Protection of acts Schedule The Global Open University (Nagaland) Act,2006 (Act No. 3 of 2006) Received the assent of the Governor of Nagaland on 30f0812006 and published in the Nagaland Gazette Extraordinary dated : 18" of September, 2006. To establish a Private University by name the Global Open University (Nagaland) in the State of Nagaland and to provide for matters connected therewith or incidental thereto. Whereas the Government of Nagaland had signed a Memorandum of Understanding with a Trust called the World Institution Building Programme (WIBP), New Delhi, on the 13" September, 2005, for allowing the said Trust to establish a Private University in the State of Nagaland to offer to the people of Nagaland more choices for pursuing higher professional, technical and technological education; and Whereas the establishment of a Private University can be done only through anAct of the State Legislative Assembly as per provisions in the University Grants Commission (Establishment and Maintenance of Standards in Private University) Regulations, 2003: Be it enacted by the Nagaland Legislative Assembly in the fifty-seventh year of the Republic of India as follows: Chapter 1 Preliminary Short title and commencement 1. (1) This Act may be called the Global Open University (Nagaland)A ct, 2006. (2) It shall come into force on the date appointed by the State Government by notification in the Official Gazette. Defmitions 2. In this Act, unless the context otherwise requires, the following words shall have the meanings assigned herein: (1) "Academic Council" means the Academic Council of the University; (2) "Board of Studies" means the Board of Studies constituted under this Act; (3) "Chancellor" means the Chancellor of the University; (4) "Director" means a Director of the University; (5) "Executive Council" means Executive Council of the University; (6) "Finance Committee" means Finance Committee of the University; (7) "Finance Officer" means Finance Officer of the University; (8) "Fund" means the funds of the University and includes fund for a sponsored scheme; (9) "Governing Council" means the Governing Council of the University; (10) "Governor" means the Govemor of Nagaland; (11) "Notification" means notification published in the Oflicial Gazette of the Government of Nagaland; (12) "Pro-Chancellor" means the Pro-Chancellor of the University; (13) "Registrx" means the Registrar of the University; (14) "Regulation" means a regulation made under this Act; (15) "Schedule" means schedule to this Act; (16) "State Government" means the State Government of Nagaland (17) "Trust" means the World Institution Building Programme, New Delhi registered under the Indian Trusts Act, 1882; (18) "UGC" means University Grants Commission constituted under the University Grants Commission Act, 1956 (19) University" means the Private University by name the Global Open " University (Nagaland) established under this Act; and (20) "Vice-Chancellor" means the Vice-Chancellor of the University. Chapter I1 Establishment, objectives powers and functions of University Establishment of University 3. (1) As soon as after the commencement of this Act, the State Government shall call upon the trust to sep up an endowment Fund of Rs. One crore for the purposes of the University. (2) Immediately after the setting up of the Endowment Fund as aforesaid, the State Government shall accord sanction for establishment of the university by name the Global Open University (Nagaland) and thereafter the Trust shall accordingly establish the University. (3) The State Government shall notify the fact of establishment of the University in the Official gazette as soon as may be after the establishment of the university by the Trust. "Provided that no such notification by the State Government shall be issued unless a High Powered Committee appointed in that behalf certifies to the State Government that all necessary infrastructure including buildings, equipments, Lcd~iilngs taff etc, are in place and that the provisions of section 60, wherever applicable, have been fully complied with by the University". (4) The University shall be a body corporate by the name aforesaid, having perpetual succession and common seal and shall, by that name, sue and be sued. (5) (i) The main campus of the University shall be at Wokha in the State of Nagaland. (ii) The University shall have power to establish other campuses, study centres etc, within the State of Nagaland for reasons of operational expediency and for broad basing the activities of the University. (6) The University may establish off-campus centres off-shore campuses and study centres subject to the provisions of the University grants Commission Act, 1956 and the regulations made thereunder and the provision of any law for the time being in force. (7) The University may further institute its own colleges and also affiliate any other college or institution in accordance with the procedure enshrined in regulations. Objects of University 4. (1) The University shall design and run courses and programmes leading to the award of certificates, diplomas, degrees of bachelor, master, doctoral and post-doctoral levels and other academic distinctions, under the faculties and in the subjects enumerated in the schedule to this Act. (2) The University, by regulation, has the power to abolish or create any faculty or any course or programme of study enumerated in the schedule without causing any detriment to the interests of teachers or students concerned, and any such regulation shall not be deemed as n amendment of this Act. (3) (i) The University may impart instructions in regard to a course or programme of study through one or more modes, which may include distance, continuing and regular modes of teaching and learning. (ii) Without prejudice to the above, the main objective of the University shall be to provide high quality professional, technical and technological in- campus, class room, foml and regular courses and programmes of study to the students hailing fromNagaland in such subjects, areas and fields of study whlch are generally not offered by other institutions in Nagaland. (iv) The University shall specially strive to have professional, academic and other possible link-ups and ties with various Centres of Excellence in and outside the country for promoting the standards of education provided, for improving the methodologies of teaching and for upgrading the potentials of teaching and non-teaching staff of the University. Powers and functions of University 5. (1) Without prejudice to the generality of the foregoing provisions, the University shall have the following powers and functions: (i) To provide for instruction, teaching and training in all branches of study and particularly for research, advancement and dissemination