अ(cid:4)ध(cid:31)नयम स(cid:14)ं या- 04, 2018) भारत गणरा9य के अड़सठवH वष , मH झारख(cid:5)ड रा9य 3वधानम(cid:5)डल (cid:17)वारा 4न5न(cid:20)ल6खत Jप से यह अ0ध4नय(cid:20)मत होः- 2 झारख(cid:5)ड गजट (असाधारण) मंगलवार, 13 माच,,, 2018 अ(याय I (cid:19)ारं(cid:20)भक 1) संLMNत नाम, 3वOतार एवं (cid:19)ारंभः- (क) यह अ0ध4नयम झारख(cid:5)ड अ4नवाय , 3ववाह 4नबंधन अ0ध4नयम, 2017 कहा जाएगा। (ख) यह अ0ध4नयम रा9य सरकार (cid:17)वारा सरकार2 गजट मH (cid:19)का(cid:20)शत होने क> 4त0थ से (cid:19)भावी होगा। (ग) इसका MेRा0धकार संपूण , झारख(cid:5)ड रा9य होगा। 2) यह अ0ध4नयम लागू होने क> 4त0थ से उन समOत संपTन 3ववाहो पर (cid:19)भावी होगा, जहाँ 3ववाह के दोनU अथवा एक पMकार झारख(cid:5)ड रा9य मH 4नवास करने वाले भारतीय नागVरक हU। 3) पVरभाषाए%ँ- (1) इस अ0ध4नयम मH, जबतक (cid:19)संग अTयथा अपेLMत न हो (क) 3ववाह से अ(cid:20)भ(cid:19)ेत है, 4न5नांCकत अ0ध4नयम अTतगत, जा4त एवं धम , से 4नरपेM, ORी एवं पुJष के मWय संपा:दत 3ववाह अथवा पुन3वव, ाह (i) 3वशषे 3ववाह अ0ध4नयम, 1954, (ii) :हTद ु 3ववाह अ0ध4नयम, 1955, (iii) भारतीय इसाई 3ववाह अ0ध4नयम, 1872, (iv) मुिOलम पसन, ल लॉ अ0ध4नयम (शर2यत) 1937, (v) आनTद 3ववाह अ0ध4नयम, 1909 (vi) काजी अ0ध4नयम, 1880 (vii) 3वदेश 3ववाह अ0ध4नयम, 1969 तथा (viii) पारसी 3ववाह एवं तलाक अ0ध4नयम, 1936 (ix) 3ववाह से संबं0धत अTय पसन, ल लॉ अथवा परंपरा (ख) ‘‘Oथानीय (cid:19)ा0धकार2‘‘ से ताZपय , है [ाम पंचायत, नगरपा(cid:20)लका, नगर 4नगम आ:द (ग) ‘‘सरकार‘‘ से ताZपय , है झारख(cid:5)ड सरकार (घ) ‘‘3वदेशी नागVरक‘‘ से ताZपय , है ऐसा ^यि_त जो भारतीय नागVरक नह2 है तथा उनमH सि5म(cid:20)लत होगH भारतीय मूल के ^यि_त तथा पारसमु`2 भारतीय नागVरक। (ड़) ‘‘पंजी‘‘ का अथ , है, इस अ0ध4नयम अTतगत, संधाVरत 3ववाह पंजी झारख(cid:5)ड गजट (असाधारण) मंगलवार, 13 माच,,, 2018 3 4) अTय अ0ध4नयम का (cid:19)भाव बा0धत नह2ं%- अTयथा उपबं0धत को छोड़कर, इस अ0ध4नयम के (cid:19)ावधान, अTय (cid:19)भावी अ0ध4नयमU के मानमद,न मH न होकर उनके अ4तVर_त होगे, (cid:20)सवाय उस पVरOथ4त के जबCक अTय अ0ध4नयमU के (cid:19)ावधान इस अ0ध4नयम के (cid:19)ावधानU के असंगत हो। 5) इस अ0ध4नयम अTतगत, 4न5नांCकत अथवा अTय 3वषयU पर रा9य सरकार, सरकार2 गजट मH अ0धसूचना (cid:17)वारा 4नयम बना सकेगी। (क) 3ववाह के अ4नवाय , 4नबंधन हेतु ऑनलाईन आवेदन के (cid:19)ेषण के संबंध मH। (ख) इस अ0ध4नयम अTतगत, , शु(cid:25)क, जुमा,ना, दंड, अथद, ंड, अ0धरो3पत करने तथा शु(cid:25)क आ:द के भुगतान क> र24त के संबंध मH। (ग) उन अवOथाओं तथा पVरिOथ4तयU के संबंध मH जबCक 3ववाह 4नबंधन क> (cid:19)3वdटयU को संशो0धत अथवा 4नरOत करना हो। (घ) इस अ0ध4नयम के अTतगत, वां4छत अTय Cकसी 3वषय के 4नधा,रण हेतु इस अ0ध4नयम अTतगत, 4न(cid:20)मत, समOत 4नयम रा9य3वधानमंडल क> सहम4त हेत ु यथाशीe सदन के पटल पर रखे जाऐंगे। अ(याय II 4नबंधन पदा0धकार2 5) महा4नबंधक 3ववाहः- (i) रा9य सरकार सरकार2 राजपR मH अ0धसूचना 4नगत, कर इस अ0ध4नयम के (cid:19)भावी अनुपालन तथा इसके अनुfवण हेतु Cकसी पदा0धकार2 को महा4नबंधक 3ववाह 4नयु_त कर सकेगी। (ii) महा4नबंधक 3ववाह के पयव, ेMण मH इस अ0ध4नयम अTतगत, कZत^, यU के 4नवह, न हेतु रा9य सरकार समय-समय पर अTय पदा0धकाVरयU को, ऐसे पदनाम से, जैसा रा9य सरकार चाहे, 4नयु_त कर सकेगी तथा उTहH महा4नबंधक के 4नदेशानुसार काय , करने हेत ु (cid:19)ा0धकृत कर सकेगी। (iii) रा9य सरकार के 4नदेशU के अTतगत, इस अ0ध4नयम के (cid:19)ावधानU तथा अ0ध4नयम अTतगत, 4नगत, 4नयमU 4नदेशो के अनुपालन हेतु महा4नबंधक 3ववाह ह2 मु#य कायप, ालक पदा0धकार2 होगH। (iv) रा9य अTतगत, 3ववाह 4नबंधन के काय , को सुगमता से संपा:दत करने हेत ु महा4नबंधक 3ववाह, (cid:17)वारा उ0चत आदेश 4नगत, करने तथा अधीMण संबंधी काय , संपा:दत करने का काय , Cकया जाएगा। 4 झारख(cid:5)ड गजट (असाधारण) मंगलवार, 13 माच,,, 2018 6) मु#य 3ववाह 4नबंधकः- (i) रा9य सरकार (cid:17)वारा (cid:19)Zयेक राजOव िजला मH उपायु_त को मु#य 3ववाह 4नबंधक 4नयु_त Cकया जाएगा, जो महा4नबंधक 3ववाह के 4नयंRण तथा 4नदेशानुसार उन कायh का 4नdपादन करHगे जैसा महा4नबंधक 3ववाह उTहH करने हेतु (cid:19)ा0धकृत करH। (ii) मु#य 4नबंधक (cid:17)वारा महा4नबंधक 3ववाह के 4नदेशU के अनुसार िजलाTतगत, संपTन 3ववाहU के 4नबंधन का पयव, ेMण Cकया जाएगा, साथ ह2 इस अ0ध4नयम के (cid:19)ावधानU तथा समय-समय पर महा4नबधं क (cid:17)वारा 4नगत, आदेशU का अनुपालन का उZतरदा4यZZव भी उसपर होगा। 7) 3ववाह 4नबंधकः- (i) शहर2 MेR मH अ4नवाय , 3ववाह 4नबंधन का काय , Oथानीय शहर2 4नकाय यथा नगर 4नगम, नगरपा(cid:20)लका, अ0धसू0चत MेR स(cid:20)म4त, नगर पषद, आ:द के उTह2ं पदा0धकाVरयU (cid:17)वारा संपा:दत Cकया जाएगा जो अपने MेRा0धकार अTतगत, जTम एवं मZृ यु का 4नबंधन करते हi, अथवा ऐसे अTय पदा0धकाVरयU (cid:17)वारा िजTहH रा9य सरकार अ0धसू0चत करH। जबCक [ामीण MेR मH यह काय , उन पदा0धकाVरयU (cid:17)वारा संपा:दत Cकया जाएगा जो MेRा0धकार अTतगत, जTम एवं मZृ यु का 4नबंधन करते हi यथा पंचायत सेवक, अथवा ऐसे अTय पदा0धकार2 िजTहH रा9य सरकार अ0धसू0चत करH। (ii) (cid:19)Zयेक 3ववाह 4नबंधक का काया,लय उसी Oथानीय MेR मH होगा जहाँ के (cid:20)लए वह 4नयु_त हो। (iii) महा4नबंधक 3ववाह के 4नदेश के अनुसार (cid:19)Zयेक 3ववाह 4नबंधक 4नधा,Vरत :दन तथा 4नधा,Vरत समय पर अपने काया,लय मH उपिOथत रहHगे तथा अपने कायाल, य के बाहर2 दरवाजे के 4नकट Cकसी 3व(cid:20)शdट Oथान पर अपना नाम, पदनाम, काया,लय अव0ध, MेRा0धकार, अ[ं र् ेजी, :हTद2 तथा Oथानीय भाषा मH प:kका पर अCं कत करHगे। 