About this statute

The Act may be cited as the Government Proceedings Act. Section 2 provides definitions for terms used in the Act (including "agent", "armed forces", "civil proceedings", "officer", "order", "prescribed", "proceedings against the Government", and "statutory duty") and states that references to the Act include rules of court; Part IV and V references to civil proceedings by or against the Government include the Attorney-General and Government departments, with a proviso limiting when the Government is deemed a party. A person with a claim against the Government (after this Act begins) is entitled to enforce that claim by proceedings against the Government, subject to this Act. Section 4 establishes when the Government is liable in tort for acts of its servants, agents or officers and limits liability in specified circumstances. Subsection (2) preserves the rights of any Government department under section 46 of the Patents Act, 1949 and under section 12 and the First Schedule to the Registered Designs Act, 1949.