of knowledge through establishment of institutes, departments, schools, faculties and other centres of excellence; To hold examinations and to grant and confer certificates, diplomas, degrees and other academic distinctions on those pass the examinations, to confer honorary distinctions on men and women of (ii) Eminence and to withdraw the certificates, diplomas etc., from those who had been conferred for good and suficient reasons; (iii) To transform the University into a Centre of Excellence particularly in the fields of healthcare, medical and para-medical education, hospital administration, physical and biological sciences, technology including information and communication technologies, Engineering, Social Work, Environmental Science, Law, Fine Arts etc.; (iv) To maintain and manage the physical and financial assets of the University in the most effective manner with a view to promoting the purposes of the University; (v) To appoint professors, associate professors, assistant professors, readers, lecturers and others connected with teaching with a view to imparting instructions of very high standards; (vi) To establish all physical amenities conducive to the most effective learning by the students enrolled with the University; (vii) To institute fellowships, scholarships, prizes, medals etc., with a view to promoting research and motivating study; (viii) To collaborate, cooperate and act jointly with other organizations, institutions, Universities etc., within and outside India, particularly in the fields of medical education, Engineering, Technology, Environmental Science, Law and Fine Arts etc., for suL~ib'iz ning research and improving the quality of instructions to students; (ix) To disseminate knowledge through seminar, conferences, executive education programs community development programs, publications and training programs; (x) To provide consultancy to industry, Government and public organizations; (xi) To establish and maintain within the premises of the University or elsewhere, such class rooms, study halls as University may consider necessary and adequately furnish the same; (xii) To receive grants, subscriptions, donations and gifts for the purpose of the University and consistent with the objects for which the University is established; (xiii) To purchase, take on lease or accept as gift or otherwise any land or building or works which may be necessary or convenient for the purpose of the University on such terms and conditions as the University may deem fit, and to construct or later and maintain any such buildings or works; (xiv) To execute conveyances, transfer, re-conveyances, mortgages, leases, licenses and agreements in respect ofprom,m ovable or immovable, includmg securities belonging to the University or to acquire the same for the purpose of the University; (xv) To enter into agreements with Organizations which may include the Central Govemrnenf the State Government, the University Grants Commission or other authorities for receiving grants; (xvi) To accept grants money, securities or property of any kind on such terms and conditions as may be deemed expedient; (xvii) To raise and borrow money onmortgage, promissoy notes or on other obligations or securities based upon all or any of the properties and assets of the University with or without any securities and upon such terms and conditions as it may deem fit and to pay out of the funds of the University, all expenditures incidental to the raising of the money and to repay and redeem any money borrowed; ( ~ To) in vest the funds of the University or money entrusted to the University in other such securities and in suchmanner as it may deem fit and fi-om time to time transpose any investment; and (xix) To do all other acts as the University may consider necessary that are conducive or incidental to the attainment and promotion of the aforesaid objectives. (2) The Pro-Chancellor shall be responsible for the distribution of the aforesaid powers and functions ofthe University amongsttheofficers,c ouncils, committees, boards and other authorities oftheuniversity in accordance with the provisions of this Act for carrying out the objectives of the University. Chapter I11 Admission, Discipline, Honorary Degrees and withdrawal of Degrees Secular character of University 6. The University shall be open for study to all persons irrespective of class, caste, creed, religion, language or gender or like considerations: Provided that nothing in this section shall be deemed as preventing the University - kom ma!ang special provisions for admission into courses of study in the University or for concessions in fee, in favour of students who are ordinarily residents of the State ofNagaland. Eligibility for admission 7. Subject to the provisions in this Act, no student shall be eligible for admission to a course orpmgmme of study in.the University unless he possesses the quali6cations prescribed in regulations. Residence of Students 8. Students of the University may reside in a hostel maintained or recognized by the University under such conditions as may be prescribed in the regulations. Discipline 9. (1) The Vice Chancellor shall be responsible for the maintenance of discipline in the University and his orders in this regard shall be canied out by the officers and authorities ofthe University. (2) Notwithstanding anythmg in sub-section (I), the punishment of debarring a student h ma n examhafion of the University or rusticating hirnihm the University or hostel or an institution ofthe University or any other punishment of such serious nature, shall be imposed only by the Executive Council on receipt of a report h m the Wce Chancellor: Provided that the Executive Council shall impose such a punishment only after giving the student concerned a reasonable opportunity of being heard. Award of Certificates, Diplomas etc., 10. A Certificate, Diploma or a Degree or any other academic distinction shall be granted to. or conferred upon. a student only after he has undergone the relevant course or programme of study for the duration prescribed therefor and passed the same with qualifyng marks prescribed therefor by the regulations. Award of honorary degrees I 1. The University shall have the power to confer at honorary degree of academic distinction ofthe University on any person for his eminent attainments and position, it the Governing Council approves by majority arecommendation ofthe Academic Council passed by two-thirds ofthe membership of the Academic Council for doing so. Withdrawal of Certificates, Diplomas etc., 12. The Governing and Academic Councils shall have the power to withdraw a Certificate or a Diploma or a Degree or any other academic distinction, including an honorary degree of academic distinction granted to, or conferred upon, a student or