8) वतम, ान पदा0धकाVरयU क> 4नयुि_त अथवा पुनन, ा(cid:20)मत करनाः- (i) रा9य सरकार यथो0चत अ0धसूचना (cid:17)वारा Cकसी ^यि_त अथवा (cid:19)ा0धकार2 को 4नबंधन महा4नबंधक, मु#य 4नबंधक तथा 3ववाह 4नबंधक के Jप मH 4नयु_त अथवा पुनना,(cid:20)मत कर सकेगी। (ii) रा9य सरकार इस अ0ध4नयम, अTय Cकसी अ0ध4नयम अथवा (cid:19)थाओं के अTतगत, Oथान 3वशषे अथवा Oथान 3वशषे पर 4नवास करनेवाले 3वशषे समुदाय के मWय संपTन 3ववाह के 4नबंधन हेतु Cकसी ^यि_त अथवा (cid:19)ा0धकार2 को 4नयु_त या पुनना,(cid:20)मत कर सकेगी। (iii) ऐसे 4नयु_त या पुनना,(cid:20)मत ^यि_त तथा (cid:19)ा0धकार2 इस अ0ध4नमय के (cid:19)ावधानU के अTतगत, 3ववाह 4नबंधन के कायl को 4नdपा:दत करHगे। झारख(cid:5)ड गजट (असाधारण) मंगलवार, 13 माच,,, 2018 5 9) 3ववाह 4नबंधक का MेRा0धकारः- (i) शहर2 एवं [ामीण MेR मH अ4नवाय , 3ववाह 4नबंधन हेत ु (cid:19)ादे(cid:20)शक सीमाएँ वह2 होगीं जो जTम एवं मZृ यु हेतु 4नधा,Vरत हi। (ii) इस MेRा0धकार अTतगत, (cid:19)Zयेक 3ववाह 4नबंधक को ऐसे संपTन 3ववाह के 4नबंधन का अ0धकार होगा, जो उसके MेRा0धकार मH संपTन हुआ हो अथवा MेRा0धकार के बाहर संपTन 3ववाह िजसमH कम-से-कम एक पMकार उसके MेRा0धकार का 4नवासी हो। अ(याय III 3ववाह 4नबंधन 10) 3ववाह का अ4नवाय , 4नबंधनः- (i) इस अ0ध4नयम के (cid:19)भावी होने के उपरांत झारख(cid:5)ड रा9य अTतगत, 4नवास करनेवाले समOत नागVरको हेतु उ_त िOथ4त मH संपTन 3ववाह का 4नबंधन कराना अ4नवाय , होगा जबCक 3ववाह, 3ववाह 4नबंधक का MेRा0धकार अTतगत, संपTन हुआ हो अथवा 3ववाह, 3ववाह 4नबंधक के MेRा0धकार के बाहर संपTन हुआ हो CकTतु दोनU अथवा एक पMकार उस 3ववाह 4नबंधक के MेRा0धकार अTतगत, 4नवासी हो। परTतु जब 3ववाह का एक पMकार अ4नवासी भारतीय अथवा 3वदेशा नागVरक हो तो उस पVरOथ4त मH ऐसे पMकार हेतु पासपोट, सं#या/पासपोट, 4नगत , करनेवाले देश का नाम/Oथायी 4नवास/ Oथायी 4नवास वाले देश अTतगत, उसका पूण , पता/ वतम, ान सामािजक सरु Mा सं#या, अTय Cकसी (cid:19)कार का पहचान (cid:19)माण, जो उस ^यि_त को उसके देश से 4नगत, हो, का वणन, करना अ4नवाय , होगा तथा यह सूचना 3ववाह (cid:19)माण पR तथा 3ववाह पंजी मH भी अCं कत होगी। (ii) परTतु अTय Cकसी 3ववाह अ0ध4नयम अTतगत, 4नबं0धत 3ववाह का 4नबंधन इस अ0ध4नयम अTतगत, कराना आवnयक नह2 होगा। (iii) परTतु अTय Cकसी 3ववाह अ0ध4नयम के (cid:19)ावधान इस अ0ध4नयम अTतगत, 3ववाह के पMकारU को 3ववाह के 4नबंधन से बा0धत नह2 करHगे। (iv) 3ववाह के पMकारU का यह दा4यZव होगा Cक वह 3ववाह के अ4नवाय , 4नबंधन हेत ु आवnयक कदम उठायH। 11) 3ववाह 4नबंधन क> शत%o- 3ववाह के 4नबंधन हेतु 4न5नांCकत शतl को पूरा करना अ4नवाय , होगाः- (i) वर क> आयु Tयूनतम 21 वष , तथा वध ु क> आयु Tयूनतम 18 वष , हो। (ii) दोनो पMकारU मH Cकसी का प4त अथवा पZनी िज3वत न हो, जबतक Cक पMकारU के संबं0धत पसन, ल लॉ मH ऐसा (cid:19)ावधा4नत न हो। 6 झारख(cid:5)ड गजट (असाधारण) मंगलवार, 13 माच,,, 2018 (iii) दोनU पMकारU मH से कोई पागल अथवा मान(cid:20)सक Jप से असंतु(cid:20)लत न हो। (iv) दोनU पMकारU के मWय (cid:19)4तबं0धत संबंध न हो। (v) दोनU पMकारU मH से एक भारतीय नागVरक तथा संबं0धत 3ववाह 4नबंधक के MेRा0धकार अTतगत, 4नवासी हो अथवा 3ववाह उस 3वशषे MेR मH संपा:दत हुआ हो। 12) 3ववाह 4नबंधन क> (cid:19)Cpयाः- (i) 3ववाह के अ4नवाय , 4नबंधन हेतु समOत आवेदन ऑनलाईन पq4त से अथवा पVर(cid:20)शdट के (cid:19)पR-I अTतगत, 3व:हत (cid:19)पR मH 3व(cid:20)शdट MेRा0धकार के 3ववाह 4नबंधक को (cid:19)े3षत Cकये जायHगे। पMकारU तथा गवाहU क> ^यि_तगत उपिOथ4त हेतु 4त0थ तथा समय का 4नधा,रण ऑनलाईन भी Cकया जा सकेगा। (ii) इस (cid:19)योजनाथ,, 3ववाह के पMकारU (cid:17)वारा ऑनलाईन आवेदन भरा जाएगा िजसमH पMकारU का नाम, फोटो, आयु, 4नवास Oथान, ^यवसाय, 3ववाह क> 4त0थ, 3ववाह का Oथान, आधार सं#या, मोबाईल सं#या तथा ऐसे अTय आवnयक वणन, , िजसे 3वभाग मांगे, व6णत, हUगे। (iii) [ामीण MेR मH आवेदन के साथ Oथानीय मु6खया, सरपंच, Cकसी राजपrRत पदा0धकार2 अथवा ऐसे अTय ^यि_त िजTहH रा9य सरकार (cid:19)ा0धकृत करे, के Oतर से (cid:19)माण-पR संलsन Cकया जाएगा िजसमH यह व6णत, होगा Cक म i (cid:19)मा6णत करता हूँ Cक fी एवं fीमती........................................................... का 3ववाह अमुक 4त0थ को संपा:दत Cकया गया है। जबCक शहर2 MेR मH 3ववाह के पMकार वाड , क(cid:20)मशनर, Cकसी राजपrRत पदा0धकार2 अथवा अTय ऐसे ^यि_त िजTहH रा9य सरकार (cid:19)ा0धकृत करH, के Oतर से (cid:19)ाNत (cid:19)माण-पR संलsन करHगे िजसमH व6णत, होगा Cक ‘‘म i (cid:19)मा6णत करता हूँ Cक fी एवं fीमती................................................................ का 3ववाह अमुक 4त0थ को संपा:दत हुआ है। (iv) ऑनलाईन आवेदन के साथ पMकारU (cid:17)वारा उपरो_त व6णत, (cid:19)माण-पR, वर एवं वधु के 3ववाह का फोटो, आमंRण पR अथवा पंuडत/काजी आ:द (cid:17)वारा 4नगत, 3ववाह (cid:19)माण पR, आयु (cid:19)माण-पR, 4नवासी (cid:19)माण-पR, आधार काड , तथा अTय ऐसे दOतावेज िजसे 3वभाग चाहे, अपलोड Cकये जायHगे। (v) आवेदन के साथ रा9य सरकार (cid:17)वारा 4नधा,Vरत शु(cid:25)क/3वलंब शु(cid:25)क आ:द भी ऑनलाईन पq4त से जमा Cकये जायHगे। (vi) आवेदन के सफलतापूवक, (cid:19)ेषण के साथ आई0डी0 सं#या ज4नत होगी तथा आवेदक अपने आवेदन क> िOथ4त उ_त आई0डी0 (cid:17)वारा पता कर सकH गे। झारख(cid:5)ड गजट (असाधारण) मंगलवार, 13 माच,,, 2018 7 (vii) 3ववाह 4नबंधक अपने यूजर आई0डी0 तथा पासवड , (cid:17)वारा ऑनलाईन (cid:19)ाNत आवेदन क> जाँच कर सकH गे तथा य:द आवेदन मH कोई Rु:ट (cid:19)तीत होती है तो आवेदन (cid:19)ािNत के एक माह के अदं र वह R:ु ट सुधार हेतु पMकार को ऑनलाईन Jप से सू0चत करHगे। य:द 3ववाह 4नबंधन के संबंध मH कोई आपिZत (cid:19)ाNत होती है, तो भी 3ववाह 4नबंधक आवेदक को उसक> सूचना ऑनलाईन दHगे। (viii) एक माह के उपरांत य:द पMकार Cकसी R:ु टसुधार अथवा 3ववाह 4नबंधन से संबं0धत Cकसी आपिZत क> सूचना नह2ं पाते हi, तो दोनो पMकार 3ववाह 4नबंधन हेतु संबं0धत 3ववाह 4नबंधक के काया,लय मH उपिOथत हUगे। (ix) 3ववाह 4नबंधक के काया,लय मH आवेदक क> आयु, 4नवास Oथान, पहचान, मु6खया/वाड , क(cid:20)मशनर से (cid:19)ाNत (cid:19)माण-पR क> जाँच क> जाएगी। सभी दOतावेज उ0चत होने क> िOथ4त मH दोनU पMकारU तथा तीन गवाहो का फोटो (cid:20)लया जाएगा तथा 3ववाह 4नबंधक (cid:17)वारा 3ववाह (cid:19)माण-पR ऑनलाईन 4नगत, Cकया जाएगा िजसे पMकार डाउनलोड कर सकH गे। (x) 3ववाह 4नबंधक (cid:17)वारा दरू भाष, एस0एम0एस0, ई-मेल अथवा अTय वैकि(cid:25)पक माWयमU (cid:17)वारा 3ववाह के पMकारU तथा गवाहU को पूव , 4नधा,Vरत समय एवं 4त0थ पर उपिOथत होने हेत ु सू0चत करने का (cid:19)यास Cकया जाएगा, जो कम-से-कम एक :दन पूव , 4नगत, क> जाएगी। (xi) आवेदक (cid:17)वारा ऑनलाईन आवेदन के वैकि(cid:25)पक Jप मH 4नधा,Vरत (cid:19)पR मH हाड , कॉपी मH समOत दOतावेजU, (cid:19)माण-पRU (जो धारा 12 iv मH व6णत, है) के साथ 4नबंधक के समM आवेदन :दया जा सकेगा। 