(EXTRA), DECEMBER 26, 2005 241 (PAUSA 5, 1927 SAKA) (q) “prescribed” means prescribed by Statutes, Ordinances and Regulations; (r) “President”means the President ofthe Lovely International Trust; (S) “Principal”meansa Headoftheinstitution andincludesany otherpersonofficiatingas such ; \ (t) “Registrar” means the Registi'arofthe University ; (u) “State” means the State ofPunjab ; (v) “Statutes”, “Ordinances” and “Regulations” means respectively, theStatutes,OrdinancesandRegulationsofthe UniversitymadebyitunderthisAct ; (W) “Teacher” includes Professor, Reader, Associate Professor, Assistant Professor, Lecturer and any such other person imparting instructions on full time or part time basis in the Universityorinstitution; (X) “Trust”meanstheLovelymtcmationalTrust ; (12) “University” means the Lovely Professional University as incorporatedunderthisAct ; (Z) “Vice-Chancellor” means the Vice-Chancellor of the University; and (20) “Visitor”meanstheVisitoroftheUniversity. . 3. (1) There shall be established a University by the name of the Establishment of LovelyProfessionalUniversityintheStateofPunjab. the University. (2) TheUniversityshallbeabodycorporatebythename,specified in sub-section (Ij, and shallhaveperpetual succession andacommon seal. It shall have the power to acquire, hold and dispose ofpropertyboth movable and immovable and to make contract, and shall sue, and be sued by the said name. (3) The headquarters of the University shall be at Jalandhar— Ludhiana G.T. Road, near Cheheru RailwayBridge, Phagwara, District Kapurthala 242 PUNJAB GOVT GAZ. (EXTRA), DECEMBER 26, 2005 (PAUSA 5, 1927 SAKA) Objects of the 4. Theobjects ofthe University shall be}- University (i) toprovide for instruction, teaching, education, research and trainingatall levels in all disciplines ofeducation including professional,medical,technical,higher,generaleducationand in any other streams and subjects, as per the needs of the industry and the society in general, as may be deemed necessatybytheUniversitythroughallthemodesofeducation, as may emerge or become relevant in future ; ‘ (ii) toundertakeindustryorientedteaching,Walnutsandresearch, extensionprogrammesandtoprovideemployableskillsW? a viewto contribute tothe developmentofthe society ; {s (iii) to provide for research, creation, advancement and disseminationofknowledge, wisdomandunderstanding;and (iV) to‘cloallsuchactsandthings,asmaybenecessasvordesirable to fudherthe objects ofthe University. Powers and 5. TheUniversityshallhavethefollowingpowersandfunctions abe f“"°"°"s ”f exercised and performed by or through its various officers and authoritnes, the University. namely:——~ (1') to make provisions for instruction, teaching, education, researchandtrainingatalllevelsinalldisciplinesofeducation through all possible modes including regular, continuing, distance,onlineandotherinnovativemodes, as it maydeem necessary and appropriate ; (ii) tocond‘... .‘andholdexaminationsandgrantorconferdegrees,' diplomas, cwtificates, awards, grades, credits, honorary degrees, academic distinctions as well as other distinctions andcertifications ; (iii) tocreate,designandrunvariouscoursesofstudyandprescribe the curricula for the same, as maybe deemed appropriate ; {iv} toundertakeandpromoteeducational, cultural,co—curricular, extra-curricular,sports,games,athleticsandanyotherwelfare and development related activities and to confer awards, medals,distinctions,prizesandcredits ; PUNJAB GOVT GAZ. (EXTRA), DECEMBER 26, 2005 243 (PAUSA 5, 1927 SAKA) (V) to generate resources through fees, consultancy services, testing, continuinganddistanceeducationprogrammes ; (Vi) to provide for equivalence of the degrees, diplomas and certificates ofthe studentscompletingtheircoursespartially or in full from any other University, Board, Council or any othercompetentauthority ; (vii) toinstituteandawardfellowships, scholarships, studentships, Exhibitions, visitorships,medalsandprizes ; (viii) to institute and confer the designation ofProfessor, Reader, AssociateProfessor,AssistantProfessor,Lectureroranyother equivalent designation as maybe required by the University oritsinstitutionsandtoappointpersonstosuchposts ; {ix} to provide for dual degree, diploma or certificate and simultaneousdegree ordiplomaorcertificate ; (x) to establish, operate and manage its campus, its constituent colleges,institutionsandregionalcentres,zonalcentres,study centres or learning centres, by whatever name they may be called; (xi) to design and run various academic, practice