an eminent person, for good and sufficient reasons to be enumerated in the regulations. The Councils shall follow the same procedure followed for awarding honorary degrees. Teaching and cumculums 13. (1) All teaching in the University shall be done by teachers appointed by the University in accordance withthe regulatiom. (2) The syllabus, cumculum, the manner of organization of teaching and other connected matters inrespect ofeach course or programme of study in the University shall be as prescribed in the regulations. Chapter IV Officers of University Officers of University 14. The following shall be the oflicers ofthe University: (1) Thechancellor (2) The Pro Chancellor (3) The Xce Chancellor (4) TheRegistrx (5) The Directors (6) TheDeans (7) The Finance Officer (8) Suchother persons who may be declared by regulation as Officers of the University. Chancellor 15 Tne Governor ofNagaland shall be the Chancellor of the University. Powers and functions of Chancellor 16. (1) The Chancellor shall preside overthe convocations oftheuniversity and in the case of his inability, the Pro Chancellor shall do so. (2) The Chancellor shall constitute a Committee every five years h mth e date of establishment ofthe University comprising eminent persons in the field of education to review the working ofthe University and cause its report to be laid before the Nagaland LegislativeA ssembly. (3) The Committee's tenure shall ordinarily be threemonths and in no case be extended beyond six months. (4) The University shall bear the expenditure incurred on the Committee. (5)The Officers and Councils under this Act have an obligation to send all the notices, minutes and decisions of their meetings to the Chancellor well inadvance. (6) The Chancellor has the powerto attend the meetings ofthe Governing Council and when he so attends, he shall preside overthe meetings of the Governing Council. (7) The Chancellor has the power to seek h mth e Pro Chancellor information on all affairs ofthe University which shall be provided to him with utmost dispatch. Pro Chancellor 17. The President or the Chief Officer of the Trust, by whatever designation he may be called, shall be the Pro Chancellor of the University. Powers and functions of Pro Chancellor 18 . (1) The Pro Chancellor is the plenipotentiary of the University and has all powers in regard to the conduct of the affairs of the University in accordance with the provisions of this Act and all unspecified powers shall vest in him which shall be used formore effective implementation ofthls Act. (2) Subject to the foregoing provision, he shall preside over the meetings ofthe Governing Council. (3) He shallpreside over theExecutive and Finance Councils. (4) He has the power to attend meetings of other Councils under this Act and when he so attends, he shall preside over the meetings of such Councils. Vice Chancellor 1 9. (1) There shall be a whole time Vice Chancellor for the University who shall &tion as the Principal Executive and Academic Officer of the University. (2) There shall be a Selection Committee to recommend the selection of the Vice Chancellor which shall comprise a nominee of the Chancellor, a nominee of the Government ofhiagaland, two nominees of theTrust and anominee of the Pro Chancellor. (3) The recommendation of the Selection Committee shall further be considered and recommended by the Governing Council to the Chancellor for his fwd approval. (4) The Vice Chancellor shall not hold officer beyond 65 years of age. (5) In case of emergent circumstances where the appointment of a Vice Chancellor on the basis of a panel prepared by a Selection Committee is not possible for any reason, the Pro Chancellor, until an appointment is made in accordance with that procedure, may appoint a suitable person to function as Vice Chancellor for a period not exceeding one year. (6)O ther terms and conditions of service of the Vice Chancellor shall be as per regulations. Powers and functions of Vice Chancellor 20. (1) Subject to the foregoing provision, the Vice Chancellor shall preside over the meetings of the Academic Council. (2) He shall,- (I) Exercise general supe~sioann d conb-01o verthe affairs of the University; (ii) Ensure the observance of the provisions of this Act and the regulations made thereunder; (iii) Be responsible for organi7inginshctionsa nd maintenance of discipline inthe Universiw, (iv). Create temporary posts for apenod not exceeding one year and abolish the same; (v) Take such as he may deem necessary in case of any emergency and report the same to the Officero r Council or authority concerned whichwould have ordinarily dealt with the matter: Provided that ifthe Officer or Council or authority does not approve of the action taken by the Vice Chancellor, the matter will be referred to the Pro Chancellor whose decision shall be 6nal; Prov~dedfu rther that the person aEected by the decision of the Vice Chancellor or the Officer or Council or authority has a right of appeal to the Pro Chancellor or the Chancellor, as the case may be, within thirty days of the decision coming to the knowledge of the affected person; and (vi) Exercise such other powers and perform such other duties as may be assigned to him by the Pro Chancellor or any Council or Officer or authority under this Act orby any regulation. Registrar 21. (1) There shall be awhole time Registrar forthe University. (2) The Registrar shall be appointed by the Vice Chancellor from our of three persons empaneued by the Executive Council which shall not indicate any order of preference and leave the selection solely to the independentj udgement of thevice Chancellor. (3) In case emergent circumstances where the appointment of a Registrar on the basis of apanel prepared by the Executive Council is not possible for any reason, thevice Chancellor, until an appointment is made in accordance with that procedure, may appoint a suitable personlofficer of the University to function as Registm for aperiod not exceeding one year. (1) The R e msh all be the ex officio Seaetayo f all the Councils ofthe University under the Act. (2) The Registrar shall,- (i) Comply with all directions and orders of the executive Council and the Pro Chancellor; (ii) Be the custodian of the records, the common seal and such other property of the . University as the executive Council may commit to his charge; i Issuenotice for, and keep minutes ofthe meetings of the Councils, Board of Studies and other authoritieso f the University; (iv) Conduct all official correspondence between the University and others outside the University and between various Councils, Board and authorities within the University; (v). Furnish notices, minutes and other records of the University to the Chancellor on his own and furnish all information when asked by the Chancellor; (vi) Call meetings of the Executive Council for takings emergent decisions, if any, in the absence ofhoth the Pro Chancellor and the Vice- Chancellor, Vice Chancellor and the Executive Council; and (viii Be directly responsible to the Vice Chancellor for the proper discharge of his duties Directors 23. (1) There shall be the following whole time Directors who shall be appointed by the Pro Chancellor: (i) A Director for operations in the State of Nagaland; and (ii) As many Directors as required to be fixed by regulations for looking after the operations outside the State ofNagaland. (2) The Directors shall not hold office beyond the age of 62 years. (3) Their other terms and condition shall be as per regulations. Powers and function of Directors. 