3ववाह 4नबंधक से संबं0धत समOत शु(cid:25)क का भुगतान ऑनलाईन Jप से Cकया जा सकेगा। (xii) आवेदकU (cid:17)वारा आवेदन (cid:19)vा केT`ांs अथवा सरकार (cid:17)वारा (cid:19)ा0धकृत अTय एजेिTसयU के माWयम से भी Cकया जा सकेगा। (xiii) 3व:हत (cid:19)पR मH (cid:19)ाNत आवेदन तथा समOत वां4छत दOतावेजU क> जांच 4नबंधक (cid:17)वारा क> जाएगी। समOत दOतावेजU क> सZयता के संबंध मH आnवOत होन े के उपरांत 4नबंधक (cid:17)वारा 3ववाह का 4नबंधन Cकया जाएगा तथा (cid:19)पR&iii मH 4नधा,Vरत पंजी मH उसक> (cid:19)3विdट क> जाएगी। (xiv) अ(cid:19)वासी भारतीय अथवा 3वदेश मH (cid:19)वासी पMकार के साथ 3ववाह संपTन होने क> िOथ4त मH 4नबंधक (cid:17)वारा संबं0धत दतू ावास से उस ^यि_त के संबंध मH जानकार2 (cid:19)ाNत क> जाएगी। (xv) ऑफलाइन आवेदन देने क> िOथ4त मH आवेदकU (cid:17)वारा 3ववाह संपTन होने के एक वष , के भीतर दो (cid:19)4त मH 3व:हत (cid:19)पR मH आवेदन सम3पत, Cकया जाएगा। 3ववाह 4नबंधक 8 झारख(cid:5)ड गजट (असाधारण) मंगलवार, 13 माच,,, 2018 (cid:17)वारा (cid:19)ाNत आवेदन सूचनापk पर (cid:19)द(cid:20)शत, Cकया जाएगा िजससे य:द ^यि_त को आपिZत करना हो तो वह इस संबंध मH आपिZत कर सके। (xvi) 3ववाह 4नबंधन हेतु ^यि_तगत उपिOथ4त के समय पMकारU (cid:17)वारा 4न5नांCकत (cid:19)माण (cid:19)Oतुत Cकये जाएगH%- (क) 3ववाह के कम-से-कम दो फोटो एवं 3ववाह से संबं0धत आमंRण-पR अथवा पंuडत/काजी आ:द (cid:17)वारा 4नगत, 3ववाह (cid:19)माण-पR (ख) प4त एवं पZनी का एक साथ तीन फोटो िजनमH दो 3ववाह (cid:19)माण-पR मH तथा एक काया,लय अ(cid:20)भलेख मH साटे जाएगH। (ग) धारा 12 (iii) एवं (iv) मH व6णत, दOतावेज/(cid:19)माण-पR। (13) दOतावेजU क> जांचोपरांत संतुdट होने के उपरांत तथा Cकसी (cid:19)कार क> कहा जा सकेगा िजससे आवेदन मH व6णत, तwयU/पMकारU या गवाहU क> पहचान सZया3पत हो सके। (ख) इस संबंध मH 3ववाह 4नबंधक (cid:17)वारा पMकारU के आवासीय थाना MेR के थाना से भी सूचना माँगी जा सकेगी। (14) CकTतु जब सम3पत, दOतावेजU क> जांच अथवा अTय माWयम से 4नबंधक को यह 3वnवास हो Cक- (क) पMकारU का 3ववाह पMकारU के Oवधमश, ाOR के अनुसार संपा:दत नह2ं हुआ है या (ख) पMकारU क> पहचान, गवाहU क> पहचान अथवा 3ववाह का संपादन शंकार:हत Jप से संपा:दत नह2ं हुआ है या (ग) (cid:19)Oतुत दOतावेज पMकारU क> वैवा:हक िOथ4त को (cid:19)मा6णत न करता हो तो (15) पMकारU क> सुनवाई के उपरांत 3ववाह 4नबंधन अOवीकृत Cकया जाएगा तथा उससे संबं0धत कारण Oपdट Jप से व6णत, Cकये जाऐगH। अOवीकृ4त आदेश क> (cid:19)4त मु#य 3ववाह 4नबंधक को भी (cid:19)े3षत क> जाएगी। (16) 4नबंधक (cid:17)वारा केवल ऐसे 3ववाह का ह2 4नबंधन Cकया जाएगा जहाँ आवेदक सभी शतl को पूरा करते हU तथा जहाँ आवेदन एक वष , क> समय-सीमा के अदं र (cid:19)ाNत हो, (17) 3ववाह 4नबंधक (cid:17)वारा 3ववाह (cid:19)माण-पR दो (cid:19)4त मH पMकारU को अपने हOताMर एवं मुहर के साथ 4नःशु(cid:25)क उपलxध नाम, पता, 3ववाह 4नबंधन क> 4त0थ आ:द से संबं0धत 3ववरण के साथ अनुpमणी ऑनलाईन ज4नत होगी। 3ववाह के पMकारU (cid:17)वारा उन अनुpम6णयU क> खोज अवलोकन 4नधा,Vरत शु(cid:25)क भुगतान कर Cकया जा सकेगा तथा रा9य सरकार (cid:17)वारा 4नधा,Vरत शु(cid:25)क चुका कर 3ववाह (cid:19)माण- पR क> (cid:19)मा6णत (cid:19)4त(cid:20)ल3प (cid:19)ाNत क> जा सकेगी। अTय ^यि_तयU (cid:17)वारा 3ववाह 4नबंधक क> अनुम4त (cid:19)ाNत कर अनुpमणी क> खोज एवं 4नर2Mण तथा 3ववाह (cid:19)माण पR क> (cid:19)मा6णत (cid:19)4त (cid:19)ाNत क> जा सकेगी। (iii) 3ववाह 4नबंधक (cid:17)वारा यह अनुम4त उसी िOथ4त मH (cid:19)दान क> जाएगी जब उसे (cid:19)तीत हो Cक यह जाँच उ0चत कारणU से क> जा रह2 है। 20) 3ववाह 4नबंधन के संबंध मH आपिZतः- (i) य:द कोई ^यि_त 3ववाह 4नबंधन के सबं ंध मH आपिZत करना चाहता है तो उसके (cid:17)वारा आपिZत क> सZयता के संबंध मH शपथ-पR के साथ (cid:20)ल6खत आवेदन ऑनलाईन 3ववाह 4नबंधक को (cid:19)े3षत करना होगा। (ii) यह आवेदन 3ववाह 4नबंधन आवेदन (cid:19)ेषण क> 4त0थ के पं`ह :दनU के अदं र, 4नधा,Vरत शु(cid:25)क य:द हो तो, के साथ सम3पत, Cकया जाएगा। (iii) 3ववाह 4नबंधक (cid:17)वारा आपिZत क> जाँच कर उ0चत समय सीमा के अदं र आदेश पाVरत Cकया जाएगा। 21) 4नबंधन 3ववाह क> वैधता का (cid:19)माण न होः- इस अ0ध4नयम के अTतगत, 3ववाह का 4नबंधन 3ववाह क> वैधता का (cid:19)माण न होकर 3ववाह के 4नबंधन का (cid:19)माण होगा। 22) अ4नवाय , 3ववाह 4नबंधन हेत ु समय-सीमाः- अ4नवाय , 3ववाह 4नबंधन हेत ु 3ववाह संपTन होन े के एक वष, के अदं र संबं0धत 3ववाह 4नबंधक के काया,लय मH इस अ0ध4नयम के (cid:19)वतृ होने के पूव , 3ववाह संपTन करा (cid:20)लया हो, उनके (cid:20)लए इस अ0ध4नयम अTतगत, 3ववाह 4नबंधन वैकि(cid:25)पक होगा, अ4नवाय , नह2ं। 23) द(cid:5)डः- (i) rबना उ0चत कारण के 3ववाह का अ4नवाय , 4नबंधन न कराने क> िOथ4त मH पMकारU को 4नबंधन के समय 3वलंब के (cid:19)4त:दन पाँच Jपये क> दर से अ0धकतम 100 J0 (एक सौ Jपये) अथद, (cid:5)ड देना होगा। 