The Speaker And Deputy Speaker Of the Legislative Assembly Of The National Capital Territory Of Delhi (Salaries And Allowance) Act, 1994 THE SPEAKER AND DEPUTY SPEAKER OF THE LEGISLATIVE ASSEMBLY OF THE NATIONAL CAPITAL TERRITORY OF DELHI (SALARIES AND ALLOWANCES) ACT, 1994 (ACT NO. 7 OF 1995) [19th December, 1995] AN ACT to provide for the salaries and allowances of Speaker and Deputy Speaker of Legislative Assembly of the National Capital Territory of Delhi. Be it enacted by the Legislative Assembly of the National Capital territory of Delhi in the Forty-fifth Year of the Republic of India as follows :- 1. Short title, and commencement.–– (1) This Act may be called the Speaker and Deputy Speaker of the National Capital Territory of Delhi (Salaries and Allowances) Act, 1994. (2) It shall come into force on such date1 as the Lt. Governor may, by notification in the Official Gazette, appoint. 2. Definitions.–– In this Act, unless the context otherwise requires,- (a) “Speaker” means the Speaker of the Legislative Assembly of the National Capital Territory of Delhi; (b) “Deputy Speaker” means the Deputy Speaker of the Legislative Assembly of the National Capital Territory of Delhi; (c) All words and expressions used and not defined herein but defined in the Ministers of Government of the National Capital Territory of Delhi (Salaries and Allowances) Act, 1994 shall have the meanings respectively assigned to them in that Act. 3. Salaries and Allowances of the Speaker and Deputy Speaker :–– (1) The Speaker and the Deputy Speaker shall be entitled to receive a salary, Constituency Allowance, and Daily Allowance at the same rates as are admissible to a Minister under the Ministers of the Government of the National Capital Territory of Delhi (Salaries and Allowances) Act, 1994. (2) The Speaker and the Deputy Speaker shall be entitled to receive sumptuary allowance at the same rate as is admissible to a Minister under the Ministers of the Government of the National Capital Territory of Delhi (Salaries and Allowances) Act, 1994. (3) The Speaker and the Deputy Speaker shall also be paid such conveyance allowances, travelling allowances and daily allowances for tour outside Delhi and shall be entitled to such amenities regarding residence or compensatory allowance in lieu thereof and use of motor car as are admissible to a Minister under the Ministers of the government of the National Capital Territory of Delhi (Salaries and Allowances) Act, 1994. 4. Medical Facilities.–– The Speaker and the Deputy Speaker and members of their families shall be entitled to free of charge accommodation in hospitals maintained by the Government and also to medical treatment in accordance with the Medical Attendance rules, as amended from time to time, as applicable to Group ‘A’ officers of the highest grade of the Government. 114th March, 1996 sec Notification No. F 13 (7)/95-L.A. dated 14th March, 1996, Delhi Gazette extraordinary part IV dated 14th March, 1996. The Speaker And Deputy Speaker Of the Legislative Assembly Of The National Capital Territory Of Delhi (Salaries And Allowance) Act, 1994 4. Telephone Facilities.–– The Speaker and the Deputy Speaker shall be entitled to two telephones each at the office and the residence with STD facilities in the telephones at the office and one out of two telephones at the residence and to full reimbursement on telephone charges for the office telephones and on call charges up to 50,000 local calls per year (including charges on STD calls covering both the telephones) at the residence. 5. 1[* * * * * * * *] 6. Speaker and Deputy Speaker not to draw salary as Members.–The Speaker and the Deputy Speaker shall not be entitled to receive any sum by way of salary or allowances in respect of their membership of the Assembly except what is specifically provided for by and under this Act. 7. Notification respecting appointment Speaker, etc. to be conclusive evidence. –– The date on which any person become, or ceased to be, a Speaker or the Deputy Speaker shall be published in the official Gazette and any such notification shall be conclusive evidence of the fact that he became, or ceased to be, the Speaker or the Deputy Speaker, as the case may be, on that date for the purpose of this Act. 8. Repeal. –– The Speaker and the Deputy Speaker of the Legislative Assembly of the National Capital Territory of Delhi (Salaries and Allowances) Order, 1993 shall ceases to have effect as from the date of the enforcement of this Act. ––––––––––––– 1Omitted by section 2 of Delhi Act 3 of 1996.