24. (1) The Director in-charge of operations in the State of Nagaland shall be a member of all Councils of the Univefiity. (2) The Pro Chancellor may appoint the Director-in-charge of operations in the State of Nagaland to any other Committee, Board or authority of the University. (3) The Pro Chancellor may co-opt any other Director of the University in any Council, Committee, Board or authority of the University. (4) The Directors shall be solely responsible for the operations of the University at the respective field levels. (5) Their other powers and functions shall be as regulations. Fiance Officer 25. (1) There shall be a whole time Finance Officer for the University who shall be appointed by the pro Chancellor. (2) The Pro Chancellor. on the subiective satisfaction. mav revlace the Finance \ , " . < A Officer by any other Oficer in the employment of the University or by special - - recruitment. in which case. the outgoing Finance Officer. if he is considered fit shall be assigned some other duties in the University. (3) His other terms and conditions of service shall be as regulations. Powers and Functions of Finance Officer 26. (I) The Finance Oficer shall be responsible for assisting the Pro Chancellor, Vice Chancellor, the other Officers, the Councils, Committees, bodies and other authorities of the University in managing the administration of the finances of the University subject to regulations. (2) He shall be a member of the Governing, Executive and Finance Councils. (3) The Pro Chancellor may co-opt the Finance Officer in any other Council Committee, Board or authority of the University. Deansmeads of DepartmentslFaculties 27. (I) There shall be a Dean or Head for each Department or Faculty of study in the University who shall be appointed in accordance with the regulations. (2) Their other terms and conditions of service shall be as per regulations. Powers and functions of Deansmeads 28. (I) The DeansIHeads of Departments Faculties are mainly responsible for the educational administration in respect of courses or progammes of study in the (2) Their otherpowers and functions shall be as per regulations Chapter V Councils, Committees and Boards Councils of University 29. (1) The following shall be the members of the Goveming Council: (i) The Pro Chancellor shall be the ex officio Chairman, (ii) The Vice Chancellor shall be the ex oficio Vice Chairman; (i) The Director in-charge of the operations in Nagaland shall be an ex oficio rnemk, (iv) The Finance Officer shall be an ex oficio member; (v) Two eminent educationists/academiciansn ominated by the Chancellor; (w) Two persons nominated by the Government ofNagaland; ($1 Two persons nominated by the Trust; (@ii Twb persons nominated by the Pro Chancellor; (ix) Two members of the teaching community of the University to be nominated by theAcademic Council; and (2) The Governing Council shall be reconstituted every five years. (3) A nominated member may resign from the membership of the Governing Council at any time by addressing his resignation to the Pro Chancellor. (4) An ex- officio member shall cease to be a member ofthe Governing Council when he ceases to be in office by virtue of which he became an ex oficio member. (5) A nominated member shall cease to be a member of the Governing Council if he ceases to be in office on account ofwhich he was nominated to the Governing Council. (6) Amember shall cease to be amember ofthe Governing Council on declaration to be of unsound mind or insolvent by a competent court or ifhe is convicted for a criminal offence involving moral turpitude or if he fails to attend three consecutive meetings of the Council. (7) The nomination authorities shall have aright to replace their nominees to the Council at any point oftime. (8) Casual vacancies arising in the Council before its reconstitution shall be filled for the unexpired term. Powers and functions of Governing Council 3 1 . The Governing Council shall,. (1) Recommend the broad policies and programmes of the University and suggest measures for the improvement and development of the University; (2) Consider and pasr esolutions on theAnnua1 Report, the financial statements and audit reports; (3) Take all necessary steps for the fulfillment of the objectives of the University; (4) Acquire, hold, control and administer the property and other movable and immovable assets of the University; (5) Administer funds placed at the disposal of the University; (6) Manage and regulate finances, accounts, investments, property and business and allo ther administrative affairs of the University and for that purpose appoint agents as it may deem fit: (7) Invest the money belonging to the University, including any income &om trust, endowment funds etc., in such stocks, funds, shares or securities as it may, from time to time, deem fit and appropriate; (8) Enter into, vary, cany out and cancel contracts on behalf ofthe University; Regulate and determine all other matters concerning the University; Cooperate with other institutions, Universities and other authorities in such manner and for such purposes as it may determine; Delegate any of its powers to the Vice Chancellor or Registrar or any Council or any other authority ofthe University for a temporary duration; and Perform such other functions as it may deem fit for the proper functioning and administrationof the University. Meetings of Governing Council 1 32. (1) The Governing Council shall meet at least once in a year on a date fixed in consultation with the Executive Council. The Chairman or in his absence, the Rce Chaiian or in the absence of both, the Secretary shall preside overthe meetings. Ifthe Chancellor chooses to attend any meeting, the Chancellor shall have the overriding right to preside overthe meeting. Areport on the working of the University during the previous year, the statement of receipts and expenditure, the balance sheet, the audit report and other such data shall be placed before the Annual Meeting of the General Council. All meetings ofthe Council shall be called by