Judiciary Fund Act

The Act may be cited as the Judiciary Fund Act.

Defines the terms "Chief Registrar" and "Fund".

Section 3 states objectives to safeguard the financial and operational independence of the Judiciary.

The National Assembly may appropriate monies out of the Consolidated Fund.

The Chief Registrar must submit the Fund's accounts to the Auditor‑General within three months after the end of each financial year; the accounts must be audited and reported in accordance with the Public Audit Act.

The Chief Registrar must, within three months after each financial year ends, prepare and submit to the National Assembly a report on the Fund's operations for the preceding year and must forward a copy of that report to the Chief Justice.

The Chief Registrar may, in writing and for purposes of the Fund, delegate the powers or functions of an Accounting Officer to a judicial officer or judiciary staff, in accordance with the Public Finance Management Act (Cap. 412A).

The Chief Registrar may, in writing, authorize a judicial officer or member of staff to act for the efficient management of the Judiciary; the authority to incur expenditure must be accompanied by guidelines on its usage.

Ensure compliance with the Public Finance Management Act (Cap. 412A).

The Fund is to be used to defray the administrative expenses of the Judiciary.

All receipts, savings and accruals to the Fund and the balance of the Fund at the end of each financial year must be retained in the Fund and applied in accordance with the Constitution and this Act.

The Fund's financial year is the twelve-month period ending on 30 June each year.

The Chief Registrar must open and maintain bank accounts necessary for the effective management of the Fund.

The Chief Justice may, in consultation with the Chief Registrar, make regulations for the proper management of the Fund.