3ववाह 4नबंधक का यह अ0धकार होगा Cक वह उ0चत कारण बताने पर द(cid:5)ड को माफ कर सके। (ii) (cid:19)Zयेक ^यि_त जो 3ववाह के 4नबंधन से संबं0धत अथवा अTय 3वषय पर (cid:20)मwया वणन, करता है उस पर अ0धकतम 5000 J0 (पाँच हजार Jपये) तक का अथद, (cid:5)ड अ0धरो3पत Cकया जा सकेगा। (iii) 3ववाह 4नबंधन के संबंध मH अवैध आपिZत करने पर भी 5000 J0 (पाँच हजार Jपये) का अथद, (cid:5)ड अ0धरो3पत होगा। (iv) ऐसे समOत 3ववाह 4नबंधक जो rबना Cकसी उ0चत कारण के 3ववाह 4नबंधन नह2 ं करते हi, उनपर उनक> सेवा 4नयमU के अTतगत, 3वभागीय कायव, ाह2 क> जाएगी। 24) 3ववाह 4नबंधन हेतु शु(cid:25)कः- (i) 3ववाह 4नबंधन के सभी ऑनलाईन/ऑफलाइन आवेदनU के साथ 50 J0 का शु(cid:25)क भी ऑनलाईन जमा Cकया जाएगा (ii) गर2बी रेखा से नीच े के ^यि_तयU हेतु Cकसी (cid:19)कार का शु(cid:25)क अथवा 3वलंब शु(cid:25)क देय नह2ं होगा। (iii) 3ववाह (cid:19)माण-पR क> (cid:19)मा6णत (cid:19)4त (cid:19)ाNत करने हेतु जा सकेगी। 27) 3ववाह का 4नबंधन न होना- इस अ0ध4नयम के अTतगत, िजन 3ववाहU के 4नबंधन अ4नवाय , है, उनका 4नबंधन न होने के कारण 3ववाह अवैध नह2ं माना जाएगा। 28) 3ववाह का वैकि(cid:25)पक 4नबंधनः- इस अ0ध4नयम के (cid:19)भावी होने क> 4त0थ के पूव, संपा:दत 3ववाह के पMकार, िजTहUने वतम, ान मH लागू अTय Cकसी अ0ध4नयम अTतगत, अपना 3ववाह 4नबं0धत नह2ं कराया है, वह भी इस अ0ध4नयम के (cid:19)ावधानU के अTतगत, अपने 3ववाह का 4नबंधन करा सकH गे। 29) इस अ0ध4नयम के (cid:19)ावधान, भारतीय इसाई 3ववाह अ0ध4नयम, 1872, आनTद 3ववाह अ0ध4नयम, 1909, :हTद ु 3ववाह अ0ध4नयम, 1955, 3वशषे 3ववाह अ0ध4नयम, 1954, काजी अ0ध4नयम, 1880, 3वदेश 3ववाह अ0ध4नयम, 1969, पारसी 3ववाह तथा तलाक अ0ध4नयम, 1936 तथा 3ववाह से संबं0धत अTय (cid:19)थाओं, ^यि_तगत कानून के मानमद,न मH न हो कर उनके अ4तVर_त होगा। 30) M4तपू4तः,- इस अ0ध4नयम अथवा 4नयमावल2 अTतगत, सदभावपूवक, Cकये गये Cकसी-Cकसी कृZय हेतु Cकसी (cid:19)कार का वाद, अ(cid:20)भयोजन अथवा अTय कानूनी काय,वाह2 (cid:19)ारंभ नह2ं क> जाएगी। 31) क:ठनाईयाँ हटाने क> शि_तः- (क) इस अ0ध4नयम के (cid:19)ावधानU को पाठ समझा जाएगा। The Jharkhand Compulsory Registration of Marriage Act, 2017 (Jharkhand Act No. 04, 2018) Preface:- Currently there are Acts like Special Marriage Act, 1954, Hindu Marriage Act, 1955, Indian Christian Marriage Act, 1872, Anand Marriage Act, 1909, Kazi Act, 1880 for the registration of marriage of citizen of country. But under none of these Acts, the registration of marriage is compulsory. Compulsory Marriage Registration Act will do away the evils of child marriage and polygamy. Besides, it will strengthen the social condition of women in the society which will be in the interest of state as well as its citizens. Be it enacted by the legislature of the State of Jharkhand in the Sixty Eight Year of the Republic of India as follows:- Chapter I Preliminary 1. Short title, extent and commencement. - (a) This Act may be called the Jharkhand Compulsory Registration of Marriages Act, 2017. (b) It shall come into force on such date as the State Government may by notification in the official Gazette, publish. Application of the Act.- This Act applies to all marriages solemnized, on or after the coming into effect of this Act, wherein both or one of the parties is a citizen of India and resides in Jharkhand. 3. Definitions.- (1) In the Act, unless the context otherwise requires.- a) "Marriage" means and includes all marriages solemnized between a male and a female, irrespective of the religion or caste of either party to the marriage and also includes a remarriage under any of the following Act, custom or laws, namely :- (i) the Special Marriage Act, 1954; (ii) the Hindu Marriage Act, 1955 (25 of 1955); (iii) the Indian Christian Marriage Act, 1872 (15 of 1872); (iv) the Muslim Personal Law (shariat) Application Act, 1937 (26 of 1937) ; (v) the Anand Marriage Act, 1909 (7 of 1909); (vi) the kazis Act, 1880; (vii) the Foreign Marriage Act, 1969; or (viii) the Parsi Marriage and Divorce Act, 1936 (ix) any other custom or personal law relating to marriage. b) "Local authority" means Gram Panchayat or Municipality or Municipal Corporation as the case may be (c) "Government" means Government of Jharkhand. d) "Foreign national" means any person who is not a citizen of India and shall include Persons of India Origin (PIO) and Overseas Citizens of India (OCI). e) "Register" means a register of marriages maintained under this Act. 4. Application of other laws not barred- save as otherwise provided, the provisions of this Act shall be in addition to and not in derogation of any other law for the time being in force, except to the extent the provisions of other laws are inconsistent with any provisions of this Act. 5. The State Government may by notification in the official Gazettee make rules for carring out the purposes of this Act for all any of the matter mentioned below. (a) The form of submitting online application for Compulsory Marriage Registration. (b) The fee, fine and penalty to be paid under this Act and the manner of its payment. झारख(cid:5)ड गजट (असाधारण) मंगलवार, 13 माच,,, 2018 17 (c) The condition and circumstances in which entries may be corrected or cancelled regarding marriage registration. (d) Any other matter required to be prescribed by or under this Act. Every rule made under this Act shall be laid as soon as may be before the State Legislature for its approval. CHAPTER II REGISTRATION-AUTHORITIES 5. Registrar General-Marriages- (1) The State Government