the Secretary at fifteen days notice. - Ifanv five members of the Council desire a meeting to discuss a matter of urgent importance, the Secreta~ysh all call a meeting forthwith and the requirement of fifteen days notice shall he deemed to have been waived. Two-mmembers shall constitute quorum. ' All questions shall be decided by majority of members present and voting. Eachmember shall have one vote and in case of tie, the Presiding Officer shall have an additional casting vote. If business of the Council has to be transacted urgently without waiting for a formal meeting to take place, the Pro Chancellor may authorize the circulation of questions to the members for decision, which shall be deemed as valid decision of the Council for action; however, such decisions shall be circulated at the earliest to all concerned for information and compliance. (1 I) All other detailsreIatingt o the conduct ofmeetings, functions etc., of the Goveming Council shall be as per regulations. Executive Council 33. (1) The following shall be the members ofthe executive Council: (i) The Pro Chancellor shall be the ex officio Chairman, (ii) The Vice Chancellor shall be the ex-officio Vice Chairman, i i The Director in-charge of the operations inNagaland shall be an ex officio member; (iv) The Finance Officer shall be an ex officio member; (v) One nominee of the Government of Nagaland, who shall be a member of the Governing Council, to he named by the Government of Nagaland; (vi) One nominee ofthe Trust who shall be amember ofthe Governing Council, to be named by the Trust; (vii) One nominee of the Pro Chancellorwhos hall a member of the Goveming Council, to be named by the Pro Chancellor; and (Gi The Registrar shall be the ex oficio Secretary. (2) The termofthe Executive Council shall run simultaneously with the Governing Council. Amember ofthe Executive Council when ceases to be amember of the (3) Governing Council, shall cease to be a member of the executive Council. (1) The Executive Council shall,- Create posts and appoint, from time to time, the members of the teaching (i) and non-teachin-g staff for carrying out the p- urp- oses of this Act on such . - terms and conditions prescribed by regulations; u) Exercise control and impose discipline over the employees of the University; Accept on behalf of the University, endowment, bequests, donations, grants and transfers of any immovable properly; Receive money securities, instruments or any other movable properties for and on behalfof the University; Grant receipts, sign and execute instruments and endorsement, discount cheques or other negotiable instruments through its accredited agencies; Make. signand account for such documents and instruments as may be necesmy for proper carrying out of the management of the property or affairs of the university; Introduce course of study at the University and take decisions in this regard on the recommendations oftheAcademc Council; Cooperate with and coopt other educational, medical and other institutions and authorities in India and abroad; Create fellowships and scholarships or other assistance on such terms and conditions, as it may prescribe by regulations, for carrying out research, investigation and study; Grant leave except casual leave to officers and other employees of the University and provide for alternative arrangements in the absence of officers and employees; Manage and regulate finances, accounts, investments, property, businessand all other adminisbtive aEairs ofthe University and appoint, for that purpose, agents; Invest money belonging to the University. including any unapplied income. in such stocks, funds, shares or securities or movable and immovable - pro - pert y - in lndiaand abroad, as it may hmtiine to h e ,d eem fit, and vary such investments; Transfer or accept transfers of movable or immovable property on behalf of the University; Enter into, cany out and cancel contracts on behalf ofthe University and for lhat purpose appoint agents; Provide buildii,premises, furniture, apparatus and other infkhctural facilities for the carrying out the work ofthe University; Entertain, adjudicate upon, and if it thinks fit, redress grievances of officers and employees ofthe University; Appoint examiners, moderators and others and if necessary, to remove them for good and sufEcient cause, in consultation withthe Academic Council; Select a common seal for the University and provide forthe custody of the seal; Delegate any ofthe powers to the Vice Chancellor or Registrar or any Council orany other authority of the University for a temporary duration and (m) Exercise such other powers and perform such other duties as may be entrusted to it by the General Council or by regulations. Meetings of Executive Council 35. (1) The Executive Council shall meet at least once in three months. (2) The Chairman or in his absence, the Vice Chairman or in the absence of both, the Secretary shall preside over the meetings. (3) All meetings of the Council shall he called by the Secretary at fifteen days notice. (4) If any three members ofthe Council desire ameeting to discuss amatter of urgent importance, the Secretary shall call a meeting forthwith and the requirement offifteen days notice shall be deemed to have been waived. (5) Two-fifth members shall constitute quonun. (6) All questions shall be decided by majority of members present and voting. (7) Each member shall have one vote and in case of tie, the Presiding Officer shall have an additional casting vote. (8) ifbusiness ofthe Council has to be transacted urgently without waiting for a formal meeting to take place, the Pro Chancellor may authorize the circulation ofquestions to the members for decision, which shall be deemed as valid decision ofthe Council for action; however, such decisions shall be circulated at the earliest to all concerned for information and compliance. (9) All other details relating to the conduct ofmeetings, fimctions etc., of the Executive Council shall be as per re~alations. Academic Council 36. (1) The following shall be the members of the Academic Council: (i) The Vice Chancellor shall be the ex officio Chairman, (ii) The senior most DeaniHead of Department'Faculty ofthe University as the ex officio Vice Chairman; [ii) "The Director in-charge of the operations in Nagaland shall be an ex ofiicio member; (iv) Four professors of the University to be nominated by the Vice Chancellor who shall be ex officio members: (v) The Finance Officers shall be an ex officio members and (vi) Four external experts to be nominated by the Pro Chancellor who shall be members; (vii) The D e d e a do f DepartmentIFacultyc oncerned with the subject matter under discussion shall be coopted as member; and (viii) The Registrar shall be the ex officio Secretary. (2) The term oftheAcademicC