oriented or integratededucationprogrammesandother coursesatvarious levels and award certificates ; (xii) ‘ toreceive funds, grants, advances and loans from thebanks, institutions, corporate sectors, international organizations, institutionsoranyothersource ; (xiii) toreceivegifts,donations, funds,benefactionsandbequests, both movable and immovable, from donors, benefactors, internationalorganizationsoranyothersource ; (xiv) topurchase, acquire and take on lease ormortgage, and sell, lease, mortgage, alienate and transfer any immovable or mdvablepropertybelongingto orvestedin the University ; (IV) to prescribe the fee structure at its own level for the various categories ofstudents as may be specified by the University andto fix, demandandreceive fees, funds, security andother charges from the students studying in the University and in theinstitutionsaffiliatedtoit ; 244 PUNJAB GOVT GAZ. (EXTRA), DECEMBER 26, 2005 (PAUSA S, 1927 SAKA) (xvi) to collaboratewithotherinstitutions, colleges,universities, researchorganizations,industryassociationsororganizations, professionalassociations,Statebodiesoranyotherindividual, institutionororganization; (xvii) to fix, determine and provide remuneration to the officers, teachers and employeesofthe University ; (xviii) toraise,collect,subscribeandborrowmoneyonthesecurity \ ofthepropertyoftheUniversity ; (xix) to issue no objection. certificate, essentiality certifies feasibilitycertificate,eligibilitycertificate,letterofintentor anyothercertificateordocumentortomakerecommendation asmayberequiredtostartanynewinstitutionornewcourse orforadditional intake in the existing studyprogrammesor coursesbytheUniversity,itsinstitutionsorbyanyinstitution runbytheTrust; (xx) to create administrative, academic, executive, teaching and otherpostsandtomakeappointments thereto ; (xxi) to create and incorporate societies, trustandany one:body orentityandtoestablishtraininginstitutes,centres,hospitals andundertakevariousactivitiesrelatedtoindustry,academia or research ; (xxii) to run, certify‘and recognize the various programmes or courses offered and recognized by other State Boards, Councils,otherUniversitiesoranyotherbodyandtoexecute” orsignaMemorandumofUnderstandingwiththeconcerned StateBoard,Council,otherUniversityoranyotherbody; (xxiii) toprescribeandchargefines,penaltyandtakeanydisciplinary action for the misconduct or disobedience, violationofthe Rules,Regulations,StatutesorOrdinances ; (xxz'v) toconductvariousentrancetests, examinationsoranyether testonitsownorwiththehelpofanyotheruniversity,institutim oranyotherbody ; (xxv) to affiliate the centres and institutions establishedorrunby theTrust ; PUNJAB GOVT GAZ. (EXTRA), DECEMBER 26, 2005 245 (PAUSA 5, 1927 SAKA) (xxvz) todoselfcertification,whichshallbeexemptedfromobtaining any permission, approval, license, certificate, no objection certificate,authorizationoranyotherdocumentfromtheState Governmentoranyentityorautonomousbodycreatedbythe State Government or under any State Act and Central Act insofaras itis applicableto the State ; (xxvii) to create and operate trusts and endowments ; (xxviii) to frame Statutes;Ordinances and Regnlations for carrying outtheobjectsoftheUniversityandtoalter,modifyorrescind the same ; and (xxix) todoallsuchotheracts,whichmaybenecessary ordesirable to furthertheobjectsoftheUniversity. 6. (I) In pursuit ofits objectives and in exercise ofits powers and in University not performingofitsfunctions,theUniversityshallnotdiscriminatewithanyperson to discriminate. whosoever on the basis ofcaste, class, colour, creed, sex, religion, area or race. (2) The University shall adhere to the State Policy in respect of reservationmadeby theStateGovernmentundertheConstitutionofIndiaor any 3thc: law-"for the time being in force for reserving seats for different categoriesofstudents in respectofthe Statequota forPunjab domicile. 7. (I) TheUniversity shall exercise itsjurisdictionwithin its campus. Jurisdiction of the University. (2) Notwithstandinganythingcontainedinsub-section(1),theTrust ortheUniversitymay setup orruninstitutions outside thejurisdictionofits campus and the institutions so set up or run, shall be deemed to have been affiliatedWiththeUniversityirrespectiveofthefactthattheareawithinwhich suchinstitutionsarerunorsetup, fallwithintheterritorialjurisdictionofany otherUniversity,Boardoranyotheraffiliatingbody. (3) AftertheestablishmentoftheUniversity,itmaydecideastofrom whichdatetheinstitutionsrunorestablishedbytheTrust,whichwereearlier affiliatedtoanyotherUniversity,Boardoranyotheraffiliatingbody, shall be affiliatedwiththeUniversity. 