure for arbitration in case of disputes betueen officers, teachers, employees and students; (i) the conferment of honorary degrees; (j) the provisions regarding exemption of studenb from payment of tuition tee and for awarding to them scholarships and fellowships; (k) provisions regarding the policy of admi$sions, including regulation of reservation of seats; (l) provisions regarding fees to be charged from students; (m) provisions regarding number of seats in difierent courses; (n) creation of new authorities of the U ni\r'ersity: (o) accounting policy and financial procedure; (p) creation of heu, departments and abolitron or restructuring of existing departments; (q) institution of medals and prizes; 274 (r) creation of posts and procedure for abolition ofposts; (s) revision offees; (t) atteration of thenumberof seats in different syllabusi and (u) all other matters which under the provisions ol this Act are required to be, or may be, prescribed by the Statutes. (2) The Statutes of the University shall be made by the Board of Management, and shallbe submitted to the State Govemmentfor its approval. (3) The S'tate Govemment shallconsider the Statutes, submitted by the University and shali give its approval thereon within two months from the date of its receiptwith such modifications, if any, as it may deem necessary (4) The University shall communicate its agreementto the Statutes as approved by the State Government, and if it desires not to give effeci to any or all o{ the modiflcations made by the State Government under sub- section(3), it may give reasons therefor and after considering such reason, the State Government shall accept the suggestions made by the University. (5) The State Government shall publish the Statutes, as finally ap- proved by it, in the Official Gazette, and thereafter, the Statutes shall come into force from the date of such publication. 29, The Ordinances : (1) Subject to the provisions of this Act or Statutes made thereunder, the Ordinances may provide for all or any of the following matters, namely:- (a) the admission of students to the University and their enroF ment as such; (b) the courses of study to be laid down for the degrees, diplo- mas and certificates of the University; (c) the award of the degrees, diplomas, certificates and other academic distinctions, the minimum qualification for the same and the measures to be taken relating to the granl- ing and obtaining ofthe same; (d) the conditions for award of fellowships, scholarships, sti- pends, medals and prizes; (e) the conduct of examinations, including the terms of office and manner of appointment and the duties of examining bodies, examiners and moderators; 27s (0 fees to charged for fle courses, examinations, degrees and diplomas of the University; (g) the conditions of residence of the students of the Univer- sity; (h) provision regarding disciplinary action against the students; (i) the creation, composition and functions of any other body wtlich is considered necessary for improving the academic life of the University; (j) the manner of co-operation and collaboration with other Universities and institutions of higher education, and (k) all other matters which by this Act or Statutes made thereunder are required to be provided bythe Ordinances. (2) The Ordinances of the University shall be made by theAcademic Council which after being approved by the Board of Management, shall be submitted to the Chancellorfor its approval. 30. Rcgulations : The authorities ofthe University may, subject to he prior approvalofthe Board ofManagement, make regulations, consistent with thisAct and the rules, Sttatutes and the Ordinances made thereundet for the conduct of their own business and that of the committees appointed by them. 31. Admissions : (1)Admission in the university may be made on the basis of merit or in any other manner as the academic council may decide. (2) Merit for admission in the University may be determined either on the basis of marks or grade obtained in the qualifying examination and achievements in co-curricular and extrarurricular activities or on the basb of marks or grade oblained in the entrance conducted at the Sltate level either by an association ofthe universities conducrting similar courses or any other manner; (3) lf the students pass out a level of any course, university may consider the admission of that student in next level on credit transfer basis from other universities or institutes. (4) Reservation in admission to the Universityfor Scheduled Castes, Scheduled Tribes and other backward classes, women and handicapped persons shall be provided as per the approval of the board of management. 276 32, Feestructur€: (1)The Univercity may, fromtimetotime, prepare its fees struclure and send it for approvalofthe committee constituted for the purpose. (2) The committee shall consider the fees structure prepared by the University and if it is satisfied that the proposed fees is- (a) sufficient for:- (i) generating resources for meeting the recurring expenditure of the University: and (ii) the saving required forthe further development ofthe University; it may approve the fees structure. (3) The fees structure approved by the committee under sub- section(2) shallremain in force for one year and the University shall be entitled to charge fees in accordance with such fees structure. : 33. Examination At+Ure begrnning of each academic session and in any case not later than 30"' ofAugust of every calendar year or such other date as the academic council may decide, the university shall prepare and publish a schedule of examination for each and every course conducted by it and shall strictly adhere to the schedule. : Explanation 'Schedule of Examination" means a table giving details about the time, day and date of the commencement of each paper which is a partof a scheme of examinations and shall also include the details about the practical examinations: Provided that if, for any reason whatsoever, the University has been unable to follow this schedule, it shall, as soon as practicable, submit a report to the State Government incorporating the reasons for showing a departure from the published schedule. The Govemment may, thereon, issue such directions as it may deem lit for the compliance of the schedule; 34. Declaration of results : (1) The university shall declare the resulls of every examination conducted by it within sixty days from the last date of the examinalion for that particular course orwithin such time period as may be mentioned in the statute; Provided that, if for any reason whatsoever, the university is unable to finally declare the results of any examination within the aforesaid period of sixty days, it shall submit a report incorporatlng the reasons for such delay to the State Government. The State Government may, thereon issue such directions as it may deem fit. ?77 (2) No examination or the results of an examination shall be held invalid only for the reasons that the university has not followed the time schedule as stipulated in section 33 or as the case may be in section 34. 