may, by notification in the official Gazette designate an officer as Registrar General of Marriages for the State of Jharkhand to monitor and review the effective implementation of this Act. 2) The State Government shall also appoint such other officers with such designations as it thinks fit for the purpose of discharging duties under the superintendence and direction of the Registrar General and such other functions of the Registrar General under this Act as he may, from time to time, authorize them to discharge. (3) The Registrar General shall be the chief executive authority in the state for carrying into execution the provisions of this Act and the rules and orders made there under subject to the directions, if any, given by the state Government. (4) The Registrar General shall take steps, by the issue of suitable instructions or order, to co-ordinate, and supervise the work of registration of marriages in the State and for securing an efficient system for Marriage Registration within the state. 6. Chief Registrar of Marriages.- (1) The State Government shall appoint Deputy Commissioner as Chief Registrar of Marriage for each revenue district who shall, subject to the general control and direction of the Registrar General, discharge such functions as the Registrar General may authorize them to discharge. (2) The Chief Registrar of Marriage shall superintend, subject to the direction of the Registrar General the Registration of marriages in the district and shall be responsible for carrying into execution in the district, the provisions of this Act and the orders of the Registrar General issued from time to time for the purposes of this Act. 7. Registrar Marriages.- (1) In urban area, the task of compulsory marriage registration will be done by those officers of urban local bodies i.e. Municipal Corporation, Municipality, Notified Area Committee, Nagar Parishad etc. who register the birth and death in their jurisdiction or such other officers whom the State Government may notify. 18 झारख(cid:5)ड गजट (असाधारण) मंगलवार, 13 माच,,, 2018 While in rural area, this task will be done by those officers who register birth and death in their jurisdiction i.e. Panchayat Sevaks, or such other officer as the State Government may notify. (2) Every Registrar of Marriage shall have an office in the local area for which he is appointed. (3) Every Registrar of Marriage shall attend his office for the purpose of registering marriages on such days and at such hours as the Registrar General may direct and shall cause to be placed in some conspicuous place on or near the outer door of his office, a board bearing in English, Hindi and the local language, if any, his name and designation, namely Registrar of Marriages, for the local area for which he is appointed, and the days and hours of his attendance. 8. Appointment or re-designation of existing authorities-(1) the state government as the case may be shall, by suitable notification:- a) Appoint or re-designate any person or authority, as the Registrar General or Chief Registrar of Marriage or Registrar Marriage. b) Appoint or re-designate any person or authority competent to register marriages under this Act or under any other of law or by practice, a registrar for a particular local area and/or persons belonging to any particular community residing in a particular local area. (2) All persons and authorities appointed or re-designated under the provisions of this Act shall discharge their functions relating to registration of marriages in accordance with the provisions contained in this Act. 9. Jurisdiction of Registrars.- (i) In both rural and urban area, the jurisdiction for registration of compulsory marriage will have the same territorial limit, as is fixed for registration of birth and death. (ii) Every Registrar of Marriage shall be empowered to register a marriage solemnized within the local area of his jurisdiction or a marriage solemnized outside his jurisdiction, between persons at least one of whom is resident within his jurisdiction. CHAPTER III REGISTRATION OF MARRIAGES 10. Compulsory registration of marriages- (1) After the commencement of this Act, it shall be compulsory for all citizen residing in Jharkhand, whose marriage has been solemnised in the jurisdiction of a particular Marriage Registrar or if the marriage is solemnised outside the jurisdiction of Marriage Registrar but either of the parties of marriage is a resident of the particular Marriage Registrar jurisdiction, to get their marriage registered before the office of that Marriage Registrar. झारख(cid:5)ड गजट (असाधारण) मंगलवार, 13 माच,,, 2018 19 (2) Provided that in case of any marriage, where one of the parties is non-resident Indian or foreign national, it shall be mandatory for such parties to disclose and mention in writing, his/her passport number, name of country from which it has been issued and its period of validity, besides his/her permanent residential/official address in the country of current overseas abode and his/her valid, present social security number or any such similar other identification proof officially issued by the country of foreign abode, which information shall be entered in the certificate of marriage as also in the marriage register. (3) Provided that a marriage registered under any other enactment relating to registration of marriage for the time being in force, need not be registered under this Act. Provided further that nothing contained in any other Act or law shall preclude the parties to a marriage from registering their marriage under the provisions of this Act. (4) It shall be a duty of both the parties to the marriage to take all necessary steps for compulsory registration of marriage. 