8. Thefollowingshallbetheofficersofthe University,namely fw~ Officers of the University (i) theVisitor; (it) theChancellor; 246 PUNJAB GOVT GAZ. (EXTRA), DECEMBER 26, 2005 (PAUSA 5, 1927 SAKA) (iii) theVice-Chancellor; V (iv) the Registrar ; '(v) theDirector-General ; (vi) the Deans ; (vii) the Directors ; (viii) theFinance Officer; and . \ (ix) SuchotherofiicersoftheUniversity, asmaybedeclaredbyit bystatutes tobe the officersoftheUniversity. "N 9. (1) The GovernorofPnnjab shall betheVisitor oftheUniversuy. (2) The VisitorshallpresideovertheconvocationoftheUniversity. -.(3) TheVisitorshallhavetherighttocall foranyinformationrelating totheaffairs oftheUniversity. (4); The Visitor in consultation with the Chancellor, may cause the inspection,scrutiny,investigation,surveyorinquiryoranyothersuchlikething _ tobemadeby_suchperson,ashemaydirect,oftheUniversity,itsconstituents andinstitutionsinrespectofadministrative,academicorexecutivemattersof theUniversity. . (5) TheVisitorshall,ineverycasegivenoticetotheUniversityofhis intentiontocausetheinspection,scrutiny,investigation,surveyorinquirytobe madeandtheUniversityshallappointarepresentative,whoshallbepresentat suchinspection,scrutiny,investigation,surveyorinquiry (6) TheVisitormayinformtheVice-Chancellorabouttheresults of suchinspection,scrutiny,investigation,surveyorinquiryandtheVice—Chaneellor shall communicateto the Governing Council the views ofthe Visitor along with-such advice, as theVisitor may have tendered on the actiontobe taken on'suchadvice. (7) The Vice—Chancellor shall inform the Visitor about the action takenorproposedtobetakenbytheUniversitywithrespecttotheinspection, scrutiny)investigation,survey,inquiryoranyothersuchlikething. (EXTRA), DECEMBER 26, 2005 247 (PAUSA 5, 1927 SAKA) (8) If any agency or authority of the State Government wishes to maketheinspection,scrutiny,investigation,surveyorinquiryoranyothersuch likethingoftheUniversity,itsconstituents oranyinstitution,thenareference in this regard shall have to be made to the Visitor who, ifsatisfied, may in concurrence with the Chancellor, cause an intended inspection, scrutiny, investigation, surveyorinquiryoranyothersuchlikething tobemadeas"per theprovisionsofthis section. 10. (1) ThePresidentshallbetheChancelloroftheUniversityandin The Chancellor theabsenceoftheVisitor,theChancellorshallpre§ideovertheconvocationof theUniversity. , (2) The Chancellorshall betheChairman oftheGoverningCouncil and he shall decide or approve. all appointments, nominations, removals, suspensions and reinstatements of the University either suo moto or as ' reeommendedbytheconcernedauthorityoftheUniversityfromtimetotime. (3) The Chancellormay'amendorrevokeanydecisiontakenbyany authority or ofilcers ofthe University, and may exercise his powers either suo moto or otherwise to do. all necessary things to facilitate the smooth fimctioningoftheUnivereity. ' (4) The’Chancellorshallhavethepowerto'doall suchotherActs, as may be required to further the objects ofthe University and the decisions taken by the Chancellor, shall be final and binding on all concerned ofthe University. 11. (1) TheVice-ChancellorshallbeappointedbytheUniversityonsuch The Vice Chancellor. terms andconditions, asmaybeprescribed. (2) The Vice-Chancellor shall be the Principal Administrator and Academic Officer oftheUniversity. (3) The Vice-Chancellor shall preside over the convocation in the absence ofthe VisitorandtheChancellor. (4) The Vice-Chancellorshall exercise thegeneral superintendence and control over the affairsoftheUniversity. (1) The Registrar shall be appointed by the University and he shall be a whole-time salaried officer ofthe Univelsity on such terms and conditions, asmaybeprescribed. (2) The Registrar shall conduct the official correspondence ofthe Un1vers1tyandshallkeeptheminutesofthemeetingsoftheGovemingCouncil. AcademicCouncil,ExecutiveConnoilandFinanceCommittee. (3) The Registrarshallbethecustodianoftherecordscommonseal andsuchotherpropertyoftheUniversity,astheGovemingCouncilmayentrust to hischarge. (4) TheRegistrarshallexercisesuchpowersandperfonnsuc‘?ti_es as may fiom time to time be assigned to himby the Chancellor, Governing CounciloranyotherauthorityoftheUniversity 1 The Director- 13. In the event ofoccurrence ofany vacancy in the office ofthe of vacancies. (1) TheAcademicCouncilshallconsistofthefollowingpersons, Council. namely:—— (/a) theVice-Chancellor; Chairman (b) twopersons from the Academia or Members Industry, tobenominatedbytheChancellor; (C) oneNomineeoftheGovernment Member ofthe State ofPunjab, Department of TechnicalEdueation orMedical EducationorHigherEducation ; (d) all Deans, Heads oftheDepartments Members andDirectors oftheUniversity ; A (e) PrincipalsandDirectorsofthe Members InstitutesoftheTrust ; C” Incharge ofthe Libraryofthe Member University;and (5;) , twopersons, tobenominatedbythe Members Chancellor. (2) The Registrar shall be the Member—Secretary ofthe Acaecmic Council. . (3) The Academic Council shall be the supreme academic body of theUniversity. The Academic Council shall, subjectto theprovisions ofthe Ordinances, StatutesandRegulationshavethepowertocontrol,regulateand maintain the standards of teaching, education and examinations and shall exercise suchpowers andperform such duties, as maybe prescribed. The Executive 21. (1) TheExecutive Councilshallconsistofthefollowingpejns, Council. namely:~ (61) theChancellororhisnominee; Chairman (b) theVice-Chancellor; Member (C) one Dean, tobenominatedby the Member University; ' (4)., .oneMember ofthe Trust, to Member ‘ benominatedbytheTrust; and PUNJAB GOVT GAZ. (3) The Executive Council shall be the supreme executive body of theUniversity.TheExecutiveCouncilshallexercisesuchpowersandperform such functions, as maybeprescribed. \ (4) TheExecutiveCouncilshallberesponsiblefortheadministration, development and management of the affairs and all other matters of the University. (1) There shall be an Academia-Industry Interface Council The Academia- consistingofthefollowingpersons,namely:~« Industry Inter- face Council, (a) onedistinguishedpersonfromIndustry, .. (EXTRA), DECEMBER 26, 2005 253 (PAUSA 5, 1927 SAKA) (e) the withdrawal ofdegrees, diplomas, certificates andother academicdistinctions ; (f) the establishment, maintenance and abolition offaculties, departments,hostels, collegesandinstitutions ; (g) theconditionsofaffiliationofinstitutionswiththeUniversity andthoseunderwhichaffiliationmaybewithdrawn ; (h) the institution of Emeritus Professorships, Visiting Professorships, fellowships, scholarships, studentships, medalsandprizes ; (i) the classification and nomenclature ofteachers and other postsoftheUniversityanditsaffiliatedinstitutions ; (j) theacceptanceandmanagementofbequests,donationsand endowments ; and (k) allothermatters,forwhichStatutesarerequiredtobemade underthisAct. ' (4) 1111131 the Statutes are made by the Governing Council, the Universitymayborrowthe StatutesmadebyanyotherUniversitytowhichit may deemappropriate. 25. (3) Subject to the provisions ofthis Act and the Statutes, the Ordinancesmayprovide forthefollowingmatters,namely :— (a) theadmissionofstudentstotheUniversityandtheirenrolment as such ; (b) thecoursesofstudytobelaiddownforalldegrees,diplomas andcertificates ofthe University ; (c) the degrees, diplomas, certificates and other academic distinctionstobeawardedbytheUniversity, thequalifications 254 PUNJAB GOVT GAZ. (EXTRA), DECEMBER 26, 2005 (PAUSA 5, 1927 SAKA) forthe-vsame, and the procedure to be adopted for granting and obtainingofthe same ; (d) thefeestobechargedforcoursesofstudyintheUniversity and its affiliated institutions and for admission to the examinations for degrees, diplomas and certificates ofthe University; (6) the conditions for the award offellowships, scholarships, studentships,medalsandprizes; (f) the conduct ofexaminations, including the terms ofoffice andmannerofappointmentandthedutiesoftheexamining, bodies,examinersandthe like ; . (g) the maintenance of discipline among the students ode University; ' (h) theconditionsofresidenceofstudentsattheUniversity ; (1‘) the emoluments andthe terms and conditions ofservice of teachingandnon—teachingemployeesoftheUniversity; (j) themanagementoftheinstitutionsfoundedoradministered bytheUniversity; (k) thesupervisionandinspectionofinstitutionsoftheUniversitv oraffiliatedwiththeUniversity;and (1) allothermatters,whichunderthisActortheStatutesareto be ormaybeprovided forbythe Ordinances. (4) Until the Ordinances are made by the Governing Council, the University may borrow the Ordinances made by any other University from whichitmaydeemappropriate. 26.(I) TheGoverningCouncilmay, fromtimetotime, makeregulatiopx Power to make Regulations. or may amend orrepeal the same. (4) Until the Regulations are made by the Goveming Council) the Universitymayborrowthe Regulations made by any other University from whichitmaydeemappropriate. 27.
