West Bengal Act XX of 1955 THE SADAR AND SUBDIVISIONAL HOSPITALS ACT, 1955. [Passed by the West Bengal Legislature.] [Assent of the Governor was first published in the Calcutta Gazette, Extraordinary, of the 9th September, 1955.] [9th September, 1955.] An Act to provide for the taking over of certain Sadar and ' Subd,ivisional hospitals by the State Government with a view to the better promotion of public health. It is hereby enacted in the Sixth Year of the Republic of India, by the Legislature of West Bengal, as follows:- 1. (1) This Act may be called the Sadar and Sub- Short title and com• divisional Hospitals Act, 1955. menefi- moat. (2) It shall come into force on such dais as the State Government may, by: notification in the Official Gazette, appoint. 2. In this Act, unless the context otherwise requires,— Definitions. (a) "appointed day" means the date appointed under sub-section (2) of section 1; (b) "the said hospitals" means the Sadar and Sub- divisional hospitals described in the Schedule and includes(cid:9) any dispensaries attached to such hospitals. 3. As from the appointed day,— (cid:9) Transfer. (1) (a) the said hospitals together with all lands, build- ings, erections, fixtures, furniture, equipments, stores, drugs, monies, contracts, debts and all other assets and liabilities thereof shall, subject to sub-section (2); stand transferred to the State Government ; ‘(b) the said hospitals shall be run by the State Government as State Hospitals; (c) persons employed in the said hospitals and conti- nuing in office immediately before the appointed day shall, as from that day, be deemed to be employees of the State Government and the terms and conditions of their service shall be such as may be determined by the State Government having regard to the terms and conditions of their service as in force before that day; (2) all endowments and trust funds, created solely or substantially for the purpose of the maintenance or improvement of the said hospitals, shall stand transferred to and be administered by the Official Trustee, West Bengal: Provided that the income from every such endowment and trust fund shall be credited to the State Government and shall be applied by the State Government for the purposes for which the 2(cid:9) The Sadar and Subdivisional Hospitals Act, 1955.