11. Conditions relating to registration of marriage:- For the registration of marriage the following conditions need to be fulfilled:- (i) The bride must have completed 18 years of age and bride groom 21 years. (ii) Neither party should have a spouse living, unless specifically provisioned in the personal law of the party. (iii) Neither of them should be mentally insane or lunatic (iv) Neither parties should be within degree of prohibited relationship (v) Neither of them should be incapable of giving a valid consent to it in consequence of unsoundness of mind (vi) Either of the parties must be a citizen of India and a resident of the jurisdiction of concerned marriage officer or the marriage should have been solemnized in that jurisdiction. 12. Procedure for registration of marriage:- (a) All application for compulsory registration of marriage may be submitted online or in prescribed format as Form-I in the Annexure before the Registrar of Marriages of that particular jurisdiction. Date and time may be fixed for appointment for the personal appearance of applicant and witnesses. 20 झारख(cid:5)ड गजट (असाधारण) मंगलवार, 13 माच,,, 2018 (b) For this purpose, parties of marriage will be required to fill online the application form having details such as name, photographs, age, dwelling place, profession, date of marriage, place of marriage, Aadhar Number, Mobile number or such other details as the department may require of both the parties of marriage. (c) In rural areas, with the application, the parties will attach a certificate from the level of respective Mukhiya or Sarpanch or any gazetted officer or such other person as the State Government may notify, mentioning that “I hereby certify that, the marriage of Mr. and Mrs.………….. has been solemnized on…………. Date. While in urban areas, the parties will be required to attach a certificate from the level of ward commissioner, any gazetted officer or such other person whom the State Government notifies, mentioning that “I hereby certify that the marriage of Mr. and Mrs……………….. has been solemnized on………………. Date. (d) The applicants will be required to upload the above mentioned certificate, wedding photos, wedding card or certificate of marriage from priest, Kazi etc., age proof, Residence proof, Adhaar card or such documents as the department may require at the time of submission of online application. (e) At the time of submission of application for compulsory registration of marriage, a fine/late fee, as prescribed by the State Government shall also be paid online. (f) After the successful submission of application, an Id will be generated and the applicants will be able to track the status of their application, through this Id. (g) The Registrar of Marriage shall examine with his user ID and Password the application online, and if he finds any defect in the application he will communicate to the parties online for its rectification within one month of the submission of application. He will also communicate the parties, about the objection raised by any one regarding their marriage. (h) After one month, if the parties don’t receive any communication regarding the rectification of any mistake or regarding any objection to the registration of marriage, they will appear before the Registrar of Marriage for the registration of their marriage. झारख(cid:5)ड गजट (असाधारण) मंगलवार, 13 माच,,, 2018 21 (i) In the office of Marriage Registrar, all documents, regarding applicant’s age, dwelling place, identity Certificate from the level of Mukhiya/Ward Commissioner, etc. will be examined. If the Registrar of Marriages finds everything proper, the photograph of the applicants along with 3 witnesses will be captured and the certificate of marriage will be generated online by the Registrar of Marriages. The applicant will be able to download the certificate of marriage issued by the Registrar of Marriage. (j) Each office of the Registrar would endeavour to provide a prior appointment on a designated date and time for the personal appearance of the applicant along with the witnesses either telephonically, through a text message (sms), email or other alternative means giving no less than one day advance notice to the applicant. (k) The applicant would have the choice of adopting a paper based process wherein the prescribed application and other proofs as mentioned