ouncil shall run simultaneouslyw ith the Governing Council. (3) An ex oficio member when ceases to hold the office by virtue of which he became an ex oficio member, shall cease to be a member oftheAcademic Council. (4) The hominating authorities shall have aright to replace their nominees to the Council at any point of time. (5) Casual vacancies arising in the Council before its reconstitution shall be filled for the unexpired term. Powers and functions ofAcademic Council 37. (1) The Academic Council shall bethe supreme academic body of the University and it shall, subject to the provisions of this Act and the regulations made thereunder, - have power of control and general regulation in regard to, and be responsible for, the maintenance of standards of education, instruction and examinations of the University. (2) The academic Council shal I. - (i) Make recommendations to the Executive Council with regard to creation, abolition, classification and other conditions of service of posts in teaching cadre in the University; (ii) Formulate and modify or revise schemes for the organization of the teaching Departmentdfaculties, assign subjects to theDepattrnentdfaculties and report on the expediency of creation, abolition, division and merger of departments/ faculties; i Make arrangements for instruction and examination ofpersons other than those enrolled in the University; (iv) Promote research in the University and require, h mti me to time reports on such research; (v) Consider proposal submitted by the Departmentslfaculties; (vi) Appoint Committees' for admission to theuniversity; (vii) Recognize diplomas, degrees and other academic distinctions of other Universities and institutions after determining their equivalence to diplomas, degrees and other academic distinctions of the University; Fix the time, mode and conditions of competition of fellowship, scholarship and other prizes and award the same; Make recommendations to the executive Council in regard to the appointment of examiners and if necessary their removal, and the determination of their fees, emoluments and traveling and other expenses; Make arrangements for the conduct of examination and fix dates for holding them; Declare the results ofvarious examinations, a-p-p oint Committees or oficers to do so make recommendations regarding conferment or granting of degrees, honours, diplomas, licences titles and marks of honour; Award stipends, scholarships, medals and prizes and make other awards m accordance with the regulations, and such other conditions as may be attached to the awards; Publish lists of prescribed or recommended text books and syllabus for courses and programmes of study at the University; Prepare such forms and registers as are, from time to time, required to he mhtained by regulations; Report on any matter referred or delegated to it by the Governing and Executive Councils; Receive periodic reports fromthe Boards of Studies andmake recommendations in regard thereto; and Perform all other functions assigned to it by this Act and the regulations made thereunder as well as by the Governing and executive Councils. Theuniversity shall have Finance Committee and establish other adhoc Committees whenever occasion arises. Finance Committee 40. (5) Casual v,acancies arising in the Committee before its recons';h~tions hall be filled for the unexpired term. Powers and functions of Finance Committee 4 1. (I ) TheFinance Committee shall be responsible for the financial administration of the University and in doing so, shall take decisions subject to the approval of the Governing Executive Councils. Finance Committee shall,- (i) Examine and scrutinize the annual budget of the University and make recommendations on financial matters to the Executive Council; (ii) Consider all proposalsfor new expenditure and make recommendations to the Executive Council; (iii) Examine the annual accounts oftheuniversity and advise the executive Council on matters pertaining to the annual accounts; (iv) Reviewthe financial position of the university eom time to time; (v) Make recommendations to the Executive Council on all financial matters relating to the University; (vi) Make recommendations to the Executive Council on all proposals involvingthe raising of funds, receipts and expenditure; and (viii Scrutinize all proposals having financial implicationspresented to it by the officers, councils and other authorities of the University and make recommendations in regard thereto. Meetings of Finance Committee 42. (1) The Finance Committee shall meet at least twice in a year. (2)- The Chairman or in his absence, thevice Chairman or in the absence of both, the Secretary shall preside over the meetings. (3) AU meetings ofthe Committee shall be called by the Secretary at fifteen days notice. (4) If any three members of the Committee desire a meeting to discuss a matter of urgent importance, the Secretary shall call a meeting forthwith and the requirement of fifteen days notice shall be deemed to have been waived. The University shall have power to constitute ad hoc Committees for any purpose connected with the aEairs of the University and such Committees shall present their reports to the Pro Chance110~T he reports are advisory innature and wherever fa~ible shall be actedupon by theuniversity. Boards of Studies 44. (1) For eachDeparbnent/Faculty,t heuniversity shall establishaBoard of Study which shall comprise the following: , (i)S enior most member ofthe academic community inthe Depar!mentiFaculty concemed as the Chairman; in) The next senior most member ofthe academic community inthe Department/ Faculty concemed as the %ce Chairman; and (i] Three members of the Academic Community in the departmenflaculty as members of the Board. (2) The Chairman, Vice Chairmanand members ofthe Board will be nomted by the Pro Chancellor. (3) The Board shall meet every quarter in a year and submit quarterly reports to the Academic Council which shall consider the reports at the earliest and report to the Governing and executive Councils. (4) The reports of the Boards are advisory in character and mainly should relate - to academic and connected admi~stdvmea tters with the utmost aim of converting the DepartmentEacultyi n to a Centre of Excellence. (5) All other details relating to the conduct ofmeetings, functions etc., ofthe Boards of studies, shall be as per regulations. Inter se priority amongst Council, committees, boards etc. 45. (1)As farpossible, the Councils, Committees, Boards under this Act and the ad hoc Committees that be constituted under regulations, shall function in harmony. (2) Notwithstanding anything in thisAct or any regulationmade thereunder, any conflict between the Councils, Committees, Boards under this Act shall be deemed to have beenresolvedn favour ofthe Council or Committee or Board which has precedence over the other as found in the following order: (i) The Governing Council u) The Executive Council (iii) The Academic Counc~l (IV) The Finance Comttee (v) The Boards of Studies (vi) The ad hoc Committees Chapter VI Finance, Contract, Audit Etc,,. No financial obligation on State Government 46. (1) This Act and the reg-u lations that may be made thereunder shall not cast any financial obligation in any manner on the Government ofNagaland or its agencies.A.11 expenditure called for the implementation of this Act and the re-g ulations shall be exclusively borne by the University.

