The pali municipality administrator appointment (validation) act, 1961

--- Section 1. Section 1.Short title --- This Act may be called the Pali Municipality Administrator Appointment (Validation) Act, 1961. --- Section 2. Section 2.Validation of the appointment of Administrator and his actions --- (1) Notwithstanding anything contained in the Rajasthan Town Municipalities Act, 1951 (No. 23 of 1951 repealed) or the Rajasthan Municipalities Act, 1959 (No. 38 of 1959) or any other enactment, law or rule or in any judgment, decree or order of any court- (a) the appointment of Sub-Divisional Officer, Pali, by virtue of his office as administrator to exercise the powers and perform the duties of the Municipal Board, Pali, made under State Govern- ment Notification No. D. 6352./F. 1 (24) LSG/A/58, dated 21st August, 1959 in consequence of the election of all members of the Board, Pali, having been declared void by the Rajasthan High Court, shall be valid and shall be deemed always to have been valid and such administrator shall continue to perform all the functions and discharge all the duties of the Municipal Board, Pali, as if he was an administrator deemed to have been appointed under section 295 (4) (c) (ii) of the Rajasthan Municipalities Act, 1959, till the re-constitution of the Board; (b) all taxes levied and recovered by such administrator within the Pali Municipality shall be deemed always to have been lawfully levied and recovered in pursuance of the statutory taxing powers of the Board; and (c) all rules and bye-laws made and other actions taken by him in the exercise of the statutory powers of the Board shall be deemed always to have been lawfully made and taken, as the case may be, and to be operative, and in full force within the Pali Municipality. (2) No such tax, rule, bye-law or other actions shall be liable to he called in question nor shall the propriety or otherwise of the appointment of the said administrator shall be challenged in any Court on the ground that the appointment of the administrator was in any way defective. --- Section 3. Section 3.Repeal --- The Pali Municipality Administrator Appointment Validation Ordinance, 1961 (Ordinance No. 1 of 1961), is hereby repealed.
