AND WHEREAS, it is mandatory to get the election of notified societies conducted by an authority within six months from such notification which may further be extended for a period of six months could not be completed on account of various factors such as prolongment of reorganisation process and strike of non-gazetted employees leading to delay in preparation of Voter List. Besides this, due to the proposed Lok Sabha Election, whose process is likely to be completed in May, 2009 and as such the election is not possible to be completed in the stipulated time. AND WHEREAS, it was necessary to have more time to get the election of notified societies conducted by an authority. AND WHEREAS, it is necessary to bring out certain amendment to the Bihar Co-operative Societies Act, 1935. Be it enacted by the Legislature of the State of Bihar in the sixtieth year of Republic of India as follows:- 1. Short title, extent and commencement.- (1) This Act may be called the Bihar Co- operative Societies (Amendment) Act, 2009. (2) It shall extend to the whole of the State of Bihar. (3) It shall come into force at once. 2. Substitution of Section-14A of the Bihar Co-operative Societies Act, 1935.—The "sub- section (3)" of Section-14A of the said Act shall be substituted by the following:- "Not withstanding anything contained in the sub-section (9) of the Section-14 of this Act, rules made thereunder and the bye-laws of the registered society, the election of the managing committee of the class or classes of the registered societies notified under sub-section (1) shall be held within six months from the date of such notification and which may further be extended with due reason for a term of six months at a time but not exceeding two years from the date of first publication of such notification in the official gazette.