in 12 (C)(D) may be submitted to the Registrar in paper form. The payment of all fees shall be made online at the time of submission of application at the treasury or such authorized service outlets. (l) The applicant would be able to submit the application through the Common Service Centers, or other service outlets authorized/ notified by the government. (m) Registrar shall receive and scrutinize application in Form-I for registration of marriages and ensure that all the documents required (as detailed in Form-I) with the application have been received. On being satisfied with the genuineness of the documents submitted, the Registrar shall register the marriage by making entry in the prescribed register as per Form-II. (n) In case of marriage of any indian citizen solemnized in india with a person of foreign domicile the Registrar shall verify such domiciliary status from the embassy of the country of which he/she claims to be citizen. (o) For offline Marriage the parties to a marriage shall prepare and sign memorandum on prescribed form and deliver the same in duplicate to the Registrar of the area concerned within a period of 1 Year from the date of marriage, who will publish it on the notice board of office so that if any one of has objection, he could lodge it. 22 झारख(cid:5)ड गजट (असाधारण) मंगलवार, 13 माच,,, 2018 (p) At the time of personal appearance the following documents are required as proof of marriage: (a) At least two wedding photos, wedding card or certificate from religious institution or priest who solemnized the wedding or Nikah Naama or Certificate from Anand Karaj in Gurudwara's. (b) Three Joint photos of husband and wife (3 inch x 2 inch photographs i.e. two for marriage certificate and one for office record). (c) The documents/certificates mentioned in para 12(c)(d). 13. Where on scrutiny of the documents, the Registrar concerned is satisfied that there is no objection to registering the marriage, he shall register the same within the period as may be prescribed by making an entry in the register, as at Form-II. (a) Registrar may call upon the parties to produce such further information of documents as deemed necessary, for establishing the identity of the parties and the witnesses or correctness of the information or documents presented to him: or (b) If deemed necessary, he may also refer the papers to the local police station within whose jurisdiction the parties reside, for verification. 14. Whereas the Registrar before whom the memorandum/application form is presented, on scrutiny of the documents submitted with the application or, on the other facts noticed or brought to his notice, has reason to believe that - (a) The marriage between the parties is not performed in accordance with the Personal law of the parties: or (b) The identity of the parties of the witnesses or the persons testifying the identity of the parties and the solemnization of the marriage is not established beyond reasonable doubt; or (c) The documents tendered before him do not prove the marital status of the parties. 15. The Registrar, after hearing the parties, refuse to register the marriage if it is not fit for registration and after recording the reasons in writing, in such event, the registrar shall send the duplicate copy thereof to the Chief Registrar of Marriage. झारख(cid:5)ड गजट (असाधारण) मंगलवार, 13 माच,,, 2018 23 16. Registrar shall register only those marriages for which the applicants fulfil all the conditions as stated above and the application for registration is presented within the stipulated period of one year from the date of marriage. 17. The Registrar shall issue two copies of the marriage registration certificate in Form IV, free of cost to the couple under his hand and seal. 18. The Registrar shall send an annual report to the Chief Registrar of Marriage, for each calendar year, by the 15th of January of the subsequent year. 19. Maintenance of Records and Certified Copy:- (i) All records of online application, queries raised by the marriage registrar, all objections regarding marriage, all marriage certificates shall be preserved digitally while the records of offline application will be maintained in hard copy. (ii) At the time of issuing marriage certificate index relating to it having the particulars such as the name of both parties, address date of marriage registration etc. will be generated online. Parties to marriage will be permitted to search & inspect, on payment of cost prescribed in rules these indexes and obtain certified copy of marriage certificate online paying the required fees fixed by the State Government. Every other person will be permitted to view and inspect these index and obtain certificate from registrar of marriage subject to permission granted by registrar of marriage. The marriage registrar shall grant permission on finding that it is being used for genuine and reasonable purposes. 