35. Convocation : The convocatjon oi the University shall be held in every academic year in the manneras may be prescribed by the Statutes for conferring degrees, diplomas or for any other purpose. 36. Accreditation of the University : The University may obtain accreditation from any nationalor international body. 37. Annual report : (1) The annual report of the University shall be prepared by the Board of Management which shall include among other matters, the steps taken by the University towards the fulfillment of its objects and copy of the same be submitted to the Sponsoring Body. 38. Annual account8 and audit : (1) The annualaccounts including balance sheet ofthe University shall be prepared under the directions ofthe Board of Management and the annual accounts shall be audited at least once in every year bythe auditors appointed by the University for this purpose. (2) A copy of the annual accounts together with the audit report shall be submitted to the Board of Management. (3) A copy of the annual accounts and audit report along with the observation of the Board of Management shall be submitted tc the Sponsoring Body. 39. Porvers of the State Govemment to inspect the University : ( l ) For the purpose of ascertaining the standards of teaching, examination and research or any other matter relating to the University, the State Govemment may cause an inspection, to be made in such manner as may be prescribed, by such person or persons as it may deem fit. (2) The State Government shall communicate to lhe University iE recommendat ons ln regard to the result of such inspection for conective action. The Unh/ersity shall adopt such conective measures and make efforts so as to ensure the compliance of the recommendations. 40. Powe6 of the State Government to call for information : (1) The S:tate Government maycallfor information from the University relating to its working, functions, achievements, standard of teaching, examination and research or any other matters as it may consider necessary tojudge the efflciency of the University in such form and within such time as may be prescribed by rules. 278 (2) The University shall be bound to fumish the information as required by the State Government under sub-section (1) withln the prescribed time. 41. Dissolution of the University by the Sponsoring Body : (1) The Sponsoring Body may dissolve the University by giving a notice to the effect in the prescribed mannerto the Sltate Government and the employees and the students of University at least one year in advance: Provided thatdissolution ofthe University shall have effect only atter the approval of the State Governmentand the last batches of students ofthe regular courses have completed their courses and they have been awarded degrees, diplomas or awards, as the case may be. (2) On the dissolution of the University land and property of the university wiU be vested with the State Government. 42. Special powers of the State Government in ceftain i circumstances (1) lf it appears to the Slate Govemment that the University has contravened any of the provisions of this Act made thereunder or has violated any of the directions issued by it under this Ac t or has ceased to carryout any undertakings given by itto the State Government or a situation or mal-adminishation has arisen in the University, it shall issue notice inquinng the University to show cause within forty-five days. (2) lf the State Government on [eceipt of reply of the University on the notice issued under sub-section (1), is satisfied that there is a prima facie case of contravening any of the provisions ofthisAct or the rules made thereunder or of violating directions issued by it underthisAct or ofceasing to carryout the undertaking given by it or mal-administration, it shall make an order of such enquiry as it may consider necessary (3) The State Govemment shall, for the purposes of any enquiry under suFseciion (2), appointan arbitrator to inquire into any of the allegations and to make report thereon. (4) The arbitrator appointed under sub-section (3) shall have the same powers as provided as per the Arbitration and Conciliation Act, 1996 ; while trying a suit in respect of the following matters, namely:- (a) summoning and enforcing the attendance of any person and examining him on oath; (b) requinng the discovery and producton of any such document or any other material as may be predicable in evidence; and (c) requisitioning any public record from any court or office. 279 (5) On receipt of the enquiry report from the officer or officers appointed under sub-section (3), if the Slate Government is satisfied that the U niversity has contravened any of the provisions of this Act or the rules made thereunder or has violated any of the directions issued by it under this Act or has ceased to carryout the undertakings given by it or mal-administration has arisen in the University which threatens the academic standard of the University, it shall make orders for corrective actions or direction. 43. Power to make Rules:- For carrying out the purposes of this Act, the Board of Management, Academic Council or the Authorities of the University, may make rules, c-nsistent with this Act for all or any of the provisions of the Act or for all or any ofthe provisions which are not covered by the Statutes, Ordinances and Regulations made under thisAct. 44. Power to remove difficulti* : (:1) lf any difficulty arises in giving effect to the provisions of this Act, the State Government may, by order published in the Official Gazette, make provisions, not incrnsistent with the provisions of this Act, as appear to it to be necessary or expedient for removing the difficulty; Provided that no order under this section shall be made after the expiry of a periods of two years from the date of commencement of thisAct. (2) Every order made under this section shall, as soon as may be after it is made, shall be laid before the House of the State Legislature. 45. The Act to have overriding cffect : The provisions of this Act and the rules, Statutes, Ordinances made thereunder shall have effect notwithstanding anything to the contrary contained in any other law; for the time being in force, relating to the matters in respect of which the State Legislature has exclusive powerto make laws. 46. Savings : Notwithstanding anything contiained jn this Act, all rules, orders, notifications, scheme, bye-laws, regulation, circular, office memoranda issued by the State Government in pursuance oftheArunachal Pradesh and other lnstitutions of Higher Education (Establishment and Regulations) Act, 2010 (No. 6 of 2010) and the Arunachal Pradesh State Council for Technical Education Act 2010 (No. g of 2010) shall mutatis mulandis apply to the University until the same superseded by the State Govemment. 280 SCHEDULE- I lnfrastructure 1.