(2) Nothing herein shall be deemed to prevent the Government of Nagaland h m contributingor giving agrant to the University forpromotingacademic excellence. Funds of University 47. The University shall operate the following two hnds namely: ( 1) The Endowment Fund (2) The General Fund. (4) When a resolution by the Trust or an Act for repeal of this Act by the Nagaland Legislative Assembly for dissolution of the University is passed, all moneys in the General Fund and all other receipts ofthe University on all other counts, shall stand transferred to the Endowment Fund for exclusively applying the Fund for the purposes of rehabilitating the students and others affected by such dissolution: Provided that the quantum of moneys in the Endowment Fund shall be reviewed on a five yearly basis by the Governing Council and all the end of such review, if the fund position is found to be reasonably comfortable, one-third of moneys in the Endowment Fund may be withdrawn and credited to the General Fund for purposes of developing the infrastructure of the University if two-thirds ofthe members of the Governing Council vote in favour of such a proposal. Provided further that no such transfer as in the first proviso shall be made once a resolution or an Act for dissolving the University has been passed. General Fund 49. (1) The University shall also set up a General Fund into which the following shall be credited. (i) Contributions and grants made by the Trust, (ii) Contributions and grants made by the Government of Nagaland (iii) Contributions and grants made by the University Grants Commission; (iv) Contributions and grants made by the Central Government; (v) Contributiors and grants made by other organizations in India and abroad, subject to laws m force: (vi) Bequests, donations, endowments or other grants made by private individuals and organizations: (4 Income received by the University on account of fees and other charges: and (vii) Amounts received &om any other source. (2).T he h d ss hall be deposited in banking institution or held in shares securities. debentures or in any other form as may be determined by regulations and as far as possible they may held in such form which does notpose serious risks. (3) The funds shall be operated exclusively for the purposes ofthe University m su~mha nner as may be prescribed by regulations. Funds for sponsored schemes 0 The conhihunons. funds amounts, gmts received for a sponsored scheme shall not he credited Lo the llniversity Fund hut shall he kept separately and i~t~li~cd only for the purpose of the scheme. The staff required to execute the sponsored scheme shall be mmited inacwrdance withthe terms and conditions stipulated by the sponsoring Annual accounts and audit 5 1. (1) The AnnualAccounts ofthe University shall be prepared by the Finance Officer under the directions of the executive Council. (2) The accounts of the University, shall be audited every year by certified auditors duly appointed by the executive Council. (3) The annual accounts and the audit reports shall be first approved by the h c e Committee before presented to the Governing and Executive Councils. (4) The Executive Council and the Governing Council, in that order, consider the annual accounts and audit reports and make recommendations in regard thereto for Mer action by theFinance Committee which shall give anActionTakenReport to the Governing and Executive Councils at the earliest. Financial estimates 52. (1) The annual budget for a financial year shall be prepared by the Finance Committee well before the commencement ofthe iinancial year. (2) The budget will thereafter be considered by the Executive Council and then M yap proved by the Governing Council. (3) Expenditure in excess of the budget in a financial year in extraordinary circumstances shall be incurred only with the approval of the Executive Council. (4) Such excess expenditure shall M e rb e approved by the Governing Council at the time of approving the annualbudget for the next financial year. Execution of contracts 53. (1)All contracts relating to the management and administration ofthe University shall bc expressed to have been made by the Executive Council. The Vice Chancellor shall execute contracts above rupees ten lakhs and the Registrar shall do so in all other cases. All contracts shall be executed with the prior approval of Pro Chancellor. (2)Nothing heremshall be deemed to prevent the Registrar, withihe prior approval of the Pro Chancellor to delegate some of his contracting powers to the Financial Officer. Chapter VII Recruitment and conditions of service of employees Recruitment and conditions of service of employees 54. (1) Subjecttot he provisions ofthisAcf all officers and employees oftheuniversity shall be recruited under awritten agreement. (2) Officers and employees shall hold the posts to which they are recruited as per terms and conditions prescribedin regulations. Preference to persons from Nagaland 55. (1) Persons who are ordinarily residents in the State ofNagaland shall be given preference over others in the matter of recruitment to all posts in the University in the State ofNagaland, subjectto fulfillment ofthe qualifications, terms andother conditions of appointment prescribed inregulations. (2) The Executive Council has a right to relax the qualifications, terms and other conditions of appointmentto various posts in the University in favour of persons who are ordinarily residents in the State ofNagaland without grossly compromising merit. Chapter Vm AnnualReport, Directive and Dissolution Annual Report 56. (1) The Annual Report of the University shall be prepared by the Executive Council and approved by the Governing Council. The Annual Report shall be sent to the Chancellor who shall cause it to be laid before theNagaland Legislative Assembly. (2) Ifthe Universityhas off-campus inanother State or off-shore campus in another country, the Annual reports shd also be sent to the Government of the State or foreign country. Directives by State Government 57. (1) The Government ornagatand has powers to give directives to the University if mismanagement, maladministration,i ndiscipline financial crisis and f d