20. Objection to Marriage Registration:- (i) Any person who wants to lodge an objection regarding the registration of marriage will be required to submit online a written complaint before the Registrar of Marriage along with an affidavit regarding the genuineness of his objection. (ii) This objection can be lodged within 15 days of the submission of marriage application along with the prescribed fee, if any. (iii) The Registrar Marriage will examine the objection and pass order within reasonable time. 24 झारख(cid:5)ड गजट (असाधारण) मंगलवार, 13 माच,,, 2018 21. Registration to be no proof of the validity of marriage:- The registration of marriage under this Act shall not be a proof of the validity of marriage under any law. It shall only be proof of registration of marriage. 22. Time Limit of Compulsory Registration of Marriage:- After the commencement of this Act, it shall be compulsory for all people mentioned in section 10, to get their marriage registered in the office of Marriage Registrar of that particular jurisdiction, within one year of the solemnisation of marriage. But for those couple who have got their marriage registered under any other Act such as Special Marriage Act, 1954, Hindu Marriage Act, 1955, Anand Vivah Act, 1909, Kazi Act, 1880, Indian Christian Marriage Act, 1872, or any other Act for the time being in force, or marriage solemnized before commencement of this Act, the registration of marriage under this Act will be only optional and not compulsory. 23. Penalty:- (i) A penalty of Rs 5 per day, subject to a maximum of Rs 100 will be levied from the parties at the time of marriage registration, in case of non registration of marriage with in time without reasonable cause. The Marriage Registrar may remit the fine on proper cause being shown. (ii) Any person who makes a false statement regarding his marriage or other details shall be punished which may extend upto Rs. 5000. (iii) Making baseless and false objection about the registration of marriage shall also attract a penalty of Rs. 5000. (iv) All Registrar of Marriages, who fail to register marriage without proper reason will be liable of departmental proceeding under their service rule. 24. Fee for Registration of Marriage:- (i) All online/offline application for Compulsory Registration of Marriages will be submitted with online payment of Rs. 50 as registration fee (ii) No fee or late fine will be charged from the applicants, if either of the two, or both belong to Below Poverty Line category. (iii) A fee of Rs 50 to be paid online will be charged for getting the certified copy of a marriage certificate. (iv) For searching the indexes, a fee of Rs. 10 per year will be charged from the applicant. 25. Certificate of Registration of Marriage to be Conclusive Proof of Marriage Registration.- झारख(cid:5)ड गजट (असाधारण) मंगलवार, 13 माच,,, 2018 25 (1) A Certificate of Registration of Marriage shall be conclusive proof of the marriage registration of the parties named in the certificate. (2) A Certificate of Registration of Marriage issued under this Act shall ordinarily be received by any court, government office or public authority as proof of marriage between the persons named therein and the same shall be presumed to be correct, unless the contrary is proved. 26. Appeal against the order of refusal of marriage registration:- (i) All appeals against the order of refusal of marriage registration by the Marriage Registrar shall be made before the Chief Registrar of marriage within one month of the order of refusal. (ii) Appeals against the order of Chief Registrar of marriage will be made before the Registrar General of Marriage, within one month of order. 27. Non registration of marriages.-No marriage performed to which this act applies shall be deemed to be invalid solely by reason of the fact that it was not registered under this Act. 28. Voluntary registration of Marriages.- Persons married before the coming into force of this Act and whose marriage is not already registered under any other Act previously in force, may also register their marriage under this Act by following the procedure under the Act. 29. The provision of this Act shall be in addition to and not in derogation of the provisions of Indian Christian Marriage Act 1872, Anand Marriage Act 1909, Hindu Marriage Act 1955, Special Marriage Act 1954, Kazi Act 1880, Foreign Marriage Act 1969, the Parsi Marriage and Divorce Act 1936 or any other custom or personal law relating to marriage. 30. Indemnity - No suit, prosecution or other legal proceeding shall be instituted against any person for anything which is done or intended to be done in good faith under this Act or the rules made there under. 31. Power to remove difficulties - (1) If any difficulty arises in giving effect to the provisions of this Act, the State Government, by notification in the official Gazette, make such orders, not inconsistent with the provisions of this Act, as to appear to it necessary or expedient for removing the difficulty. (2) Every order made under this section, as soon as may be after it is mad be laid before the state legislative while it is in session. 32. Power to make rules.