mto comply with this Act and regulations made thereunder, come to notice of the Government of Nagaland. (2) The University shall comply with all the directives given to it by the Government ofNagaland. Dissolution 5 8. (1 ) If aresolution by the highest dec~sionm aking body of the Tmstpassed for the dissolution of the University or a Bill for repeal of this Act is passed by the Nagaland Legislative Assembly and assented to by the Governor ofNagal4 for gross inability ofthe University to cany out its functions in accordancewith this Act and regulations made thereunder, the University shall stand dissolved within one year of the passing of the resolution or the Act. Provided that any such resolution passed by the Trust may be rescinded by it before the expity of one year h mth e date of passing ofthe on& resolution. The dissolution shall not affect the pursuit of courses by students but no (2) further enrolment of students shall fake place from the date of passing of the resolution or Act and if for any reason, such continued pursuit of courses by students is not possible, the Trust shall take necessary steps for transferring the studies of students to other institutions, organizations or Universities., m consolation with UGC etc., or provide reasonable financial compensation in lieu thereof, as may be determined by the Governing Council ofthe University: (3) The moneys in the Endowment Fund of the University shall be exclusively applled forthe purposes ofrehabilitatingthes tudents and others affected by . the dissolution ofthe University. The State Government shall have overriding powers to monitor and ensure (4) the implementahon of the provisions in h ss ection and, in case of any failure of the University to discharge its obligations, it this section and, in case of any failure of the assets of the Universi$ at anytime, f o r mth e obligations either by itselfor by appointing an agency on its behalf. (5) After all the obligations under this section have been met, the remaining funds, assets and liabilities of the University shall stand b-ansferred to the Chapter IX Regulations .. 59. (1) All matters relating to the conduct of affairs of the University not expressly provided for in this Act in details, shall be provided for in the regulations of the university. (2) The executive Council shall make all draft regulations. (3) While making draft regulations which affect the powers, functions, authority and other relating matters of officers, Councils, Committees, Boards, Employees etc., of the University, the Executive Council shall provide an opportunity of being heard to the affected parties. (4)All draft regulations made by the Executive Council by majority shall have to be approved by the Governing Council by two-thirds majority of members present and voting for coming into affect. (5).AU regulation appruved by the Governing Council shallbe notilied in appropriate form (6) A copy of the regulations shall be circulated to all concerned in the University. (7)Acopy of the regulations shall also be sent to the Chancellor, State and foreign Government concerned. (8)All regulations, as soon as made, shall be laid before theNagaland Legislative Assembly which may annual the regulations by motions by simple majority within 90 days of laying. (9) Ifthe regulations are annulled or amended by theNagaland Legislative Assembly, they will be of no effect or amended effect, as the case may be, fiom the date of passing of the motions for annulment or amendment ChapterX Miscellaneous Accreditation and compliaace with laws 60. (1) Theuniversity shall seek obtainandretainaccreditationhmrespecmien ational accreditation bodies for all its courses and programmes of study, asrequiredundert he University Grants CommissionA ct, 1956 and the University Grants Commission BtablihentandMaintenance,o f Standards inF'rivateUniversities)R egulations 2003, as amended h mti me to time. (2) The Univenity shall obtainpriorpermission/recognitionf rom bodies like All IndiaCouncil offechnical Education, Bar Council of India, DistanceEducation Council. Dental Council of India, IndianNursing Council, Medical Council of India, National Council for teacher Education, Pharmacy Council of India etc., for its courses and programmes of study. (3) The University shall also comply withall other laws, desregdations in force in regardto maintenance of educational and other standards in the University. Acts not invalidated on ground of defect etc.,. 61. No act or proceeding of the University shall be invalidated merely on the ground that a Council, Committee, Board or any other authority of the University has not been duly constituted or there is a vacancy in such Council etc., or o ground of any technical defect or demerit in this Act orregulations made thereunder or on ground of any irregularity in service ofnotice of meetings etc.,. Transitory Powers 62. (I) Until the Councils, Committees, Boards etc., and the officers and employees of the University are established or appointed, the Vice Chancellor with the assistance of the Registrar, with the prior approval of the Pro Chancellor, discharge all the duties under this Act and no action taken by him shall be questioqed on ground that the procedure laid down in this Act has not been followed: Provided that the transitory powers as aforesaid shall be available only for one year &om the date of commencement of this Act. Of doubts 63. (1)Nothing in tbisAct shall be conshed as b-dnsfeninghmfhe Tnutto theunivmity any right of ownership or possession, if any, held over, or in respect of, the institutes established by it other than the University established under this Act. (2) If any difficulty arises in giving effect to the provisions of thisAct, the State Government, may, by order, make suchprovisions, not inconsistent with the provisions of this Act, as appear to it to be necessatyor expedient, forremoving the diaculties: Provided that no order under sub-section (2) shall be made after the expiration of aperiod of five years &om the commencement of this Act. (3). Every order made under sub-section (2) shall, as soon as may be laid before the Nagaland Legislative Assembly which annual or amend the orders by motions by sirnplemajorifywithin 90 daysof laying. (4) If the orders are annulled or amended by the Nagaland LegislativeA ssembly, they wilI be of no effect or be of amended effect, as the case may be, &om the date of passing ofthe motion for annulment or amendment. Protection of acts 64. No suit, prosecution or order Iegal proceedings shall lie against, and no damages shall be claimed kom the officers, Councils, Committees, Boards, Employees and other authorities of the University in respect of anything done or purported to have been done in good faith in pursuance of this Act or any regulation made thereunder.
